6 Date: Aoril 4, File No.: SA83RF0002 The Attorney General of California has prepared the following title and summary of the chief purpose and points of the proposed measure: REAPPORTIONNEl"rr OF ASSDmLY, SENATE, AND CONGRESSIONAL DISTRICTS. INITIATIVE STATUTE. Repeals statutes enacted at the First Extraordinary Session of the Legislature that establish boundary lines for the 80 Assembly Districts, the 40 Senate Districts, and the 45 Congressional Districts in California. Enacts replacement statute~ establishing new boundary lines for these districts. Contains statement of findings and declarations of purpose concerning reapportionment principles. Provides that specified maps describing boundaries of districts" prepared by the proponents may be deposited with Secretary of State and may be used to assist in interpretation and to facilitate performing administrative functions involv~d in conduct of elections. Summary of estimate by Legislative.Analyst and Director of Finance of fiscal impact"on state and local governments: Their analysis states "Assuming this measure is on the June 1984 ballot, and that the new district lines would be effective starting with the 1986 elections, its approval by the voters would result in a one-time increase in county costs of about $1 million.. If the adoption of this measure results in the holding of a special primary election after June of 1984, to reflect the newly reapportioned districts, the counties would incur costs for the special election, which would be about $13 million. 7 ,; 1 a ~ 10 II : TEXT OF SEBASTIANI INITIATIVE This initiative measure amends Chapters 1, 2, 3 and 4 of Division 18 of the Elections Code by amending, adding and repealing sections thereof. FINDINGS AND DECLARATIONS OF PURPOSE The people find and declare as follows: (a) The continued viability of the Staters democratic system requires fair elections with eq~al representation of all citizens; (b) In order to ensure fair elections and adequate representation of all citizens, the State should be reapportioned in an equitable manner; (c) Assembly, Senate and Congressional Districts should, insofar as possible, be geographically contiguous, and should, insofar as possible, preserve natural geographic regions, cities and counties; (d) Population deviations between districts should be minimized; (e) J;:a-ch district should preserve common and. 22 social economic interests within the ~o~,daries 0: the 23 district; 24 (f) The districts should ensure adeqcate 25 representation of racial, ethnic and language mincri~ies~ 26 (q) Article L~! of the California Constit~tion mandates the Legislature to reapportion the State and 28 develop new Assembly, Senate ~~d Congressional Dist=ic~s in 29 the year following the year in which a national census is taken; (h) After the 1980 Census, the Legislature passed. legislation providing for new Assembly, Senate and Congressional Districts (A.B. 1, Chapter 5 of the ~4 Statutes of 1981, S.B. 99, Chapter 5 of the Statutes of.. ~~ 1981; and A.B. 0, Cha?~er 537 of the Statutes of 1981);

8 1 (i) The legislation was rejected by voter 2 referendum in the November 1982 general election, following 3 which the Leqislature adopted new reapportionment plans for 4 the Assembly, Senate and Congressional Districts (S.B. 3, 5 Chapter 8 of First Extraordinary Sess~on, and 6 A.B. 2, Chapter 6 of First Extraordinary Session, ): a (j) The recently adopted reapportionment plans 9 are not geographically contiquous, fail to provide for the 10 adequate representation of all citizens, and otherwise fail 11 to meet the principles set forth in subsections (a) through 12 (f) above. 13 (k) The peop1e propose this amendment to 14 Chapters 1, 2, 3 and 4 of Division 18 o the Elections Code 15 to reapportion the State pursuant to the principles set 16 forth in subsections (a) through (f) above

9 PROPOSED AMENDMENT 2!. CHAPTERS 1, 1" 3 AND 4 OF DIVISION 18 OF THE ELECTIONS CODE. First - Chapter 1 (commencing with Section 000) of Division 18 of the Elections Code is repealed. Second - Chapter 1 (commencin"g with Section 000) is added to Division 18 of the Elections Code, to read: CHAPTER 1. GENERAL PROVISIONS 00'0. Any maps describing the boundaries of the districts, as contained in this division, which have been prepared by the proponents of this initiative measure in connection with the proposal of this initiative measure may be deposited with the Secretary of State in order to illustrate the boundary lines set forth in this division. Maps deposited with the Secretary of State pursuant to this section may be used by the Secretary of State and the several county clerks for purposes of assisting in the interpretation of this division and - to facilitate the Seeretarv - of State and the county clerks in their administrative functions involved in the conduct of elections. Third - That Chapter 2 (commencing with Section 010) of Division 18 of the Elections Code is repealed. Fourth - That Chapter 2 (commencing with Section 010) is added to Division 18 of the Elections Code, to read: CHAPTER 2. ASSEMBLY DISTRICTS 010. It is the intent of the people of the State of California in enacting this chapter -3-

10 1 2 3 to implement Article XXI of the California Constitution For purposes of this chapter, 4 references to "CT" shall mean "census tract," as 5 that demographic unit is established by the United 6 States Bureau of the Census for the 1980 census as 1 described by maps and publications of the bureau. S References to "Block," "Slocks" or'-block Groups" 9 refer to those demographic units as established by 10 the United States Census Bureau for the census as descri~ed by maps and publications of 12 the bureau. 13 In addition, any reference to a "city," "city 14 boundaries or city limits" shall refer to the 15 boundaries or limits of the particular city as 16 they existed on April 1, Reference to a 11 city shall refer to the particular incorporated 18 municipality provided for herein. 19 Excep"t as indicated, all census tracts ending 20 with the suffix ".99" shall be deemed part of the census tract designated by the whole number 22 preceding the suffix, and shall be contained 23 within the same district as the accompanying 24 whole-number census tract. 25 If any census tract, block or block group is 26 omitted, listed more than once, or is only partially provided for, it is the intent of this chapter that the 28 districts be defined in such a manner as to not omit any 29 area of California from a district and to comply with Article XXI of the California Constitution requiring that 31 districts be reasonably equal. In order to carry out the intent of the people as expressed herein, the Secretary of State shall undertake such measures as are necessary to ensure compliance with this section. -4-

Reapportionment of Assembly, Senate, and Congressional Districts (Initiative Statute) (Sebastiani).. The deadline for additional measures to qualify is 131 days before the election, or August 4, At this point I don't anticipate the passage of further measures, but I certainly would not rule out the possibility. It is also unclear whether the Legislature will attempt to consolidate the special election with a presidential preference primary. If they do, it is likely that only the presidential candidates' names will appear on the ballot, not the delegates' names. In fact, it is not clear whether the election would result in the apportionment of delegates to the candidates or whether it would simply be a "beauty contest." Finally, we come to the question of cost. There is no appropriation in the budget for a special election, and the Legislature is threatening to include budget language precluding the use of public money for such an election. At this point, there seem to be three funding possibilities: An appropriation will be added to the current year budget; The budget will not contain an appropriation and claims will have to go to the State Board of Control;

The ruling states in part, " the proposed initiative is constitutionally impermissible and may not be submitted to the voters." Reapportionment will be in accordance with the statutes enac.ted during the First Extraordinary Session provided to you earlier this year. Following are comments and information currently available on some related issues: 1) No funds are available for reimbursement of costs incurred in preparing for the special election. Such claims must be submitted to the State Board of Control. 2) Please submit your Voter Registration Index, by computer tape if available, on October 1st if practical but not later than October 14, 1983, and use the same districts as with the January, 1983 post purge. 3) Maps of the future senate districts have been received and copies will be forwarded to you when available. 4) -There is no authority for conducting local general law elections on December 13. "Reapportionment of Assembly, Senate and Congressional Districts Initiative Statute" requires 393,8 registered voter signatures by Sept. 1 to qualify for a statewide ballot, presumably in June of 1984 unless there is a special statewide election prior to that time. The initiative seeks to repeal the statutes enacted in January which established the boundary lines for the 80 Assembly, 40 State Senate, and 45 Congressional districts in California; replaces the statutes with statutes establishing new boundary lines for the legislative and congressional districts; makes a statement of findings and declarations about reapportionment guidelines and principles; and provides that the proponents may prepare and deposit with the secretary of state copies of the proposed district maps for assisting in interpretation and administration of election duties. The statement of findings and declarations of purpose of the proposed plan state that equitable reapportionment is ensured by "fair elections and adequate representation of all citizens," and that "Assembly, Senate and Congressional districts should, insofar as possible, be geographically contiguous,"... Referenda against three reapportionment bills (those which defined the Assembly, Senate and Congressional districts) qualified for the June 1982 primary election ballot and voters rejected the plans devised by the Legislature. In Nov. 1982, voters were asked to consider a plan to establish a non-partisan districting commission to remove reapportionment from the Legislature, but rejected this initiative as well. In the first extraordinary session of the legislative session, new reapportionment plans were drawn by the Legislature, and will take effect for the 1984 elections, barring legal action or the success of this or similar initiatives or legislative alteration.
