Draft Ordinance POLICY & BUDGET INFO Comp Plan Policy Nos. n/a Consistent: n/a Expenditure Required $ n/a Amount Budgeted Other Policies n/a $ 0 SUMMARY STATEMENT The development of a plat to improve a portion of NW James Bush Road has resulted in negotiations between the developer, Summit Homes, and property owners Kendra and Caleb Hug. The Hugs have submitted a petition requesting vacation of approximately 400 square feet of right-of-way on NW James Bush Road adjacent to their property in exchange for a similar area to be dedicated as right-of-way (Exhibit C). The Administration has reviewed the petition and finds it is complete per the requirements of IMC Chapter and has signed the Certification of Sufficiency of Petition (Exhibit A). RCW requires a public hearing established by resolution be held before the City Council as they consider the petition. The proposed resolution sets the public hearing date for the City Council regular meeting of May 2, 2016 beginning at 7:00 PM (Exhibit B). Vacating the proposed portion of right-of-way is not anticipated to impact the operation of NW James Bush Road now or in the future. Compensation of the appraised value of the property being petitioned for vacation is not being sought as a similar property will be dedicated in exchange. The developer, Summit Homes, has paid the administrative costs and the appraisal fee related to the vacation petition. If the vacation is granted as conditioned, an appraisal would not be needed, and return of the appraisal fee would be recommended. If Council chooses to grant the petition, the vacation and any conditions will be authorized by an ordinance, a draft of which is attached as Exhibit C. Council action is not required to accept the right-of-way dedication. Consistency With Comprehensive Plan: Page 3 of 20

6 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ISSAQUAH, WASHINGTON, SETTING A PUBLIC HEARING DATE TO CONSIDER VACATION OF RIGHT-OF-WAY (NW JAMES BUSH ROAD). WHEREAS, a petition signed by the owners of more than two-thirds of the property abutting the street sought to be vacated, located in Issaquah, Washington, and more particularly described in Exhibit A attached and incorporated fully by this reference, was filed with the City Clerk of the City of Issaquah for the vacation of the above described property; and WHEREAS, a Certification of Sufficiency has been signed acknowledging the sufficiency of the Petition for Vacation of Street Right-of-Way; and WHEREAS, the State law requires a hearing on such petition, and the date of such hearing must be fixed by Resolution of the City Council; NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF ISSAQUAH, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. Public Hearing. The City Council Regular Meeting of May 2, 2016 at 7:00 PM in the Council Chambers, located 135 East Sunset Way, Issaquah, Washington, shall be fixed as the time and place for the public hearing and determination by the City Council of said petition. 14 ORDINANCE NO. AN ORDINANCE OF THE CITY OF ISSAQUAH, WASHINGTON, VACATING A PORTION OF NW JAMES BUSH ROAD RIGHT-OF-WAY. WHEREAS, owners of property have presented a petition requesting a vacation of a portion of NW James Bush Road Right-of-Way in Issaquah, Washington, which right-of-way does not abut a body of fresh salt water; and WHEREAS, the Public Works Engineering Director determined that said petition was sufficient; and WHEREAS, the City Council did, by Resolution No approved April 4, 2016, set May 2, 2016 as the date for a public hearing on the proposed street vacation; and WHEREAS, written notice of the public hearing was given by the City in the manner prescribed by RCW ; and WHEREAS, on, May 2, 2016 the City Council held a public hearing and at the conclusion of said hearing determined that the portion of right-of-way should in fact be vacated; and WHEREAS, the City Council has determined that the owner shall pay administrative costs; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ISSAQUAH, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The following portion of street right-of-way located in the City of Issaquah, Washington, legally described and depicted on Exhibit A attached hereto and incorporated herein by this reference as if set forth in full, is hereby vacated; provided, that the {JEH DOC;1/ / } Page 14 of 20
15 City of Issaquah hereby reserves an easement over said vacated street and reserves the right to grant easements in respect to said vacated streets for the construction, repair, maintenance, and access to any and all public utilities and services presently in existence in said area or which may be installed in the future, including, but not limited to, water, storm, sewer, sanitary sewer, power, gas, telecommunication, and other communications systems. Section 2. In lieu of monetary compensation for the vacation, the property owner has agreed to dedicate that certain property legally described on Exhibit B attached hereto and incorporated herein as if set forth in full to the City of Issaquah as public street right-of-way. The City Council finds that the right-of-way to be dedicated is sufficient compensation for the right-of-way vacated and therefore accepts the dedication in lieu of the compensation otherwise provided for in RCW The City Council also authorizes return of the appraisal fee deposited with the street vacation application since no appraisal of the vacated right-of-way is necessary under these circumstances. The City shall retain the nonrefundable street vacation application fee. Section 3. The City Clerk is hereby directed to cause the recording of a copy of this ordinance with the King County Recorder's Office after a deed of dedication is recorded dedicating the property legally described on Exhibit B to the City of Issaquah as public right-ofway. Section 4. This ordinance, or a summary thereof consisting of the title, shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after publication, provided, that the vacation of that portion of NW James Bush Road legally described on Exhibit A shall not become effective until a copy of this ordinance is recorded as provided in Section 3 above. {JEH DOC;1/ / } Page 15 of 20
