1 FOREST PRESERVE DISTRICT OF KANE COUNTY COMMISSION MEETING November 12, 2013 The Forest Preserve Commission meeting was called to order by President Hoscheit at 9:00 a.m. on Tuesday, October 8, 2013, in the County Board Room at the Kane County Government Center, Building A, 719 Batavia Avenue, Geneva, Illinois. The Pledge of Allegiance was led by Commissioner Vazquez Present: Monica Meyers, Executive Director Jerry Culp, Director of Planning and Development John Goreth, Director of Operations Laurie Metanchuk, Director of Community Affairs Drew Ullberg, Director of Natural Resources Tracey Smith, Director of Human Resources Mike Gilloffo, Police Chief Jerry Hodge, Attorney Patricia Hestekin, Recording Secretary The roll call of Commissioners present included: Allan, Auger, Barreiro, Castro, Donahue, Ford, Frasz, Gillam, Kenyon, Kojzarek, Lewis, Molina, Pollock, Scheflow, Silva, Smith, Taylor (late), Vazquez and Wojnicki. Commissioners absent: Davoust, Haimann, Laesch and Starrett. MINUTES: President Hoscheit called for approval of the October 8, 2013 minutes. -Motion by Commissioner Lewis, seconded by Commissioner Frasz, to approve the minutes October 8, 2013 as read: motion carried. PUBLIC COMMENT: Mr. John Kavalunas, a resident and HOA Board member of the Bowes Creek Country Club addressed the Commissioners with concerns about the land donation. The HOA members are unclear as to the specifics of the land donation, as the residents are setting aside $2.50 per household each month for the upkeep of the open space. Members are not clear as to what areas this includes, who is the contact person with questions and maintenance issues, what should residents expect from the District and the HOA. Executive Director Meyers replied that once the donation is accepted the District will contact the HOA President and arrange a meeting to discuss the maintenance program and answer any other questions they may have. PUBLIC RECOGNITION: CERTIFICATE OF ACHIEVEMENT FOR EXCELLENCE IN FINANCIAL REPORTING: Chris Minick, Director of Finance for the City of St. Charles and a Board Member of the IGFOA presented a Certificate of Achievement for Excellence in Financial Reporting to the Director of Finance Stanish and the District. The recognition is for the District s Comprehensive Annual Financial Report for the year ended June 30, This is the first time the District has received this commendation, which is the highest form of recognition for governmental accounting and financial reporting. The Comprehensive Annual Financial Report offers an overview and analysis of the annual financial activities of the District. The receipt of this award is proof and commitment to the work and the dedicated leadership of the Finance Department and its staff. President Hoscheit thanked and congratulated Director Stanish and his staff for all their hard work on the audit. CHICAGO WILDERNESS 2013 EXCELLENCE IN ECOLOGICAL RESTORATION ACCREDITATION. Director Ullberg presented the District with the newly-launched Excellence in Ecological Restoration Program, which was developed to recognize high-quality restoration sites and the organizations that manage them. Organizations conduct comprehensive selfassessments of their adaptive management programs and the quality of the natural areas being accredited. The program uses rigorous professional standards of excellence in natural resource management and ecological restoration, based on the Chicago Wilderness biodiversity Recovery Plan, to recognize best practices in natural resource management. The Chicago Wilderness Commission on Excellence in Ecological Restoration reviews the assessments and determines the level of site certification.
2 The District received the Gold Accreditation for the Dick Young Forest Preserve with 1,288 acres; Dick Young Forest Preserve contains one of the most ecologically important natural areas in the region, and includes the most botanically diverse marsh areas, sedge meadow, fen and tallgrass prairie in Kane County. Its extraordinary Nelson Lake Marsh is a product of a late melting ice mass from the last retracting glaciers. Its geology allows an abundant and complex source of water to persist; what thwarted early pioneer attempts to drain the area for agriculture serves to preserve significant remnants of the original habitats managed by the Forest Preserve District today. The Dick Young Forest Preserve is a critical site for waterfowl, shrubland and grassland birds, and supports more than 300 bird species in total. These include rare and threatened migratory species such as American pelican, canvasback, northern harrier, Henslow s sparrow, and osprey. Named in honor of one of the county s long-time environmental advocates and two-time Iwo Jima Purple Heart recipient, the preserve is also the restoration focus of the Veteran s Conservation Corps. President Hoscheit thanked Director Ullberg and his staff for the vision and work on this 20+ year project and for restoring the land for future generations. FP-R A RESOLUTION AUTHORIZING THE PURCHASE OF TWO (2) FORD F 450 REPLACEMENT TRUCKS THROUGH THE STATE OF ILLINOIS-KANE COUNTY JOINT PURCHASING AGREEMENT WHEREAS, the Commissioners of the have previously authorized joint purchases with the State of Illinois for certain items, including vehicles, that are bid by the State of Illinois; and WHEREAS, it has been determined by the Commissioners of the that the District needs to purchase two (2) Ford F450 replacement dump trucks for the Operations Division through this State of Illinois joint purchasing agreement for the total price of $129,368. NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the that said vehicles be purchased through the joint purchasing agreement with the State of Illinois from Bob Ridings Fleet Sales Program of Taylorville, Illinois in the total amount of $129,368. FP-R A RESOLUTION AUTHORIZING THE PURCHASE OF ONE (1) TOW MASTER T-50 TRIPLE AXEL TRAILER THROUGH THE NATIONAL INTERGOVERNMENTAL PURCHASING ALLIANCE WHEREAS, the Commissioners of the have deemed it necessary to purchase such items as a trailer through the National Intergovernmental Purchasing Alliance; and WHEREAS, it has been determined by the Commissioners of the that the District desires to purchase one (1) Tow Master T-50 triple axel trailer for use by the District s Trades Department through the National Intergovernmental Purchasing Alliance for a price of $37,482. NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the that said trailer be purchased through the National Intergovernmental Purchasing Alliance from Patten Caterpillar Construction Solutions in the total amount of $37,482. 5 STATE OF ILLINOIS COUNTY OF KANE ss RESOLUTION NO. FP-R A RESOLUTION ACCEPTING A BID THE PAUL WOLFF CAMPGROUND ROADWAY AND CAMPSITE IMPROVEMENTS WHEREAS, bids have been solicited and received for the roadway resurfacing and campsite improvements on the eastern half of the original campground at the Paul Wolff Campground, Burnidge Forest Preserve to include; two (2) of the repaved RV sites to be made ADA compliant, two (2) RV sites in the new section will be repaved to be ADA compliant and an ADA compliant car parking space will be added by the restroom; and WHEREAS, the apparent low qualified bidder for the re-paving of the roadway and campsites improvements is Evans and Sons of West Chicago, Illinois for a Base Bid totaling $201,671, Alternate B totaling $31,993 and Alternate C totaling $35,787 for a total bid in the amount of $269,451. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of Kane County, Illinois that the low qualified bid by Evans and Son of West Chicago, Illinois for a Base Bid totaling $201,671, Alternate B totaling $31,993 and Alternate C totaling $35,787 for a total bid in the amount of $269,451 be, and hereby is accepted and approved. 6 STATE OF ILLINOIS COUNTY OF KANE ss RESOLUTION NO. FP-R A RESOLUTION ACCEPTING A BID FOR THE CUSTOM GROWING OF OAK TREES WHEREAS, the has observed that pot grown oak trees have a larger and healthier root system for transplanting; and WHEREAS bids have been solicited and received for the custom growing of oak trees; and WHEREAS, the apparent low qualified bidder for the custom growing of oak trees is Majestic Oaks of Spring Grove, Illinois in the amount of $33,000 for a minimum of 2,000 potted oak trees and the District has the right to purchase an additional 500 trees at a cost $11 each for a cost of $5,500 for a total contract price of $38,500. WHEREAS, this is a multi-year contract with delivery of 2,000 trees in 2015 at 2 years of age and the right to purchase additional trees if desired. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Forest Preserve District of Kane County, Illinois that the low qualified bid by Majestic Oaks of Spring Grove, Illinois for $33,000 for the custom growing of 2,000 oak trees with an additional 500 trees for $5,500 for a total contract price of $38,500 be, and hereby is accepted and approved. FP-R A RESOLUTION AUTHORIZING THE RETENTION OF ARCHITECTURAL SERVICES FOR DESIGN ASSOCIATED WITH THE NATURAL RESOURCE FACILITY AT THE MEISSNER-CORRON FOREST PRESERVE WHEREAS, the has determined that architectural services for the construction of the Natural Resources facility are necessary; and WHEREAS, the finds it is necessary and desirable to retain the services of Williams Architects of Itasca, Illinois for the architectural services for the Natural Resources Facility to be constructed at the Meissner-Corron Forest Preserve. Such conclusion being reached after the District conducted an RFP of qualified architects familiar to the District. NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the that Williams Architects of Itasca, Illinois (see Exhibit A), be retained to perform the necessary architectural services for the construction of the Natural Resources facility at Meissner-Corron Forest Preserve, for a cost not to exceed $39,200. 8 STATE OF ILLINOIS COUNTY OF K A N E ss RESOLUTION NO. FP-R A RESOLUTION AUTHORIZING ACCEPTANCE OF LAND DONATION WITHIN THE BOWES CREEK COUNTRY CLUB IN THE CITY OF ELGIN FROM THE TOLL IL. L.P. WHEREAS, the, Illinois, is organized and existing under An Act of the General Assembly of the State of Illinois entitled AAn Act to Provide for the Creation and Management of Forest Preserve Districts@ approved June 27, 1913, as amended; and WHEREAS, it has been deemed advisable, necessary and in the best interests of said Forest Preserve District that the Board of Commissioners of Forest Preserve District acquire additional lands for forest preserve purposes, which said lands, together with all lands heretofore acquired, will not exceed 55,000 acres; and WHEREAS, from time to time persons desire to contribute lands to the by gift and for no consideration to be paid for such land; and WHEREAS, the Forest Preserve District desires to receive land by gift which meets its criteria for use for forest preserve purposes, and is otherwise acceptable to it. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That it has been determined that a forest preserve should be laid out, established, constructed and maintained on certain real property hereinafter described, said real property being located within the corporate boundaries of the, Illinois, and that said forest preserve be used, occupied, improved and developed for forest preserve purposes in a manner necessary and convenient for public use. 2. It is hereby determined that it is necessary and desirable that the, Illinois, shall acquire title to or any interest in and possession of the real property within Bowes Creek Country Club by Toll IL, LP which is described on Exhibit A attached hereto, and which real property meets the criteria established by the Forest Preserve District for property to be acquired by it. 3. That the, Illinois, does hereby accept the real property within the Bowes Creek Country Club by Toll IL, L.P. described on Exhibit AA@ attached hereto as a gift by the grantors and for no consideration to be paid by it for same. That the agreement included the dedication of 32 acres of wetland to the District with a $25,000 onetime donation and a monthly service fee of $2.50 per dwelling unit per month in perpetuity for the ongoing maintenance of the dedicated wetlands. The monthly service fee per dwelling unit will be increased yearly on January 1st based on the increase in the consumer Price Index. 4. That the, Illinois does hereby express its gratitude to the grantors of the real property being conveyed to it and does hereby acknowledge receipt and acceptance of the gift being made by the grantors. 9 Executive Director Meyers commented that during the planning / concept stages of the sub-division a portion of the development was to be dedicated to the District. District Staff will contact the HOA and will establish a working relationship with them. The District will oversee and manage the property and will set standards with the HOA that will be maintained. FP-O AN ORDINANCE abating the tax heretofore levied for the year 2013 to pay debt service on the Taxable General Obligation Bonds (Alternate Revenue Source), Series 2008, of the, Kane County, Illinois. * * * WHEREAS, the Board of Commissioners (the Board ) of the Forest Preserve District of Kane County, Kane County, Illinois (the District ), by ordinance adopted on the 13th day of May, 2008, did provide for the issue of $8,000,000 Taxable General Obligation Bonds (Alternate Revenue Source), Series 2008 (the Bonds ), and the levy of a direct annual tax sufficient to pay principal and interest on the Bonds; and WHEREAS, the District has irrevocably deposited Pledged Revenues or other available funds in the Bond Fund (as each is defined in the Bond Ordinance) sufficient to pay debt service on the Bonds on June 15, 2014 and December 15, 2014; and WHEREAS, it is necessary and in the best interests of the District that the tax heretofore levied for the year 2013 to pay such debt service on the Bonds be abated: NOW, THEREFORE, Be It and It is Hereby Ordained by the Board of Commissioners of the Forest Preserve District of Kane County, Kane County, Illinois, as follows: Section 1. Abatement of Tax. The tax heretofore levied for the year 2013 in the Bond Ordinance is hereby abated in its entirety. (Actual amount of $680,608.76) Section 2. Filing of Ordinance.
