1 ELECTION COMMISSION OF INDIA Nirvachan Sadan, Ashoka Road, New Delhi Tele.No No.203/Pest Control/2014 Dated : TENDER NOTICE Sealed Tenders (two bids system) are invited from experienced and financially sound authorized contractor for cleaning of expansion joint surface to remove all loose materials and bats dropping such as urine and faeces and sealing/ filling the joint and other entry points of bats with EPE Foam applying a coat of DEU PROOF PU and laying of high flexible elastomeric Acrylic coated 12X12 fibre embedded Acrylic sheet without affecting the original features in the structure of the building and without compromising the safety norms of the building. 2. Sealed Tenders with separate envelopes clearly superscripting on it Technical Bid and Financial Bid and duly filled in enclosed proforma in Annexure-I-II respectively and Annexure-I be put in technical bid cover while Annexure-II be put in financial bid cover separately and shall be put together in the third envelope superscripting Technical and Financial Bids for cleaning, filling/sealing of expansion joint in Nirvachan Sadan building. addressed to the Under Secretary (General Administration), Election Commission of India, Nirvachan Sadan, Ashoka Road, New Delhi , should reach the undersigned latest by noon on in Nirvachan Sadan, Ashoka Road, New Delhi. 3. The tenderers can submit the bid either directly or through their authorized representative(s). In case, the tender is submitted by the authorized representative of the tenderers, then the tender shall be signed and submitted by authorized representative(s) under legal power of attorney from the tenderers. The sealed tenders can be submitted in the Receipt & Issue Section located at the ground floor of the Nirvachan Sadan building during normal working hours. 4. Tender receives after the prescribed time and date shall not be entertained. The Election Commission of India will not be responsible for the postal loss/delay. 5. The Technical Bids shall be opened on the same day i.e at 3.30 p.m. in Room No.209-E by a Committee constituted for the purpose by the Commission, in the presence of tenderers or their representative(s) who choose to be present. 6. The Financial Bids of only those tenderers who qualify the conditions of technical bids shall be opened. The date and time for opening of Financial Bids shall be intimated separately. The Financial Bids shall be opened by the Committee constituted for the purpose by the Commission in the presence of those qualified tenderers or their representative(s) who choose to be present.

3 TERMS AND CONDITIONS FOR TENDER Period to get the Blank Tender Form and to related documents at Election Commission of India on all working days (except Saturday/Sunday/Holidays) Time of submission of completed Tender Upto noon on Date & time of opening of Tender at 3.30 p.m. Availability of Tender Document in Website 1. Tenderers shall submit their quotations/rates per item/individual job basis for the whole work. 2. Validity of Contract : The contract, if awarded, will be initially till the completion of work, subject to satisfactory performance However, on failure on this aspect by the contractor, the Election Commission of India has the right to terminate the contract forthwith and security deposit will be forfeited. The Commission may also take further action such as deemed fit. 3. Responsibility for executing contract : The contractor is to be entirely responsible for the execution of the contract in all respects in accordance with the terms and condition as specified in the Tender. 4. The contractor shall not sublet, transfer or assign any part of the contract thereof to any third party without prior written permission of the Election Commission of India. In the event of the contractor contravening this condition, the Election Commission of India be entitled to initiate such administrative action as may be deemed fit. 5. The Election Commission of India reserves the right to award any or part or full contract to any successful agency(ies) at its discretion and this will be binding on the tenderer. 6. In case of failure of the agency to comply with the provisions of the terms and conditions mentioned in the contract, the Election Commission of India reserves the right to award the contract to the next higher tenderer or outside agency and the difference of price will be recovered from the defaulter agency who has been awarded the initial contract and this will be binding on the tenderer. 7. Arbitration : In the event of any question, dispute or difference arising under these conditions or any special conditions of the contract, or in connection with this contract, the decision of Election Commission India shall be final and binding. 8. Assistance to contractor : The contractor shall not be entitled to assistance either in the procurement of raw materials required for the fulfilment of the contract or in the securing of transport facilities. 9. Inspection : The work shall also, in any case be liable to inspection by the Election Commission of India Authority after execution and any item(s) not found as per specification/quality shall be rejected and the firm shall has to re-execute the same at their own cost and risk and shall be liable for such rejection otherwise. 10. The agency shall be responsible to arrange at its own cost all necessary tools and appliances required for execution of the work.

4 11. The Commission will bear no liability of any kind for any casualty /physical injury suffer by any worker during the course execution of the said work 12. During execution of said work there would be no damaged to the original structure of the building. 13. The contractor would also be able to pay damages to Election Commission of India in case of any loss or damage to the Nirvachan Sadan building its, people or resources during or as a result of this work. 14. The contractor would be required to coordinate with CPWD as and where necessary in relation to this work. He would also have to work at such times and under such conditions as prescribed by the Election Commission of India looking into Election Commission of India work requirements. 15. Complete payment only on 100% completion of work. 16. Taxes will be deducted as applicable as per Govt. Rule. 17. The contractor shall give an undertaking of lasting solution to the problem not less than 5 years. The contractor shall maintain the work for the next one year without any extra cost. 18. In case of failure to rectify on existence of problems as described above after completion of the work, the Bank Guarantee would be liable to be forfeited and encashed by the Election Commission of India after a written notice of one month, Election Commission of India would be free to get the work done/improvements made at the risk & cost of the contract within or beyond the amount of the Bank Guarantee as may be needed.

Details description of work TECHNICAL SPECIFICATION FOR EXPANSION JOINT BETWEEN mm. PREPRATION OF EXPANSION JOINT: 1. Repairing and if required removal of existing concrete from the joint. 2. Cleaning of joints surface to remove all loose material, previous coating, paint and dust etc. and bats dropping of urine and faeces and to keep them out of the building by sealing entry points. 3. Preparation of groove of respective size. 2. EXPANSION JOINT TREATMENT 1. Filling the joint with EPE Foam. 2. Applying a Coat of DEUPROOF PU on either side of the joint and laying of Acrylic sheet. 3. Applying 2 coats of DEUPROOF SP once the Acrylic sheet is stuck with DEUPROOF PU and dried up. I/We hereby undertake that we shall make good any loss/damage caused the above work or any other property of the Government thorough our negligence. I/We also undertake that the decision of the Under Secretary (General Administration), Election Commission of India, Nirvachan Sadan, Ashoka Road, New Delhi in this regard as well as the matter of dispute arising due to the provision of this contract shall be final and binding on us. The rates quoted by me are valid and binding upon me for the entire period of contract and it is certified that the rates quoted and the lowest quoted for any other institution in India. C.
