1 Page 1 of 8 Minutes of the Planning Board of the Township Of Hanover Chairman Eugene Pinadella called the Work Session Meeting to order at 7:00 PM in Conference Room A and The Open Public Meetings Act Statement was read into the record. Board Secretary, Kimberly Bongiorno took the Roll Call. In attendance were Members: Critchley, Deehan, De Nigris, Dobson, Ferramosca, Mayor Francioli, Glawe, Nardone, Olsen, and. Absent was Member: Also present were: Byrne Township Engineer Gerardo Maceira and Township Planner Blais Brancheau I. RESOLUTIONS 1) CASE NO APPLICANT/OWNER: CARRIAGE HOUSE HOLDINGS, LLC LOCATION: 218 RIDGEDALE AVENUE CEDAR KNOLLS BLOCK: 1702 LOT: 11 ZONE: IB-3 Applicant sought preliminary and final site plan approval and variance relief in order to modify and expand the on-site parking lot and signage. APPLICATION APPROVED NOVEMBER 20, A motion to memorialize the resolution was moved by Member Critchley and seconded by Member De Nigris. Members Critchley, Deehan, Dobson, Olsen, De Nigris, Mayor Francioli, and Chairman Pinadella all voted in favor of memorializing the resolution. 2) CASE NO APPLICANT/OWNER: THE PATRIOTS PATH COUNCIL, BOY SCOUTS OF AMERICA LOCATION: 1 SADDLE ROAD CEDAR KNOLLS BLOCK: 701 LOT: 23 ZONE: I Applicant sought preliminary and final site plan and C variance relief in order to install a seating area with a brick paver walkway. Additionally proposed are two (2) signs to be

2 Page 2 of 8 mounted on a decorative wall, a Boy Scout statue and a flag pole with both the American flag and Boy Scouts flag. APPLICATION APPROVED NOVEMBER 20, A motion to memorialize the resolution was moved by Member Nardone and seconded by Member Deehan. Members Critchley, Deehan, Dobson, Nardone, De Nigris, Ferramosca, Mayor Francioli, and all voted in favor of memorializing the resolution. II. MINUTES NOVEMBER 20, 2018 The minutes were deferred to a later date. III. REFERRAL OF ORDINANCE Amending the regulations for the B-10, I, I-2, I-4, I-5, I-P, I-P2 and I-R zone districts, in order to permit and regulate certain veterinary and pet care centers and authorizing the Chairman to sign referral letter to the Township Committee. A motion to authorize the Chairman to sign the referral letter to the Township Committee was moved by Member Nardone and seconded by Member De Nigris. Members Critchley, Deehan, Dobson, Nardone, Olsen, De Nigris, Ferramosca, Mayor Francioli, and all voted in favor of authorizing the Chairman to sign referral letter to the Township Committee. IV. REFERRAL OF ORDINANCE Adopting a redevelopment plan for property located at the 1515 Route 10 in Whippany and also designed as Block 3030, Lots 13 & 14 and amending the zoning map and zoning regulations to implement various policies set forth in the Land Use Element of the Master Plan including but not limited to the creation of the R-40N, R-30, and R-21 Residential Zone District and the amendment of the regulations for all of the single family zone districts and the amendment of the various other zone district boundaries and classifications and authorizing the Chairman to sign referral letter to the Township Committee. A motion to authorize the Chairman to sign referral letter to the Township Committee was moved by Member Nardone and seconded by Member Critchley. Members Critchley, Deehan, Dobson, Nardone, Olsen, De Nigris, Ferramosca, Mayor Francioli and all voted in favor of authorizing the Chairman to sign referral letter to the Township Committee. V. REFERRAL OF ORDINANCE

3 Page 3 of 8 Amending the subsection M., paragraph (6)(f) in section with the inclusion of the required payment for the Administrative costs incurred in the sale of affordable housing units and authorizing the Chairman to sign referral letter to the Township Committee. A motion to authorize the Chairman to sign referral letter to the Township Committee was moved by Member Deehan and seconded by Member De Nigris. Members Critchley, Deehan, Dobson, Nardone, Olsen, De Nigris, Ferramosca, and Chairman Pinadella all voted in favor of authorizing the Chairman to sign referral letter to the Township Committee. VI. DISCUSSION RESTAURANT PARKING REQUIREMENTS Blais Brancheau - Explained the need for this ordinance. - In the past there have not been many restaurant applications but there are currently three with a fourth pending. - Referred to the restaurant parking had out that he distributed to the Board. - Explained the parking calculation and how it is determined. - It is currently determined as 15.4 parking spaces for every 1000 sq. ft. or.75 parking per seat. - This is the same rule for both fancy sit down restaurants and fast food restaurants and everything in between. - The question before the board is: do they want to fine tune the standards? - Gave an overview of ITE studies. - The ITE looks at the average peak demand. - Explained the color coding on the table, green means that they found the ratios to be lower than what the Township requires and the red means that they found that the ratios to be greater than what the Township required. - The suggestion is that the Township reduces the ratio for seating to parking. - Discussed the issue of parking per floor area. Mr. De Nigris - Wants to know if we currently monitor the restaurant parking. - We don t go and study it but when there is a problem it is looked into. Mr. Nardone - Asked if there is anything in the land use code that regulates seating and square footage.

4 Page 4 of 8 - It is more than likely in the building code. - Right now there is a one size fits all standard. - The building department would usually be the one to follow up on the parking issue. - Thinks that before they start looking at numbers they need to discuss how they will require parking based on the type of restaurant. - Agrees that different types of restaurants might need different requirements. - Does not think they should change the per 1000 sq. ft. number but could reduce the required spaces per seat number. - Our finer restaurants in town have the real parking issues. - Discussed the issues in town with certain restaurants and what potential issues they could face in the future. Mr. Critchley - Feels the seat standards look high. - Having different regulations for different types of restaurants makes the most sense. - Feels seating is more important than floor area when determining parking. Mr. Nardone - Questioned if at the time of the CO if there is a way to attach a standard for parking on that based on the seating. - Believes seating is a better indicator on the number of parking spaces needed. - It is harder to enforce seating than it is to enforce floor area. - His suggestion is to increase the floor area and reduce the seats. - Thinking in view of the pending restaurants the potential for restaurants coming in is greater and we should address this now rather than waiting. The Board discussed how they would enforce these rules and if it would be something they could trust to restaurant owners to enforce themselves.

5 Page 5 of 8 - High turnover with or without a bar and the quality restaurants should go with Mr. Brancheau s recommendation. - High turnover and quality has one standard and fast food has another standard. The Board had an open discussion regarding the parking requirements and issues in town. Also discussed the restaurants with bars and how they should be determined. Mr. Dobson - Explained how the fire department determines the occupancy. - Discussed how their numbers would compare to the fire departments numbers. - Brought up how occupancy determined by the fire company could potentially cause issues for places that do not have a lot of seating such as a dance company. - We could come up with our number and then come up with a statement that says it is not to exceed fire company standards. - We have two categories, fast food and the quality and high turnover. - The quality and high turnover should be at 55 sq. ft. as is recommending. - And the fast food should be at the 65 sq. ft. - There should be.5 spaces per seat. - Can check with Sean Donlon to see how numbers line up between occupancy and seating. Mr. Nardone - Does not feel we can do this with only two categories. - Feels lounge/bar issue is important as is a drive through. - They should have at least four categories.

6 Page 6 of 8 - Gave a breakdown of the four suggested categories and breakdowns. - High quality restaurants with a bar and lounge in one category at 1 space per 50 sq. ft. and.7 spaces per seat. - High quality and high turnover with no bar and lounge as the second category at 1 space per 55 sq. ft. and.6 spaces per seat. - Fast food as the third category at 1 space per 65 sq. ft. and.5 spaces per seat. - Drive-through with no seating as the fourth category at 1 space per 80 sq. ft. and.5 spaces per seat. The Board had an open discussion about why they are discussing parking standards and where they got the baselines from. VII. DISCUSSION PERFORMANCE AND MAINTENANCE GUARANTEES Blais Brancheau - There has been a change in the state law for performance and maintenance guarantees. - Explained what performance and maintenance guarantees are used for. - It is a way to make sure that developers finish projects that are started. - Developers are charged a guarantee to make sure that projects are finished. - Reviewed three pages from the state law. Mr. Maceira - The value that is charged is based on the improvement value. - The law changed and only allowed to bond certain areas of the improvements. - There are some maintenance and guarantees that are allowed. - Environmental controls are the function of the DEP. - This is the state law. Mr. Maceira - Wants to take advantage of all of the state requirements and does not want to leave a pass for developers. The Board agrees with Mr. Maceira and state standards. VIII. DISCUSSION SIGN REGULATIONS FOR RETAIL USES Blais Brancheau

7 Page 7 of 8 - There are all different kinds of standards for retail, listed all of the different retail zones. - Some special cases obviously require more signs than others but not most. - The Board needs to decide if they want to reduce the variations of standards. - Currently does not have a recommendation at this time will only do it if the Board wants to reduce the variation. - Feels that the sign regulations need to be changed and upgraded. The Board agreed to have come back with uniform standards for new sign regulations. IX. OTHER BUSINESS Mayor Francioli - Explained to the Board that the quotes made by Jim Lent in the Hanover Eagle regarding affordable housing numbers quoted by Ron are bogus. - The Lowes is proceeding very nicely. Mayor Francioli - Nothing has taken place with the Post Office yet because last we heard a brewery wanted to come in. Mr. Maceira - The brewery came in to get SPEC approval and will be coming before the Planning Board. X.
