Online Digitally signed tenders are invited by undersigned for supply of veterinary medicines i.e Mineral Mixture ISI Mark Type-II (without salt) to institutes under Maharashtra Livestock Development Board, Akola and Vety. Institutes under Animal Husbandry Department. The tenders are invited in the prescribed tender format from manufacturers and authorized dealers/distributors, by way of online two bid system for fixing Rate Contract for a period up to June,2013. The Tender Form along with Terms & Conditions can be purchase & downloaded from MLDB s etendering Portal w.e.f to by payment of Rs. 5000/- (Rs. Five thousand only) as the cost of tender form in the form of Demand Draft. The Demand Draft should be drawn in favor of Chief Executive Officer, Maharashtra Livestock Development Board, Akola, Payable at Akola. This amount is non-refundable. The Online tender form duly filled, should prepare on above mentioned etendering Portal on or before (SCHEDULE BID PREPARATION DATE) & submit on same site on or before (SCHEDULE BID SUBMISSION DATE). 3 GENERAL TERMS & CONDITIONS FOR SUBMITTING TENDER 1 ITEMS UNDER TENDER PROCESS FOR FIXING RATE CONTRACT Items with specifications for which rates are being called are given in Annexure A appended to this tender Packaging Details- Packing should be of standard type and acceptable to the Road transportation or Railway Authority and Government Insurance Fund similarly and it should be easy for handling. 2 ELIGIBILITY FOR PARTICIPATION IN TENDER PROCESSa) Original manufacturers with valid manufacturing license as issued by FDA or authorized distributor/dealers having authorization from original manufacturing companies can participate in the tender process with valid manufacturing license of the original manufacturing companies issued by FDA for the items under "Annexure A are eligible to submit the tenders. i) Such manufacturers or authorized distributor shall submit tender in their own name and seal of firm / manufacturing unit. ii)no Conviction Certificate having any remarks about pending court cases against the tenderer will render him ineligible. The commercial bids of such tenderer will not be opened in case such tenderer have pending court cases in any court, lodged by FDA that are mentioned in non conviction certificate (issued by FDA). b) It must be noted that the tenderer should not have been black-listed/debarred by any Government Agency / Institutions of local self Government / Public Sector in India under any contractual relation with them or facing process of penal action as such on complaints of quality. In such cases undersigned reserves the right for insisting upon submission of Good Performance Certificate issued by any such agency. c) The registration certificate of manufacturing company must indicate the date of production of the items shown in Annexure- A is commenced. Only provisional Registration of the item without commencement of production is not sufficient. d) The bidder company should clearly state so if his firm is registered with NSIC/SSI Unit or has paid Earnest Money Deposit e) The drugs for which the rates will be quoted by the bidder, must be manufactured by the bidder for at least three consecutive years from the date of tender. 3 HOW TO GET BLANK TENDER FORMS- The Tender form along with Terms & Conditions can be purchase & downloaded from MLDB s etendering Portal by paying Rs. 5000/- (Rs. Five thousand only) as the cost of tender form in the form of Demand Draft. drawn in favor of Chief Executive officer, Maharashtra Livestock Development Board, Akola, payable at Akola. This amount is non-refundable. 4 SUBMISSION OF SAMPLES- Sample of each item for which rate is quoted must be submitted giving the required information in the format at page no. 13, along with completed tender forms. Bidders are required to bring along with them attested copy of Manufacturing License valid for each sample. They should obtain a receipt for the same format at page 13 and submit a copy of the said receipt in Technical Bid.. Sample should be submitted on from am to 5.00 pm, at the office of the Chief Executive Officer, Maharashtra Livestock Development Board, Akola. This is mandatory. All the columns in the format should be completely filled in. In case of need of more rows, separate sheet having same information headings may be attached. Any Alteration in the format at page 13 may result in rejection of tender. 3

4 The rates will be considered for the medicines for whom the samples are submitted / accepted. 5 EARNEST MONEY DEPOSIT (EMD)- a) Earnest Money Deposit of Rs. 10,00,000/- (Rs.. Ten Lakhs) only in the form of Demand Draft of any nationalized bank, payable to the Chief Executive Officer, Maharashtra Livestock Development Board, Akola should be submitted along with tender form as per instructions. Cheques and cash will not be accepted at any stage and in that case tender will be rejected b) The manufacturing firms located in Maharashtra & Registered with DGS & D (if item quoted is manufactured by them in Maharashtra will be exempted from payment of EMD) c) The SSI units registered with NSIC, SSI Govt. of India for their manufacturing items only will be exempted from payment of EMD. In such cases, the bidder must submit Exemption Certificate from concerned authorities in order to grant validity to the claimed exemption. d) Valid Certificate indicating Registration No. & Date of registration as mentioned above should be furnished in each case failing which the tender will not be considered. For this purpose attested Photostat copy of valid registration certificate stating items manufactured should also be accompanied with tender. If the tenderer is not registered as above or has not paid E.M.D. his tender will not be considered. e) The EMD is liable to be forfeited to Govt. Of Maharashtra in case the rates quoted by the tenderer are approved but the party refuses to enter into the agreement. 6 LAST DATE AND PLACE OF SUBMISSION OF COMPLETED TENDER FORMS The Online tender form duly filled, should prepare on above mentioned etendering Portal on or before (SCHEDULE BID PREPARATION DATE) & submit on same site on or before (SCHEDULE BID SUBMISSION DATE). The tenders will be opened online possibly on (SCHEDULE TENDER OPENING DATE) in the Office of Office of Chief Executive Officer, Maharashtra Livestock Development Board, Akola 7 MANNER OF SUBMISSION OF COMPLETED TENDER FORMS- a) Tenderers should submit online tenders on above mentioned department s etendering Portal using Valid Digital Signature Certificate issued by Government of India authorized Certifying Agency s DSC. b) Accordingly, rates quoted for the items in ANNEXURE A, should be submitted in online commercial form (C1), using Digital Signature Certificate. All other required documents such as tender Form Registration Certificate, a copy of terms and conditions duly signed, Certificates from Director General of Supplies and Disposals, demand draft and all other documents supporting the Eligibility criteria for participation in tender process (Eligibility participation in tender process no. 2 - a to e and EMD ) etc. should be uploaded in technical envelope (T1). Attested photocopy of above mentioned document needs to uploaded and tenderer need to produce documents in original, If department wants to see. It may be noted that while opening the tender online, Technical Bid will be opened in the first stage. Commercial Bid will be opened only after ascertaining whether the tenderer has fulfilled all requisites terms and conditions. The tenderer not fulfilling any of the requisites terms and conditions will be rejected and no further claim will be entertained. C) Technical Bid :- Envelope no 1 marked AS TECHNICAL ENVELOPE. It contains technical information in the form of following documents. All the photo copies uploaded in Technical Bid. Should be duly certified/attested by Gazetted Officer/ Notary and the originals should be kept ready for submission on demand. Failure to enclose the certified /attested copies of following certificates will make the tender form liable for rejection. i. Manufacturing license issued by FDA along with list of approved products. This license should cover-up the medicines for which samples are submitted by the tenderer. The 4

5 ii. iii. distributor should submit the manufacturing license of the manufacturing company for the items they are authorized. Recent and valid License wise GMP(wherever necessary) preferably with products(for which the rates will be quoted by the bidder) issued by FDA(valid GMP means certificate on which period of validity is mentioned and valid on the date of tender or certificate must have been issued on or after by FDA), Non-Conviction Certificate, Drug wise Free Sale Certificate as well as Drug wise Performance Certificate - these three certificates as issued by FDA after for the products for which rates will be quoted. The Non-Conviction Certificate, Drug wise Free Sale Certificate and Drug wise Performance Certificate issued by FDA before will not be considered. These documents must mandetorily be submitted, failing which the tender will be rejected. Analysis Reports by in-house quality control laboratory of Manufacturers for the samples of products for which rates will be quoted. iv. Articles of association and memorandum of association of bidding firm. v. Sale Tax Registration of Unit with no. or TIN Certificate valid on the date of filing or valid certificate for exemption of Sales Tax. In case of filing Application for obtaining TIN with the concerned authorities, attested Xerox copy indicating receipt of such an application by the office of such authority must be submitted. vi. vii. Last annual report and audited financial statement of bidding firm. Earnest Money Deposit :- (1) Demand Draft of Nationalized Bank (of Rs.10,00,000/-) (Rs. Ten lakhs). drawn in the Name of "Chief Executive Officer, Maharashtra Livestock Development Board, Akola " or (2) Certificate for exemption of Earnest Money Deposit - To avail this, please attach exemption certificate from concerned authorities viii. Details of samples submitted be enclosed in the prescribed format at page no. 13 This is mandatory. ix. Product Catalogue and or Information brochure x. Details regarding participation in earlier tenders by this office or Commissioner of Animal Husbandry, Maharashtra State if any. xi. Details of earlier rate contract with this office & or Commissioner of Animal Husbandry, M.S.if any. xii. If item is under the Contract, rate contract copy should be attached. xiii. you may attach information as stated above and number the same pages xiv. Tenderer must fulfill all entries in the check list to confirm the exact follow up of process. The tender form must be indexed and page nos. from 1,2,3,... must mandatorily be entered at relevant places in the check list. All columns of the checklist must be filled in. The checklist must be placed at page no. 1. xv. a) Duly Signed terms and conditions, along with Tender Form. The declaration by the tenderer must be signed director /proprieter of the company. This is mandatory. b) All the Xerox copies submitted along with the tender form must be attested by a Government Gazatted Officer or be notarized. This is mandatory xvi. xvii. Self declaration indicating date of start of the firm and starting of production for the products intended to be quoted by the firm. This is mandatory The Declaration by the tenderer must be signed director / proprietor of the company. This is mandatory. 5

6 d) Commercial Bid :- Commderial Bid should contain rates quoted only on prescribed priced tender form. Rates not quoted in priced tender form or quoted on separate paper will not be considered and the tender form will be rejected. The rates should be quoted as directed. Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the rights to call for break up of abatement wherever necessary. This envelope should be marked AS COMMERCIAL TENDER ENVELOPE e)envelope No.1 and No.2 should also be sealed separately and again be put together appropriately into 3 rd big envelope and sealed and on left hand upper corner the details of tender inquiry and date of tender opening shall be marked. The full name and address of the tenderer along with phone number, fax number, id shall be written on the left-hand bottom of each envelope. The envelope should be addressed to the Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola f) No tenders will be accepted after stipulated date & time. similarly no request for extension of time will be considered. g) The firm who makes any undue effort to bring the pressure from out side or from any departmental authority will be liable for outright rejection. h) Tenders not submitted AS per the above-prescribed manner will be treated AS invalid. 8 SUBMISSION OF SAMPLE- Samples should be submitted along with tender and it is mandatory. Tenders without samples will not be considered. Samples should be affixed with a label showing :- a. Name and address of the firm. b. Tender No. and item Serial number c. Opening date of tender. 9 HOW TO QUOTE RATESa) Rate should be quoted F.O.R. Destination. Rates should be quoted as. Tender Rate + VAT or Taxes applicable = Final Rate Tax structure as per VAT / CST as applicable, must be followed. b) The tenderers are free to quote for all items in the tender or any part of the items c) Breakup may however be given separately indicating the rates of duties, taxes etc. against concessional form. d) F.O.R Destination rates would be on the basis of supplies to be made at _various destinations in Maharashtra State which may go upto district level. e) If the item /items is /are covered under D.G.S. & D. rate-contract, the tenderer should quote D.G.S. & D. Rate-contract, Nos. and furnish other relevant particulars along with the copy of the rate-contract. f) Rates should be written in clear and readable writing. Any correction should be duly countersigned. Correction in rates by over writing will not be accepted. 10 FALL CLAUSES :- a) It is a condition of the contract that all through the currency thereof, the price at which you will supply the stores should not exceed the lowest price charged by you to any customer during the currency of the rate contract and that in the event of the prices going down below the rate contract prices you shall promptly furnish such information to us to enable to amend the contract rates for subsequent supplies. 11 PRICE VARIATION (ESCALATION)- a) Increase in rate on any account such as increase in input cost etc will not be at all, admissible. b) The tenderer will not quote or offer less price than the approved price in relation with this tender and agreement to any agency / institute concerned with Government of Maharashtra or Government of India or supply the same medicine to any of its distributor / dealers /whole- sellers at a lower rate, (after applying all relevant discount structures) during the contract period including 6

7 extension if granted, failing which the tenderer will have to accept the lesser price for all the orders concerned during the contract period. 12 OPENING OF TENDERS- Opening of tenders shall be done on above mentioned department s etendering Portal on at11.00 hours, in the Office of the Regional Manager, Frozen Semen Laboratory, Mula Road, Khadki, Pune-3. Every bidder is at liberty to remain present or authorize his / her (only one ) representative to be present at the opening of the tender at the time and date specified. 13 ACCEPTANCE OF TENDERS - a) The Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right to call for break-up of the quotations wherever necessary. b) Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola does not pledge himself to ace pt the lowest tender and reserves to himself the right of accepting the whole or any part of the tender or portion of the quantity offered against any item and tenderer shall supply the same at the rate quoted c) The Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right of accepting the whole or any part of the tender or to refuse all tenders without assigning any reason. 14 SIGNING OF AGREEMENT a) Successful tenderers (authorized Director / Proprietor as detailed under condition no. 14-c) shall have to come to the Office of the Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola, for completing formalities of Agreement Bond as and when called, preferably within 10 days of acceptance of tender and also will have to deposit security deposit equal to 3% of the total value of the order or Rs. 1,00,000/- in the form of TDR /Bank Guarantee. b) The successful tenderer may appoint distributor for better distribution. They should give them the authorization. Later the bill will be made by distributor and payment will be made to distributor. c) Only the Director / Proprietor as authorized by due resolution in this context is allowed to sign the agreement on behalf of the successful tenderer. Any other person whether authorized or not authorized, will not be eligible to sign the agreement on behalf of the successful tenderer. EMD of Rs. 9,00,000/- will be forfeited in case of failure to sign the agreement in proper way. The tenderer may also be blacklisted in such case. d) The security deposit will be returned after 6 months period after successful completion of three year period of rate contract i.e. up to Hence security deposit should be of 36 months. Indemnity bond will be required to be given by the party agreeing and assuring that in case of any complaint of losses the same will be paid by the contractor to the Chief Executive Officer, Maharashtra Livestock Development Board, Akola. e) Security Deposit will stand forfeited to Chief Executive Officer, Maharashtra Livestock Development Board, Akola in case of any breach of terms and conditions of the tender and / contract. 7

8 f) The successful tenderer should have their distribution depot location or carrying and forwarding agent in state of Maharashtra for execution of order and avoid delay in supply. The tenderer may request to make payment on his behalf to the concerned CFA in working or on the bond. 15 INDENTING PARTIES- Chief Executive Officer, Maharashtra Livestock Development Board, Akola / OR Any other Officer authorized by Chief Executive Officer, Maharashtra Livestock Development Board, Akola shall be the indenting officers for the items under the contract. 16 DEMAND AND SUPPLY SCHEDULEa) Successful tenderer will have to supply the goods as per order placed, within the stipulated period mentioned in the supply order and { if not mentioned (period of 3 weeks ) } failure to do so, the penalty of 0.5% of value will be charged subject to a maximum limit in case of an order not exceeding rupees one lakh in value of 10 per cent and in case of an order exceeding rupees one lakh in value of five per cent of the stipulated price of the stores so undelivered, will be charged per week or part thereof, for late delivery of goods till the date of its supply/receipt b) There is possibility of repeat order within the validity period of the tender. c) The Contractor will have to necessarily supply the medicines of the same quality, make as have been specified in his bid. 17 TO WHOM & BY WHOM BILLS TO BE RAISED AND PROCEDURE THEREOF- Bills must be raised by successful bidders - contracting company under its own letter head to indenting agency. and payment against the same will be made in the name of contracting successful bidder. 18 TAX DEDUCTIONS FROM BILLS- Appropriate Income Tax will be deducted at source for jobwork. 19 QUALITY CONTROLa) The stores should be, in case the supplier has manufacturing unit in India, got inspected by DGS & D before dispatch & the cost of the inspection will be borne by the supplier as per DGS & D Rules. b) 1% of number of units / quantity supplied in any or each order shall be taken as random sample by person authorized by undersigned, under intimation to the supplier or his representative and same will be got tested at any of the labs approved by Government of India or its agencies, and the cost of such inspections will be borne by the successful tenderer. 20 MODE OF PAYMENTa) Payment shall be made by indenting officer on production of bills raised by the contracting company. All payment shall be made in the name of contracting company only. The payment shall be made after analyzing the field samples by Govt. accredited laboratory or Govt. approved laboratory. b) As the payments are made from Chief Executive Officer, Maharashtra Livestock Development Board, Akola, the undersigned shall not be responsible for delay in receipt of grants from Government or procedural delay due to treasury operations which is beyond direct control of undersigned or indenting officer / agency. Any delay over and above 45 days from submission of completed bills for any other reason within control of indenting agency shall be liable for interest payment. 8

9 21 PENALTY CLAUSE- In case, contracting party fails to deliver the consignment thereof within the contracted period of delivery or in case the goods are found not in accordance with the prescribed specifications and / or as per approved samples and / or analysis reports the Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola shall exercise his discretionary powers to take one or more of the following actions. Any loss, penalty imposed on supplier shall be deducted from the bills payable to him to the extent of bill amount and any other amount due to contractor under the same or any other contract with the undersigned or any of the indenting agency. a) To recover from the contractor as liquidated damages a sum equivalent to half percent subject to a maximum limit in case of an order not exceeding rupees one lakh in value of 10 per cent and in case of an order exceeding rupees one lakh in value of five per cent of the stipulated price of the stores so undelivered, will be charged per week or part thereof, for late delivery of goods till the date of its supply/receipt and / or, b) To purchase such medicines from any other sources and at such price as the purchasing officer in his sole discretion feels fit and to recover the differences of cost if any from the tenderer. The additional amount of expenditure incurred over and above approved rates will be liable for recovery from the approved tenders. The defaulting contractor will be penalized to the extent of differences in the rate or 100% of the value of the order. If action as above to be taken If the defaulting contractor fails to pay penalty he will be permanently de-listed from the list of approved contractors of any Department of Maharashtra Govt. / Central Govt. and security deposits of the contractor will be forfeited to Government. c) To forfeit the security deposits of the contractor to Chief Executive Officer, Maharashtra Livestock Development Board, Akola d) Cancel the contract e) Black list/ debar the supplier f) The tenderer will replace the medicines lost / broken during transit, free of cost 22 FORCE MAJEURE : If, at any time during the continuance of this contract the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of the public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lock outs or acts of God ( hereinafter referred to as events) provided notice of happening of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof, neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other in respect of such non performance or delay in performance; and deliveries under the contact shall be resumed as soon as practicable after such event has come to an end or ceased to exist, and the decision of the purchasing officer as to whether the deliveries have been so resumed or not, shall be final and conclusive, provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days, either party may at its option terminate the contract provided also that if the contract is terminated under this clause, the purchaser shall be at liberty to take over from the contractor at a price to be fixed by the purchasing officer which shall be final all unused, undamaged and acceptable materials, bought out components and stores in course of manufacture in the possession of the contractor at the time of such termination or such portion thereof as the purchaser may deem fit accepting such material, bought out components and stores as the contractor may with the concurrence of the purchaser elect to retain. 23 PERIOD OF VALIDITY OF RATE CONTRACT- The contract shall be valid for two years from date of contract (ie upto ). However, the said Rate Contract may be extended by the undersigned for further three to six months period as desired by competent authority which will be binding on the supplier at the same approved rate and at the same terms and conditions 9

10 24. SETTLEMENT OF DISPUTESa) All disputes between indenting agencies and the supplier shall be settled by the undersigned. However, the disputes between the contractor and the undersigned or the appeal against the decision of undersigned in disputes referred to him shall lie with the Secretary / Principal Secretary, ADF, Mantralaya, Maharashtra State, Mumbai-32 b) Judicial proceedings, if any, can be started only in Courts of the State of Maharashtra. at Dist. & Sessions Court, Akola only 25 REMOVAL OF DIFFICULTY- The dates quoted in the tender form are subject to change in the event of any holiday abruptly declared by Govt. Undersigned shall take such decisions to remove difficulties due to ambiguity of provisions in the tender documents or due to provisions which are inconsistent with the objective of this tender. 26 If any company has not given satisfactory performance during previous years Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right to reject its Tender. 10

11 DECLARATION OF THE TENDERER 1. That I/We am / are the director / proprietor of the firm.. That I/We hereby submit tender to the Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola for the Supply of Veterinary Medicines for the year That I/We have read the terms and conditions as mentioned in this tender form carefully and that I shall/we will abide by to all the terms and conditions contained therein. 2. That I am/ We are well acquainted with the facts about the firm and the information provided in the tender form is true and correct. 3. That the drugs quoted in this tender are manufactured for at least three consecutive years from the date of tender and I am holding the manufacturing License/Authorization certificate as a distributor from the manufacturing company in my/company s name the such quoted drugs are manufactured in the plant/unit owned by me / company 4. I/ we may be punished as per law for any wrong information misleading facts provided in the tender form besides rejection of my/our tender 5. In case of any disputes the jurisdiction will be Akola only. 6. Force majeure conditions contained in the manual of office procedure for purchase of store for Govt. Department 1978, page No.99, Appendix xxxi is accepted by Company. 7. I/ We am/ are bound to supply medicines to the allotted districts of the Maharashtra State on the same terms and conditions and on the same rates as approved in the rate contract for further 3-6 months, if Competent authority - Chief Executive Officer, Maharashtra Livestock Development Board, Akola at his discretion desires to give extension to the said rate contract over and above the period of tender.
