3 STANDARD AGENDA PUBLIC HEARINGS CU Timber Pines Plaza, LLC: Conditional Use Permit Renewal for Carnival Events, Tool Sales, Fireworks, Furniture Sales, Art Shows and Craft Shows; Northwest corner of Commercial Way (US Hwy 19) and Pine Forest Drive Representative: Frank Territo Mr DePablo reviewed the staff report It is recommended that the Planning and Zoning Commission approve the renewal for Conditional Use Permit for a Carnival Events, Tool Sales, Fireworks, Furniture Sales, Art Shows and Craft Shows for a period of two (2) years Approval should be conditioned upon the following performance conditions: 1 The petitioner must obtain all permits from Hernando County and other applicable agencies and meet all applicable land development regulations, for either construction or use of the property, and complete all applicable development review processes 2 All events shall meet the minimum requirements of the Hernando County Commercial Development Temporary Tent Procedures 3 All firework sales shall meet the minimum requirements of the Hernando County Commercial Development firework sales and tent procedures and state regulations 4 The requested uses shall be located in conformance with the approved site plan 5 The petitioner shall insure that adequate parking is available for each individual event in accordance with the requirements of the Development Department 6 All events shall meet the requirements of Spring Hill Fire Rescue Department 7 Adequate restroom facilities shall be provided or accessible on-site, during all events 8 The Conditional Use Permit shall be displayed in a conspicuous area and be available for public inspection for each event held throughout the year 9 Events shall be limited to the following hours of operations and frequency: Tool Sales Times per year requested Two (2) Length of Event: 4 Days Hours of Operation: 9:00 AM to 8:00 PM Planning and Zoning Commission Page 3 Hernando County

5 H Peter V DeNunzio: Revision to a Master Plan on property zoned PDP(GC)/ Planned Development Project (General Commercial) with Mini Warehouse Storage; West side of Exultant Drive, approximately 600' south of Pacific Drive Representative: Stephen Garufo, U-Stor Management Corp Mr DePablo read into record a letter from Mr Garufo dated April 30, 2010, requesting a continuance of the petition Stephen Garufo, representing the petition, under oath, explained his intention to meet with the Regency Oaks community on May 20, 2010 Regency Oaks residents Ronald Ruge and Bonnie Ruge spoke under oath in opposition to the extension of outdoor storage proposed under the petition Mr Ruge pointed out the limited period for outside storage approved under the 2003 rezoning and Mrs Ruge referenced testimony by Mr Donald Lacey of Coastal Engineering Associates Inc from the September 10, 2003 BCC public hearing Mr Garufo answered questions posed by Comm Widmar regarding the impacts of a declining economy and how his business relies on the outside storage for RV parking for income He discussed his 2007 development plans and continued intention to construct the additional building Mr Garufo discussed his meeting with the Regency Oaks Civic Association Board and submitted a letter indicating their support by a 4-1 vote Discussion ensued Comm Widmar was in favor of the continuance based on Mr Garufo's testimony Mr Pinata advised Chairman Hammond that the complaint filed with Code Enforcement would be held in pending until action is taken on this rezoning petition To postpone consideration of the petition to the June 14, 2010, Planning and Zoning hearing TABLED [UNANIMOUS] Next: 6/14/2010 9:00 AM Thomas Deutschle, Alternate Commission Member Hammond, Riley, Widmar, Deutschle SE Pastor Richard Rossiter - Cornerstone Baptist Church: Special Exception Use Permit for a Place of Public Assembly, namely a Religious Establishment; East end of Tara Street, approximately 1,000 feet east of Mariner Boulevard Representative: Lawrence McNally Mr DePablo reviewed the staff report It is recommended that the Planning and Zoning Commission approve the petitioner s request for a Special Exception Use Permit for a Place of Public Assembly with the following performance conditions: Planning and Zoning Commission Page 5 Hernando County
6 1 The petitioner must obtain all permits from Hernando County and other applicable agencies and meet all applicable land development regulations, for either construction or use of the property, and complete all applicable development review processes 2 Minimum Building Setbacks: North: 25'; South: 50'; East: 25'; West: 50' 3 The maximum seating capacity of the sanctuary shall be A 25' vegetative buffer shall be provided along the south and west property lines A 10' vegetative buffer shall be provided along the north and east property line All buffers shall be enhanced by native vegetation to achieve 80% opacity at time of planting 5 All onsite lighting must provide for full cutoff fixtures and retain all light on-site to prevent any light spillover to surrounding properties Lighting shall be reduced by 50% during non-operating hours 6 A portion of the project is located within a 100-year floodplain area Any land alterations that impact the 100-year floodplain capacity and volume shall be appropriately mitigated The 100-year floodplain shall be delineated and shown on all site plans; and all roadways, driveways, and finished floor elevations must meet the Facility Design Guidelines and adopted building codes 7 The petitioner shall provide a wildlife survey, prepared by a qualified professional prior to any development occurring on the property Further, copies of any required permits shall be provided prior to the issuance of development permits by Hernando County 8 The project shall connect to central water and all associated costs shall be the responsibility of the petitioner 9 The petitioner shall comply with the requirements of the Hernando County Health Department for the installation of the septic system 10 The petitioner shall dedicate 80' of right-of-way for the future eastward extension of Lola Drive 11 The petitioner shall conduct a traffic study as part of the development review process 12 Interconnection shall be provided between the northern parcel and the parcel south of the power line easement 13 If a developer fails to obtain a building permit for vertical construction within a period of not more than two (2) years from the approval date or the special exception use is not established during this period, then the special exception Planning and Zoning Commission Page 6 Hernando County
7 use permit shall be null and void All Phase II structures shall obtain a building permit within five (5) years Lawrence McNally, representing the petition, under oath, asked to defer the 80' ROW dedication under condition #10 until development occurs on the south side of the overhead power lines, which bisect the property The sanctuary and accessory uses are restricted to the north side of the property, and they have no intention of developing the southern portion at this time Charles Haig, Lola Drive, under oath, spoke in favor of the petition Comm Riley questioned if the increased traffic would impact road capacity and the intersection at Mariner Boulevard Mr Chris Wert, with the Hernando County Engineering Office, did not think there would be any major traffic congestion since the traffic would be during off-peak hours They would also determine if connection is required at Lola Drive during the traffic study review Mr Pianta suggested adding to condition #11 that the applicant be responsible for any access improvements required by the traffic study Mr McNally advised Comm Riley that they did not anticipate any activities after 9:00 pm or 10:00 pm Comm Widmar and Mr Pianta discussed the applicant's request to defer the ROW dedication in condition #10 Mr Pianta noted there was no immediate need for the right-of-way; however, he was concerned that the ROW dedication could become problematic if the petitioner does not develop Phase II within 5 years or not at all Mr Pianta suggested the right-of-way be dedicated with Phase II or upon a demonstration of need and demand by the County Engineer, whichever occurs first Mr Wert responded to Comm Widmar's question regarding the use of deputies for traffic control Mr McNally agreed to pay for any officers during peak hours should the need arise Chairman Hammond and Mr Pianta discussed the possible warrant of a second traffic study during Phase II development To approve the Special Exception Use Permit per staff recommendations with the following modifications: 10 The petitioner shall dedicate 80' of right-of-way for the future eastward extension of Lola Drive The dedication shall occur prior to Phase II or based upon a demonstration of need and demand by the County Engineer, which ever occurs first 11 The petitioner shall conduct a traffic study as part of the development review process and shall be responsible for any access improvements required by the traffic study Planning and Zoning Commission Page 7 Hernando County
8 ADOPTED AS AMENDED [UNANIMOUS] Hammond, Riley, Widmar, Deutschle H Sankara Dinavahi, Tiyyagura Sami Reddy, Durgarao Parimi, Mallik A Piduru: Rezoning from PDP(SU)/ Planned Development Project (Special Use) to PDP(OP)/ Planned Development Project (Office Professional); South side of Spring Hill Drive, approximately 385' east of Whitewood Avenue Representative: Robert G Grieves Mr DePablo reviewed the staff report It is recommended that the Planning and Zoning Commission recommend the Board of County Commissioners adopt a resolution approving the petitioner s request to rezone from PDP(SU)/ Planned Development Project (Special Use) to PDP(OP)/ Planned Development Project with the following performance conditions: 1 The petitioner must obtain all permits from Hernando County and other applicable agencies and meet all applicable land development regulations, for either construction or use of the property, and complete all applicable development review processes 2 Office Professional uses shall be limited to a maximum of 7,680 square feet for the site, and shall be limited to one (1) story in height 3 The petitioner shall provide a hundred percent opaque fence or wall along the south and east property lines and a 10' landscape buffer along the west The south and east buffers shall include trees for additional screening 4 The petitioner shall provide a wildlife survey, prepared by a qualified professional prior to any development occurring on the property Further, copies of any required permits shall be provided prior to the issuance of development permits by Hernando County 5 All onsite lighting must provide for full cutoff fixtures and retain all light on site to prevent any light spillage into neighboring residential uses 6 The project shall connect to central water and all associated costs shall be the responsibility of the petitioner 7 The petitioner shall comply with the requirements of the Hernando County Health Department for the installation of the septic system 8 Final driveway location/design shall comply with the site distance triangle at Spring Hill Drive in accordance with the Hernando County Facility Design Guidelines Planning and Zoning Commission Page 8 Hernando County
9 9 The petitioner shall comply with the County Engineering Department as to any requirements for a traffic study All improvements required as a result of the traffic study shall be at the developer s expense 10 The petitioner shall provide a revised plan in compliance with all of the performance conditions within 30 calendar days of BCC approval Failure to submit the revised plan will result in no further development permits being issued Robert G Grieves, representing the petition, under oath, discussed their request for office professional zoning Rich Markford, who lives behind the subject site, under oath, inquired to the type of use and proposed buffering Mr DePablo reviewed the proposed buffer depicted on the site plan and referenced condition #3 regarding the required buffering Comm Riley asked to restrict after-hour lighting under condition #5 Mr Pianta noted the Code typically requires reduced lighting by 50% during non-operating hours, as some lighting may be needed for security Discussion ensued regarding lighting impacts to the abutting residential neighbors Mr Pianta suggested adding the following language to condition #5: The lighting shall be reduced by a minimum of 50% during non-operating hours and the lighting along the south property line be restricted to the building Mr Grieves did not object to the modification Comm Widmar expressed concern with the steep elevation of the property and access, and he questioned if conditions #8 and #9 would allow the county to determine the proper access from Spring Hill Drive to the property Interim County Engineer Susan Goebel replied that the Facilities Design Guidelines would determine the proper driveway placement and would ensure the site distance is not compromised Assistant County Attorney Jeff Kirk suggested adding the phrase "and subject to approval by the County Engineer" to the end of condition #8 for clarity Chairman Hammond was concerned with removing existing trees along the southern boundary to erect the wall or fence under condition #3, and she suggested the wall/fence be placed at the 10' buffer mark instead of at the property line Mr Pianta and Mr Grieves discussed their concerns with maintaining that portion between the fence/wall and the property line Discussion ensued Mr Grieves agreed to meet with the three abutting residents to the south prior to the BCC hearing to ascertain their preference as suggested by Comm Widmar Mr Pianta asked that the applicant meet with the neighbors within the next five days so Staff could know in advance and be able to advise the BCC of the preference at their hearing Planning and Zoning Commission Page 9 Hernando County
10 To recommend approval per staff recommendations with the following modifications: 5 All onsite lighting must provide for full cutoff fixtures and retain all light on site to prevent any light spillage into neighboring residential uses Lighting shall be reduced by 50% during non-operating hours, and lighting along the south property line during non-operating hours shall be restricted to the building 8 Final driveway location/design shall comply with the site distance triangle at Spring Hill Drive in accordance with the Hernando County Facility Design Guidelines subject to approval by the County Engineer In addition, the petitioner would meet with the neighbors within the next five days and advise Staff of their preference in advance of the BCC hearing ADOPTED AS AMENDED [UNANIMOUS] Hammond, Riley, Widmar, Deutschle COMMISSIONERS AND STAFF ISSUES The public hearing was running ahead of schedule The next advertised item could not be heard prior to 10:30 am Commissioner and Staff Issues were moved up on the agenda Mr Pianta elaborated on the duties of Ms Pat McNeese, who was introduced to the P&Z members prior to the meeting Ms McNeese would be in charge of the Evaluation and Appraisal Report (EAR) of the comprehensive plan, and would be assisting in the Hernando Beach Community Initiative and the South Brooksville Community Initiative Regarding the EAR, Mr Pianta stated that a schedule would be given to the P&Z members at the appropriate time and he asked them to provide any suggestions for Staff to consider Discussion ensued regarding the P&Z participation in the EAR process Comm Riley asked to discuss buffering issues with the staff and to be educated on various options using vegetation and fencing Mr Pianta noted that each situation is unique based on the property size and characteristics He suggested having Mr Vic Heisler or Mr Chris Linsbeck attend a future meeting to discuss the landscape ordinance, as they implement the performance conditions relative to buffers He also suggested inviting someone from the Extension Office to talk about native vegetation Recess/Reconvene The Board recessed at 10:02 am and reconvened at 10:30 am Planning and Zoning Commission Page 10 Hernando County
11 VI PUBLIC HEARINGS - CONTINUED CPAM Hernando County Board of County Commissioners (South Brooksville PDD): An amendment request to change the Future Land Use Map for a 2895 acre tract from Residential, Industrial, Recreation, and Commercial to create the South Brooksville Planned Development District; to amend the Future Land Use Element by the inclusion of an Objective and Policies regarding the Planned Development District; and to amend Section D Future Land Use Map Mapping Criteria to include a description of the South Brooksville Planned Development District; North of Cortez Boulevard, east of Main Street, and south of Martin Luther King Jr Boulevard and Jefferson Street Representative: Paul Wieczorek, Hernando County Planning Department Mr Wieczorek, representing the petition, under oath, reviewed the staff report and associated maps It is recommended that the Planning and Zoning Commission review CPAM-10-02, the proposed amendment to the Future Land Use Element Objective and Policies, the Future Land Use Map, and the Section D Mapping Criteria, provide comments to the LPA/BCC and recommend that the amendment be transmitted to the Department of Community Affairs and agencies for review and comment Mr Wieczorek announced that a workshop will be held on May 27, 2010 at 4:30 pm at the Brooksville City Council Chambers All drawings associated with the amendment will be available for public review and staff will be on hand to answer any questions The workshop will be held for one hour prior to the CIT (Community Initiative Team) meeting beginning at 5:30 pm The following people spoke under oath regarding the petition: Donald Lacey discussed Coastal Engineering Associates, Inc' s role in the project and he elaborated on the effectiveness of the proposed uses Jerome Hammett, who owns three commercial lots in the area, stated he was present to learn about the proposal Geraldine Badger asked what was planned for the Kennedy Park area and what the zoning would be Clarence Clark asked for clarity of the mixed uses and definition of the South Brooksville PDD He asked for copies of the data maps James Holland asked what would happen to existing businesses near Twigg Street and Josephine Street, and inquired to new businesses proposed for the area Edmond H Johnson was concerned with drainage issues on St Francis Street and inquired to plans for drainage and sewer lines Planning and Zoning Commission Page 11 Hernando County
12 Angelina Philanders asked for clarity of the boundaries for the future land use area She questioned the matching funds for lighting, as she understood it would be a loan to be repaid by assessment of the property owners Mr Wieczorek addressed the questions posed by the public Referencing Policy 107(H)(28), he explained that this proposal would not change any existing zoning; changes would have to be initiated by the property owner through the rezoning process Mr Wieczorek and Mr Pianta discussed initial funding for street lighting coming from confiscated funds from the Sheriff's office, and a MSBU paid by the property owners would provide funding for long-term maintenance Interim County Engineer Susan Goebel provided an update of the St Francis Street drainage issue Mr Donald Lacey elaborated on possible drainage designs, and suggested concerned citizens attend the May 27 workshop where detailed information regarding the drainage would be provided Assistant County Attorney Jeff Kirk discussed a proposed interlocal agreement between the City and County to pay for stormwater improvements so they can apply for federal and state grant funding Mr Pianta added that once funding is secured, those projects would be incorporated into the County's Capital Improvement Element and Capital Improvement Program Mr Wieczorek indicated that improvements for Kennedy Park would occur as funding becomes available Mr Pianta elaborated on property owned by the School District near the Kennedy Park area that potentially may be used for drainage improvements, if the School District and neighborhood agreed Mr Pianta summarized that the vision plan is policy driven and changes are not anticipated to the county and school facilities in the area There are no specific changes to zoning, and no associated zoning or land use maps He reviewed several policies that outline various uses in the PDD to answer the questions posed by the public Any zoning changes proposed by a property owner would be handled through the zoning process, which includes advertised public hearings Mr Wieczorek reviewed the boundaries of the South Brooksville PDD using the Map A exhibit Comm Widmar suggested the May 27th workshop be advertised to inform the area residents Mr Pianta, Mr Wieczorek, Mr Lacey, and Mr Kirk responded to various questions posed by Comm Widmar regarding what the Community Initiative Team (CIT) is, community involvement in the PDD, grant funding and costs for projects, and the City of Brooksville public hearing process regarding their comprehensive plan amendment In response to Comm Deutschle's question regarding financial impacts to residents with septic systems connecting to central sewer, Mr Pianta indicated the County and City are looking at funding sources through programs like the Community Development Block Grant Program that might help pay for any connection fee costs He noted, Planning and Zoning Commission Page 12 Hernando County
13 however, that individuals would have to provide facilities should they redevelop their properties Mr Lacey addressed questions regarding timing for infrastructures under Policy 107(H)(21) for Comm Deutschle Chairman Hammond noted some policies reference the South Brooksville PDD where others did not Mr Wieczorek clarified that policies relating to the PDD were listed under Objective 107(H) Mr Pianta and Mr Wieczorek responded to Chairman Hammond's question regarding how the School District can determine student generation when specific acreage is not listed for residential units Mr Pianta explained that a numeric analysis is difficult to determine at this time, as the plan is a long-range vision for the neighborhood Individual redevelopment projects that move forward will have to meet the concurrency test The analysis will change over time based upon seating availability, population growth, and number of schools provided Should the State ask for additional information during the comprehensive plan amendment review process, County staff will confer with Ms Wheeler to get a better understanding of the impact, he explained Amber Wheeler noted she had expressed concern with specificity of the acreage and density for single family and multifamily uses She pointed out that DCA and DOE will look for total maximum potential student generation and whether capacity is available Referencing Policy 107(H)(2)(n), Ms Wheeler inquired to what design guidelines the School Board would have to comply with Mr Pianta clarified that was a general policy statement that refers to the Martin Luther King corridor and references transit-oriented design policies listed elsewhere in the amendment It is not a general requirement for the entire district Comm Widmar opined that there should be some type of incentive provision for affordable and workforce housing under Policy 107(H)(7) He suggested including the statement "Incentives may or will be provided" In response to additional questions posed by Comm Widmar, Mr Lacey stated that consultants were studying the drainage issue because placing culverts under SR 50 would be expensive He elaborated on the proposed Newgate Street Extension Mr Wieczorek and Mr Lacey responded to Comm Riley's inquiry regarding a possible commuter rail station and if an area was considered to store commuter cars at the terminus point Chairman Hammond discussed her concern with the development forcing people out of their homes if grant funding cannot be secured and a MSBU is put in place, when the intent of the plan is to improve the community She questioned if there was a policy provision for the PDD Mr Kirk explained the water and sewer interlocal agreement envisions contributions at 60% from the City and 40% from the County for any deficits above what is provided by Planning and Zoning Commission Page 13 Hernando County
