1 Walk to Make Cystic Fibrosis History T-Shirt Contest Rules & Regulations CONTEST: The following rules and regulations are applicable to the contest described hereafter (the Contest ), which is being conducted by Cystic Fibrosis Canada ( CF Canada ) in connection with CF Canada s Walk to Make Cystic Fibrosis History, which is scheduled to take place on May 27, 2018 (the Walk ). The Contest will consist of a t-shirt design competition. Up to 5 designs (as chosen by CF Canada staff members) will be put forward for public voting to select a final winner with the goal of community input and community building. The Contest period begins at 12:00:01 a.m. Eastern Standard Time ( EST ) on January 2,2018, and ends at 11:59:59 p.m. (EST) on February 9, 2018 (the Contest Period ). ELIGIBILITY To be eligible for entry in the Contest, an individual must be a resident of Canada from the start of the Contest Period. Eligible participants must also be over the age of majority in the province of their residence by the end of the Contest Period or have the permission of a parent or guardian to accept the reward, if won. Employees of CF Canada or the sponsors and prize partners of the Walk, employees of any affiliates of CF Canada or such sponsors and prize partners, and the immediate family members of any such employees (father/mother, brother/sister, son/daughter, spouse) or persons living under the same roof as any such employees are not eligible to win prizes in connection with the Contest. HOW TO ENTER THE CONTEST No purchase is required. Entry Details: To enter the Contest, an individual must create a design that adheres to the t-shirt contest guidelines, which can be found at: (the Contest Guidelines ). A design must be in the format, size and resolution described in the Contest Guidelines or it will not be considered as a Contest entry. Designs must be ed to walk@cysticfibrosis.ca by 11:59:59 p.m. (EST) on February 9, Designs submitted after such time and date will not be accepted for entry in the Contest. All designs that are submitted in accordance with the Contest Guidelines will be considered by the judges selected from CF Canada s staff. WINNER SELECTION: All valid entries will be judged by members of CF Canada s staff based on, among other things, the following criteria: 1. the Contest Guidelines; 2. creativity; and 3. how the design represents the Walk. Up to 5 designs will be chosen by CF Canada staff and put forward for an online public vote on the Walk website ( The decisions of the Contest judges are final in respect of any matter relating to the

2 Contest. The public will have 2 weeks to vote for their favourite design. The design that received the greatest number of votes will be featured on t-shirts that are created in connection with the Walk occurring on May 27, The designs that are selected for public voting will be identified by February 15, Public voting will occur between February 15, 2018 and March 1, The design that receives the highest number of votes will be announced the week of March 5, The winner and/or a parent or legal guardian of the winner will be contacted directly by telephone or by a representative of CF Canada and must reply within 48 hours of being contacted to maintain eligibility. If the potential winner or, as applicable, a parent or legal guardian of a potential winner cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her entry will be declared null and void and CF Canada may select the design that received the next highest number of votes as the Contest winner. PRIZE Credit card gift card valued at $ Feature on the Cystic Fibrosis Canada Blog Feature in the summer/fall 2018 issue of Connections In order to accept a prize under this Contest, the winner and/or parent or legal guardian, if applicable, must sign a declaration form, in form specified by CF Canada, within 48 hours of being notified that they have won. Prizes will not be awarded and the winner will not be announced until the declaration form has been signed. If a potential winner is unable or unwilling to accept or otherwise redeem any prize on the terms it is awarded, the prize shall be forfeited. The prize cannot be transferred or substituted. SUBMISSION REQUIREMENTS: By submitting a design to CF Canada in accordance with these Contest rules and regulations, an individual (the Entrant ) and, as applicable the Entrant s parent or guardian, acknowledges and agrees that each design submitted to the Contest (each, a Submission ) shall be the property of CF Canada. Each Entrant and, as applicable, the Entrant s parent or guardian agrees, and further warrants and represents, that any Submission the Entrant submits: (a) is an original work of the Entrant and that the Entrant has all necessary rights in and to the Submission to: (i) submit the Submission to CF Canada as a Contest entry; and (ii) allow CF Canada to use the submitted design in connection with the Walk as described herein and any future CF Canada event or promotion, as may be determined by CF Canada at its sole and absolute discretion; (b) has not been entered in any other contest, won any other prize or been previously published in any other medium; (c) does not violate any applicable law; (d) does not contain any reference to any identifiable third parties, unless consent has been obtained from each such third parties; (e) will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; (f) is owned by the Entrant or the Entrant has the necessary licenses, rights, consents and permissions to use and authorize CF Canada to use all copyright, trademark or other proprietary rights in and to the Entrant s Submission to enable inclusion and use of the Submission in the manner contemplated by these Contest rules and regulations; and

3 (g) is not defamatory, or obscene, and further that it will not contain, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by CF Canada in its sole and absolute discretion. CF Canada reserves the right to reject, remove and disqualify any Submissions that could be offensive or inappropriate or that do not meet the terms and conditions of these rules and regulations. RELEASE, LICENSE TO USE COPYRIGHT AND WAIVER OF MORAL RIGHTS By providing a Submission to CF Canada, each Entrant and/or the Entrant s parent or legal guardian, if applicable, irrevocably: OTHER RULES (a) authorizes CF Canada to use the Submission, including without limitation the Entrant s, name, city and province/territory of residence, photograph, image, picture, portrait, likeness, and statements (together, Material ) in connection with CF Canada s business, including without limitation for this Contest, the Walk, or for general advertising and promotional purposes, in any and all forms of media now owned or hereafter invented, without further notice, review, approval, consent or compensation; (b) grants CF Canada a perpetual, irrevocable, worldwide, royalty-free exclusive license to publish, use, reproduce, copy, display, distribute, edit, merchandise or modify any Entrant s design in connection with this Contest, other marketing and advertising purposes, or for any other reason or purpose, and each Entrant waives any and all moral rights he/she may have in any design submitted or any element thereof. Each Entrant and/or the parent or guardian of the Entrant, if applicable, agrees to complete and sign all documents necessary to confirm the rights granted to CF Canada under these official rules and regulations; and (c) consents to the use of the Entrant s design on t-shirts or other merchandise, in advertisements for CF Canada, and to the posting of the Entrant s design in print and online in CF Canada s and its affiliates publications, websites and in social media without any further notice, review, approval, consent or compensation. In addition, each Entrant and the Entrant s parent or legal guardian, if applicable, acknowledges and agrees that publishing the design in print and posting the design online brings that design within public view, and CF Canada will not be held liable for any copying, reproducing, re-posting, or unlawful use of any published or posted design, or any other injury, damage or loss to any Entrant or any other person that may result therefrom. a) The decisions of CF Canada with respect to the Contest will be final and binding on all Entrants. b) CF Canada with its respective employees, directors, officers, agents, representatives, successors and assigns, and all of their respective employees, directors and officers (collectively, the Releasees ) shall not bear any liability for or in connection with (a) Contest entries which are lost, stolen, delayed, not received, destroyed, or illegible, incomplete or otherwise improperly completed, (b) any faulty electronic data transmission, equipment failure or other online communication problems, or any other difficulties of whatever nature in the administration of the Contest; (c) loss, theft, use or misuse of any prize, (d) damage to a user s system; and (e) any property damage, personal injury, death, loss or misfortune in any way attributable to this Contest or any prize or its awarding, acceptance or use. Contest entrants release the Releasees from all liability relating to or arising in connection with the Contest and/or the prizes. Contest entrants also agree not to make any claim against any of the Releasees or any third party in respect of any matter relating to or arising in connection with the Contest and/or any prizes. By entering this Content, each Entrant grants CF

4 Canada the right to use the Entrant s name, the fact that Entrant is the winner of this Contest (if applicable), the Entrant s city name, photo and/or likeness, without further compensation, in advertising or publicity announcing the winner of the Contest. Such announcement may be made in a Walk or CF Canada newsletter and/or on the Walk or CF Canada website at c) Prizes include only what is specifically described in these rules and regulations and no other allowances will be granted. The prizes may not be exchanged or refunded for an amount of money, sold or transferred. d) Without limiting any other provision of these Contest rules, CF Canada reserves the right to substitute any prize or any part of any prize with one of equal or greater value, without notice. e) Illegible, fraudulent or mutilated entries are void. f) This Contest is subject to all applicable federal, provincial and local laws. g) Refusal to accept a prize releases CF Canada from any obligation toward the winner. h) Individuals found tampering with or abusing any aspect of the Contest, including but not limited to acting in violation of the Contest rules, or to be acting with the intent to disrupt the normal operation of the Contest, as determined by CF Canada, will be disqualified. The discovery of any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Contest will void any attempted participation effected by such methods and the disqualification of the contestant utilizing the same in CF Canada's sole and absolute discretion. i) CF Canada reserves the right to cancel or suspend this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, CF Canada reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. j) With respect to the personal information that an Entrant is providing in order to enter this Contest, such personal information (a) will be collected and used by CF Canada to administer this Contest, and (b) may be used and disclosed by CF Canada to send to the Entrant information about similar future events in support of CF Canada, provided that the Entrant is not considered to be a minor in the Province or Territory of the Entrant s residence. If an Entrant does not wish the Entrant s information to be used for either or both of the purposes set out in the preceding sentence, please call CF Canada at k) If an Entrant wins a prize through this Contest, the fact that the Entrant is a winner in this Contest, the Entrant s name, city name, photo and/or likeness, may be used and disclosed by CF Canada to its advertising and promotional agencies and/or any media, for the purpose of advertising and publicity announcing the winner of the Contest. l) CF Canada reserves the right to amend the Contest rules or to terminate the Contest at any time without any liability to any Entrant. Any amendments to these rules and regulations will be posted on CF Canada s website. m) By entering, you agree to abide by the Contest rules and regulations and the decisions of CF Canada, which decisions are final and binding on all Entrants. n) CF Canada may, in its sole discretion, prohibit any person from entering the Contest whom it believes to be abusing the rules. Such abuse includes but is not limited to entering false information.
