1 Board of Directors, Fairfax Station Homeowners Association Minutes of the Meeting on 18 Sep 2018 Location: Burke Center Library Conference Room The following Board Members were present representing a quorum: Vinnie Burruano (President/Director) Matt Howard (Vice President/Director) Mike Bugelski (Director) Kurt Seibert (Director) Other Attendees present: Paul Ciatti (Neighborhood Watch) Pat Flaherty (Roads & Common Drives, Grounds) Peggy Speelman (ARB) 1) Call to Order/Member Forum. Vinnie Burruano, FSHOA President called the meeting to order at 7:00 PM. 2) Approval of the previous FSHOA Board Meeting Minutes. Approval of 19 July & 16 Aug minutes deferred to October meeting upon return of Secretary. 3) Association Members Forum. Homeowners - Alison Graziano, Mary Wharton, Bob Orlovsky, Noah Van Dyke Homeowner Alison Graziano very interested in composting. She spoke about a composting company The Compost Crew and their business and process. This company is willing to start a pilot program in our area for interested residents. If more residents participate, the cost will be reduced. With the board s support, Alison would like to notify residents of this opportunity. She will provide text and information for a link from the association website as well as text for an blast. Vinnie moved to agree to accept Ms. Graziano s notification to other members of this opportunity. Matt seconded. All agreed. Homeowner Bob Orlosky asked the board about the pending litigation against the Association. President responded to Mr. Orlosky that counsel has advised the board not to discuss any details regarding the pending litigation. V2 (19 Dec 18 AM) Page 1

2 Homeowner Noah Van Dyke asked about the Fairfax County Parkway Widening. Matt explained that the project design is moving forward and there are several upcoming meetings hosted by VDOT about the project, one of which will be at Fairview Elementary on 9/27. The neighborhood was notified about the meeting through an blast and by the website. 4) Reports: A) President's Report. (Vinnie Burruano). (1) Update on Legal Issue (Executive session). (2) Vinnie Burruano reports that A homeowner, Mary Wharton, submitted a complaint to the Association regarding speeding in the neighborhood. After much discussion of the speeding problem in the neighborhood and the traffic study done several years prior, and the recommendations from that study, the board was sympathetic to the homeowner s complaint but ultimately the recommendations from her complaint fall outside of the board s authority. Homeowner would like to participate with other board members in informal review of previous traffic study. B) Treasurer Report. (Andrew Combe). Andy Combe reports that as of 18 September, FSHOA is $7, under budget. (See attached graph) Keep in mind that we will need to expend $10,000 or more annual pond work before the end of the year. Five lot owners remain in delinquency and their accounts have been turned over to Chadwick Washington et al. One of the five has declared bankruptcy and recovery of the $ owed is unlikely. FirstService billing is still problematic. Bills now come from Fairfax, but payments are sent to a New Jersey office. Bills still come in two parts every month. The New Jersey office says billing questions should be referred to that office, but Fairfax office says billing questions should be referred to them. I will refer questions to Mr. Coleman. Until this month, there had been no activity in the Common Drive Escrow Account this year (very unusual). Within the past two weeks, two common drives have had contracts for repaving, totaling $12, I was hoping to provide a proposed 2019 budget at the 18 September meeting but have not yet received inputs from all. I will provide by as soon as possible. I propose an increase in the annual assessment from $ per year to $ per year. This is an increase of 4.7%. I have not received a bill from Fairfax County Public Schools for rental of the room at Fairview School for annual meeting. In the past, I have received this bill in June (noted that Matt will provide 2018 invoice and Mike will locate invoice from 2017). C) Committee Reports V2 (19 Dec 18 AM) Page 2

3 (1) Common Grounds. (Pat Flaherty). Tree removal on common area due to dead trees threatening homeowner property continues to be costly. Previous years have been less expensive this year s cost will exceed $11,500. Budget item for next year should be increased to $10K. (2) Pond. (Pat Flaherty). More maintenance will be required this year beyond the normal allotted $10,000 because of increased debris and blockages. Pat recently attended a meeting with the Stream Restoration Project Engineer and the design contractor. The County anticipates final prep for the project mid-next year, with contractor bids and permit applications later in calendar year If the schedule is followed construction could start in late (3) Roads and Common Drives. (Pat Flaherty). VDOT is performing erosion repairs to shoulders along roads in the community. Pat recommends no increase to the rate for common drive escrow accounts. (4) Management Services. (Matt Howard). ). 8 new violations. Two uncorrected violations have been sent a notice of hearing for 18 Oct. FirstService Management Company has been notified that we are reducing our neighborhood-wide inspections to 4x per year. Therefore, the next inspection in early October will be the last sweeping inspection for the calendar year. Pat Flaherty and others sorting out requirements/updates for resale inspection packets. Pat would like to develop a new letter for new renters and other new residents not receiving a resale packet. (5) Architectural Review Board. (Peggy Speelman). There were no applications since the last Board meeting. (6) Neighborhood Events. (Nancy Hoyler). Not present. (7) Neighborhood Watch. (Paul Ciatti). Paul Ciatti requested the Board to ask for increased police patrol for speed enforcement. Vinnie Burruano agreed to contact our local Fairfax City desk sergeant to discuss. (8) Website/Message Board. (Mike Bugelski and Kurt Seibert). Mike indicated the management services info is not on the ARB application, so the website needs some clarification/notes for users of the form. Mike expressed concern about the use of FSHOA blasts for FSSTC use and events. It was agreed that future promotion of non-hoa content will be more clearly identified as being sent on behalf of that organization and not directly endorsed or created by FSHOA. Mike indicated the blast list is losing members (opt-out) for various reasons and has followed up with some to discover why. V2 (19 Dec 18 AM) Page 3

4 (9) Newsletter. (Mike Bugelski). Mike Bugelski reports that Linda Feller is controlling newsletter compilation/design but an editor is still needed. Newsletter distribution will be done through constant contact/ blast list in a new format (PDF attachments not supported). Mike is testing the new distribution and should be sending it out soon. D) Special Committee / Project Reports (1) Election Refinements (Matthew Howard). Matt Howard reports the new resolution was approved by electronic vote. Final copy being published on website. (2) Management Services (Matt Howard). Matt Howard reports the Committee meeting currently scheduled for 10/2, 7pm at the Library Conference Room. Matt requested all committee members to begin process of contacting other local HOA management companies for interest in submitting proposal. 5) Unfinished Business: Matt Howard reports that the owner of Lot 959 at 6108 Arrington Dr refuses to provide plans/permits for new house, asking board to prove the property is subject to HOA jurisdiction. Matt has contacted HOA attorney, Laurie Dolson for advice. 6) New Business: 8:50pm Room was cleared except for Board members for executive session to discuss pending litigation involving association. 8:58pm, came out of exec session. No votes held during executive session. 7) Association Members Forum. No members issues presented. 8) Next Meeting 7:00 PM, 18 October 2018, Burke Centre Library, Room 116/117, Burke VA. 9) Adjournment. (Vinnie Burruano.). Vinnie Burruano ended the meeting at 8:50 PM and the Board of Directors moved to an Executive Session.
