2 La Promesa en el Derecho The Promise in the Law What do George Washington, Benito Juárez, and Simón Bolivar have in common? All three led revolutions against governments that were oppressing the people. These leaders believed that governments should exist for the good of all the people, and not just for a few rich or powerful persons. They were willing to die for this belief. After the wars they led were over, they worked hard to establish laws that recognized that all men and women are born equal, and that everyone is born with rights that no one should be able to take away. They understood that only a system of strong laws could make sure that governments were by and for the people. The founding fathers of the United States of America had the same belief, and that is why the United States is known around the world for its form of government and the freedoms that Americans have. America is not perfect. In the past, some laws have been used in a way that hurt individuals, especially the poor, and people of color. But many of those laws were thrown out because the people understood that they had a right to change things for the better, and they used the law to make these changes. See, the great thing about our government is that it was formed under a Constitution that contains a promise, a promise of respect and dignity for everyone, and a promise that each of us has a right to succeed in life. This is a wonderful promise, but we need to understand and respect the promise so it can never be taken away. The information in this book was written by Latinx lawyers who once were in school just like you. They became lawyers by staying in school and working hard. Do you want to be a lawyer one day? 4 THE CONSTITUTION The Constitution of the United States: Why Should I Care? The United States Constitution was written over 200 years ago but it affects each of us every single day. The Constitution was created because America was once ruled by the King of England. Americans became angry and they revolted and overthrew the King s power. But now they needed to create a new government. Instead of choosing a new King, the Americans decided to write a Constitution that created a government where power was separated and the people s basic rights were protected. The first words in the Constitution, called the Preamble, are We the People. This explains that the government is by and for the people, not a king, or group of powerful people. What an amazing idea, that the government serves the people and not the other way around! The Constitution also describes that the government is run by three branches of government that check each other to make sure the Constitution is not violated. For example, the President must examine every single law passed by Congress and can sign it into law or refuse to sign it (called a veto). This gives the President a way to make sure Congress does not do whatever it wants, but Congress can still enact the law after a presidential veto if two thirds of the members of each chamber vote for it. Another part of the Constitution is called the Bill of Rights. The Bill of Rights limits the power of the government and protects the individual rights of all the people living in the United States. Imagine a government founded on the rights of individuals to engage in freedom of speech, the right to vote, or the guarantee of a trial by jury! The Constitution allows EVERYONE to exercise these individual freedoms, no matter how rich or poor, or the color of your skin! The Constitution belongs to every single person in the United States and gives power to the people to come together for the good of everyone. Since the Constitution is the supreme law of the land, the courts, Congress, and the President cannot violate it. 5 LA CONSTITUCIÓN La Constitución de los Estados Unidos: Por Qué Le Debe Importar? La Constitución de los Estados Unidos fue escrita hace más de 200 años pero nos beneficia a cada uno de nosotros cada día. La Constitución fue creada debido a que las antiguas trece colonias británicas en Norte América eran gobernadas por el Rey de Inglaterra. Los colonos americanos se rebelaron y declararon su independencia, pero necesitaban crear un nuevo gobierno. En vez de elegir un sistema monárquico, los colonos americanos decidieron escribir una Constitución que creara un gobierno donde el poder estuviera separado y que protegiera los derechos básicos de las personas. Las primeras palabras en la Constitución, llamadas Preámbulo, son Nosotros la Gente Esto indica que el gobierno está formado por la gente y para la gente y no por o para un rey o un grupo de gente poderosa. Qué idea tan magnífica que el gobierno sirva a la gente y no al revés! La Constitución describe además que el gobierno está formado por tres ramas de gobierno que se vigilan unas a otras para asegurarse de que la Constitución no se viole. Por ejemplo, el/la Presidente debe examinar cada una de las leyes que son aprobadas por el Congreso y las puede convertir en ley o negarse a firmarlas (llamado veto). Esto le da al presidente la posibilidad de asegurarse de que el Congreso no haga lo que quiera. Sin embargo, el Congreso puede pasar la ley después de un veto presidencial si dos tercios de sus miembros votan por la ley. Otra parte de la Constitución es llamada el Acta de Derechos. El Acta de Derechos limita el poder del gobierno y protege los derechos individuales de todas las personas que viven en los Estados Unidos. Imagínate un gobierno fundado en el derecho de los individuos de participar en la libertad de expresión, el derecho al voto o la garantía de ser juzgado por un jurado! La Constitución permite a TODOS gozar de estas libertades individuales, sin importar el color de tu piel o si eres rico o pobre. La Constitución pertenece a cada persona en Estados Unidos y le da poder a la gente para unirse en busca del bienestar de todos. Porque la Constitución es la ley suprema, las Cortes, el Congreso y el/la Presidente no pueden violarla. 6 SEPARATION OF POWERS Who s Your Protector? Our government is like a big tree with a solid trunk and three branches. The trunk is the Constitution and the three branches are the Executive branch (the President), the Legislative branch (Congress) and the Judicial branch (the Courts). Each of the branches works to fulfill its responsibilities and to ensure that the other branches do not exceed or misuse their power. By separating government powers, we ensure that rights of individuals are protected and that we remain a government by and for the people. The President is the head of the Executive branch, which is made up of many departments and agencies, like the Department of Defense and the Department of Health and Human Services. This branch enforces and administers our laws. But if the President takes actions that Congress does not like, Congress can change the law to stop the President, or it can refuse to pay for what the President wants to do. The Supreme Court can also prevent the President from taking action by ruling that the action is illegal (unconstitutional). The Legislative branch is made up of the Members of Congress who are responsible for creating laws. Although Congress is powerful, the power of Congress can be checked (limited) by the President who can refuse to sign a law. Similarly, the Judicial branch has the power to overturn laws that are unconstitutional. The Judicial branch is headed by the Supreme Court and is made up of all of the federal courts. The Supreme Court interprets the meaning of the Constitution and decides whether laws passed by Congress or actions taken by the President are proper. If Congress disagrees with the Supreme Court s interpretation of one of its laws, Congress can amend the law. While the President cannot overrule the Supreme court, it is the President s responsibility to nominate justices for the Supreme Court. Our government is based on the principle that no single branch should be able to control all of the government s power. Understanding the responsibilities and limits of these different branches helps us to assert our rights and protect ourselves under our government s laws. 7 LA SEPARACIÓN DE PODERES Nuestra Protectora Real Nuestro gobierno es como un gran árbol con un tronco sólido y tres ramas. El tronco es la Constitución y las tres ramas son la Ejecutiva (el ó la Presidente), la Legislativa (el Congreso) y la Judicial (las Cortes). Cada una de las ramas trabaja para cumplir con sus responsabilidades y asegurarse de que las otras ramas no excedan ni hagan mal uso del poder. Al separar los poderes del gobierno, nos aseguramos de que los derechos de los individuos estén protegidos y de que mantengamos un gobierno del pueblo y para el pueblo. El/La Presidente es el/la líder de la Rama Ejecutiva la cual esta formada por varios Departamentos y Agencias, como el Departamento de Defensa y el Departamento de Salud y Servicios Sociales. Esta rama administra y hace que se cumplan las leyes. Pero si el Presidente toma acciones que el Congreso no apoya, el Congreso puede cambiar la ley para detener al Presidente, o puede negarse a pagar por lo que el/la Presidente quiere hacer. La Corte Suprema también puede prevenir que el/la Presidente tome cierta acción, decidiendo que esa acción es ilegal (inconstitucional). La Rama Legislativa está formada por los miembros del Congreso, quienes son responsables de crear las leyes. Aunque el Congreso es poderoso, el poder del Congreso puede ser verificado (limitado) por el/la Presidente, quien se puede negar a firmar una ley. Así mismo, la Rama Judicial tiene el poder de rechazar leyes que violen nuestros derechos bajo la Constitución. La Rama Judicial está dirigida por la Corte Suprema y formada por todas las Cortes de los Estados Unidos. La Corte Suprema interpreta el significado de la Constitución y decide si las leyes que han sido aprobadas están de acuerdo con la Constitución. Si el Congreso está en desacuerdo con la interpretación de la Corte Suprema, sobre alguna ley aprobada por el Congreso, el Congreso puede enmendar la ley. El/la Presidente nombra a los jueces para la Corte Suprema pero no puede sobrepasar sus decisiones. Nuestro gobierno se basa en el principio de que ninguna de las ramas puede controlar todo el poder del gobierno por sí sola. El entender las responsabilidades y los límites de las diferentes ramas del gobierno nos ayuda a reafirmar nuestros derechos y a protegernos bajo las leyes de nuestro gobierno. 8 THE PRESIDENT Leader, Commander and Chief Enforcer The President of the United States is the head of the Executive branch, one of the three branches that form the federal government. The President enforces federal laws, commands the armed forces, and manages the nation s relationships with other countries. The President fulfills all of these different responsibilities through departments and agencies that form the Executive branch, like the Army, the Department of Education, and the Central Intelligence Agency. The President cannot make laws (only Congress can do that) or overrule the decisions of the Supreme Court. Both the Congress and the Supreme Court act as a check against the President s power. Not everyone can be President. The Constitution requires that Presidents be natural-born citizens of the United States and be at least 35 years old. Also, Presidents must have lived in the United States for at least 14 years at the time of running for office. Many Presidents have previous experience as Vice President, Governor of a State, or a Member of Congress. The President cannot remain in office forever. A President is limited to two fouryear terms. If the people are not pleased with a President s policies or performance, they can vote for a different President. If the President dies, the Vice President takes over. Some say that the President is the most powerful person in the world. That may be true, but the President is not a king or dictator. The President is very powerful, but our system of government protects us from a President engaging in dishonest acts or breaking the law. The President is subject to our laws and there is a system of separation of powers that prevents a President from taking over the country. A President can be kicked out of office (impeached), or can be voted out of office. Under our laws, the President may be in charge, but the people are the boss. 9 EL/LA PRESIDENTE Líder, Comandante, y Encargado/a Principal El/La presidente de los Estados Unidos es la cabeza de la Rama Ejecutiva, una de las tres ramas que forman el gobierno federal de los Estados Unidos. El/La Presidente hace que se cumplan las leyes federales, dirije a las fuerzas armadas de los Estados Unidos y maneja las relaciones de la nación con otros países. El/La Presidente cumple con todas estas diferentes responsabilidades mediante los Departamentos y Agencias que forman la Rama Ejecutiva como el Ejército, el Departamento de Educación y la Agencia de Inteligencia Central (CIA). El/La Presidente no puede legislar (solamente el Congreso puede hacerlo), ni rechazar las decisiones de la Corte Suprema. Tanto el Congreso como la Corte Suprema actúan como contrapesos al poder de el/la Presidente. No todas las personas pueden ser Presidentes. La Constitución requiere que los Presidentes sean ciudadanos estadounidenses por nacimiento, que tengan al menos 35 años de edad y que hayan vivido en los Estados Unidos por lo menos 14 años. Muchos Presidentes han tenido experiencia previa como Vice Presidentes, Gobernadores de Estado o miembros del Congreso. Los Presidentes no pueden permanecer en su cargo por siempre; están limitados/as a un máximo de dos términos de cuatro años. Si la gente no está de acuerdo con las políticas o con el desempeño de el/la Presidente, pueden votar por un Presidente diferente. Si el/la Presidente muere, el Vice Presidente toma su cargo. A pesar de todo el poder presidencial, nuestro sistema de gobierno nos protege de un(a) Presidente que tome acciones deshonestas o que no cumpla la ley. El/La Presidente está sujeto(a) a nuestras leyes y existe una separación de poderes que previene a cualquier presidente tomar el control completo del país. Si el/la Presidente excede su autoridad presidencial puede ser sacado(a) del poder por el Senado después de un juicio. 10 THE CONGRESS Our Elected Representatives The Congress of the United States is one of the three branches of our government. Congress is called the Legislative branch because it writes the laws that the Executive branch enforces and that the Judicial branch interprets. Congress performs its functions in Washington D.C., the capital of the United States. Under the Constitution, Congress has the power to pass laws on things that are very important to each of us, like taxes, immigration, money, and education. Congress performs its job by writing, debating, and voting on laws. Congress is divided into two bodies: the Senate and the House of Representatives. The House of Representatives has 435 Members that are elected every two years and represent areas or districts that are divided by population. Senators are elected for a term of six years and represent an entire state. There are two Senators from each state for a total of 100 Senators. The Senate and House of Representatives are divided into many committees. Members of Congress are assigned to committees that cover specific areas like agriculture or immigration. Each Member has one vote to cast on the laws that are debated. A Member s vote should reflect the beliefs and concerns of the people that they represent. Members of Congress are elected by the people. You have a right to vote for your members of Congress after you turn 18 and register to vote. Once elected, your Senators and Representatives have a responsibility to represent you and be your voice in Washington D.C. It is the job of your elected representatives in Congress to listen to you about issues that affect you and your community. The Constitution created a legislative branch that could represent the people. Because it creates laws, Congress is a powerful branch of government, but its power is kept in balance by the other branches of government, the Executive and Judicial branches. It is your responsibility to vote for the person that you want to represent you in Congress. Your elected officials in Congress serve you and they want to hear from you. 11 EL CONGRESO Nuestros Representantes Electos El Congreso de los Estados Unidos es una de las tres ramas de nuestro gobierno. Se le conoce como la Rama Legislativa, pues se encarga de escribir las leyes que la rama Ejecutiva hace cumplir y que la rama Judicial interpreta. El Congreso lleva a cabo sus funciones en Washington, D.C., la capital de los Estados Unidos. Bajo la Constitución, el Congreso tiene el poder de crear leyes sobre asuntos que son muy importantes para cada uno de nosotros, como los impuestos, la inmigración, el dinero y la educación. El Congreso lleva a cabo su trabajo escribiendo, debatiendo y votando sobre las leyes. El Congreso está dividido en dos cuerpos: El Senado y la Cámara de Representantes. La Cámara de Representantes tiene 435 miembros que son electos cada dos años y representan áreas o distritos que están divididos por población. Los Senadores son electos para un período de seis años y representan a un estado completo. Hay dos Senadores por cada estado y un total de 100 Senadores. 12 THE SUPREME COURT Our Protector and Final Arbiter The Supreme Court of the United States is the highest Court in the Country. It decides whether anyone including the government is acting within federal law or the Constitution. The Supreme Court, along with other lower courts, is the principal protector of individual rights, especially for minority groups. There are nine individuals, referred to as Justices, who serve on the Supreme Court. The President nominates individuals to serve as Justices, and the Senate must then approve the nominees before they can be appointed to serve on the Supreme Court. The confirmation process is important because Supreme Court Justices serve for life. This means that generally they cannot be removed, but rather stay on the Court until they voluntarily retire or die. The Supreme Court is the only federal court established by the Constitution of the United States (in Article III), so it can decide any question of Constitutional law whether Congress wants it to or not. It has wider authority to decide questions of federal law than the lower federal courts. Because it is only a single Court, and because there are so many legal proceedings in the United States every year, the Supreme Court can only decide a very small percentage of the cases that it is asked to look at. Because it can only hear and decide a relatively small number of cases, the Supreme Court mostly focuses on cases with important questions of law that will affect many people and which the lower federal or state courts have not agreed upon. For instance, the Supreme Court has made, and will continue to make, very important decisions that affect each of us involving such issues as affirmative action, abortion, immigration, equal rights, free speech, and even presidential elections. The Supreme Court promises the Nation and its people, including you and me, that both the state and federal governments will act within the law and protect our rights. 13 LA CORTE SUPREMA Nuestra Protectora y Árbitra Final La Corte Suprema de los Estados Unidos es la Corte más alta del País. Ella decide si alguien inclusive el gobierno está actuando dentro de las leyes federales y/o de la Constitución. Junto con otras cortes, es la principal protectora de los derechos individuales, especialmente para grupos minoritarios. Hay nueve personas que sirven como jueces del tribunal (llamados Justices en inglés) en la Corte Suprema. El/La Presidente nomina a las personas para servir como Justices y el Senado debe aprobar a los nominados antes de ellos ser designados para servir en la Corte Suprema. El proceso de confirmación es importante, ya que las personas designadas como Justices sirven de por vida en la Corte Suprema. Generalmente, esto significa que no pueden ser removidos de sus puestos y que se quedan en la Corte hasta que se retiran voluntariamente o mueren. La Corte Suprema es la única Corte Federal establecida por la Constitución de los Estados Unidos (en el Artículo III), por la tanto, puede decidir sobre cualquier asunto relacionado a Leyes Constitucionales sin importar si el Congreso lo quiere o no. La Corte Suprema tiene una autoridad más amplia para decidir las cuestiones de las leyes federales que cualquier otra corte federal. Por ejemplo, la Corte Suprema ha tomado decisiones muy importantes que afectan a cada uno de nosotros y envuelven asuntos tales como: acción afirmativa, aborto, inmigración, igualdad de derechos, libertad de expresión y las elecciones presidenciales. La Corte Suprema promete a la Nación y a su gente, incluyéndonos a usted y a mí, que tanto el Gobierno Federal como el Estatal actuarán de acuerdo a las leyes y protegerán nuestros derechos. 14 THE COURTS Friends or Foes? The American court system is very different from the court systems in other countries. For example, our court system is often called the justice system because it is based on principles of justice, fairness, and equality. It is often said of the American courts that justice is blind meaning that everyone is the same under the law and courts try to apply the law fairly to everyone. There are two different branches of the law. Civil law is the branch of the law dealing with private rights of individuals, groups or businesses such as contracts, personal injury and divorces. Criminal law is the branch of the law dealing with crimes and their punishment. In both civil and criminal matters the court has a judge that directs, or presides, over the particular case. Judges are required to apply the law to the facts of cases in an impartial way and they do not consider public opinion in their decisions. Instead, judges uphold the law, interpret constitutional questions, and establish the law when none exists. A unique feature of our justice system is the right to appeal. If the court makes a decision against one party, that party can take the case to a higher authority or appeal the lower court s decision in the case. The general rule in the American justice system is that the loser deserves one appeal. The courts serve a vital role in our society. Men and women who serve as judges make difficult decisions every day that can affect a person s freedom, property, family, and business. The American justice system makes a promise that the courts will treat you fairly and apply the law equally. This promise means the court is a friend, not a foe. 15 LAS CORTES Aliadas o Enemigas? El sistema americano de cortes es muy diferente a los sistemas de cortes de otros países. Por ejemplo, nuestro sistema de cortes es comúnmente llamado el sistema de justicia ya que se basa en principios de justicia, imparcialidad e igualdad. Con frecuencia se dice de las cortes americanas que la justicia es ciega refiriéndose a que cada persona es igual ante la ley y que las cortes tratan de aplicar la ley de una manera justa para todos. Hay dos ramas diferentes de la ley. El Derecho Civil es la rama de la ley que trata los derechos privados de los individuos, grupos o negocios, tales como contratos, daños corporales y divorcios. El Derecho Criminal es la rama de la ley que trata los crímenes y sus castigos. Tanto en asuntos civiles como criminales la corte tiene un/a juez que dirije, o preside sobre un caso particular. A los jueces se les exige aplicar la ley a los hechos de los casos de forma imparcial y no toman en cuenta la opinión pública al tomar decisiones. Al contrario, los jueces mantienen las leyes, interpretan preguntas constitucionales y establecen la ley cuando no existe ninguna. Una característica única de nuestro sistema de justicia es el derecho de solicitar una revisión judicial o apelar una decisión. Si la corte toma una decisión en contra de una de las partes, esa parte puede llevar el caso a una autoridad judicial más alta o apelar la decisión de la corte menor en el caso. La regla general en el sistema americano de justicia es que el perdedor merece una apelación. Las cortes tienen un papel vital en nuestra sociedad. Las personas que sirven como jueces toman decisiones difíciles todos los días; decisiones que afectan la libertad, la propiedad, la familia y el negocio de la población. El sistema americano de justicia promete que las cortes te tratarán justamente y que aplicarán la ley igualmente. Esta promesa significa que la corte es una aliada y no una enemiga. 16 THE JURY PROCESS What Does it Mean to be Tried by a Jury of Your Peers? The right to trial by jury is a fundamental principle of the American legal system. It preserves a right deeply rooted in history that allows Americans to have their case, both criminal or civil, heard by a jury of one s peers. The right to a jury is preserved in the Sixth and Seventh Amendments to the United States Constitution, and every State has included this right in their State Constitutions in one form or another. Thomas Jefferson said that the jury process was the best of all possible safeguards for the person, property and reputation of every citizen. Jurors keep the law in the United States close to the people, preserving a guarantee of freedom and democracy that many in the world are still struggling to achieve. Jury service allows individual citizens, like you and I, to play an important part in the judicial process, because it imposes an awesome responsibility on citizens to make decisions that are fair and just. The people who sit on a jury decide the outcome of a trial. Until recently, the pool of potential jurors did not reflect the diversity of their communities, and prospective jurors were dismissed from jury service because of their race, gender, class, or even religion. The American jury system depends on the participation and attitude of all citizens. Most people, including you, will one day be called to serve on a jury, and this is a responsibility you should welcome. The right to a trial by our peers is a promise that we do not have to be judged by strangers. Instead, the persons that judge you, me and our friends should look and talk like us and our friends, they should be people from our own community. 17 EL PROCESO DE JUICIO Qué Significa Ser Juzgado por un Jurado de Personas Como Usted? El derecho a ser juzgado por un jurado es un principio fundamental del sistema legal americano. Este principio preserva un derecho que ha sido arraigado a través de la historia de esta nación, y el cual permite a los americanos presentar su caso, tanto criminal como civil, y ser escuchados por un jurado formado por ciudadanos comunes. El derecho a tener un jurado se establece en la Sexta y Séptima Enmiendas a la Constitución de los Estados Unidos y cada estado ha incluído este derecho en sus Constituciones de una u otra forma. 18 YOUR BASIC RIGHTS Your Basic Rights in a Criminal Proceeding After the Constitution became the supreme law of the United States, it was changed to add the Bill of Rights (the first ten amendments) which provides specific protections for all of us who live in the United States, especially in the area of criminal law. For example, the Fourth Amendment guarantees that the police cannot search us, our homes or belongings, or confiscate our property without an arrest or search warrant that has been signed by a judge. The judge must make sure that there are good reasons (reasonable grounds) for the search or arrest. Also, the warrants cannot be wide open, but have to describe the place to be searched, the items to be taken away, or the person to be arrested. The Fifth Amendment protects us from being forced to testify against ourselves. This means that we have the right to refuse to answer any questions that may incriminate or put the blame on us. If we are in police custody, we have a right to remain silent and not say anything that can be used against us. The Sixth Amendment provides that we have the right to an attorney in a criminal trial. If we do not have enough money to pay for a lawyer, the Government must provide one for free. Some courts have said that the Sixth Amendment also means that we should be able to understand what is going on during a trial and that an interpreter should be made available if we do not fully understand English. The Bill of Rights is important because it contains protections of our civil rights. It is a promise that the government will not get out of control and trample the rights of the people. 19 SUS DERECHOS BÁSICOS En un Procedimiento Criminal Cuáles Son Sus Derechos? Después de que la Constitución se convirtiera en la ley suprema de los Estados Unidos, se realizó un cambio para incluir el Acta de Derechos (llamada Enmiendas) la cual provee protecciones específicas para todos los que vivimos en los Estados Unidos, especialmente en el área de derecho criminal. Por ejemplo, la Cuarta Enmienda garantiza que la policía no puede inspeccionarnos ni a nosotros ni a nuestras pertenencias o nuestra casa, o confiscarnos nuestras propiedades, sin tener una orden de arresto o una autorización de registro que haya sido firmada por un juez. El juez debe asegurarse de que existan razones válidas (motivos razonables) para el registro o arresto. Además, las órdenes de registro no pueden ser generales, deben describir el lugar de registro, las cosas que se deben tomar en posesión, o la persona que debe ser arrestada. La Quinta Enmienda nos protege de ser obligados a testificar en contra de nosotros mismos. Esto significa que tenemos el derecho de negarnos a contestar cualquier pregunta que nos incrimine o que nos ponga la culpa a nosotros. Si estamos bajo custodia de la policía tenemos el derecho a permanecer en silencio y a no decir nada que pueda ser usado en nuestra contra. La Sexta Enmienda establece que tenemos el derecho a tener un/a abogado/a en un juicio criminal. Si nosotros no tenemos dinero suficiente para pagar a un/a abogado/a, el Gobierno debe proveernos uno/a gratuitamente. Algunas cortes han considerado que la Sexta Enmienda también significa que debemos entender lo que está pasando durante el juicio y que deben proveernos con un intérprete si no entendemos por completo el Inglés. El Acta de Derechos es importante ya que incluye la protección de nuestros derechos civiles. Es una promesa de que el gobierno no se saldrá de control ni pisoteará los derechos de las personas. 20 CIVIC ACTIVITIES The Freedom to Engage in Civic Activities: Why is this Important? Unlike certain countries, the United States of America is a democracy. A democracy is a government that is run by the people, so we get to decide as a group how the country will be run and who our leaders will be. But a democracy will not work if we do not get involved. What you and the community want is important, and civic involvement is how we can make it known. Civic involvement is a way for each of us to participate in the governmental process and to ensure that we have a say in the way our government is run. You can become civically involved in many ways. For example, you can organize or attend community meetings, collect signatures for ballot proposals, attend and participate in protests, write letters to the newspaper, stay current on local politics, or create a blog. And one of the most important things you can do to become involved is to vote! The freedom to engage in civic activities is really a promise that your voice will be heard by our government and that you can affect the priorities of the government. It means that you and every citizen are important and deserve a say in what our government does. It is part of the guarantee that all citizens are equal. If we participate, our government will respond to us and, at least in part, the laws will reflect our own beliefs. By speaking out in our communities and at all levels of government, we influence the opinions of others. We have the opportunity to make what is important to us important to other people and then important to our government. When we do not participate, the laws will not represent our interests, and they may be unfair or unjust. 21 ACTIVIDADES CÍVICAS La Libertad de Participar en Actividades Cívicas: Por Qué Es Importante? A diferencia de algunos países, los Estados Unidos de América es una democracia. Una democracia es un gobierno dirigido por el pueblo y, por lo tanto, nosotros decidimos como grupo la manera en que el país funciona y quienes serán nuestros líderes. Pero una democracia no funciona si nosotros no participamos en ella. Lo que usted y su comunidad quieren es importante y su participación cívica es la manera de demostrarlo. Participar en actividades cívicas es la manera en que cada uno de nosotros contribuye al proceso gubernamental y nos aseguramos de que nuestra opinión en las acciones del gobierno. Usted puede participar cívicamente de diferentes formas. Por ejemplo, usted puede organizar o asistir a reuniones comunitarias, recolectar firmas para hacer propuestas, participar en protestas, escribir cartas al periódico, mantenerse al tanto de la política local, o crear una página de opinión en internet (blog). Y una de las maneras más importantes en las que usted puede participar es votando! La libertad de participar en actividades cívicas representa una promesa real de que su voz será escuchada por nuestro gobierno y de que usted puede influenciar las prioridades del gobierno. 22 VOTING What Is in It for Me? The Voting Rights Act of 1965 is generally considered the most successful piece of civil rights legislation ever adopted by the United States Congress. The Voting Rights Act states that no person shall be denied the right to vote on account of race or color. Voter turnout of the Hispanic community directly affects the decisions made about many issues including health care, a fair minimum wage, access to a college education, immigration and the environment. When a significant population is left out of the decision making process and does not have power to affect the decision makers, the policies that are created do not represent the community. That is why your community needs your vote! The right to vote is a promise that you can create change and make a positive impact in the community. Today, registering to vote is a basic rite of passage for most high school seniors. It is simple. When you turn 18, you fill out a short voter registration form that usually asks general information such as your name and address. Once you register, you become eligible to vote for elections where you live. Typical elections include those for Mayor, Governor, City Council, School Board, United States Congress Representatives and Senators, and the President. It is important to learn about the candidates and issues before you cast your vote. Newspapers and television are a good source to learn about candidates positions on different issues. On election day, you are able to use your power to make your voice heard when you vote. Your vote along with others can act as a force to create positive, lasting change in your community. La Ley del Derecho al Voto del 1965 es generalmente considerada la parte más exitosa de la legislación sobre los derechos civiles, adoptada por el Congreso de los Estados Unidos. La Ley del Derecho al Voto establece que ninguna persona puede ser negada el derecho a votar; ni por su raza, ni por el color de su piel. El voto de la Comunidad Hispana influye directamente las decisiones tomadas sobre asuntos como el cuidado de la salud, el salario mínimo justo, el acceso a la educación universitaria, la inmigración y el ambiente. Cuando una parte significativa de la población no participa en el proceso de la toma de decisiones y no tiene el poder de influir a los que toman las decisiones, las políticas que se crean no representan a la comunidad. Es por eso que su comunidad necesita que usted vote! El derecho a votar es la promesa de que usted puede crear un cambio y lograr un impacto positivo en la comunidad. Hoy en día registrarse para votar es un ritual básico para la mayoría de estudiantes del último año de escuela superior. Es simple. Cuando usted cumple 18 años, llena un formulario de registro corto que usualmente le pregunta sobre su información general, como su nombre y dirección. Una vez que se registra, usted es elegible para votar en las elecciones, de acuerdo a donde usted viva.
