2 Committee: Legal Francisco Nascimento A RESOLUTION RECOGNIZING THE RETIREMENT OF MSGR. FRANCIS R. SEYMOUR AS CHAPLAIN TO THE POLICE AND FIRE DEPARTMENTS The Mayor and Council have been made aware that Msgr. Francis R. Seymour will retire this year as the Chaplain to the Town of Harrison Police and Fire Departments after many years of service; and Monsignor Seymour was born in Bayonne, the son of George and Mary Boyle Seymour. Following graduation from Seton Hall University, he studied for the priesthood at Immaculate Conception Seminary in Mahwah and was ordained by Archbishop Thomas Boland on May 25, 1963, in Sacred Heart Cathedral; and His first parish assignment was to St. Charles Borromeo Church in Newark, where he served concurrently as Catholic chaplain at Beth Israel Hospital. In 1969, he was named as the Archdiocesan Archivist and also an assistant to the Matrimonial Tribunal. At that time, he took up residence at Holy Cross in Harrison and served as moderator of the parish Catholic Organization. He was named Monsignor in 1979 by Pope Paul II; and In his spare time, Msgr. Seymour has also worked on most of the major liturgical functions at the Cathedral Basilica, was a member of the Board of Trustees at Seton Hall and secretary of the Archdiocesan College of Consultors. He served as a commentator on WOR-TV during Pope John Paul II s visit to New Jersey in He writes articles for the Advocate, the weekly newspaper of the Archdiocese. Our heartiest Congratulations and Warmest Best Wishes be extended to Monsignor Francis R. Seymour upon his retirement as Chaplain to the Harrison Police and Fire Departments, and that this resolution be spread in full upon the minutes of the December 14, 2018 meeting of the Mayor and Council.

3 Committee: Legal Francisco Nascimento A RESOLUTION AUTHORIZING THE PURCHASE OF TWO VEHICLES FOR THE CONSTRUCTION DEPARTMENT OF THE TOWN OF HARRISON There is a need to purchase two 2019 Ford Escape vehicles for the Construction Department in the Town of Harrison; and The Town has joined the Educational Services Commission of New Jersey CCOP Program; and The subject vehicles can be purchased from Beyer Ford, 170 Ridgedale Avenue, Morristown, NJ 07960; and The maximum amount of this purchase is $48,609.76, and funds are available as evidenced by the certification of the Chief Financial Officer. The Chief Financial Officer is hereby authorized to approve and forward a purchase requisition to Beyer Ford for the purchase of two (2) construction vehicles as aforesaid, and the Mayor and Town Clerk are hereby authorized to sign any and all documents necessary to effectuate said purchase. 4 Committee: Legal Francisco Nascimento A RESOLUTION AUTHORIZING THE AWARD OF A NON-FAIR AND OPEN CONTRACT TO DESMAN DESIGN MANAGEMENT The Town has the need to appoint an experienced Engineering Firm to provide professional engineering services for the maintenance of the Harrison Parking Center; and Due to the nature of the subject appointment, same will be accomplished by way of a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.5; and The anticipated term of the contract is not to exceed one (1) year; and Desman Design Management previously completed and submitted a Business Entity Disclosure certification which certifies that it has not made any reportable contributions to a political or candidate committee in the Town of Harrison in the previous one (1) year, and that the contract will prohibit it from making any reportable contributions through the term of the contract, and Desman Design Management has further completed and submitted a C. 271 Political Contribution Disclosure Form; and The Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) requires that the resolution authorizing the award of contracts for Professional/Extraordinary Unspecifiable Services exempt from bidding and the contract itself must be available for public inspection; and The maximum amount of the contract is $64,000.00, and funds are available in the Harrison Parking Garage Utility Budget Other Expenses as evidenced by the certification of the Chief Financial Officer. The Mayor and Town Clerk be and the same are hereby authorized to execute a contract with Desman Design Management; and This contract is awarded as a Professional/Extraordinary Unspecifiable Services contract in accordance with N.J.S.A. 40A:11-5(1)(a) of the Local Public Contracts Law, and J.J.S.A. 19:44A-20.S. 5 Committee: Legal Francisco Nascimento A RESOLUTION SETTLING LITIGATION REGARDING TAX SALE CERTIFICATE NUMBER FNA JERSEY BOI, LLC brought suit against the Town of Harrison in Hudson County, Docket No. HUD-DC regarding Tax Sale Certificate Number for real property located at 710 Warren Street in Harrison, Block 194, Lot 30; and The parties wish to amicable resolve this matter by the payment of $ from the Town to FNA JERSEY BOI, LLC. The Chief Financial Officer be and she is hereby authorized to issue a check in the amount of $ to FNA JERSEY BOI, LLC in full and final settlement of Doc No. HUD-DC , and Paul J. Zarbetski, Esq. be and he is hereby authorized to sign a settlement agreement regarding same.

7 COUNTY OF HUDSON ORDINANCE NO AN ORDINANCE OF THE, COUNTY OF HUDSON, STATE OF NEW JERSEY, ADOPTING AN AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE WATERFRONT REDEVELOPMENT AREA WHEREAS, the Mayor and Council of the Town of Harrison ( Town ) desire to adopt amendments to the Waterfront Redevelopment Plan; and WHEREAS, the Town previously established a Redevelopment Area, pursuant to the Local Redevelopment and Housing Law (N.J.S.A. 40A:12A-1 et. seq.), which area is commonly referred to as the Waterfront Redevelopment Area ; and WHEREAS, a Redevelopment Plan for the redevelopment area entitled Harrison Waterfront Redevelopment Plan was prepared by Heyer, Gruel, & Associates and adopted by Ordinance Number 1077 on July 23, 2003; and WHEREAS, an Amended Redevelopment Plan for the redevelopment area entitled Amended Harrison Waterfront Redevelopment Plan 2012 was prepared by Heyer, Gruel, & Associates and adopted by Ordinance Number 1262 on April 24, 2012; and and WHEREAS, since the adoption of the Redevelopment Plan, subsequent amendments have been adopted; WHEREAS, due to questions regarding the interpretation of the Redevelopment Plan, it is prudent to further amend the Redevelopment Plan to clarify certain provisions; and WHEREAS, the Mayor and Council desire to amend the Redevelopment Plan as set forth below. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF HARRISON, COUNTY OF HUDSON, STATE OF NEW JERSEY AS FOLLOWS: The subsection of the Redevelopment Plan entitled LAND USE PLAN - Residential District Bulk Standards - Height, is hereby amended to read as follows: Height: In accordance with the Building Heights map. Parking structures attached to residential buildings are permitted to exceed the height of the adjoining residential building by not more than one (1 ) foot as measured from the highest point of the roof/parapet of the residential building to the highest point of the parapet of the parking structure. Parking of cars is permitted on the roof of parking structures creating a functional 8 th level of parking provided the structure complies with the height standard contained herein. All prior Ordinances, which are inconsistent with the provisions of this Ordinance, as well as any prior versions of the above referenced Redevelopment Plan, are hereby repealed to the extent of such inconsistency. 9 COUNTY OF HUDSON ORDINANCE NO AN ORDINANCE AMENDING ORDINANCE NOS. 798, 977, AND 1272 REGARDING 2-HOUR PARKING IN THE WHEREAS, The Mayor and Council are desirous of amending Ordinance Nos. 798, 977 and 1272 regarding the annual fee for Non-Resident Employee Parking Permits. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Harrison, in the County of Hudson, New Jersey as follows: Section 1. Section 2. Section 3. That Section IV of Ordinance No. 977 and Section 3 of Ordinance No be amended to provide at the annual fee for a Non-Resident Employee Parking Permit shall be raised from $40.00 to $ Any existing ordinances or parts thereof which are inconsistent with the provisions herein are hereby repealed. Doran A RESOLUTION SUPPORTING THE DRIVE SOBER OR GET PULLED OVER 2018 YEAR END HOLIDAY CRACKDOWN Impaired driving on our nation's roads killed 10,874 people in 2017; and 20% of motor vehicle fatalities in New Jersey are alcohol-related; and An enforcement crackdown is planned to combat impaired driving; and The season at the end of the year is traditionally a time of social gatherings which often include alcohol; and The State of New Jersey, Division of Highway Traffic Safety, has asked law enforcement agencies throughout the state to participate in the Drive Sober or Get Pulled Over Year End Holiday Crackdown; and The project will involve increased impaired driving enforcement from December 7, 2018 through January 1, 2019; and An increase in impaired driving enforcement and a reduction in impaired driving will save lives on our roadways. It supports the Drive Sober or Get Pulled Over 2018 Year End Holiday Crackdown from December 7, 2018 through January 1, 2019, and pledges to increase awareness of the dangers of drinking and driving.
