1 esapeake h VIRGINIA ity v 44 w Docket Item A1 Office of the ity Attorney 36 edar Road hesapeake Virginia Fax February TO Mayor Krasnoff Vice Mayor de Triquet and Members of the ity ouncil Re ONSIDERATION OF A REQUEST TO AUTHORIZE THE DIRETOR OF THE DEPARTMENT OF PUBLI UTILITIES TO DISUSS WITH THE HAMPTON ROADS SANITATION DISTRIT HRSD THE EXPANSION OF THE HRSD SERVIE AREA TO INLUDE THE OLAH PROPERTY The Department of Public Utilities received a request from W Pete Burkhimer of Engineering Services for the expansion of the HRSD Service Area to serve the proposed residential development of the Olah property A rezoning application R 1325 has been filed by The Miller Group of Virginia LL to rezone the property from A1 Agricultural 51 9 acres and R15 Residential District 1 8 acres to R12s Residential for the development of approximately 11 single family homes The property is located off Johnstown Road south of Hanbury Road Approximately 22 of the site is located outside of the HRSD Battlefield Boulevard Interceptor and cannot be served with public sewer unless the Service Area is expanded The request is made under the ity s Service Area Expansion Policy adopted by the ity ouncil in 1997 The Policy states that where an expansion of an HRSD service area is proposed the landowner or authorized agent shall henceforth submit the request for expansion to the ity ouncil for approval or denial In reviewing the request the ity ouncil may consider i the extent to which ity utility facilities must be installed altered or upgraded to accommodate the expansion and any adverse impact the expansion may have on functional or operational integrity of the ity utility system and 2 the fiscal obligations to be assumed by the ity in operation and maintenance of utility facilities installed to accommodate the expansion of the service area The ity of hesapeake adheres to the principles of equal employment opportunity This policy extends to all programs and services supported by the ity

3 esapeke VIRGINIA E 1 1 UM Department of Public Utilities TO James E Baker ity Mana VIA FROM Amar Dwarkanath PE Deput David Jurgens Utilities Director 44 anager DATE February RE Olah Property Request to Allow Discussion with Hampton Roads Sanitation District REOMMENDATION Staff recommends that this item be placed on the ity ouncil Agenda to permit Public Utilities to discuss the requirements for extending HRSD Service Area to the Olah Property Project BAKGROUND In 1997 ity ouncil established a policy copy attached whereby ouncil authorization is needed before staff can discuss the feasibility and requirements of allowing a development outside the HRSD service area as it existed in 1997 to be provided with sewer service This consideration is separate from but connected to the evaluation of whether a property can be provided service in the Public Utilities Franchise Area as defined in the omprehensive Plan We have received a request from Mr W Pete Burkhimer PE representing The Miller Group of Virginia LL He is the contract purchaser of land on Johnstown Road tax parcel numbers also known as the Olah Property This property is currently the subject of rezoning application R The parcel consists of approximately 18 acres is currently zoned R15s and 51 acres zoned A1 for a total of 519 acres The proposed rezoning for the property is to R12s for the construction of 11 single family detached residential dwellings DISUSSION This proposed development is within the existing Public Utilities Franchise Area see attached map but is partly outside the HRSD service area The developer proposes to construct an onsite ity standard sewer pump station and install a sewer force main that will connect to the existing ity sewer force main in Johnstown Road No plans or street layout have been submitted for the project When compared to similarly sized projects we estimate the developer will construct approximately 5 linear feet of water main and gravity sewer main within the project Discussions are needed with HRSD to determine whether there is adequate capacity in their facilities to allow this or whether other facilities would be needed Adding this area to the HRSD Service Area does not create any adverse impact on the functional or operational integrity of the ity s utility system Once the discussions are completed ity staff will include the findings of those discussions in the evaluation of the rezoning request

6 SERVIE AREA EXPANSION POLIY The ity of hesapeake city recognizes that the Ha pton Roads Sanitation District HRSD has established service areas for its sewage disposal force mains inter ceptors and gravity sewer lines collectively referred to herein as force main or force mains These service areas generally extend one mile from an HRSD force main The ity also recognizes that from time to time a landowner or authorized agent will request HRSD to expand its service area beyond the onemile limit to serve a particular piece of property proposed for development Such expansicns usually require additions or alterations to ity utility facilities including ity pump stations and sewer lines Due to this direct impact on the ity s public utility system the ity ouncil deems it necessary to review and analyze all proposed expansions of HRSD areas service For purposes of this policy an expansion shall include any extension of sewage disposal ocrviceo to a property located in whole or in part farther than one mile of an existing HRSD force main In cases where a service area currently extends beyond this one mile limit an expansion shall be deemed to occur if sewage disposal services are offered to any property outside the boundaries of the HRSD service area as it exists on this 21st day of

7 October 1997 The service areas of ity pump stations shall not be considered in determining the current boundaries of an existing HRSD service area Where an expansion of an HRSD service area is proposed the landowner or authorized agent shall henceforth submit the request for expansion to the ity ouncil for approval or denial In reviewing the request the ity ouncil may consider the following factors and criteria 1 The extent to which ity utility facilities must be installed altered or upgraded to accommodate the expansion of the HRSD service area and any adverse impact on the functional or operational integrity of the ity utility system which may be generated by the expansion of the HRSD service area 2 The fiscal obligations to be assumed by the ity in the operation and maintenance of ity utility facilities installed altered or up graded to accommodate the expansion of the HRSD service area as weighed against the public benefit to be realized by the expansion of the HRSD service area All requests for the expansion of an HRSD service area shall be processed within a reasonable time period in no event 2

9 1 Li engineering services inc J January ivil Engineering Lend Surveying Honorable Alan P Krasnoff Mayor And ouncil of the ity of hesapeake Virginia co Mr David Jurgens P E Director Department of Public Utilities P O Box hesapeake VA Reference R13 25 Olah Property Request for Expansion of HRSD Service Area Dear Mayor Krasnoff oundi Members and Mr Jurgens Gerard P erunick Jr LB Walton P Burkhlmer Jr PE Sharon D Hoe1 PE Michael Rheeinhert L5 Edward F Rudiger Jr LEI First to Mr Jurgens welcome to hesapeake It is a wonderful ity and i know you will enjoy being part of its leadership team 1 look forward to meeting you in person For everyone s reference i enclose a copy of the HRSD Service Area Expansion Policy the Policy adopted by hesapeake ity ouncli on October On behalf of the owners and applicant of the rezoning case numbered Rc13 25 we hereby request that the ity concur in the expansion of the Hampton Roads Sanitation District HRSD Service Area to include the entirety of the parcels which are the subject of that rezoning appiication that is Tax Parcels and 685 The intent of the Policy is very dear it assures there is no extension of public sewer service In leapfrog fashion well beyond the typical and customary principle of one mile from the nearest HRSD force main without careful scrutiny by ity ouncil In the subject case the Oiah Property the opposite is true its development is In no respect a leapfrog and could fairly be caiied infill Please consider the following points A Force Main Most 78i of the property is already within 1 mile of the HRSD Battlefield Boulevard interceptor 8 The small portion which Is outside the 1 mile line isn t far beyond it Of the area to be developed into lots ail is within 1mile Public sewer service has already reached much farther down Johnstown Road than the Oiah Property The Stonegate subdivision developed more than 2 years ago Is a halfmile farther out D No new ity utility facilities must be instaiied aitered or upgraded to accommodate this requested minor expansion of the HRSD service area There is already a 14 ity sewer force main along the entire frontage of the Ohah Property extending beyond it to Stonegate All that is required Is for the Oiah Property to build a sewage pumping station to serve itself and a reasonable additional area per Public Utilities policies just as it would if it no HRSD service area expansion were at Issue E The 14 force main in Johnstown Road was designed for future connection by other pump stations to serve additional areas it passes by such as the Oiah Property F Although a ity force main the 14 line In Johnstown is big enough to be an HRSD line there are several HRSD lines in hesapeake as small as 12 in diameter If this existing 14 force main were an HRSD line there wouid be no one mile rule issue In this case 3351 Stoneshore Road Virginia Beach VA FAX emeii@esiofva com
