AUDIENCE COMMENTS: None UNANIMOUS CONSENT CALENDAR: Clinton made a motion to approve the Unanimous Consent Calendar. Delmar seconded. Motion unanimously carried. DIRECTOR OF OPERATIONS AND EDUCATION REPORT A. DNR Site Visit Report The DNR visited March 28th.Bert Noll of DNR did say there were no glaring issues during when he was on site. Some litter was present, but it was mostly near the cell. Additional cover dirt was being hauled in during the site visit. B. Legislative Updates: SSB 1186 and HF Bottle Bill Elimination - This bill repeals current Code chapter 455C, the beverage containers control law, and replaces it with new statewide recycling, litter control, and community enhancement programs. Subcommittees met March 20 and 21. No decision made. HF 2464 (formerly HF 2192 and HSB 539) - Land Recycling Program Fees - The Department of Natural Resources operates a land recycling program to address potentially contaminated sites throughout the state. Pursuant to the program, an owner of potentially affected real property may enter into a voluntary agreement with the department to avoid possible litigation and fines if the property poses certain health or safety risks. Upon enrollment in the program, an owner must agree to reimburse the department for the actual costs it incurs in reviewing documents that the owner submitted to enroll the site. This bill increases the cap for reimbursement to the department for reviewing submitted documents to $25,000 per enrolled site for sites enrolled on or after July 1, The current limit of no more than $7,500 per enrolled site remains the same for sites enrolled prior to July 1, Passed the House Passed the Senate Awaiting Governor's action. HF 2303 (formerly HSB 571) - DNR Solid Waste Policy Omnibus - Included in this bill is a provision that requires a recycling facility to prove that materials it stores are potentially recyclable. A person who fails to meet the criteria for legitimate recycling is subject to the provisions regarding compliance orders, litigation, and civil penalties. Approved by the House Approved by the Senate Signed into law by the Governor. C. Education: i. Enviro Kids Program for 2018 The Clinton County Enviro Kids will visit CCASWA for a tour on June 2 nd. ii. Camanche ES 4 th Grade Camanche 4 th Grade students will tour CCASWA tomorrow (FRIDAY).

2 D. Staff Evaluations/Wages for FY 2019 Staff Evaluations of all employees, except for me, have been completed. It s time to form a committee to go over wage proposals for FY 19. Can we form said committee and can I get a few volunteers to serve on said committee. Camanche and Delmar volunteered for the committee. ENGINEER SITE REPORT Kevin Jensen of Barker Lemar Engineering Sampling is complete. That wraps up services through fiscal year Last meeting we brought up new contracts for annual services and regulatory assistance. Talk was to sync it up with pump maintenance. Generally, annual services around thousand dollars per year and includes groundwater sampling, leachate system reporting, methane monitoring, financial assurance, staking, airspace analysis, semiannual landfill inspections, required items at the west site, etc. Regulatory Assistance is simply extra stuff as things come around. Generally that is not to exceed 26 thousand dollars. This includes major repairs to items, design let downs, designing RFPs for items, communications with DNR. We don t throw out change orders very lightly. Delmar: I think three years is acceptable. DeWitt: What other contracts are there? Seward: Two year SCADA Contract remaining. DeWitt: I d like contracts on the same cycle. DeWitt: Having those contracts fall in line would be easier. Clinton County: a lot of control in staggered contracts. Clinton County made motion to seek two year contract proposals for annual services and regulatory assistance from Barker Lemar, with contracts ending June 30, DeWitt seconded. LANDFILL OPERATIONS REPORT Brock Swan of Progress Contracts Everything is going pretty well. Wind hurt us last Friday and we should have maybe closed earlier. Road has been cut in to get to sediment pond. Aaron Mink has been removing trees from that area. Plan is to dig out the sediment from that sediment pond. COMMUNICATIONS FROM ANY AGENCY MEMBERS OR THEIR CONSTITUENTS: Clinton: Next month you will have a substitute. Bill Schemers will be attending for Clinton.

3 UNFINISHED BUSINESS A. Discussion: 28E Agreement DeWitt: This is fantastic. And tonight we have eight people present, which is what we generally have. I realize we have 15 members. Most likely we re never going to have three-quarters available. If we can tailor this to have a quorum present and do a supermajority of the quorum present. For example you would have to have six votes in favor. Section 7, will not happen unless we can go ahead and come to some agreement on how that super majority will work. Clinton: What about if the super majority is not present, then it would be unanimous approval? DeWitt: One member could stop all work then. If at least two people don t agree, then that might hold more credence. Matt Brooke (Clinton City Admin.): Six of 8 would be 2/3 of quorum. DeWitt: Change ¾ to 2/3. DeWitt: I don t want us to lose the opportunity to perform certain duties. I don t know how to force people to show up. Brooke: What do you need to be able to do to get the job done in the most amicable way? Clinton: Maybe we need 7 of 8 at least for big items, big expenditures, taxing, etc. DeWitt: We need supermajority of those present. Brooke: Supermajority of those present, 2/3 of those members present of the board. DeWitt: the other thing I am looking at is under financing. My concern is the language of the cell financing for one year. I don t want so much money to be made up in one year. I want to push that out over time. Brooke: A one year levy would be $21.73 over 46,000 people. That doesn t count industrial and commercial. Really it could be lower because of industrial and commercial being part of equation. Goose Lake: This is first time I have seen this. Brooke: We want to give you plenty of time to look at this. The more you can understand this, the better. It will need to pass your city councils, too. Seward: Under Organization, chairman and vice chair terms, should be calendar year. Fiscal year does not work because of elections falling in November. Andover: Do you stress the importance of communities showing up? Seward: Yes. Clinton County: Chairman and I have reached out to all communities to show up. DeWitt: If they don t show up, then what s the point of the communities being on the 28 E.?

4 Camanche: Let them slam the door, not us. Delmar: Can t eliminate them because they aren t on the board. A levy would affect the entire county. Goose Lake: It s their choice to be here. Camanche: If you don t want to participate, then it could hurt you. Clinton: Could meet quarterly. Seward: What about bills monthly? Brooke: Finance committee would meet. Seward: Another thing, Delmar and Goose Lake mentioned twice in opening paragraph. Low Moor and Lost Nation not mentioned. Goose Lake: Should be cities of, not towns. Also should be 14 cities and one entity. Clinton: Make definition of super majority of those present as 2/3 early on in document. DeWitt: Amen Brother. Seward: Shared attorney s comments. DeWitt: Addressed those comments. Seward: Peavey asked about future withdrawal. Brooke: When we launch 28E, then we will send it out to all. Clinton County: County Board has to establish the levy piece first. Goose Lake: Send paper copies to those that don t attend. Brooke: Cover Letter to those that don t attend. Clinton County: We will have to come up with the same message to prepare for the time when there is a levy. Clinton County: Public hearing in DeWitt. Clinton County: tie levy to the cost of the last cell. B. LANDFILL OPERATIONS CONTRACT DISCUSSION Barker Lemar prepared this.135 pages Andrew Phillips: Anything you want to change is up to. DeWitt: Was last contract 135 pages? Brock Swan: Yes around that length. DeWitt: I trust that Seward read this and that it is what you need. Seward: Some changes. Current contract 2100 tons per month. Barker Lemar talked of raising it to around 4000 tons per month. I don t think that s congruent with our goal of reducing tonnage with single stream. Paying for more tonnage is not a good idea. Swan: Seems counterproductive to what your goal is. Seward: Compaction incentive after three years to whoever gets the contract tons or 2100 tons is a good number for a month. Clinton: What if we scale it down each year?

5 Seward: Without knowing what we do with contract hauling, then we should keep baseline tonnage lower and around 2100 tons per month. Brooke: Single Stream recycling in Clinton is on pace to lower landfill tonnage by 325 per year. Andover: Does public drop off get recycling pulled out of it? Seward: Yes. Clinton County: Is there an incentive to not go longer contract or a one year contract? Seward: one year contract will make it difficult to procure equipment for contractor. Clinton County: What s down side for us of one year? Seward: Having to rebid it and not having solid year to year budget numbers. Clinton: one year contract would not attract many bids. 2-3 years is a better approach. Seward: Last contract was five years. Airspace incentive is measured by surveying. DeWitt: three years is a better option. And I like the lower amount of monthly tonnage. Seward: If we have a bad month I rather pay for a lower amount than 4000 tons. Let s stay at 2100 tons instead of Clinton agrees. Seward: Virtually same contract, except for incentives and length. Clinton: If we get fined by DNR, then is contractor responsible for fine? Seward: Yes. We will do public notice and notify interested parties. Have this performed by next month. C. Single Stream Study Report Discussion Seward reported he has: -Contacted several compactor companies, 3 have been on site for a visit, trying to get specifications to match as near as possible for a more informed decision. It s going to take several weeks to have a compactor built also. -If we go with our own trailers, we could operate with one, but two might be an option. Do we take a chance of something breaking down? -May need to purchase our own trailer(s) in order to match pin measurements for compactor. Hallco Industries has contacted me about trailer specifications. I have also been in touch with Jackson County on some of its transfer station trailer specs. -Worried about changing companies without owning own trailers because of necessity of matching equipment. Andover: How many loads? Seward: A trailer or two a week. Seward also reported: -Contacted nearby transfer stations for guidance on hauler contracts.

6 -Contacted Barker Lemar for sample agreements for transfer agreement templates. -Contacted DNR and received permission use retained recycling reserve funds for the project. So $700 thousand in reserves can be used. That s good news. -Contacted Scott County to share our intent to bring materials to them. -Compactors will take about 5-10 weeks to build. - For those who want July 1, then it s not going to happen. Could be fall. Phillips: Six months out in his opinion. -Seward wants to avoid haulers from having to direct haul in winter.
