1 Minutes of the City of Calera Council Meeting April 2, 2018 The Council of the City of Calera met in the Council Chambers of the City Hall at 7901 Highway 31 on Monday, April 2, 2018 at 6:30 p.m., in a regular meeting. Mayor Graham presiding. Mayor and Council Members Present: Jon G. Graham, Mayor David Bradshaw, Council Member Chris Bunn, Council Member Philip Busby, Council Member Ernest Montgomery, Council Member Kay Snowden Turner, Council Member Alan Watts, Council Member Department Heads Present: Reggie Darden, Building Official Kelly Ellison, Finance Director Seth Gandy, Park and Recreation Director Sean Kendrick, Fire Chief Sean Lemley, Police Chief Chris Pappas, City Engineer Doug Smedley, Sewer Operations Director Matt Worthen, IT Services Manager Absent: Alison Powers, Library Director Guests: Arianne Turner, Mike Bullard, Calvin Morgan, Fred Hoskins, Bill Davis, David Comer, Sharon Cooper, Jerry Bice and Harold Cole Mayor Graham called the meeting to order at 6:30 p.m.

2 Word of Prayer and Pledge of Allegiance: Fred Hoskins opened the meeting with prayer and the Pledge of Allegiance. Approval of Minutes: Council Member Turner made a motion to approve and dispense with the reading of the following minutes: Regular Meeting March 5, 2018 Work Session March 5, 2018 Council Member Watts seconded said motion and upon vote, the results were as follows: Graham, Bradshaw, Bunn, Busby, Montgomery, Turner, Watts Motion Passed REPORTS OF DEPARTMENT HEADS: Kelly Ellison, Finance Director Presented Budget Adjustments (See Attached) Seth Gandy, Park and Recreation Director announced the Strawberry Festival will be held on Saturday, April 28, 2018 at Oliver Park during the hours of 10:00 a.m. till 1:00 p.m. This year the Strawberry Festival will feature the following: Automatic Slim, Live Blues Band, Kid Zone with Inflatables, Tether Hot Air Balloon Rides, Classic Car Show, Food Vendors and a host of Local Arts and Crafts Vendors. COUNCIL MEMBER REPORTS: Council Member Turner announced the upcoming ribbon cutting: Quick Lane Tire and Auto Center at 172 Marketplace Circle, Calera, Alabama 35040, April 6, 2018, 11:00 a.m. till Noon Council Member Turner thanked Mayor Graham for attending the recent ribbon cutting for Big J s Grill at 8176 US Hwy 31 Calera, Alabama Council Member Montgomery requested we review the current Comprehensive Plan as it relates to the Downtown Revitalization Plan. MAYOR REPORT: Mayor Graham reported a meeting is scheduled for Thursday, April 19, 2018 at 2:00 p.m. with Kelley Taft with The Kelley Group to discuss the Downtown area. Mrs. Kelley has worked with other cities to revitalize their downtown areas.

Council Member Busby seconded said motion which was carried unanimously. 8 PROCLAMATION WHEREAS, strong family relationships constitute the foundation of our community; and WHEREAS, alienating behaviors are frequently seen in high-conflict divorces, separations and asymmetrical custody arrangements but can occur in intact marriages; and WHEREAS, Parental Alienation is a term used to describe any number of behaviors and attitudes on the part of one parent, both parents or third party designed to interfere, damage or destroy the relationship a child has with their other parent. It's a form of abuse that causes emotional trauma to children; and WHEREAS, Parental Alienation deprives children of their right to freely love and be loved by both parents, their extended families and robs children of their sense of security; and WHEREAS, we encourage all Alabamians to visit paawareness.com for information on raising awareness to stop Parental Alienation, and we call on community and state leaders to support shared parenting because of its benefits for children; and WHEREAS, the recently published Diagnostic and Statistical Manual of Mental Disorders (DSM-5) made several references to the dysfunctional family dynamic of alienation to be a form of psychological child abuse; and WHEREAS, approximately 40,000 Alabama children a year experience court ordered visitation with one parent for only two to six days a month; and WHEREAS, Parental Alienation Prevention Week is intended to increase the knowledge and understanding of this problem to help Alabamians, institutions, the legal and mental health community and leaders to better identify and combat this abusive behavior to children; and WHEREAS, God so loved us, we also ought to love one another; love does no harm to its neighbor; therefore Children should be able to freely express the meaning of F.A.M.I.L.Y.; Father And Mother, I Love You; and WHEREAS, in honor of Parental Alienation Prevention Week, come and show your support by taking 10 minutes out of your day at noon, on Wednesday, April 25, to blow soap Bubbles For Love. Each bubble we blow represents the love our children have and should be allowed to share with both their parents: NOW, THEREFORE, I, Jon G. Graham, Mayor of the City of Calera, do hereby proclaim April 22 through April 28, 2018, as PARENTAL ALIENATION PREVENTION WEEK and April 25, 2018, as PARENTAL ALIENATION AWARENESS Bubbles For Love DAY

9 Mayor Graham introduced the following Ordinance: ORDINANCE NO WHEREAS, the Planning Commission of the City of Calera, Alabama conducted a public hearing on February 6, 2018 and has recommended changes in the City of Calera zoning map, and advises that said zoning is in compliance with the City of Calera Comprehensive Plan, and WHEREAS, the Council of the City of Calera, Alabama has conducted a public hearing after proper legal and actual notice to landowners to consider changes in the zoning map recommended by the Planning Commission. IT IS THEREFORE ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALERA, ALABAMA AS FOLLOWS: That the zoning request of property described in Exhibit A be rezoned as follows: From: M-1 (Light Industrial District) To: RG (Residential Garden District) Council Member Bradshaw moved that unanimous consent of the Council be given for immediate action upon Ordinance No Council Member Turner seconded said motion and upon vote, the results were as follows: Montgomery, Watts, Bradshaw, Graham, Bunn, Busby, Turner Thereupon, the Mayor declared said motion carried and unanimous consent given for the consideration of said Ordinance.

12 Mayor Graham introduced the following Ordinance: ORDINANCE NO BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALERA, ALABAMA: (1)WHEREAS, the Code of Ordinances of the City of Calera, Alabama is hereby amending the Zoning Ordinance Section Commercial Uses by: Deleting: Construction Service A place of business engaged in construction activities and incidental storage as well as wholesaling of building materials (but not a home improvement center which also sells at retail) such as a building contractor, trade contractor or wholesale building supply store. (2) WHEREAS, the Code of Ordinances of the City of Calera, Alabama is hereby amending the Zoning Ordinance Section Industrial Uses by: Adding: Construction Service A place of business engaged in construction activities and incidental storage as well as wholesaling of building materials (but not a home improvement center which also sells at retail) such as a building contractor, trade contractor or wholesale building supply store (3) WHEREAS, the Code of Ordinances of the City of Calera, Alabama is hereby amending Table 5.2 Permitted Uses for Non-Residential Districts of the current Zoning Ordinance by inserting the following: Deleting: Construction Services (Commercial Uses) Allowed by Right in B-2 and M-1 Adding: Construction Services (Industrial Uses) Allowed by Right in M1, M2, M3 and SE in B2 Council Member Bunn moved that unanimous consent of the Council be given for the immediate action upon said Ordinance. 15 Mayor Graham introduced the following Resolution: RESOLUTION NO. R WHEREAS, the City of Calera, Alabama (hereinafter at times referred to as City) is desirous of having certain improvements made on SR-3(US-31) within the City Limits of Calera, in accordance with plans prepared by the Alabama Department of Transportation and designated as Project Number: STPAA-0003(613) Resurface, Plane, Traffic Stripe, Level and Patch SR-3(US-31) from the Chilton County Line to 7 th Avenue in Calera. (Including Railroad Crossing of Norfolk and CSX) MP to MP WHEREAS, The Alabama Department of Transportation is now or may later be desirous of receiving Federal Aid for improvement of said highway; and WHEREAS, The Federal Highway Administration, an agency of the United States of America, will not participate in any funding for the construction of said project until and unless the City will agree to certain requirements of the Federal Highway Administration. The City for the purpose of complying with requirements of the Federal Highway Administration in regard to its funding of improvements of the type and kind in this agreement provided for, does hereby pass and adopt the following resolution: BE IT RESOLVED by the City Council of Calera, that the plans of said project including alignment, profile, grades, typical sections and paving layouts as submitted to this City and which are now on file in the office of the City Clerk are hereby approved and that the location of said project as staked out by the Alabama Department of Transportation and as shown by said plans referred to are hereby approved and the Alabama Department of Transportation, in cooperation with the Federal Highway Administration, is hereby authorized to proceed with the grading, draining, paving, and otherwise improving and construction of said project in accordance with said plans. The City by and through its Council hereby grants to the Alabama Department of Transportation

16 the full use of and access to the dedicated widths of any existing streets for the construction of said project and hereby agrees to permit and allow the Alabama Department of Transportation to close and barricade the said project and intersecting streets for as long as necessary while the said project is being graded, drained, paved, and otherwise improved, and hereby agrees that the use of any street or highway for parking within an interchange area will not at any time be permitted. The City hereby further agrees to adopt or pass such legally effective ordinances and/or laws as will permanently barricade and/or relocate certain intersecting streets as required by the State and to permanently deny or limit access at certain locations as required by the State along said improvements, all of which are more specifically stated as follows: N/A This project does not require permanent barricade or relocation of any intersecting streets. Please refer to: Project Notes (Sheets 2L 2N) Please refer to: General Traffic Control Notes (Sheets 2P-2Q) Please refer to: Traffic Control Plan Summary (Sheets 6-14) BE IT FURTHER RESOLVED by the City Council, that for and in consideration of the Alabama Department of Transportation in cooperation with the Federal Highway Administration, constructing said highway and routing traffic along the same through the City over said project, such City hereby agrees with the Alabama Department of Transportation and for the benefit of the Federal Highway Administration, that on the above mentioned project the City will not in the future permit encroachments upon the right of way; nor will it pass any ordinances or laws fixing a speed limit contrary to those limits provided for in Title 32, Chapter 5, Code of Alabama 1975, as amended, and other laws of Alabama; nor will it permit other than parallel parking in areas where parking is permitted; nor will it allow the placing of any informational, regulatory, or warning signs, signals, median crossover, curb and pavement or other markings, and traffic signals without written approval of the Alabama Department of

17 Transportation and the Federal Highway Administration, of the location, form and character of such installations. The traffic control devices and signs installed during construction, and those installed after completion of this project shall be in accordance with the latest edition of the national Manual on Uniform Traffic Control Devices and accepted standards adopted by the Alabama Department of Transportation of the State of Alabama and by the Federal Highway Administration. The City further agrees that subsequent traffic control devices deemed necessary by it in keeping with applicable statutes, rules and regulations to promote the safe and efficient utilization of the highway under the authority of Title 32, Chapter 5, Code of Alabama 1975, and all other applicable laws of Alabama, shall be subject to and must have the approval of the Alabama Department of Transportation of the State of Alabama and of the Federal Highway Administration, prior to installation and the City further agrees that it will enforce traffic and control the same under the provisions of Title 32, Chapter 5, Code of Alabama 1975, and other applicable laws of Alabama.

18 BE IT FURTHER RESOLVED by this City Council: 1. That the City agrees to perform all maintenance on crossroads, service drives, or relocated roads that are not designated Federal or State highways that are in the jurisdiction of the City. 2. That the City agrees to perform all maintenance on any existing road which has been replaced by a new road; or, if the existing road is not used, the City has the option of vacating same. 3. That the City agrees to perform all maintenance on interchanges to the theoretical crossing of the denied access line. 4. That the City agrees to perform all maintenance on grade separations along the roadway to the end of the bridge, or the denied access fence, whichever the case. It is understood and agreed that no changes in this Resolution or Agreement shall in the future be made without having obtained the prior approval of the Federal Highway Administration. 19 NATIONAL DONATE LIFE MONTH PROCLAMATION CITY OF CALERA, Alabama PROCLAMATION WHEREAS, one of the most meaningful gifts that a human being can bestow upon another is the gift of life; and WHEREAS, 34,771 candidates on the nation s organ transplant waiting list received a life-saving or life-enhancing organ transplant in 2017; of those 501 received an organ transplant in Alabama; and WHEREAS, a new patient is added to the national waiting list for an organ transplant every 10 minutes, 20 individuals die each day waiting to be listed for an organ transplant; and WHEREAS, nearly 114,864 men, women and children are currently on the national waiting list for organ transplantations, of which approximately 2,512 are on Alabama s list; and WHEREAS, 5,430 candidates on the national waiting list died waiting for an organ transplant which did not come in time; of those 191 were on Alabama s waiting list. WHEREAS, the Alabama Organ Center is the non-profit, independent organ recovery organization dedicated to the recovery of high quality organs and tissues for transplantation therapy; and WHEREAS, CITY OF CALERA, Alabama supports the Alabama Organ Center s life-saving mission; NOW, THEREFORE, I, Jon G. Designated by the FCC in 2005, 811 provides potential excavators and homeowners a simple number to reach their local one call center to request utility line locations at the intended dig site; and Whereas, through education of safe digging practices, excavators and homeowners can save time and money keeping Alabama safe and connected by making a simple call to 811 in advance of any digging project, waiting the required amount of time, respecting the marked lines by maintaining visual definition throughout the course of excavation and finally, digging with care around the marks; and Whereas, all parties agree that safe digging is a shared responsibility.
