6 PIFGTagging Challenge2016 TaggingChallenge PIFG,inpartnershipwiththeS.TokunagaStoreandShimanoAmericaCorp,hasbroughtbackuluaand papiotagginginthestateofthehawaiibyreintroducingthetaggingchallengeinthe2016tokunagaulua Challengetournament.Asthefirstmajorlocalshorelinetournamentof2016,theTaggingChallenge providestournamentparticipantstheopportunitytodemonstrateresourceconservationandcontribute fisheriesscience.itisaprivilegetohaveshimanoamericacorp.asaproudpartnerinlaunchingthe TaggingChallengeastheyhaveactivelydemonstratedtheircommitmenttofishingandsustainingour fishingcultureandtraditionsforthefuture. Tagsand150taggingkitswillbedistributedonafirstcome,firstservedbasis.Sobesuretosignupearly. Prizeswillbeawardedduringthe2016UluaChallengeawardsceremonies. 7 RELEASE AND INDEMNITY Having received, read and understood a copy of the same, the undersigned hereby agrees to comply and abide with all the rules and regulations of the Pacific Islands Fisheries Group Tagging Challenge (PIFG-TC). I understand that participating in a fishing tournament and the PIFG-TC may be dangerous and could result in personal injury, including death, as well as loss of property. On behalf of my heirs and personal representatives, I hereby release the PACIFIC ISLANDS FISHERIES GROUP ( PIFG ), each of its members, sponsors, and contributors from any and all; property damage and injuries, including death, which I may suffer in connection, or as a result of my participation in the PIFG-TC. On behalf of myself, my heirs, and personal representatives, I further agree to indemnify and hold harmless each and every one of the aforementioned from and against any loss, damage, cost, judgment, or payment of any kind of nature, made by myself, my estate, or any person or entity in my connection with injury, including death, or property loss, which I may suffer or incur as a result of my participation in the PIFG-TC. For valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I hereby give and grant to PIFG, its affiliates, successors and assigns, and those acting under its permission or upon its authority (collectively, Releasees ), without reservation, the irrevocable, perpetual, worldwide, freely transferable, royalty-free, full and unrestricted right and permission to take, make, record, copyright, use, re-use, publish, republish, publicly perform, broadcast, transmit, display, adapt, sell, rent or upload audiovisual works, phonorecords, photographic portraits or pictures of me or in which I may be included, or of other indicia of my identity (such as my voice, signature or other characteristic or identifying attribute) of myself or of my property, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my name, a fictitious name, or no name, in all media now known or hereafter invented, and in all channels of trade, together with the right to use the same alone, or incorporated with other materials or works, even though the same may subject me to embarrassment, ridicule or scorn. I waive any right to receive any royalties or other compensation arising or related to the use of such works, and I hereby assign all copyright rights and other rights I may have therein to PIFG. I hereby waive all of my publicity, privacy and other rights, and any rights to inspect or approve the finished reproductions, derivative works, recordings, testimonial or other matter, or other works, that may include, or be used in conjunction with, my name or likenesses or other indicia of identity, or the eventual uses to which they may be applied. I hereby release, discharge, and agree to save harmless and defend Releasees from and against any liability arising from such use, and from any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in connection with the taking or making of said works, or in any subsequent copying, recording, adaptation, modification or processing thereof, as well as in any use, public performance, broadcast, transmission, display or publication or other use in connection with this release, including without limitation any claims for libel or violation of any right of publicity or privacy. This agreement constitutes the entire agreement between PIFG and me and I am not relying on any other representations, whether oral or written. This agreement shall be interpreted and enforced under the laws of the State of Hawaii. The courts of the State of Hawaii, and the United States District Court for the District of Hawaii, and no other courts, shall have exclusive original jurisdiction over any disputes relating to this agreement, and I hereby irrevocably agree to such jurisdiction and venue. I hereby certify that I am of full age (at least 18 years old), have not registered my right of publicity, and have full legal capacity to execute the foregoing authorization and release, which is hereby made binding upon me, my heirs, personal representatives, devisees, successors in trust, successors and assigns.
