1 CITY OF WARRENVILLE CITY COUNCIL Minutes of Regular Meeting Held on Monday, May 19, 2014 At the Warrenville City Hall 28W701 Stafford Place I. OPENING CEREMONIES A. Call to Order Mayor Brummel called the meeting to order at 7:00 p.m. B. Roll Call Present: Mayor David Brummel, Ald. Stu Aschauer, Clare Barry, Fred Bevier, Kathryn Davolos, Leah Goodman, Dan Leonard, William Weidner, and Robert Wilson Absent: None Also Present: City Administrator John Coakley, Assistant City Administrator Jennifer McMahon, Finance Director Kevin Dahlstrand, Community Development Director Ron Mentzer, Police Chief Raymond Turano, City Attorney David Freeman, Treasurer Robert Johnson, and Deputy City Clerk Alma Morgan Also Absent: City Clerk Emily Larson C. Pledge of Allegiance E. Presentation: Twin Peaks Restaurant Twin Peaks Vice President of Development Jeff Smith, introduced Franchise Operations Director Shad Miller, and zoning Attorney Mark Daniel. He proceeded to say that they are from Dallas and they feel that the Cantera location will be a top performing facility. Attorney Mark Daniel thanked City staff for assisting Twin Peaks with a site specific amendment. Twin Peaks has tried to align all signage with what the former occupants had, however some of the elevations will be slightly different. He also said Twin Peaks needed an additional three parking spaces to accommodate the patio expansion, and Regal Theater owners allocated 16 parking spaces to them. Mr. Daniel said that they intend to use the outdoor patio year round, within building code compliance. Mayor Brummel asked if an opening date is set. Mr. Smith said once permits are approved, remodeling will begin, and the plan is to open before the end of this calendar year. Mayor Brummel asked what the approximate investment in the community will be. Mr. Smith replied that on the capital side, roughly a $2.5 million investment.

2 Minutes of May 19, 2014, Regular Council Meeting Page 2 of 8 Ald. Weidner asked if there will be ADA accommodations for disabled patrons, and will there be outside designated areas for smoking. Mr. Smith replied that they will follow Federal ADA guidelines, including having the appropriate number of handicap parking spaces. Attorney Daniel stated that the Wheeling location currently does not allow smoking on the premises. He also said Twin Peaks will follow laws for the Illinois Clean Air Act, which currently states there must be a 25-foot radius from any entrance or any occupied area. Ald. Weidner asked what type of training program is in place for employees. Mr. Miller replied that all staff must go through a seven-day training class, certification training and alcohol awareness classes. Ald. Goodman asked where a bike rack will be installed. Attorney Daniel said north of the outdoor patio. II. CITIZENS COMMENTS Warrenville Historical Society President Dave Anderson thanked the City Council for use of the Albright building, funding of the Director/Curator position, and approval of grants. Warrenville Historical Society Director/Curator Sara Phalen also thanked the City Council for their support. She said that through the approval of two Tourism and Arts Commission (TAC) grants, the Museum will once again host a Summer Tea on Saturday, August 16, at the VFW. The Museum will also continue with the Mobile Walking Tour and they will be adding Civil War components that will go live June 1. The Museum has received a wonderful response to this program, and is also working with the DuPage County Forest Preserve to extend and build on their history app. Lastly, 120 second graders will be visiting the Museum on Tuesday, May 20 to learn about the history of Warrenville, and an additional 250 second graders will visit over the next three weeks. Bob Siebert stated that he supports the Twin Peaks proposal, and hopes that confusion of the water main easement does not prevent approval. He also stated that the TIF 3 will cause double taxation over the next 23 years however; it can be adjusted. III. OFFICIALS AND STAFF COMMENTS A. Mayor Johnson School Multi-Cultural Day Mayor Brummel stated that Johnson Elementary School s Multi-Cultural Day was the most fun event he has attended all year. Each year it gets better, and he wanted to thank all the local businesses that donated the food for this event. Bike Rodeo Mayor Brummel said the Bike Rodeo was held on Saturday, May 17, in the City Hall parking lot, and was a success. He stated that one family attended with two daughters, and both won the raffle for a free bicycle. He also said another family attended from Romeoville so that their son could complete his Boy Scout safety badge.

3 Minutes of May 19, 2014, Regular Council Meeting Page 3 of 8 Seventh Annual Document Shredding Day Mayor Brummel asked Police Chief Turano to provide details of this event. Chief Turano announced that this event will take place on Saturday, May 24, at the Public Works Facility from 9:00 a.m. to noon. Residents can bring documents in paper bags or small boxes to have them safely shredded. Old medical records, tax documents, and financial documents can be shredded. Warrenville In Bloom On Saturday, May 24, Warrenville In Bloom will hold its annual clean up day. Flower beds around City signs will be weeded and flowers will be planted. Volunteers can meet at the Gazebo at 8:30 a.m. for some light refreshments and will be assigned an area to clean up. Come and help make Warrenville beautiful. Cop on Top This event will be held at the Dunkin Donuts located at 2S721 State Route 59 on Friday, May 30, from 5:00 a.m. to 2:00 p.m. Officer Teresa McBride will be sitting on the roof of the Dunkin Donuts, and each person making a donation in any amount will receive a coupon for a free donut while supplies last. All proceeds from Officer McBride s time up on the roof will go directly to the Special Olympics. Illinois Law Enforcement Torch Run Mayor Brummel stated that Sunday, June 8, will mark the second annual Illinois Law Enforcement Torch Run to help raise funds for the Special Olympics. The event will begin at 8:30 a.m. and will start at the intersection of Batavia Road and Route 59. Mayor s Fitness Challenge Mayor Brummel said that the first week of the Mayor s Fitness Challenge is now complete. He said his first week was very dismal, and he blames the weather. However, he plans to come on strong the second week. It is not too late to join. The idea is to complete 150 minutes of activity per week for eight weeks. Participants may sign up on the City s website. B. Clerk No report C. Treasurer No report D. Aldermen Ald. Bevier thanked all the employees that participated in the first employee Casual Day for a Cause. The funds raised benefited the Cystic Fibrosis Foundation Great Strides Walk on Saturday, May 17, in honor of his daughter. Mayor Brummel stated that $830 was raised, and Deputy City Clerk Morgan responded that the total donations had increased to $855.

She said this is a family friendly event that will take place on Saturday, May 24, from 11:00 a.m. to 5:00 p.m. Pony rides, hay rides, fishing, and food will be available. E. Waive second reading and approve Ordinance No amending City Code Title 3, Chapter 2, to increase the number of class A2 Liquor Licenses from seven (7) to eight (8) for Angie V s Restaurant B. Accept Community Development and Planning Committee recommendation and endorse the City of Warrenville Geographic Information System Development and Maintenance Plan prepared by Bruce Harris and Associates, Inc. C. Accept Community Development and Planning Committee recommendation and: a. Direct staff to obtain the necessary easements for City ownership of the proposed sidewalk and existing street lights in front of the Park District s Community Building and Kleinwachter Building b. Direct the City attorney to draft an Intergovernmental Agreement between the City and Park District to cover costs associated with concrete removal and

Increase the amount of the Amusement Tax allocated to the CMRP by $125 per year to cover future maintenance costs D. Accept Plan Commission recommendation and direct the City attorney to prepare an ordinance approving a revised plat of subdivision and major amendment to the Planned Unit Development (PUD) plans and documents for the Monarch Landing/Erickson Retirement Communities development, which collectively would allow the area, scope and scale of the overall development located at the northeast corner of Ferry Road and Route 59 to be reduced E. Accept Community Development and Planning Committee recommendation and direct the City attorney to prepare ordinances approving the five revised license, covenant, intergovernmental, and easement agreements for the Monarch Landing Project listed in the May 8, 2014, memorandum from Community Development Director Mentzer F. Accept Community Development and Planning Committee recommendation and direct staff to negotiate a two year contract, with year two being optional at the City s discretion, with The Brickman Group Ltd, LLC for landscape maintenance and stewardship assistance in the parkways and medians along Route 56 based on the unit pricing and per occurrence costs outlined in its April 30, 2014, proposal G. Accept Community Development and Planning Committee recommendation, and: a. Authorize the City Administrator to execute a $15,769 proposal from RDI for the off-site soil remediation work and expend up to an additional $3,942 above the $15,769 if actual off-site soil contamination extends beyond the estimated limits identified on the May 7, 2014, exhibit prepared by V3; b. Approve the May 14, 2014, Change Number 1 to Robinette Demolition Incorporated s current Civic Center Redevelopment Site remediation contract in the amount of $56,184 and authorize the City Administrator to expend up to an additional $42,091 over the revised contract amount if actual on-site soil contamination extends beyond the estimated limits identified on the May 7, 2014 exhibits prepared by V3 Companies; 3. Approve the May 13, 2014, Change Order Number 1 to V3 Companies current professional services agreement in the amount of $47,760 and authorize the City Administrator to expend up to an additional $20,140 over the revised contract amount if actual on-site soil contamination extends beyond the estimated limits identified on the May 7, 2014 exhibits prepared by V3 Companies; and

Direct the Finance Department to prepare the necessary budget amendments for the additional unforeseen CCRS #1 soil remediation project costs H. Accept Community Development and Planning Committee recommendation and direct the City attorney to prepare an ordinance approving an amendment to the 2006 International Building Code to identify the Plan Commission as the Board of Appeals for Building Code appeals in the City of Warrenville. I. Accept Plan Commission recommendation and direct the City attorney to prepare an ordinance approving site specific amendments/exceptions to the Cantera Development Control Regulations and Warrenville Sign Ordinance to accommodate the proposed wall and canopy signage on the Twin Peaks restaurant building at Diehl Road J. Removed by Ald. Kathy Davolos for discussion K. Receive and file draft minutes of the Plan Commission/Zoning Board of Appeals regular meeting held on May 8, 2014 L. Receive and file report of invoices paid up to May 14, 2014, in the amount of $154, M. Authorize expenditures for invoices due on or before June 2, 2014, in the amount of $302, N. Receive and file report of debit card expenditures for the month of April 2014 in the amount of $5, as prepared by the Finance Department ALD. WEIDNER MOVED, second by Ald. Leonard, to approve the Consent Agenda for the May 19, 2014, regular meeting as amended. ROLL CALL VOTE: Aye: Ald. Barry, Leonard, Bevier, Wilson, Aschauer, Goodman, Weidner, and Davolos Nay: None Absent: None MOTION ADOPTED Plan Commission recommendation regarding Twin Peaks Restaurant J. ALD. DAVOLOS MOVED, second by Ald. Aschauer, to accept Plan Commission recommendation, waive second reading, and pass Ordinance No approving revised Planned Unit Development (PUD) plans and documents, site specific amendments/exceptions to the Cantera Development Control Regulations for reduced parking and foundation landscaping, and memorializing Minor PUD Amendment for exterior decorative lighting for Twin Peaks restaurant at Diehl Road.

7 Minutes of May 19, 2014, Regular Council Meeting Page 7 of 8 Discussion: Ald. Davolos stated that she will be voting in favor of item J. She wanted to say that she appreciates the information that has been provided by Twin Peaks and the Police Department report. She feels that Twin Peaks will be good for Warrenville s economic development. However, after reviewing the Plan Commissions minutes, she has concerns about the yearly activities that will be occurring at the site. Some of the events are a bit distressing. Ald. Aschauer requested clarification that reduced parking is not needed as part of the amendment, therefore that part can be removed from the ordinance. Community Development Director Ron Mentzer stated that a site specific amendment for their property is needed because the number of parking spaces that are provided on their lot proper is not equivalent to the number of spaces that would be required using the parking ratios outlined in the zoning ordinance. Twin Peaks on-lot parking spaces will be reduced by eight, and Regal Theaters has allocated 16 of their own parking spaces for Twin Peaks patrons. ROLL CALL VOTE: Aye: Ald.
