The Tenderer(s) should state:- i) Whether he is related to any member of staff working at this farm and if so, what is the relationship. ii) iii) Whether he pays any Income Tax and if so, should furnish the Income Tax payment certificate. Whether he has taken any works in the central Poultry Development Organisation(Southern Region), Hessarghatta, Bangalore in the past, and if so, the name of the works and the year in which it was taken. Transfer or adjustment of Earnest Money or Security Deposit from the one contract to the other shall not be allowed except in very special circumstances. 2. Tenders must be made out on the special form, copies of which can be obtained, from our Website, subject to DD worth Rs. 100/- to be submitted at the time of submission of Tender or on personal application of Rs. 25/- between a.m. to 3.30 p.m. on any working day upto and inclusive of the or by Demand Draft of Rs.100/- by post, and must be submitted in a strong cover securely fastened with a distinctive device and conspicuously marked Tender for the supply of POULTRY FEED INGREDIENTS & DUCK PELLT FEED addressed to the Director, Central Poultry Development Organisation(Southern region), Hessarghatta, Bangalore and not to any Office by name. Tenders will be received upto 3.00 p.m. on. 3. Tenders will be opened by The Director, Central Poultry Development Organisation (Southern Region), Hessarghatta, Bangalore at 3-00 p.m. on 25 th April in the presence of such Tenderer(s) as desired to be present. The tender shall remain open for acceptance till the acceptance letter is sent.

2 4. Each Tender must be accompanied by a deposit of DD in favour of Director, CPDO SR, Hessarghatta, Bangalore. Amount specified for each item as Earnest Money as indicated on next page or other of the following forms: a) DEPOSIT RECEIPT of the State Bank of India, made out in the name of the Pay & Accounts Officer(Acct.), Chennai duly pledged. b) Guarantee Bonds: Executed by the State Bank of India. c) Deposit at Call Demand Draft/Deposit Receipt of any Nationalized Bank duly Pledged to Pay & Accounts Officer(AH&D), Chennai d) EXECUTIVE BONDS: Executed by the Scheduled Bank provided: i) The condition in question is countersigned by the State Bank of India. ii) The Bank concerned pledges with Reserve Bank of India the requisite securities and the latter advises the Farm that the bonds may be accepted. e) NATIONAL SAVINGS CERTIFICATE duly pledged to the Pay & Accounts (AH&D), Chennai The successful Tenderer(s) will be notified of the acceptance of his/their tender(s) in whole or in part. On issue of this notice of acceptance, the tender will become a contract in so far as the notice shows the whole or part of the tender having been accepted and the Tenderer(s) will furnish the required Security Deposit within stipulated time of issue of the notice. The Earnest Money of the successful Tenderer(s) will be returned after the required Security Deposit has been furnished, but will be liable to be forfeited in the event of his/their failing to furnish it within the time specified above. 6. Earnest Money of successful Tenderer(s) will be returned as soon as the Security Deposit has been furnished (unless it be used as part of the Security Deposit or forfeited unless under Clause 5 above) and that of unsuccessful Tenderer(s) will be returned to them as soon as possible after the required Security Deposit has been furnished by the successful Tenderer(s) or the question of allotment or otherwise has been settled. 7. The lowest or any tender will not necessarily be accepted and the Director reserved to himself the right to reject any or all tenders or to accept any tender in part without assigning any reason whatsoever. Acceptance of a tender does not prevent the acceptance of other tenders as well. 8. Tenderer(s) must submit alongwith their tender, proof that they have at their disposal the capital required or carrying the contract. 9. Any erasures or alterations that may have been in the Tender Form before it is received by the prospective tenderer(s) and also any further erasures or alterations(if any)

3 that may be made the course of completing the form should be initialed by the Tenderer(s). 10. If any prospective tenderer(s) is a partner of a firm, each one of the partners must sign the tender, the schedule, and the specifications and the conditions. If any partner be absent, the tender etc., should be signed by his duly constituted attorney. This power of attorney must be submitted for inspection at the time of tendering. If any partner be unable to write, he must fix his left hand thumb impression instead and this impression must be attested by Notary Public or Magistrate authorized to attest documents. Seals will not be accepted as signatures. 11. The amount of Security Money required will be calculated in terms of rupees on the value of the estimated quantity of services to be made or tenders during the period of the contract according to the rates tendered and acceptance of the same. i) For a contract exceeding Rs.10,000/- in value 10% with a minimum of Rs.1,000/ The Security Deposit must be furnished in the form of a) Demand Draft only purchased from any Nationalized Banks in favour of PAO, CHENNAI, payable at STATE BANK OF INDIA. b) A Post Office Saving Bank Account: Duly pledged to the Pay & Accounts Officer(AH&D), CHENNAI c) National Saving Certificate: Duly pledged to the Pay & Accounts Officer(AH&D), CHENNAI d) Deposit at Call/Demand Draft drawn in favour of Pay & Accounts Officer(AH&D), CHENNAI The account must be opened by the depositor himself who will sign the necessary security deposit form (Obtainable from the Post Office). The Passbook duly pledged will then be delivered by the depositor to the Director. 13. The quantities stated in the schedule as Approximate Requirements are only given as a rough guide and no claim for compensation will be made or entertained in case those quantities be overdrawn or under drawn. All indents must be compiled with, whether the quantities demanded therein be within or in excess of the Approximate Requirements. 14. This Call for Tenders form also must be signed by the Tenderer(s) and returned with his/their tenderer(s). 15. The signature(s) of the Tenderer(s) on the tenderer(s) and other forms must be attested by two reputable witnesses in the space provided for the purpose at the last page of the Tender and other forms. Conditional Tenders shall not be accepted.

The quantities stated in the schedule as Approximate Requirements are only given as rough guide and no claim for compensation will be made by me / us in case these quantities be overdrawn or under drawn therein be within or in excess of the Approximate Requirements. 3. I/we shall deliver the supplies at my/our expenses in such quantities at such time, in such manner, to such person and at such place (within the area covered by the Contractor as specified in the schedule) as the Government may direct. Further, in consideration of your agreeing to take from me/us, the entire amount of supplies which the Government may require (other than such as the Government may themselves supply) within the period of contract. I/we bind myself/ourselves not to revoke my/our tender during the above mentioned period.

6 4. I/We furnish, a Security Deposit, within ten days of the issue of the notice of the acceptance of this tender (in whole or part) the sum of Rs. (Rupees ) towards the fulfillment of the terms of the contract. 5. All money or compensation payable by me/us to the Government under the terms of the contract may be deducted from the Security Deposit or from the interest arising there from or from any sums which may be due to me/us by the Government under this or any other account. If insufficient, the balance shall be paid on demand. 6. i) I/We agree to receive payment for the feed ingredient(s) supplied by me/us on pro-rata (proximate payment on the basis of units of proximate principles) contained in the samples basis if the ingredient(s) fall(s) short in analytical composition by only to an acceptable level, as decided by the Government. Double deduction may be made in case of items(accepted due to unavoidable circumstances) which are beyond acceptable limits prescribed. ii) iii) The Government may reject the supplies delivered in whole or in part, in their opinion (which shall be final and conclusive), these are not in all respects in accordance with the contract. The Government shall be under no liability whatsoever for rejected supplies. If rejected supplies are not removed by me/us immediately after rejection, the Government may caused the same to be removed or auctioned at me/our expenses and risk. All expenses of the same to remain on Government premises at my/our risk but will be permitted to charge rent for space occupied at the rate which will be fixed by the Government and I/We shall no claim for the compensation whatsoever. 7. In the event of rejection of my/our supplies as desired in clause 6(ii) above, or of my/our failing, declining, neglecting or delaying to comply with any demand or requisition or otherwise not executing the same in accordance with the terms of the contract, the Government shall be at liberty (without prejudice to any other remedy they may have no account of such breach or non-performance of the contract) to purchase or to procure or to arrange from Government stocks, or otherwise at my/our own expenses such may have been rejected or that we may have failed, declined, neglected or delayed to supply any excess cost so incurred over the contracted price together with all incidental charges and expenses incurred in purchasing or arranging from such supplies and in cases where issues in replacement are made from Government Stocks or supplies, the cost of value of such stocks or supplies, together with all incidental charges and expenses shall be recoverable from me/us on demand. This is without prejudice to the powers contained in clause 8. The Government may rescind the contract by two weeks notice to me/us in writing:- i) If I/We decline, neglect or delay to comply with any demand or requisition in any other way failed to perform or observe any condition of the contract

7 or are in the opinion of the Government which shall be final not likely to carry my/our contract satisfactorily. ii) If I/We assign or sublet my/our contract without the written approval or if I/We attempt to do so. a) If I/We or any of our partners become insolvent or apply for relieve as an insolvent debtor(s) make any composition with my/our creditor(s) or attempt to do so. iii) If I/We or any of my/our agent(s) or servant(s) shall a) be guilty or fraud in respect of the contract or any other contract entered into by me/us with the Government or b) directly or indirectly given promise or offer any bribe, gratuity, gift, loan perquisite, reward, or advantage pecuniary or otherwise to any Officers or person in the employment of the Government in any of way relating to such Officer s or persons office or employment or attempt to do so. iv) If any such Officer or person mentioned in clause 8(iv) becomes in any way directly or indirectly interested in the contract. In case of such recession my/our Security Deposit shall stand forfeited and be absolutely at the disposal of Government with or without prejudice to any other remedy or action that the Government may have to take. 9. Notwithstanding anything therein before contained and without prejudice thereto, the Government may recover from me/us compensation, such sums as they, at their discretion, which shall be final, may consider reasonable. i) If any Government property entrusted to me/us under the contract be lost, damaged or depreciated, unless such loss, damaged or depreciated be due to an act of God or of the Nation s enemies. ii) iii) If any damage be done to the Government s other property from any cause whatsoever arising through the action of myself/ourselves, either my/our servant(s) agent(s) or employee(s). If I/We fail to observe or perform any condition of the contract. 10. Decision as to recovery of the money from me/us in respect of purchase or arrangement at my/our expenses or of compensation by the Government under Clause 7 and or 9 above and any order for recession of the contract by the Government under Clause 8 above shall be final and conclusive. 11. Receipts of supplies delivered will be supplied to me/us by the Government at the time of delivery and I/We shall submit on the first day of the following month, in duplicate, duly supported by these receipts as sub-vouchers my/our bill in English for all

8 supplies duly accepted and payment will be made to me/us soon as possible at a Government Treasury or otherwise at the discretion of the Government. 12. My/Our Security Deposit or the balance thereof, if any remaining at the end of the contract after the penalties imposed if any, under Clause 7, 8 and 9 above have been adjusted shall not be returned to me/us. I/We have executed the usual No Demand Certificate. 13. I/We acknowledge that I/We have made myself/ourselves fully acquitted with all the conditions and circumstances under which the supplies under the contract will have to be made or furnished and with all the terms, clauses, conditions, specifications and other details of the contract and I/We shall not plead ignorance of any of these as excuse in case of complaint against or rejection of supplies tendered by me/us or with a view either to ask for enhancement or any rates agreed to in the contract or to avoiding of any of my/our obligation under the contract. 14. Any dispute or difference arising out of the contract including the interpretation of any clause of this contract, settlement of which is not herein specifically provided for shall be preferred to the arbitration of a person nominated by the Secretary to the Ministry Administratively dealing with this contract or department of the Government of India, for the time being whose decision shall be final and binding on both the parties. 16 SPECIFICATIONS AND CONDITIONS Specifications and conditions referred to in the Tender relating to the supply of Poultry Feed Ingredients and Pellet Feed for Ducks to the Director, Central Poultry Development Organistion(Southern Region), Hessarghatta, Bangalore during the period from to any later date to. 1. Any article(s) stored/stocked by me/us within the boundary of the Central Poultry Development Organisation(Southern Region) Hessarghatta, Bangalore prior to delivery to Government will be stored/stocked at my /our risk. 2. I/We agree to deliver the Poultry Feed Ingredients and Pellet Feed for Ducks as per specifications mentioned in the schedule to tender. However, the sample of the feed will be taken from the stock so delivered by me/us in the presence of the Director or any of his deputy in three separate sealed packets. Two such sealed packets will be delivered to the Director, one for preservation in his office and the other for analysis at the Nutrition Laboratory of Central Poultry Development Organisation (Southern Region), Hessarghatta, Bangalore whose report is binding and final for both parties. If the analyzed feed ingredient(s) delivered by me/us is not according to the specification of the schedule, I /We agree to take back the rejected feed ingredient(s) within specified time from the date of notice of such rejection from the stores/farm premises failing which the Director may impose clause 6(iii) of the Tender for the supply of Poultry Feed Ingredients and Pellet Feed for Ducks. 3. Indents for quantities of article(s) ) etc., required in any month during the currency of this contract will be sent to me/us for as practicable 15 days in advance of the date on which the quantities are required. I/We agree to supply the requirements within 10 days on receipt of the indent for the same and to execute urgent documents for small quantities within one day at Hessarghatta on receipt of indent 1) I/We shall give delivery of all article(s) by the Government Metric system of weights at the place that may be indicated to me/us by the Government or their accredited representative at Hessarghatta. If I/We be unable to attend weightment in person I/We shall depute my/our agent(s) for this purpose. 2) I/We shall delivery materials for weighment working on full working days during office hours. 3) I/We agree to take back the empty bags in which the material is supplied on the day following that on which the supply is made. 4) In the case of the commodities that prices of which are controlled or may be controlled hereafter during the currency of my/our contract or which are purchased

17 by me/us from the local district authorities. I/We agree to deliver such commodities if required at the rates charged by the local district authorities, plus commission at 7% to cover incidental and other charges and I/We shall have no objection, if such commodities are purchased by the Government. 5) Sales-Tax or any other tax on the articles supplied under this contract shall be made payable by me/us and the Government shall not entertain any claim whatsoever in this respect. 6) i) I/We agree to supply the Feed Ingredient(s) as per the standard/ specifications notified to me/us by the Director. iii) iv) ii) I/We agree that the sample of each consignment to be drawn in my presence or in the presence of my/our representative and the sample to be sent to the Central Poultry Development Organisation (Southern Region), Hessarghatta, Bangalore In case I/We or our representative is/are not authorized to send the sample by themselves to the Central Poultry Development Organisation Laboratory and the analysis report thus received will be binding on me/us. I/We agree that in case our consignment is found to be on sub-standard quality as per the report of the Central Poultry Development Organisation Laboratory, I/We shall accept pro-rata deduction in our bills.
