PETERSBURG PSI Committee Meeting Minutes January 17, 2013 at 9:18 a.m. PRESENT: ABSENT: ALSO: Committee Members William Dudley, Chair; Jeff Danner, Vice Chair; Wengay Newton, Steve Kornell and Karl Nurse, Alternate. The meeting was called to order by Chair Dudley at 9:18 a.m. with the above members present. In connection with the agenda for the January 17, 2013 meeting, Committee Member Danner moved to approve the January 17, 2013 agenda as submitted. All were in favor of the motion. In connection with review of the minutes of the December 13, 2012 and December 20, 2012 PSI Meetings, Committee Member Danner moved approval of the December 13, 2012 and the December 20, 2012 minutes as submitted. All were in favor of the motion. In connection with the selection of new chair, Committee Member Danner moved approval of Committee Member Dudley as the new Chair. All were in favor of the motion. Committee Member Nurse nominated Committee Member Danner as Vice Chair of the Committee. All were in favor of the motion. In connection with the item relating to Street Closure (28 th Street/50 th Avenue South), Philip Lazzara provided a brief report for the Committee. Committee Member Kornell commented that he believed the street dead-ended prior to the recent development. It was shared that to the left is the Rio Estate property; to the right is the backside of the new subdivision on 50th Avenue South. It was shared that the new subdivision had to pave the portion of 50th Ave leading to the new subdivision. Mr. Lazzara stated the initiation of a street closure application can occur by 2 options; opt 1 would require private 51% owners to sign the application form and pay the normally required fee prescribed by the City Code or opt 2 City Council could approve the initiation. He highlighted Resolution No , which provides guidance regarding when City-initiated right-of-way vacations are considered to be appropriate. While there are no such criteria for evaluation of City-initiated street closures, Mr. Lazzara suggested that the same criteria would be appropriate. He noted that the criteria reflected in the resolution would not support a City-initiated application. Moreover, with regard to the criteria for review of a proposed closure, Staff s recommendation would be to not to close the subject street. The Transportation Planning

4 PSI Meeting Minutes January 17, 2013 Page 2 Department and the Engineering Department were also available to provide input. Committee Member Kornell commented briefly on the issue when buses come down that street how narrow it is; he stated there are approximately 30 houses; and feels the street is not wide enough to allow two way traffic. Committee Member Kornell stated that since the City created this situation, then the City should initiate the application. Committee Member Newton asked staff to go back to the view of the site along 50 th Avenue South to see if it would be possible to widen the roadway. Engineering Director Tom Gibson shared that 28th street was paved back in the 90 s and recalled that the property owners in the AIP #6 requested that their street not be paved at that time. Mr. Lazzara commented that the Rios estate was never platted so they never provided the other half of the roadway, but that such dedication would occur at the time that land is platted by the owner. It was asked if the width of the paved portion was wide enough to accommodate two vehicles and the response was yes. It was shared that 20 feet is needed for standard roadway operations. Committee Member Newton expressed his concerns regarding the conditions of the paving of the road. Mr. Gibson commented briefly on the process that needs to be followed to get this road paved and stated it would require an assessment to the adjacent property owners to pave this road. Committee Member Newton inquired how much money is being spent to continue to patch this road in dollar and man hours. Committee Member Newton stated that he would like to get the information. Council Member Curran inquired if the road has ever been paved. Mr. Gibson commented that this was from the 50s and this road has not been paved since. He commented that in 1960 (AIP 6), this street was not paved per the request of the residents on 50 th Avenue South. Mr. Gibson commented that development has occurred nearby in past few years. Council Member Curran commented briefly that in order to get this road way paved, they would have to get approval from the residents. Committee Chair Dudley inquired what the traffic volume was for this street. Mike Frederick responded that it was not available; however, normal traffic patterns would generate approximately 10 trips back and forth per day and revealed that there more trips during the summer months. It was asked what would happen if they just left it alone; and perhaps contact the school to see if they can relocate the pickup for the students. Committee Member Kornell expressed concern regarding approval by the property owners. Committee Member Newton commented on the issue regarding buses for kids that are disabled. Mr. Lazzara commented that staff is seeking direction regarding whether to advise Council to initiate a street closure vacation and noted that the residents have the option of filing a privately-initiated application regardless of the decision today. Committee Member Kornell again expressed concern regarding the neighborhood and the amount of pot holes; feels that the road should be better maintained by the City. Committee Chair Dudley asked what the Committee s recommendation was. Committee Member Kornell proposed that the Committee recommendation be to move forward with a City-initiated application. Roll Call on the motion: Ayes. Kornell. Nays: Danner, Dudley, and Newton. Motion failed. In connection with the agenda item relating to Neighborhood Watch Signs, Council Member Gerdes commented on his reason for referring this item relating to use of private cameras as a security measure in the neighborhood. He commented on the uniform neighborhood sign used for Crime Watch and inquired if language could be added to the current sign to state private surveillance cameras in the neighborhood.

5 PSI Meeting Minutes January 17, 2013 Page 3 Mark Winn commented that currently they are allowed to put up government signs and only government signs can be placed in the city s right of way. There was discussion regarding whether or not to draft an ordinance and it was suggested that only those neighborhoods with Crime Watch organizations should have the listing of additional signs and shared some see the signs as a means of security or extra security where in reality there are none. Mr. Winn stated that if that is the way that they want to go that an ordinance be crafted to state the process that would need to be followed. Committee Member Newton suggested that perhaps they just add one sign to what is currently in place. It was recommended to add the language of video surveillance to the current signs and it would avoid more signs. Committee Member Newton asked that Staff review to see if they can have two signs included on the existing Neighborhood Crime Watch; and come back to the Committee with cost that would be associated. Committee Vice Chair Danner commented that he is in favor of reviewing and getting input from Chief Harmon and supports discussion of using additional signage to increase security. Committee Member Kornell inquired if they could consider using sticker which could be used to clarify who is doing the surveillance. Council Member Gerdes commented that currently he would like to see the signs placed to welcome people to the neighborhood; stated further that he would support paying for signs to include the language stating private video monitoring. Committee Member Nurse stated support of the proposed motion to have staff to see if they can add signage to the current sign that already exists; determine the cost if they can modify them to indicate private video monitoring with report back to the Committee within 60 days. Mr. Winn stated that they would need to determine how many signs that currently exist. Committee Vice Chair Danner suggested that they have someone from the Police Department come before the Committee prior to receiving a report from staff. Roll call on the motion. All were in favor. In connection with the Industrial Pretreatment Ordinance, Water Resources Director Steve Leavitt briefly introduced Wastewater Collection System Manager Lane Longley, Assistant City Attorney Kim Streeter were also present. He commented on the benefits of the Industrial Pretreatment Ordinance protects the collection system, protects the biological processes at the Water reclamation Facilities and protects the beneficial reuse of reclaimed water and biosolids. The proposed changes included in the ordinance will bring the program into compliance with the Florida Department of Environmental Protection (FDEP) and the US Environmental Protection Agency (EPA). There are also three optional changes. Two of the changes may help a permittee to reduce their monitoring requirement. For example, metal finisher users and small businesses, if they meet certain criteria, would save some money on monitoring costs. The third option may benefit an industry if they can demonstrate that their fats, oils and grease are not harmful. Administration is proposed to have first reading at the February 7, 2013 City Council meeting with the public hearing is scheduled for February 21, 2013 City Council meeting. Committee Vice Chair Danner moved to forward to full council for consideration and approval Roll call on the motion. Ayes. Dudley, Danner and Newton. Nays. Kornell. Motion passed. Committee Member Kornell expressed concern regarding the discharge of heavy metals. Council Member Kennedy inquired about the status of the Noise Ordinance. Chief Assistant City Attorney Mark Winn provided an update on the status of the Supreme Court s ruling and stated that some education is needed because the noise ordinance was not being enforced while waiting on the ruling. Committee Chair Dudley suggested placing this item on a future agenda. Committee Member Newton inquired if he could continue to direct calls to Mr. Winn regarding

Based on the attached. requests from propert) tmners and tenants alike for Cit) installed landscape maintenance along Central A\cnuc arc vcr) limited. Not\\ ithstanding. the Parks & Recreation Department has recently initiated a pro-active landscaping enhancement and maintenance initiati\e along Central Avenue and Street involving over plants. ln addition. the Parks & Recreation Department will continue to provide proacti\ e maintenance efforts in addition to re-active. \:>,. here necessary. We \Vould also like to take the opportunity to clarify roles and responsibilities as it relates to Cit) streetscape initiatives versus private right-of-\\ay enhancements in terms of respective maintenance and repair responsibilities. Private sector enhancements to the right-of-v\ ay are implemented through the permitting process. The Engineering and Capital Improvement Department issue permits with minor easements that include the condition for maintaining the enhanced pot1ions of the right-of-\vay at the abutting propet1y owner's expense. The minor easement then becomes a recorded instrument that runs \Vith the property with the proviso that if necessary repair and maintenance work is not completed b) easement holder the City has the right to perform the work and place a lien on the property. In relation to Cit) implemented streetscape projects that typically involve decorati\'c lighting. street furnishings. sidewalks. hardscape park\'vay. and landscaping features. complete \\ ith irrigation. the following rule of thumb applies going forward:

10 The City is responsible for all repair. maintenance and replacement needs associated \\ ith strcetscape features installed by the City. In recognition that our resources are stretched in order to accomplish this work. we are proposing all future streetscape initiatives will be limited in terms of those features that are most maintenance intensive and not subject to Capital Funding opportunities such as landscaping. If abutting propert) owners desire landscaping features us part of our City streetscape initiative. \VC are \Vorking on ways on accomplishing that desire via the establishment of special assessment districts vvhercin the maintenance can be borne by the abutting ovvncrs pursuant to majority of property owners (as determined by abutting rootage) approving to pay via the petition process.
