The Michigan Public Service Commission (Commission) will hold a public hearing to consider Midwest Energy Cooperative s (Midwest) July 31, 2015 application for Commission approval to reconcile its renewable energy plan (REP) costs for the period ended December 31, Midwest Energy represents that its REP filings included no request for a renewable energy surcharge, no surcharge was approved and none was charged to its member-customers in Midwest Energy further represent that there are neither revenues nor expenditures to reconcile. On January 31, 2013, the Commission opened a docket in Case No. U for the second biennial review of Midwest s REP, originally approved by the Commission on May 12, 2009 in Case No. U On October 17, 2013, the Commission approved Midwest s REP Settlement Agreement in Case No. U While the October 17, 2013 order approving Midwest s biennial review of its REP was silent as to whether Midwest was required to file an annual REP reconciliation, the Clean, Renewable, and Efficient Energy Act, 2008 PA 295, MCL et seq., and the Commission s January 27, 2015 Order in Case No. U et al require a reconciliation docket. While a reconciliation filing is required by statute and Commission Order, Midwest s REP included no request for a renewable energy surcharge, no surcharge was approved, and none was charged to Midwest s customers in With no collections and no expenditures, there is nothing to reconcile and a contested case would be wasteful of the Commission s valuable time and resources. Simply stated, there is no need to require a contested case process to report nothing. WHEREFORE, Midwest Electric Cooperative respectfully requests that this Honorable Commission: A. accept this Renewable Energy Plan Reconciliation Application; B. find that Midwest Electric Cooperative was not authorized to charge, nor did it collect, a renewable energy surcharge; C. find that there are no revenues or expenditures to reconcile; D. issue its ex parte order finding that a full contested case in such a docket need not be held; and E. grant such further and additional relief as may be deemed appropriate.
