1 MINUTES BOARD OF ZONING APPEALS VIRGINIA BEACH, VIRGINIA JUNE 3, 2015 Chair Richard Garriott, called to order the Board of Zoning Appeals Board meeting in the City Council Chambers, City Hall Building, Virginia Beach Municipal Center, on Wednesday, June 3, The Board members' staff briefing, was held at 1:00 p.m. in the City Managers Conference Room as to information pertaining to the agenda of June 3, Board Members Present: Mr. Richard Garriott, Mrs. Elizabeth Kovner, Mr. James Oglesby, Mr. Harry Purkey, Jr., Mr. Randy Sutton, Mr. David Whitley, and Mrs. Janice Anderson sat in as an alternate. REGULAR AGENDA: Case 1: Tanya Antoinette Gills Property Address/Description: 1529 Still Harbor Lane, Lot 2, Lake Christopher, Centerville District #1, ZONING: R-7.5, GPIN: Agent: Tanya Gills, Owner Board Action: APPROVED WITH 1 CONDITION ON JUNE 3, The proposed 1 story addition shall be constructed in substantial adherence to the submitted site plan and building plans found in the file. 2 A motion was made by Mrs. Kovner, seconded by Mr. Sutton to approve the variance with the 1 condition listed above. All voted for the motion. 7 NO 0 ABSTAIN 0 2 Case 2: City of Virginia Beach/Public Utilities Property Address/Description: 134 Pinewood Road, Lynnhaven District #5, ZONING: R-40, GPIN: Agent: John McDonald of Public Utilities 1. The proposed Generac SG035 35kW Industrial stand by generator and concrete slab shall be installed in substantial adherence to the submitted site and building plans. 2. The generator shall be operated during emergency power outages and for maintenance and testing purposes. John McDonald of Public Utilities and Richard Nettleton of Public Utilities appeared before the Board. The proposed porch shall be completed in substantial adherence to the submitted site plan. 2. The stoop and steps in front of the porch shall not be covered. Eddie Bourdon, Attorney with Sykes Bourdon Ahern & Levy appeared before the Board representing the applicants. 4 Case 4: DELETED Case 5: Angelique and Maynard Massey Property Address/Description: 1172 Brattleboro Arch ~ Lot 4, Bellamy Woods Kempsville District #2, ZONING: R-10, GPIN: Agent: Dan Sanders Board Action: APPROVED WITH 3 CONDITIONS ON JUNE 3, When developed the site shall be in substantial conformance with the submitted site plan entitled PHYSICAL SURVEY OF LOT 40 SUBDIVISION OF BELLAMY WOODS SECTION ONE KEMPSVILLE BOROUGH, VIRGINIA BEACH, VIRGINIA FOR MAYNARD E. MASSEY & ANGELIQUE Z. MASSEY, dated October 20, 1994 and prepared by Hoggard/Eure Associates. 2. The variance to the rear yard setback for the existing storage shed shall be for the life of the shed only. Should the shed be replaced or require significant repair, all required setbacks must be met or another variance granted by the Board of Zoning Appeals. 3. The rear home addition shall be limited to one-story in height. Maynard Massey, owner, and Don Sanders appeared before the Board. The proposed pump station building and generator (enclosure) shall be constructed in substantial adherence to the submitted site and building plans provided in the file. 2. Enclosure of the generator shall be subject to the approval of the Zoning Administrator.
