4 Office of the Secretary of State ~farch Fong Eu III Capitol Mall, Room 220 Sacramento, California Elections Division (916) November 3, 1978 TO: SUBJECT: ALL PROPONENTS CIRCULATING INITIATIVES Minimum Number of Signatures Required/Initiative Petition Please note that the number of signatures required to qualify your initiative petition is governed by California Constitution article II, section 8(b) which provides: An initiative measure may be proposed by presenting to the Secretary of State a petition that sets forth the text of the proposed statute or amendment to the Constitution and is certified to have been signed by electors equal in number to 5 percent in the case of a statute, and 8 percent in the case of an amendment to the Constitution, of the vote for all candidates for Governor at the last gubernatorial election. (emphasis added) It appears therefore that under existing law the number of signatures required to qualify your proposed initiative will be based on a percentage of the votes cast for all gubernatorial candidates at the November 7, 1978 general election rather than the 1974 general election. Haas, as proponent, the following title and su1ilil1b.ry: UNEMPLOYMENT AND DISABILITY INSURANCE. INITIATIVE CONSTITUTIONAL AMENDMENT. Eliminates state unemployment insurance and disability insurance taxes. Prohibits state from establishing any type of unemployment payments, levying any tax to finance unemployment or disability payments based on past employment, or operating any type of employment agency. Requires each employer to give each employee a one-time salary increase equal to amount employer would have paid into State Unemployment Insurance fund. Financial impact: Substantial but undeterminable effect on both state and local government. Would probably result in net increase in state costs, but net fiscal effect on local governments impossible to predict. 12 , '!"_ J..,....,-' ( ( State Unemployment Insurance (SUI) and State Disability Insurance (SDI) taxes will be eliminated. The State shall pass no la'l:'7s for the purpose of establishing any type of unemployment payments. The state shall not have the power to levy any tax for the purpose of supporting any unemployment payments or disability payments where the qualification for receiving payment is based on past employment, nor shall the state operate any type of employment agency. Upon passage of this initiative into law, each employer will give each employee a one-time salary increase equal to State Unemployment Insurance (SUI) tax that would have been paid by the employer into the SUI fund. This amount will be calculated by taking the maximum yearly taxable salary multiplied by the company's SUI rate divided by the employee's annual salary or the company's SUI rate whichever is smaller.
