1 This Regular Meeting of the Borough of Raritan Governing Body was called to order by Council President Donald Tozzi in the Meeting Room of the Raritan Municipal Building, 22 First Street, Raritan, NJ at 6:30 p.m. on Tuesday,. The Council President announced this Regular Meeting was called pursuant to applicable portions of the Open Public Meetings Act. Adequate Notice was communicated to The Courier News and The Star Ledger on January 2, 2018, posted on the bulletin board in the Municipal Building, on the Borough website and made available in the Office of the Borough Clerk. ROLL CALL Present: Councilman Bray, Councilman Giraldi, Councilman Goetsch, Councilman Orozco, Council President Tozzi Also Present: Borough Attorney Rizzo, Borough Administrator Jaxel, Borough Clerk Colvin, Borough Engineer Schrek Absent: Mayor McMullin, Councilman Carra INVOCATION AND FLAG SALUTE Councilman Bray EXECUTIVE SESSION Resolution No Executive Session 1. Contract Negotiations Library Lease On a motion by Councilman Giraldi, seconded by Councilman Orozco, Council moved to Approve Resolution No Council convened in Executive Session at 6:32 p.m. On a motion by Councilman Bray, seconded by Councilman Orozco, Council moved to Reconvene in. Council exited Executive Session and resumed at 6:58 p.m. 1

2 PUBLIC COMMENT (In accordance with Section 29-1 of the Code of the Borough of Raritan, there shall be a five-minute limit per speaker) Council President Tozzi opened this first Public Comment portion of the meeting for members of the public wishing to speak. Victor Laggini, 250 Weiss Terrace: Mr. Laggini said he is concerned about the quality of life concerning the noise and emissions coming from the NJ Transit yard. Mr. Laggini said this issue has been going on for quite some time and impacts his and his family s sleep, among other issues. He said the trains idle throughout the night. Mr. Laggini read a letter he said was from NJ Transit stating trains would not idle for more than one hour, unless the weather was freezing. Council President Tozzi agreed that the noise is very loud, noting he personally visited the location. Councilman Giraldi asked Ms. Laggini to provide a copy of the NJ Transit letter for members of the Governing Body. Carla Stanziola, 251 Weiss Terrace: Ms. Stanziola also commented on the train noise, stating she believed an agreement was reached in 2008, which banned train idling. She said the quality of life for residents is being impacted. Ms. Stanziola said she called the train yard and was told by a worker that she lives near a train yard. She said the noises are not normal train noises. Pam Febo, 264 Weiss Terrace: Ms. Febo also commented on the noise, stating she and her husband are unable to sleep at night. The windows of her home vibrate from the noise and they are unable to use their patio, she said. Council President Tozzi said sound tests will be conducted immediately. Vicky Malfitano, 1018 Arnold Avenue: Ms. Malfitano said the noise from a dust collecting fan from a business behind her home is causing loud noises and disrupting her and her husband s quality of life, noting she has been before the Governing Body four times about this issue. Ms. Malfitano said whatever sound buffer was installed did not make a difference. Council President Tozzi said he would visit Ms. Malfitano s home. APPROVAL OF MINUTES 1. May 22, 2018 Executive Session 2. May 22, 2018 On a motion by Councilman Giraldi, seconded by Councilman Bray, Council moved to Approve the Meeting Minutes of May 22, 2018 Regular and Executive. WORK SESSION 1. Engineer s Report (SS) 2

3 Engineer Schrek delivered the following, prepared report: NJTPA/NJDOT Transportation Alternatives Program (TAP) We are for NJDOT to announce the design consulting pool. To date, that has not been determined. Orlando Drive, Phase 3 We are awaiting comments from NJDOT. Once the review is complete, the project will be advertised for bid. East Ridge Development/Quick Chek Site work is progressing. Raritan 503, LLC Site work is progressing. LabCorp We recently had a preconstruction meeting for the start of the initial phase of this project. Work will commence subject to building permits. Compliance documents, for the main phase, have been reviewed and approved. A preconstruction meeting will be schedule shortly. Block 81 A preconstruction meeting was held on May 1, Site demolition has commenced. Richard Street Area Sanitary Sewer The project is progressing and will be completed later in the month. North Anderson Street and North Thompson Street Improvements Field survey and base mapping has been completed. Design work is progressing. Second Avenue and Fifth Street Field survey and base mapping has been completed. Design work is progressing. Somerset Street Streetscape Field survey and base mapping has been completed. Design work is progressing. 2. Train Noise Complaints (DT) Council President Tozzi said he would like to have a sound test ordered concerning the noise on Weiss Terrace. Various members of Council gave approval. Councilman Orozco said members of the fire department are present for an appointment and swearing in of a new member Angello Arroyo. On a motion by Councilman Giraldi, seconded by Councilman Orozco, Council moved to Appoint Angello Arroyo as a member of the Fire Department. 3

4 Council President Tozzi delivered the following Oath of Office to Mr. Arroyo: Oath of Office I, Angello Arroyo, solemnly swear (or affirm) that I will support the Constitution of the United States, and the Constitution of the State of New Jersey, and that I will bear true faith and allegiance to the same, and to the Governments established in the United States, and in this State, under the Authority of the People. I further do solemnly swear (or affirm), that I will faithfully, impartially and justly, perform all of the duties of RELIEF HOSE COMPANY MEMBER, to the best of my ability. So help me God. 3. Basilone Committee Request (PG) Councilman Giraldi said the Basilone Committee would like an additional $2, this year. On a motion by Councilman Giraldi, seconded by Councilman Bray, Council moved to Approve an Increase of $2, for the Basilone Committee. 4. Purchase Orders of $5,000 or more (DJ) Administrator Jaxel said current rules of order call for Council to approve purchase orders over $5, The administrator said the issue does not happen too often, but when the need arises it would be beneficial for him and a committee to be able to approve such purchase orders. Council did not feel it would be necessary considering such circumstances do not arise often. 5. Ford Motor Credit Company Lease Payment (DJ) Administrator Jaxel asked for authorization to release a check for payment on Police Department vehicles. 4

5 On a motion by Councilman Bray, seconded by Councilman Giraldi, Council moved to Authorize the Release of a Check to Ford Motor Credit Company. Yea: Bray, Giraldi, Goetsch, Tozzi Abstain: Orozco Motion Carried: Capital Budget (DJ) Administrator Jaxel said more information is needed from the Fire Department. Fire Department Chief Kredatus was present at the meeting and said he would like two more weeks to finalize pricing on a capital request. Council agreed to allow Chief Kredatus the time requested. 7. Authorize Bidding Process for Old York and Fifth and Farrand Improvements (PR) Engineer Shrek said the project is not yet ready to move forward and he would report back to Council when necessary. ORDINANCE SECOND READING & PUBLIC HEARING Ordinance No An Ordinance of the Borough of Raritan, County of Somerset, State of New Jersey Amending Chapter 167, Fire Prevention On motion by Councilman Bray, seconded by Councilman Giraldi, Council moved to Adopt Ordinance No Council President Tozzi opened the Public Hearing portion of the meeting to any members of the Public wishing to heard concerning Ordinance No Seeing and hearing no members of the Public, the Council President closed the Public Hearing. 7 On motion by Councilman Orozco, seconded by Councilman Giraldi, Council moved to Approve the Purchase Orders listed above. OLD BUSINESS None COMMITTEE AND LIAISON REPORTS Councilman Giraldi The Councilman said he did not have anything to report at this time. Councilman Bray The Councilman said the Historical and Cultural Committee will meet later in the month. The Councilman then read an anonymous letter he said came from a resident who urged Council to come to an agreement with the Library Board of Trustees in order to keep the Library. Councilman Orozco The Councilman said the Fire Department has had 109 calls year to date, 20 in May. There will be a tricky tray at the Manville Elks soon. Councilman Goetsch The Councilman said he did not have anything to report at this time. PUBLIC COMMENT Council President Tozzi opened the second Public Comment portion of the meeting for members of the public wishing to speak. Seeing and hearing no members of the Public, the Council President closed this Public Comment portion of the meeting. Victor Laggini, 250 Weiss Terrace: Mr. Laggini said, in addition to the train noise, he is also concerned about diesel fumes in the air. Also, Mr. Laggini said he is concerned about traffic on neighboring streets for the safety of local children. Drivers use the streets as a cut-through, he said, and travel at excessive speeds. Jim Foohey, 710 Rhine Boulevard: Mr. Foohey said the Borough has contacts at NJ Transit and urged someone from the Borough to make a phone call tomorrow not wait for a sound test. Councilman Giraldi said something needs to be in black and white, which is why the test is being ordered in order to facilitate a conversation. Christine Hinton, Wall Street: Ms. Hinton said she takes her daughter to the Library and she feels the Library makes the town very special. She asked when the lease expires. Councilman Giraldi said the lease expires in ten years, with an option to renew now and again in five years. 7
