2 The Bidders are required to download the Tender Forms for the above items online and also submit their Bids for these items online ONLY (except for Tender Form Fees, which shall be received manually). Manual Bids for these items shall not be considered in any circumstances. Earnest Money Deposit shall be submitted at the above Office before the expiry of Decryption and Re-encryption (Online Bid Submission) stage of the Tender. The online Tenders of those Bidders whose Earnest Money Deposit is not received within the prescribed time limit shall not be considered. The various activities required to be executed by the Bidders to submit their online Bids for these items are time and date locked. The Bidders are requested to execute all the activities related to their bids within the prescribed time limits (key dates) for each stage. 6 Terms & Conditions of Tender for supply of White coloured Course Dolomite Powder to Fertilizer Factories. 1) A tenderer must submit his tender in English and in legible wring preferable typed. 2) A tenderer must quote rates in words as well as in figures rates should be quoted on Factory Delivery Basis. 3) No complaint will be entertained in connection with the tender on any ground after opening of the tender. 4) A successful tenderer will have to give an undertaking in writing that the White colour Coarse Dolomite Powder supplied is ROYALTY PAID and shall mention invoices above remark. 5) A successful tenderer will have to furnish bank guarantee (As per the proforma enclosed) of 5% value of the goods ordered towards the security against the satisfactory compliance of the contract. The bank guarantee should be furnished on non-judicial stamp paper of Rs.100/- should be valid upto. 6) Should the Contractor fails to complete the contract or any part thereof within the period prescribed for such completion, the MAIDC Ltd. shall have any of the following options at its sole discretion. a) To recover from the supplier late delivery penalty charges not less than half Percent per week of the value of contract or portion thereof, subject to a maximum of 5% if the supplier failed to complete as aforesaid for each week during which the completion of such contract may be in arrears. b) To cancel the contract or portion thereof and / or if so decided to proceed with a Fresh contract with alternative sources at the risk and cost of the contractors. c) To treat the default as breach of contract and if so decided to terminate the Contract forthwith-forfeiting security deposit. The penalty/extra expenditure on purchase at the risk and cost of the supplier shall be recoverable form any dues of the supplier with the Corporation against pending bills, deposits etc. either against this or any other contract. 7) The Bank Guarantee will be returned to the party after satisfactory completion of the Contractor. 8) The Corporation reserves the right to accept or reject any tender or part of a tender or to reject all the tenders without assigning any reason for the same. The Corporation reserves the right to divide the tender among several tenderers. On the contrary tenderer is bound to execute the contract after acceptance of this Tender in whole or in part. 9) On acceptance of a tender and after placing of order, a tenderer has to supply the material conforming to the specifications mentioned in the order. If the material supplied is found in tenor in quality the same will be rejected. 10) It is not bind itself to the quantity mentioned above, however, reserves the right to place orders on one or more than one supplier. Also reserve the right to increase or decrease quantity, which will be specified in the purchase order by 5% at the sole absolute discretion and any Such increase / decrease shall be on the same terms & conditions and rates approved..

7 11) If the supplier fails to remove the rejected material from our factory/godown within 15 days from the date of intimation of rejection, after completion of supplies against purchase order for each factory the Corporation may dispose off such material without giving any further intimation to the supplier presuming that he is not interested in the said rejected material. The supplier shall be liable to pay storage 25 paise per tonne, per day after 15th day, till the date of lifting rejection. 12) Neither party shall be liable for any claims for loss damages or compensation Whatsoever arising out of the failure to carry out the terms of this agreement when such failure is due to war. Rebellion, muting civil commotion, fire, not, strike, lockout, lockout, earth-quake of a major breakdown of plant or act of God or due to any restraint or regulation of the State or Central Govt. or local authorities, provided a notice of such occurrence is given to the either party in writing within 10 days from its happening with adequate proof. 13) If at any point, preceding, during or after the currency of the present tender, it is found that concerned suppliers has tired/has approached any of the official of the Corporation to influence outcome of the tender, the suppliers concerned shall be summarily debarred from further dealing with the Corporation. 14) Welfare cess as prescribed by the competent authorities from time to time will be final and binding upon the concerned parties. 15) Due to applicability of Service Tax w.e.f if material is dispatched to our Fertilizer factories on freight to pay basis and release the payment of transportation charges MAIDC shall recover Service Tax as per specified rates and make payment to appropriate authorities.
