1 Humanities Texas Institute for Texas Teachers Shaping the Republic to 1877 Westward Expansion and Native Americans Using the Documents and Lecture Materials Jeffrey P. Shepherd Department of History University of Texas at El Paso Overview Comments Covering Westward Expansion and American Indians within one lecture or lesson plan is very difficult. The time period between 1812 through 1860 is full of complex issues, ranging from the growth of a market economy, economic and political nationalism, the establishment of a strong judiciary, labor and women s movements, debates over slavery which interacted with debates over expansion and myriad concerns about foreign relations. Understanding Westward Expansion and American Indian history in the antebellum era requires one to move across different themes and between debates about slavery, US-Mexico relations, Indian treaties, theories of government, and changing concepts of race. Thus, the lecture, documents and sources included here try to focus in on the pivotal era between the election of Andrew Jackson and the end of the U.S.-Mexico War; roughly the years The materials and lecture trace the origins of Westward Expansion in the kernel of ideas that became known as Manifest Destiny, and then the pinpoint the debates over Indian Removal, Cherokee resistance to removal, and then the legacy of Manifest Destiny that was cause and consequence of first pushing Indian nations westward and later waging war with Mexico. Thoughts on Using the Documents Despite the length of the powerpoint presentation, and the number of documents, I suggest that the two can be used together in several different ways. Drawing some direction from the TEKS for Social Studies, especially issues such as the origins of Expansion (economics, politics, culture, and government); the growth of government; geographical dimensions of expansion; notions of citizenship; and the contribution of individuals to historical change; the documents can serve as the basis for debate and discussion over the ways in which various groups in the US and in Native communities shaped expansion. Documents can be used in pairs, and students might compare and contrast the religious and political statements of John Winthrop and Benjamin Franklin to understand how and why colonists viewed themselves differently from Europeans. This issue in particular speaks to the prevalent notion that the US was an exceptional nation with a special place or role in human history. Students could also analyze the two presidential addresses to determine change over time. Students could also use Jefferson s speech and then locate on the internet any number of speeches made by Indian leaders such as Little Turtle (Miami) or Tecumseh (Shawnee) to evaluate Indian-White relations before the War of The opportunities to focus in on Indian Removal, especially with the plethora of

Students could even go online to see actually copies of the Cherokee Phoenix, the bilingual newspaper of the Cherokee Nation. Using the sources included in this set of materials, students can engage questions of nationalism, structures of government, separation of powers, federal-state relations, competing notions of citizenship, and the complete political relations between Indian Nations and the U.S. Finally, the sources on Manifest Destiny offer students a chance to ask the question, Was Manifest Destiny simply an idea that explained the world that Americans inhabited during the 1830s and 1840s, or was it a concept that elites crafted to justify expansion westward and the dispossession of Mexicans and Indians? Students can also find historical documents that reveal the contested and debated nature of expansion, both within American society and throughout Native and Mexican populations.

(Accessed ) GOD ALMIGHTY in His most holy and wise providence, hath so disposed of the condition of mankind, as in all times some must be rich, some poor, some high and eminent in power and dignity; others mean and in submission..the Lord will be our God, and delight to dwell among us, as His own people, and will command a blessing upon us in all our ways, so that we shall see much more of His wisdom, power, goodness and truth, than formerly we have been acquainted with. We shall find that the God of Israel is among us, when ten of us shall be able to resist a thousand of our enemies; when He shall make us a praise and glory that men shall say of succeeding plantations, "may the Lord make it like that of New England." For we must consider that we shall be as a city upon a hill. The eyes of all people are upon us. "Beloved, there is now set before us life and death, good and evil," in that we are commanded this day to love the Lord our God, and to love one another, to walk in his ways and to keep his Commandments and his ordinance and his laws, and the articles of our Covenant with Him, that we may live and be multiplied, and that the Lord our God may bless us in the land whither we go to possess it. But if our hearts shall turn away, so that we will not obey, but shall be seduced, and worship other Gods, our pleasure and profits, and serve them; it is propounded unto us this day, we shall surely perish out of the good land whither we pass over this vast sea to possess it. Document 2 Benjamin Franklin, Letter to Lord Kames, In William Temple Franklin, ed., The Works of Dr. Benjamin Franklin in Philosophy, Politics, and Morals, vol. 6 (Philadelphia: William Duane, 1817): Upon the whole, I have lived so great a part of my life in Britain, and have formed so many friendships in it, that I love it and sincerely wish it prosperity, and therefore wish to see that union, on which alone I think it can be secured and established. Ast to America, the advantages of such a union to her are not so apparent. She may suffer at present under

But America, an immense territory, favoured by nature, with all advantages of climate, soils, great navigable rivers, lakes, etc., must become a great country, populous and mighty, and will in a less time than is generally conceived, be able to shake off any shackles that may be imposed on her, and perhaps lace them on the imposers. In the mean time every act of oppression will sour their tempers, lessen greatly if not annihilate the profits of your commerce with them, and hasten their final revolt; for the seeds of liberty are universally found there, and nothing can eradicate them. Document 3 Thomas Jefferson, Second Inaugural Address, March 4, AMDOCS: Documents for the Study of American History. (Accessed ) I know that the acquisition of Louisiana had been disapproved by some from a candid apprehension that the enlargement of our territory would endanger its union. But who can limit the extent to which the federative principle may operate effectively? The larger our association the less will it be shaken by local passions; and in any view is it not better that the opposite bank of the Mississippi should be settled by our own brethren and children than by strangers of another family? With which should we be most likely to live in harmony and friendly intercourse? The aboriginal inhabitants of these countries I have regarded with the commiseration their history inspires. Endowed with the faculties and the rights of men, breathing an ardent love of liberty and independence, and occupying a country which left them no desire but to be undisturbed, the stream of overflowing population from other regions directed itself on these shores; without power to divert or habits to contend against it, they have been overwhelmed by the current or driven before it; now reduced within limits too narrow for the hunter's state, humanity enjoins us to teach them agriculture and the domestic arts; to encourage them to that industry which alone can enable them to maintain their place in existence and to prepare them in time for that state of society which to bodily comforts adds the improvement of the mind and morals. We have therefore liberally furnished them with the implements of husbandry and household use; we have placed among them instructors in the arts of first necessity, and they are covered with the aegis of the law against aggressors from among ourselves. But the endeavors to enlighten them on the fate which awaits their present course of life, to induce them to exercise their reason, follow its dictates, and change their pursuits with the change of circumstances have powerful obstacles to encounter; they are combated by the habits of their bodies, prejudices of their minds, ignorance, pride, and the influence of interested and crafty individuals among them who feel themselves something in the present order of things and fear to become nothing in any other. These persons inculcate a sanctimonious reverence for the customs of their ancestors; that whatsoever they did must be done through all time; that reason is a false guide, and to advance under its counsel in their physical, moral, or political condition is perilous innovation; that their duty is to remain as their Creator made them, ignorance being safety and knowledge full of danger;. Document 4 Elias Boudinot Opposes Removal, Theda Perdue, ed., Cherokee Editor: The Writings of Elias Boudinot (Knoxville: University of Tennessee Press, 1983): Our last Washington papers contain a debate which took place in the house of representatives, on the resolution, recommended by the committee on Indian affairs, published in the second number of our paper. It appears that the advocates of this new system of civilizing the Indians are very strenuous in maintaining the novel opinion, that it is impossible to enlighten the Indians, surrounded as they are by the white population, and that they assuredly will become extinct, unless they are removed. It is a fact which we would not deny, that many tribes have perished away in consequence of white population, but we are yet to be convinced that this will always be the case, in spite of every measure taken to civilize them. We contend that suitable measures to a sufficient extent have never been employed. And how dare these men make an assertion without sufficient evidence. What proof have they that the system which they are now recommending [removal] will succeed? Where have we an example in the whole history of many, of a nation or tribe, removing in a body, from a land of civil and religious means, to a perfect wilderness, in order to be civilized. We are fearful that these men are building castles in the air, whose fall will crush those poor Indians who may be so blinded as to make the experiment.

(Accessed ) An Act to provide for an exchange of lands with the Indians residing in any of the states or territories, and for their removal west of the river Mississippi. Be it enacted by the Senate and House of Representatives of the United States of America, in Congress assembled, That it shall and may be lawful for the President of the United States to cause so much of any territory belonging to the United States, west of the river Mississippi, not included in any state or organized territory, and to which the Indian title has been extinguished, as he may judge necessary, to be divided into a suitable number of districts, for the reception of such tribes or nations of Indians as may choose to exchange the lands where they now reside, and remove there.... And be it further enacted, That it shall and may be lawful for the President to exchange any or all of such districts with any tribe or nation of Indians now residing within the limits of any of the states or territories, and with which the United States have existing treaties, for the whole or any part or portion of the territory claimed and occupied by such tribe or nation, within the bounds of any one or more of the states or territories, where the land claimed and occupied by the Indians, is owned by the United States, or the United States are bound to the state within which it lies to extinguish the Indian claim thereto. And be it further enacted, That in the making of any such exchange or exchanges, it shall and may be lawful for the President solemnly to assure the tribe or nation with which the exchange is made, that the United States will forever secure and guaranty to them, and their heirs or successors, the country so exchanged with them; and if they prefer it, that the United States will cause a patent or grant to be made and executed to them for the same. And be it further enacted, That upon the making of any such exchange as is contemplated by this act, it shall and may be lawful for the President to cause such aid and assistance to be furnished to the emigrants as may be necessary and proper to enable them to remove to, and settle in, the country for which they may have exchanged; and also, to give them such aid and assistance as may be necessary for their support and subsistence for the first year after their removal. And be it further enacted, That it shall and may be lawful for the President to cause such tribe or nation to be protected, at their new residence, against all interruption or disturbance from any other tribe or nation of Indians, or from any other person or persons whatever. And be it further enacted, That for the purpose of giving effect to the Provisions of this act, the sum of five hundred thousand dollars is hereby appropriated, to be paid out of any money in the treasury, not otherwise appropriated. Document 6 Andrew Jackson, State of the Union Address, USA-Presidents.Info (Accessed ).It gives me pleasure to announce to Congress that the benevolent policy of the Government, steadily pursued for nearly 30 years, in relation to the removal of the Indians beyond the white settlements is approaching to a happy consummation. Two important tribes have accepted the provision made for their removal at the last session of Congress, and it is believed that their example will induce the remaining tribes also to seek the same obvious advantages. The consequences of a speedy removal will be important to the United States, to individual States, and to the Indians themselves. The pecuniary advantages which it promises to the Government are the least of its recommendations. It puts an end to all possible danger of collision between the authorities of the General and State Governments on account of the Indians. It will place a dense and civilized population in large tracts of country now occupied by a few savage hunters. By opening the whole territory between Tennessee on the north and Louisiana on the south to the settlement of the whites it will incalculably strengthen the SW frontier and render the adjacent States strong enough to repel future invasions without remote aid. It will relieve the whole State of Mississippi and the western part of Alabama of Indian occupancy, and enable those States to advance rapidly in population, wealth, and power. It will separate the Indians from immediate contact with settlements of whites; free them from the power of the States; enable them to pursue

6 Westward Expansion and Native Americans 6 happiness in their own way and under their own rude institutions; will retard the progress of decay, which is lessening their numbers, and perhaps cause them gradually, under the protection of the Government and through the influence of good counsels, to cast off their savage habits and become an interesting, civilized, and Christian community. Toward the aborigines of the country no one can indulge a more friendly feeling than myself, or would go further in attempting to reclaim them from their wandering habits and make them a happy, prosperous people..humanity has often wept over the fate of the aborigines of this country, and Philanthropy has been long busily employed in devising means to avert it, but its progress has never for a moment been arrested, and one by one have many powerful tribes disappeared from the earth. To follow to the tomb the last of his race and to tread on the graves of extinct nations excite melancholy reflections. But true philanthropy reconciles the mind to these vicissitudes as it does to the extinction of one generation to make room for another. In the monuments and fortifications of an unknown people, spread over the extensive regions of the West, we behold the memorials of a once powerful race, which was exterminated of has disappeared to make room for the existing savage tribes.... What good man would prefer a country covered with forests and ranged by a few thousand savages to our extensive Republic, studded with cities, towns, and prosperous farms, embellished with all the improvements which art can devise or industry execute, occupied by more than 12,000,000 happy people, and filled with all the blessings of liberty, civilization, and religion? The present policy of the Government is but a continuation of the same progressive change by a milder process. The tribes which occupied the countries now constituting the Eastern States were annihilated or have melted away to make room for the whites. The waves of population and civilization are rolling to the westward, and we now propose to acquire the countries occupied by the red men... by a fair exchange, and, at the expense of the United States, to send them to a land where their existence may be prolonged and perhaps made perpetual. Doubtless it will be painful to leave the graves of their fathers; but what do they more than our ancestors did or than our children are now doing? To better their condition in an unknown land our forefathers left all that was dear in earthly objects. Our children by thousands yearly leave the land of their birth to seek new homes in distant regions. Does Humanity weep at these painful separations from everything, animate and inanimate, with which the young heart has become entwined? Far from it. It is rather a source of joy that our country affords scope where our young population may range unconstrained in body or in mind, developing the power and faculties of man in their highest perfection. These remove hundreds and almost thousands of miles at their own expense, purchase the lands they occupy, and support themselves at their new homes from the moment of their arrival. Can it be cruel in this Government when, by events which it can not control, the Indian is made discontented in his ancient home to purchase his lands, to give him a new and extensive territory, to pay the expense of his removal, and support him a year in his new abode? How many thousands of our own people would gladly embrace the opportunity of removing to the West on such conditions! And is it supposed that the wandering savage has a stronger attachment to his home than the settled, civilized Christian? Is it more afflicting to him to leave the graves of his fathers than it is to our brothers and children? Rightly considered, the policy of the General Government toward the red man is not only liberal, but generous. He is unwilling to submit to the laws of the States and mingle with their population. To save him from this alternative, or perhaps utter annihilation, the General Government offers him a new home, and proposes to pay the whole expense of his removal and settlement.. May we not hope, therefore, that all good citizens, and none more zealously than those who think the Indians oppressed by subjection to the laws of the States, will unite in attempting to open the eyes of those children of the forest to their true condition, and by a speedy removal to relieve them from all the evils, real or imaginary, present or prospective, with which they may be supposed to be threatened. Document 7 Speckled Snake s Reply to President Jackson, In, Charles Moquin and Charles Van Doren, eds., Great Documents in American Indian History (New York: Prager, 1973): BROTHERS! We have heard the talk of our great father, it is very kind. He says he loves his red children. BROTHERS! When the white man first came to these shores, the Muscogees gave him land, and kindled hima fire to make him comfortable, and when the pale faces of the sought made war on him, their young men drew the tomahawk, and protected his head from the scalping knife. But when the white man had warmed himself before the Indian s fire,

7 Westward Expansion and Native Americans 7 and filled himself with the Indian s hominy, he became very large; he stopped not for the mountain tops, and his feet covered the plains and the valleys. His hands grasped the eastern and the western sea. Then he became our great father. He loved his red children, but said You must move a little farther, lest I should, by accident, tread on you. With one foot he pushed the red man over the Oconee River, and with the other he trampled down the graves of his father. But our great father stilled loved his red children, and he soon made them another talk. He said much: but it all meant nothing, but move a little farther; you are too near me. I heard a great many talks from our great father, and they all begun and ended the same. When he made us a talk on a former occasion, he said, Get a little farther; go beyond the Oconee, and the Oakmulgee river; there is a pleasant country. He also said, It shall be yours forever. Now he says, The land you live on is not yours; go beyond the Mississippi River; there is game; there you may remain while the grass grows and the water runs. BROTHERS! Will not our great father come there also? Document 8 CHEROKEE NATION v. STATE OF GA., 30 U.S. 1 (1831) 30 U.S. 1 (Pet.) Find Law Cases and Codes. (Accessed ) THIS case came before the court on a motion on behalf of the Cherokee nation of Indians for a subpoena, and for an injunction, to restrain the state of Georgia, and the officers, agents, and servants of that state, from executing and enforcing the laws of Georgia within the Cherokee territory, as designated by treaty between the United States and the Cherokee nation. This bill is brought by the Cherokee nation, praying an injunction to restrain the state of Georgia from the execution of certain laws of that state, which, as is alleged, go directly to annihilate the Cherokees as a political society, and to seize, for the use of Georgia, the lands of the nation which have been assured to them by the United States in solemn treaties repeatedly made and still in force. If courts were permitted to indulge their sympathies, a case better calculated to excite them can scarcely be imagined. A people once numerous, powerful, and truly independent, found by our ancestors in the quiet and uncontrolled possession of an ample domain, gradually sinking beneath our superior policy, our arts and our arms, have yielded their lands by successive treaties, each of which contains a solemn guarantee of the residue, until they retain no more of their formerly extensive territory than is deemed necessary to their comfortable subsistence. To preserve this remnant, the present application is made. Before we can look into the merits of the case,... has this court jurisdiction of the cause? The third article of the constitution describes the extent of the judicial power. The second section closes an enumeration of the cases to which it is extended, with 'controversies' 'between a state or the citizens thereof, and foreign states, citizens, or subjects.' A subsequent clause of the same section gives the supreme court original jurisdiction in all [30 U.S. 1, 16] cases in which a state shall be a party. The party defendant may then unquestionably be sued in this court. May the plaintiff sue in it? Is the Cherokee nation a foreign state in the sense in which that term is used in the constitution? The counsel for the plaintiffs have maintained the affirmative of this proposition with great earnestness and ability.... They have been uniformly treated as a state from the settlement of our country. The numerous treaties made with them by the United States recognize them as a people capable of maintaining the relations of peace and war, of being responsible in their political character for any violation of their engagements, or for any aggression committed on the citizens of the United States by any individual of their community.... The acts of our government plainly recognize the Cherokee nation as a state, and the courts are bound by those acts. A question of much more difficulty remains. Do the Cherokees constitute a foreign state in the sense of the constitution? The counsel have shown conclusively that they are not a state of the union, and have insisted that individually they are aliens, not owing allegiance to the United States. An aggregate of aliens composing a state must, they say, be a foreign state. Each individual being foreign, the whole must be foreign..... The condition of the Indians in relation to the United States is perhaps unlike that of any other two people in existence. In the general, nations not owing a common allegiance are foreign to each other. The term foreign nation is, with strict propriety, applicable by either to the other. But the relation of the Indians to the United States is marked by peculiar and cardinal distinctions which exist no where else. [30 U.S. 1, 17] The Indian territory is admitted to compose a part of the United States. In all our maps, geographical treatises, histories, and laws, it is so considered. In all our intercourse with foreign nations, in our commercial regulations, in any attempt at intercourse between Indians and foreign nations, they are considered as within the jurisdictional limits of the United States, subject to many of those

8 Westward Expansion and Native Americans 8 restraints which are imposed upon our own citizens. They acknowledge themselves in their treaties to be under the protection of the United States; they admit that the United States shall have the sole and exclusive right of regulating the trade with them, and managing all their affairs as they think proper; and the Cherokees in particular were allowed by the treaty of Hopewell, which preceded the constitution, 'to send a deputy of their choice... to congress.' Though the Indians are acknowledged to have an unquestionable, and, heretofore, unquestioned right to the lands they occupy, until that right shall be extinguished by a voluntary cession to our government; yet it may well be doubted whether those tribes which reside within the acknowledged boundaries of the United States can, with strict accuracy, be denominated foreign nations. They may, more correctly, perhaps, be denominated domestic dependent nations. They occupy a territory to which we assert a title independent of their will, which must take effect in point of possession when their right of possession ceases. Meanwhile they are in a state of pupilage. Their relation to the United States resembles that of a ward to his guardian. They look to our government for protection; rely upon its kindness and its power; appeal to it for relief to their wants; and address the president as their great father. They and their country are considered by foreign nations, as well as by ourselves, as being so completely under the sovereignty and dominion of the United States, that any attempt to acquire their lands, or to form a political connexion with them, would [30 U.S. 1, 18] be considered by all as an invasion of our territory, and an act of hostility..... At the time the constitution was framed, the idea of appealing to an American court of justice for an assertion of right or a redress of wrong, had perhaps never entered the mind of an Indian or of his tribe. Their appeal was to the tomahawk, or to the government. This was well understood by the statesmen who framed the constitution of the United States, and might furnish some reason for omitting to enumerate them among the parties who might sue in the courts of the union. Be this as it may, the peculiar relations between the United States and the Indians occupying our territory are such, that we should feel much difficulty in considering them as designated by the term foreign state, were there no other part of the constitution which might shed light on the meaning of these words..... Foreign nations is a general term, the application of which to Indian tribes, when used in the American constitution, is at best extremely questionable. The court has bestowed its best attention on this question, and, after mature deliberation, the majority is of opinion that an Indian tribe or nation within the United States is not a foreign state in the sense of the constitution, and cannot maintain an action in the courts of the United States..... The bill requires us to control the legislature of Georgia, and to restrain the exertion of its physical force. The propriety of such an interposition by the court may be well questioned. It savours too much of the exercise of political power to be within the proper province of the judicial department. But the opinion on the point respecting parties makes it unnecessary to decide this question. If it be true that the Cherokee nation have rights, this is not the tribunal in which those rights are to be asserted. If it be true that wrongs have been inflicted, and that still greater are to be apprehended, this is not the tribunal which can redress the past or prevent the future. The motion for an injunction is denied. Document 9 Worcester v. Georgia 31 U.S Cornell Law School. Legal Information Institute. (Accessed ) This cause, in every point of view in which it can be placed, is of the deepest interest. The defendant is a State, a member of the Union, which has exercised the powers of government over a people who deny its jurisdiction, and are under the protection of the United States. The plaintiff is a citizen of the State of Vermont [Worcester], condemned to hard labour for four years in the penitentiary of Georgia under colour of an act which he alleges to be repugnant to the Constitution, laws, and treaties of the United States. The legislative power of a State, the controlling power of the Constitution and laws of the United States, the rights, if they have any, the political existence of a once numerous and powerful people, the personal liberty of a citizen, are all involved in the subject now to be considered.

9 Westward Expansion and Native Americans 9 The treaty of Hopewell seems not to have established a solid peace. To accommodate the differences still existing between the State of Georgia and the Cherokee Nation, the Treaty of [p555] Holston was negotiated in July, The existing Constitution of the United States had been then adopted, and the Government, having more intrinsic capacity to enforce its just claims, was perhaps less mindful of high sounding expressions denoting superiority. The mutual desire of establishing permanent peace and friendship, and of removing all causes of war is honestly avowed, and, in pursuance of this desire, the first article declares that there shall be perpetual peace and friendship between all the citizens of the United States of America and all the individuals composing the Cherokee Nation. The second article repeats the important acknowledgement that the Cherokee Nation is under the protection of the United States of America, and of no other sovereign whosoever. The meaning of this has been already explained. The Indian nations were, from their situation, necessarily dependent on some foreign potentate for the supply of their essential wants and for their protection from lawless and injurious intrusions into their country. That power was naturally termed their protector. They had been arranged under the protection of Great Britain, but the extinguishment of the British power in their neighbourhood, and the establishment of that of the United States in its place, led naturally to the declaration on the part of the Cherokees that they were under the protection of the United States, and of no other power. This relation was that of a nation claiming and receiving the protection of one more powerful, not that of individuals abandoning their national character and submitting as subjects to the laws of a master. The Cherokee Nation, then, is a distinct community occupying its own territory, with boundaries accurately described, in which the laws of Georgia can have no force, and which the citizens of Georgia have no right to enter but with the assent of the Cherokees themselves, or in conformity with treaties and with the acts of Congress. The whole intercourse between the United States and this Nation, is, by our Constitution and laws, vested in the Government of the United States. The act of the State of Georgia, under which the plaintiff in error was prosecuted, is consequently void, and the judgment a nullity. Can this Court revise, and reverse it? If the objection to the system of legislation lately adopted by the Legislature of Georgia in relation to the Cherokee Nation was confined to its extraterritorial operation, the objection, though complete so far as respected mere right, would give this Court no power over the subject. But it goes much further. If the review which has been taken be correct, and we think it is, the acts of Georgia are repugnant to the Constitution, laws, and treaties of the United States. They interfere forcibly with the relations established between the United States and the Cherokee Nation, the regulation of which, according to... our Constitution, are committed exclusively to the government of the Union. They are in direct hostility with treaties, repeated in a succession of years, which mark out the boundary that separates the Cherokee country from Georgia, guaranty to them all the land within their boundary, solemnly pledge the faith of the United States to restrain their citizens from trespassing on it, and recognize the preexisting power of the nation to govern itself. They are in equal hostility with the acts of Congress for regulating this intercourse and giving effect to the treaties. With a view to bringing our troubles to a close, a delegation was appointed on the 23rd of October, 1835, by the General Council of the nation, clothed with full powers to enter into arrangements with the Government of the United States, for the final adjustment of all our existing difficulties. The delegation failing to

10 Westward Expansion and Native Americans 10 effect an arrangement with the United States commissioner, then in the nation, proceeded, agreeably to their instructions in that case, to Washington City, for the purpose of negotiating a treaty. After the departure of the Delegation, a contract was made by the Rev. John F. Schermerhorn, and certain individual Cherokees, purporting to be a treaty, concluded at New Echota, in the State of Georgia, on the 29th day of December, 1835, by General William Carroll and John F. Schermerhorn, commissioners on the part of the United States, and the chiefs, headmen, and people of the Cherokee tribes of Indians. A spurious Delegation, in violation of a special injunction of the general council of the nation, proceeded to Washington City with this pretended treaty, and by false and fraudulent representations supplanted in the favor of the Government the legal and accredited Delegation of the Cherokee people, and obtained for this instrument, after making important alterations in its provisions, the recognition of the United States Government. And now it is presented to us as a treaty, ratified by the Senate, and approved by the President, and our acquiescence in its requirements demanded, under the sanction of the displeasure of the United States, and the threat of summary compulsion, in case of refusal. It comes to us, not through our legitimate authorities, the known and usual medium of communication between the Government of the United States and our nation, but through the agency of a complication of powers, civil and military. By the stipulations of this instrument, we are despoiled of our private possessions, the indefeasible property of individuals. We are stripped of every attribute of freedom and eligibility for legal self-defence. Our property may be plundered before our eyes; violence may be committed on our persons; even our lives may be taken away, and there is none to regard our complaints. We are denationalized; we are disfranchised. We are deprived of membership in the human family! We have neither land nor home, nor resting place that can be called our own. We are overwhelmed! Our hearts are sickened, our utterance is paralized, when we reflect on the condition in which we are placed, by the audacious practices of unprincipled men, who have managed their stratagems with so much dexterity as to impose on the Government of the United States, in the face of our earnest, solemn, and reiterated protestations. The instrument in question is not the act of our Nation; we are not parties to its covenants; it has not received the sanction of our people. The makers of it sustain no office nor appointment in our Nation, under the designation of Chiefs, Head men, or any other title, by which they hold, or could acquire, authority to assume the reins of Government, and to make bargain and sale of our rights, our possessions, and our common country. And we are constrained solemnly to declare... this instrument on us... as an act of injustice and oppression.... And, therefore, we, the parties to be affected by the result, appeal with confidence to the justice, the magnanimity... of your honorable bodies, against the enforcement, on us, of the provisions of a compact, in the formation of which we have had no agency. In truth, our cause is your own; it is the cause of liberty and of justice; it is based upon your own principles, which we have learned from yourselves; for we have gloried to count your [George] Washington and your [Thomas] Jefferson our great teachers; we have read their communications to us with veneration; we have practised their precepts with success. And the result is manifest. The wildness of the forest has given place to comfortable dwellings and cultivated fields, stocked with the various domestic animals. We have learned your religion also. We have read your Sacred books. Hundreds of our people have embraced their doctrines, practised the virtues they teach, cherished the hopes they awaken, and rejoiced in the consolations which they afford. To the spirit of your institutions, and your religion, which has been imbibed by our community, is mainly to be ascribed that patient endurance which has characterized the conduct of our people, under the laceration of their woes. We are, indeed, an afflicted people! But we speak to the representatives of a Christian country; the friends of justice; the patrons of the oppressed.... On your sentence, our fate is suspended; prosperity or desolation depends on your word. On your kindness, on your humanity, on your compassion, on your benevolence, we rest our hopes. It is time for the common duty of Patriotism to the Country to succeed;--or if this claim will not be recognized, it is at least time for common sense to acquiesce with decent grace in the inevitable and the irrevocable. Texas is now ours. Already, before these words are written, her Convention has undoubtedly ratified the acceptance, by her Congress, of our proffered invitation into the Union; and made the requisite changes in her already republican form of constitution to adapt it to its future federal relations.... She is no longer to us a mere geographical space--a certain combination of coast, plain, mountain, valley, forest and stream.... She comes within the dear and sacred designation of Our Country; no longer a "pays," she is a part of "la patrie;" and that which is at once a sentiment and a virtue, Patriotism, already begins to thrill for her too within the national heart. Why, were other reasoning wanting, in favor of now elevating this question of the reception of Texas into the Union, out of the lower region of our past party dissensions, up to its proper level of a high and broad nationality, it surely is to be found, found abundantly, in the manner in which other nations have undertaken to intrude themselves into it, between us and the proper parties to the case, in a spirit of hostile interference against us, for the avowed object of thwarting our policy and hampering our power, limiting our greatness and checking the fulfillment of our manifest destiny to overspread the continent allotted by Providence for the free development of our yearly multiplying millions.... It is wholly untrue, and unjust to ourselves, the pretence that the Annexation has been a measure of spoliation, unrightful and unrighteous--of military conquest under forms of peace and law--of territorial aggrandizement at the expense of justice, and justice due by a double sanctity to the weak. The independence of Texas was complete and absolute. It was an independence, not only in fact, but of right.... If Texas became peopled with an American population; it was by no contrivance of our government, but on the express invitation of that of Mexico herself; accompanied with such guaranties of State independence, and the maintenance of a federal system analogous to our own, as constituted a compact fully justifying the strongest measures of redress on the part of those afterwards deceived in this guaranty, and sought to be enslaved under the yoke imposed by its violation. She was released, rightfully and absolutely released, from all Mexican allegiance, or duty of cohesion to the Mexican political body, by the acts and fault of Mexico herself, and Mexico alone.... It was not revolution; it was resistance to revolution: and resistance under such circumstances as left independence the necessary resulting state, caused by the abandonment of those with whom her former federal association had existed. What then can be more preposterous than all this clamor by Mexico and the Mexican interest, against Annexation, as a violation of any rights of hers, any duties of ours? We would not be understood as approving in all its features the expediency or propriety of the mode in which the measure, rightful and wise as it is in itself, has been carried into effect. Its history has been a sad tissue of diplomatic blundering. How much better it might have been managed--how much more smoothly, satisfactorily, and successfully! Instead of our present relations with Mexico--instead of the serious risks which have been run, and those plausibilities of opprobrium which we have had to combat, not without great difficulty, nor with entire success--instead of the difficulties which now throng the path to a satisfactory settlement of all our unsettled questions with Mexico--Texas might, by a more judicious and conciliatory diplomacy, have been as securely in the Union as she is now--her boundaries defined--california probably ours--and Mexico and ourselves united by closer ties than ever; of mutual friendship and mutual support in resistance to the intrusion of European interference in the affairs of the American republics.... California probably, [will] next fall away from the loose adhesion which, in such a country as Mexico, holds a remote province in a slight equivocal kind of dependence on the metropolis. Imbecile and distracted, Mexico never can exert any real governmental authority over such a country. In the case of California this is now impossible. The Anglo-Saxon foot is already on its borders. Already the advance guard of the irresistible army of Anglo-Saxon emigration has begun to pour down upon it, armed with the plough and the rifle, and marking its trail with schools and colleges, courts and representative halls, mills and meeting-houses. A population will soon be in actual occupation of California, over which it will be idle for Mexico to dream of dominion. All this without agency of our government, without responsibility of our people--in the natural flow of events, the spontaneous working of principles, and the adaptation of the tendencies and wants of the human race to the elemental circumstances in the midst of which they find themselves placed. And they will have a right to independence--to self-government--to the possession of the homes conquered from the wilderness by their own labors and dangers, sufferings and sacrifices.... Their right to

12 Westward Expansion and Native Americans 12 independence will be the natural right of self-government belonging to any community strong enough to maintain it-- distinct in position, origin and character, and free from any mutual obligations of membership of a common political body, binding it to others by the duty of loyalty and compact of public faith. Whether they will then attach themselves to our Union or not, is not to be predicted with any certainty. Unless the projected railroad across the continent to the Pacific be carried into effect, perhaps they may not; though even in that case, the day is not distant when the Empires of the Atlantic and Pacific would again flow together into one, as soon as their inland border should approach each other. But that great work, colossal as appears the plan on its first suggestion, cannot remain long unbuilt. Its necessity for this very purpose of binding and holding together in its iron clasp our fast-settling Pacific region with that of the Mississippi valley--the natural facility of the route--the ease with which any amount of labor for the construction can be drawn in from the overcrowded populations of Europe, to be paid in die lands made valuable by the progress of the work itself--and its immense utility to the commerce of the world with the whole eastern Asia, alone almost sufficient for the support of such a road--these coast of considerations give assurance that the day cannot be distant which shall witness the conveyance of the representatives from Oregon and California to Washington within less time than a few years ago was devoted to a similar journey by those from Ohio; while the magnetic telegraph will enable the editors of the "San Francisco Union," the "Astoria Evening Post," or the "Nootka Morning News," to set up in type the first half of the President's Inaugural before the echoes of the latter half shall have died away beneath the lofty porch of the Capitol, as spoken from his lips. Away, then, with all idle French talk of balances of power on the American Continent. There is no growth in Spanish America! Whatever progress of population there may be in the British Canadas, is only for their own early severance of their present colonial relation to the little island three thousand miles across the Atlantic; soon to be followed by Annexation, and destined to swell the still accumulating momentum of our progress. And whosoever may hold the balance, though they should cast into the opposite scale all the bayonets and cannon, not only of France and England, but of Europe entire, how would it kick the beam against the simple, solid weight of the two hundred and fifty, or three hundred millions--and American millions--destined to gather beneath the flutter of the stripes and stars, in the fast hastening year of the Lord 1945! The Red race has disappeared from the Atlantic coast; the tribes that resisted civilization met extinction. This is a cause of lamentation with many. For my part, I cannot murmur at what seems to be the effect of divine law. I cannot repine that is this Capitol has replace the wigwam-this Christian people, replaced the savages-white matrons, the red squaws.... Civilization, or extinction, has been the fate of all people who have found themselves in the trace of the advancing Whites, and civilization, always the preference of the Whites, has been pressed as an object, while extinction has followed as a consequence of its resistance.... The van of the Caucasian race now top the Rocky Mountains, and spread down on the shores of the Pacific. In a few years a great population will grow up there, luminous with the accumulated lights of the European and American civilization. There presence in such a position cannot be without it influence upon eastern Asia.... The Mongolian, or Yellow race is there, four hundred millions in number spreading almost to Europe; a race once the foremost of the human family in the arts of civilization, but torpid and stationary for thousands of years. It is a race far above the Ethiopian, or Black-above the Malay, or Brown, (if we admit five races)-and above the American Indian or Red; it is a race far above all these, but still far below the White and like all the rest, must receive an impression from the superior race whenever they come in contact.... The sun of civilization must shine across the sea; socially and commercially the van of the Caucasians, and the rear of the Mongolians, must intermix. They must talk together, and trade together, and marry together.... the White race will take the ascendant, elevating what is susceptible of improvement-wearing out what is not.... And thus the youngest people, and the newest land, will become the reviver and the regenerator of the oldest.... It is in this point of view.... I look upon the settlement of the Columbia river by the van of the Caucasian race as the most momentous human event in the history of man since his dispersion over the face of the earth.
