It does not constitute the Commission's approval of any County contract. If a contract requires Commission approval under the County's Contracting Policy or the County's Procurement Ordinance, such approval must be sought separately. FORWARD TO THE FINANCE COMMITIEE. '(This language was added by Health & Human Services Committee Chair Moceri) INTRODUCED BY: Commissioner Toni Moceri, Chair, Health & Human Services Committee Background: The budget for the Health Grant Fund for the fiscal year ending September 30, 2012 was developed in June 2011 and approved by the Board of Commissioners in September The budget was developed with information known at that time. Since then, the County has received notification of an additional award from the Michigan Department of Environmental Quality. Specifics of this grant award are as follows: Environmental Health: Increase of $90,000. The grant funds will be used to develop a digital beach model for Lake St. Clair Metropark beach (formerly Metro Beach) and Memorial Park beal:h in the City of St. Clair Shores. The model will aid in the identification and remediation of sources of bacterial pollution that contribute to beach closings and will help predict conditions that are conducive to elevated bacterial concentrations. Also, this grant will be used to conduct illicit discharge elimination activities in four storm drainage systems located near Memorial Park beach in St. Clair Shores. (This language was added by Health & Human Services Committee Chair Moceri) INTRODUCED BY: Commissioner Toni Moceri, Chair, Health & Human Services Committee Background: The attachment lists six programs for which fund balances are being carried over from 2011 to These represent the difference between earlier projected amounts remaining the grants at the end of the year and the actual amount that remained at the end of Two of these need additional explanation, as follows: DEQ Support #4: The original funds in this grant were used to operate and maintain the Real Time Drinking Monitoring System. At the time the projection was made, the Health Department did not know about the funds that were ultimately contributed by Macomb and St. Clair Counties ($50,000 each, total $100,000) to fund the data management portion of the system for The carry-over includes those addition funds. Animal Shelter Act 287: The amount specified represents excess funds appropriated for refunding costs of spaying and neutering animals adopted from the Animal Shelter. Act 287 specifies that unused funds can only be utilized for spay/neuter activities and therefore the funds are being carried forward from 2011 to Supporting documentation is attached. For the six programs, the amount of the adjustment represents the difference between the final allocation once received and the projection or estimate of that allocation which was used in the original budget submission. Powell, Director Senior Citizen Services DATE: February 13, 2012 RE: 2012 Budget Amendment The Department of Senior Citizen Services is requesting an increase in the general fund budget of $29, for Special Needs funds raised throughout previous years. The funds requested were generated by hosting various departmental fundraisers such as rummage sales, jewelry sales, etc. Historically the special needs fund has served to offset program expenses which would otherwise prevent certain community events/outreaches or place an undue burden on seniors. It is with the intent of continuing to offer programs at no cost to aging populations while increasing our reach into communities that the special needs fund was established. Execution of this request will ensure continuation of the 2012 calendar of events, programs and services which benefit Macomb County seniors. Police Officers Association of Michigan filed a Complaint in Macomb County Circuit Court asking for an injunction against the County which would prevent the County from deducting the cost of health care provided to members of the POAM. As you may recall, the state limits the amount that a public employer may pay for the cost of heath care insurance for its employees. The health care cost for the POAM members exceed those limits. The County is merely attempted to comply with the requirements of the state law. The law firm of McConaghy & Nyovich and in particularly Tim McConaghy has been involved in the negotiations concerning the POAM and are familiar with the statues and issues involved. They have represented the County in other labor matters over the years. It is requested that the Board of Commissioners concur in this appointment. The allegations are that the Department of Roads, in June of 2011, was doing work in or around the Plaintiff s home. It is alleged that because of the work that was being done, significant water damage resulted to the Plaintiff s home. Prior to the Department of Roads being a department of the County, it was the jurisdiction and responsibility for these types of actions to fall on the Macomb County Road Commission. During the previous time that the Road Commission was in existence Mr. Jack Dolan did a majority of the defense work on behalf of the Department of Roads. Mr. Hoepfner has indicated that the work done by Mr. Dolan s firm in defending the Road Commission was more than satisfactory and he recommends, and I concur, in the appointment of Mr. Dolan and his law firm to handle the representation of the County and the Department of Roads in this pending litigation. Brumbaugh, J~ Corporation Counsel April 3, 2012 Establishing Compensation for Countywide Elected Officials & Commissioners The County Charter establishes the methods and time period during which the Board of Commissioners must establish compensation for the term of office for the aforementioned Elected Officials. Prior to the adoption of the County Charter, the compensation of the Elected Officials and the Commissioners was done by a resolution. Section of the Charter requires that the establishment of the compensation for the Countywide Elected Officials and Commissioners must be done by ordinance. Further, state law provides that the compensation of the Elected Officials will be for the term of their office and that such compensation cannot be lowered during that term. State law further provides that during the term of office of an Elected Official, their compensation could be raised. The Charter, however, now indicates that an increase in compensation for a Countywide Elected Official is not effective until the commencement of the new term of office. Thus, any increase in compensation for all the aforementioned Elected Officials may only take effect at the commencement of a new term of office for them. Pursuant to statute and Attorney General Opinions interpreting same, the compensation of the Elected Officials could be established before the commencement of their office. The Charter clearly now provides that the ordinance establishing the compensation for Elected Officials must be adopted before the filing deadline for the office. '. This office has prepared two ordinances, one for the Countywide Elected Officials and one for the Board of Commissioners. Because the term of office for the Countywide

In 2011, a compensation ordinance was passed by the Board of Commissioners to establish its compensation through December 31,2012. This proposed ordinance concerning the Board of Commissioners is in conformity with the prior ordinance passed by this Board last year. With regard to the Countywide Elected Officials, the proposed ordinance mirrors very closely the past pay resolutions that have been passed by the Board in establishing the compensation and fringe benefits for the Countywide Elected Officials. The amounts of money for the salaries for both the Countywide Elected Officials and the Board of Commissioners remains the same as it has in the last pay resolutions and ordinance in the prior term of office for the aforementioned Elected Officials. YOIJ have asked this office to also comment on the request by the Public Works Commissioner for an increase in compensation for the additional duties that office has undertaken with regard to the Macomb County Waste Water Disposal District. It is totally within the discretion of the Board of Commissioners to determine the appropriate salary for the Public Works Commissioner, as well as the other Countywide Elected Officials taking into consideration their job duties and responsibilities. State statute, MCl , does require that the compensation paid to the Public Works Commissioner is to be paid from the General Fund of the County in the same manner and at the same time as other County employees are paid. The correspondence from the Public Works Commissioner for compensation for the additional duties he has undertaken for overseeing the Macomb County Waste Water Disposal District has been reviewed as requested. The proposal is that any increase in compensation could be paid by the Waste Water Disposal District. Its creation and management is set in Public Act 342 of This office could find no authority to pay compensation to Officials of the Department of Public Works from any funds collected by a sewer district. Macomb County Public Works Commissioner Dear Chairperson Brown: Submitted herewith for approval by the Finance Committee on April 11,2012 and full Board of Commissioners on April 12, 2012 is a request for a compensation adjustment for the position of Macomb County Public Works Commissioner. The supplement will have no impact on the Macomb County general fund or county budget, as the proposed adjustment will be paid for by the Macomb County Wastewater Disposal District. The adjustment being requested is $24,000. It will provide an adjusted annual compensation for the Public Works Commissioner of $135,540. The adjustment will place the Macomb County Public Works Commissioner's compensation in a range commensurate with the compensation of drain commissioners in the counties of Oakland and Genesee, (Wayne County is not representative. It does not have an elected drain commissioner and the duties are spread among several positions.) The salaries of the Oakland and Genesee county drain commissioners, which are comparable to Macomb County in terms of workload and responsibilities, are $135,524 and $134,150 respectively. The compensation for the Public Works Commissioner has not been increased in six years. IF the pay rate had been adjusted for the cost of living from 2006 to 2012, the salary today would stand at $132,806. So I am basically requesting an adjustment equal to the cost of living plus $2,734. Because the compensation can be raised only once every four years, if it is not increased this year, the salary for the Public Works Commissioner will be unchanged for a period of ten years, The adjustment is warranted based on the addition of major duties and responsibilities that have been delegated to the Public Works Commissioner in connection with the management and administration of the expanded Macomb County Wastewater Disposal District, the newly formed Macomb Interceptor Drain Drainage District (MID) and the recently created Oakland Macomb Interceptor (OMI) Drain Drainage District. Prior to 2009 the Macomb Interceptor and Oakland Macomb Interceptor districts had not been formed and the Macomb County sewer district was a contractual authority with few ownership obligations. The sewer system in Macomb County, as it then existed, was owned and operated by the city of Detroit. which billed the counties for service through sewer rates. That situation changed dramatically after 2009 with the transfer of ownership of the inter~ ceptor system from Detroit to Macomb and Oakland counties. The Macomb County Wastewater Disposal District and Macomb Interceptor Drainage District have service populations of 500,000 in eleven municipalities, while the OMI Drain Drainage District serves a joint Macomb-Oakland county population of 833,000 in 25 communities. The work effort required to manage and administer these systems represents a major expansion of duties and obligations for the Public Works Commissioner. A $160 million, five year, rehabilitation and repair program is in progress in the Oakland Macomb District. In the Macomb District, work has commenced on a $30 million contract to upgrade the Clintondale Pump Station and a series of initiatives has been launched to re store the structural integrity of the interceptors, meters and manhole structures. The county budget for Wastewater Services will not be increased by the proposed adjustment because the adjustment will be paid from the line item of $80,000 earmarked in the 2012 budget for the salary of director, which is currently vacant. The director's position will remain unfilled. I request that the adjustment be made payable effective January 1, 2012 as I have been performing the additional duties for three years. The Charter provision at Section stating that increases in salary for elected officials shall not take effect until the start of a new term (January 1, 2013) does not apply in my situation because the Charter language refers to "county" salaries, whereas this adjustment will be paid by the sewer district. To reiterate, the proposed adjustment for the Public Works Commissioner is not a general salary increase for pre-existing duties. It is an adjustment to the base pay predicated on the addition of operational tasks and responsibilities. Previously, former Public Works Commissioner Thomas S. Welsh was paid separately for his work as a drain commissioner, soil erosion control supervisor and administrator of the original sewer system before the salaries were combined into one base salary. I am suggesting that a similar approach be employed in this instance, Le., a supplement to the base salary for assumption of additional duties.
