Chris Mulholland, 505 Piping Rock Drive, representing Veterans of Foreign Wars (VFW) Post Council Member Ritter, on a motion seconded by Council Member Ike, moved to approve the Resolution, as presented. Mayor Krasnoff advised that Chesapeake was ranked #7 as best in the nation for Veterans in Council Member Ike asked that the Resolution be amended to specify two signs instead of one be placed on U.S. Route 17 South. Council Member Ritter, as maker of the motion, agreed to the amendment. There was no additional discussion. On the motion to approve the Resolution, as amended, voting yes: Council Members Craig, Davis, de Triquet, Ike, Kelly, Krasnoff, Ritter, Ward and West. CITIZENS COMMENTS ON THE SERVICES, POLICIES, AND AFFAIRS OF THE CITY (NON AGENDA SPEAKERS) Acting City Clerk Pender identified the following speakers: Max Bartholomew, 4901 Princess Anne Road, Virginia Beach, representing Dominion Virginia Power, requested concurrent advertising for UP , Western Branch High School Solar Project. Council Member Davis read the following abstention statement: I am abstaining from participating in this vote on concurrent advertising to avoid any appearance of impropriety arising out of my ownership of stock in Dominion Virginia Power and its affiliate companies. The City Attorney has confirmed that

8 my abstention is consistent with the objectives of the Virginia Conflict of Interests Act. Council Member Ward, on a motion seconded by Vice Mayor de Triquet, moved to approve the concurrent advertising request for UP-15-35, Western Branch High School Solar Project. 9 UNFINISHED BUSINESS A. RECONSIDERATION OF R(C) Johnstown Road Rezoning APPLICANT: VLP Associates, LLC AGENCY: ShepelleWatkinsWhite Consulting & Law PLLC PROPOSAL: A conditional zoning reclassification of an 8.4± acre parcel dual-zoned A-1, Agricultural District and R-15s, Residential District, to R-10s, Residential District, to construct 22 single-family homes. PROPOSED COMP LAND USE / DENSITY: Low Density Residential with something less than 4 dwelling units per acre EXISTING COMP LAND USE / DENSITY: Low Density Residential with something less than 4 dwelling units per acre LOCATION: West side of Johnstown Rd TAX MAP SECTION/PARCEL: BOROUGH: Pleasant Grove (Continued from the June 9, 2015 City Council meeting) The Planning Commission recommended approval with the following proffers: 1. The applicant/owner agrees to make a cash contribution the City of Chesapeake for capital improvements to public school facilities, public transportation facilities, public libraries, and public emergency service facilities. The amount of the voluntary cash contribution shall be $4, per residential dwelling unit. The applicant/owner agrees to make the proffered cash contribution prior to the issuance of a certificate of occupancy for each residential dwelling unit, or building containing residential units. The applicant/owner acknowledges and agrees that the cash contribution may be deposited into the City of Chesapeake s lock box, also known as the General Fund Reserve for Future Capital Needs and shall be subject to City Council approval prior to appropriation and used for capital improvements as permitted by the Chesapeake Proffer Policy and state law. The cash proffers may be used for alternative improvements approved by the City Council under Section of the Code of Virginia, including major repairs and renovations of public facilities, to the extent permitted by state law. The cash proffer shall be allocated as follows: Schools, $1,591; Transportation, $1,454; Libraries $570; Emergency Services $ The applicant/owner agrees that the total number of residential units on the property subject to this rezoning, R(C)-15-03, shall not exceed twenty-two (22) units. 3. The applicant/owner agrees that the single-family detached dwellings shall have a minimum square footage of 2,000 square feet for a one story house and 2,400 square feet for a two story house. The applicant/owner further agrees to the following conditions as detailed in this proffer and agrees that these conditions are subject to the review and approval of the Director of Planning or designee. a. Siding materials shall consist of brick, stucco, cementitious siding, stone, and/or premium vinyl (minimum 0.044' thickness). Brick and stone as used in the foregoing shall mean individual, layed-up masonry and not simulated or panelized product.

10 b. Two siding materials may be used, however, one siding material must compromise at least 75% of the exterior surface and the second siding material will be considered accent. c. All roof shingles shall be architectural grade (25 year minimum; not single-layer, '3-tab'). d. Foundations shall be crawl or 16 inch raised slab (finished floor at least 16" above outside grade) with brick skirts that are required on the front and two sided of the house. The applicant/owner shall provide a sample of all of the proffered architectural materials to the Director of Planning or designee for review and approval prior to final site or subdivision plan approval. e. The applicant/owner agrees that all dwelling units shall be constructed substantially in conformance with the elevations dated March 24, 2015 on file with the Planning Department. 4. A conceptual site plan prepared by Parrish Layne Design Group and entitled Conceptual layout for VLP Associates, LLC, Tax Parcel , Pleasant Grove Borough, Chesapeake, Virginia, date stamped March 24, 2015, a copy of which is on file with the Chesapeake Planning Department, has been submitted to the Chesapeake Planning Department, Planning Commission and City Council for illustrative purposes only and to provide support for this rezoning action. No rights shall vest nor any cause of action shall arise from the submission, review or acceptance of this conceptual site plan. However, the applicant/owner agrees to provide connectivity as generally shown on the conceptual plan. In order to obtain preliminary or final

11 site or subdivision approval, changes in the conceptual site plan will be necessary to accommodate environmental, engineering, architectural, topographic, or other development conditions, and to meet the requirements of applicable laws, ordinances and regulations. All preliminary and final site and subdivision plans are subject to the approval of the Director of Planning, or designee and/or the Director of Development and Permits or designee. A copy of the final approved site plan shall be placed in the file with the Planning Department and the Department of Development and Permits and shall supersede any previously filed conceptual site plan. Acting City Clerk Pender presented the item. Council Member Davis, on a motion seconded by Council Member Ritter, moved to deny R(C) Council Member Davis spoke to his opposition of the project siting traffic concerns in the surrounding area. Council Member Ike called Ms. Shepelle Watkins-White to the podium for additional questions. There was discussion between Council Member Ike and Ms. Watkins- White concerning the traffic that would be generated from the proposed rezoning. Council Member West reviewed the traffic level of service, discussed infill development, the need for growth and the support from the adjoining neighbors. He indicated his support for the rezoning request. Council Member Ritter discussed the reason for the reconsideration request, timing of the rezoning, possible upcoming school redistricting, roads, traffic, water and sewer issues and expectations of the citizens being met. There was discussion between Mayor Krasnoff and Director of Development and Permits Jay Tate about the need to identify areas that were available for development. Additional discussion ensued about traffic level of service classifications and what each classification encompassed. Mayor Krasnoff requested that staff create a map detailing areas ready for development with all the amenities in place naming roads, water and sewer and school needs. Additional discussion ensued between Council Member Davis and Mr. Tate concerning the current level of service on Mount Pleasant Road and the needed improvements to that corridor. There was no additional discussion. On the motion to deny R(C)-15-03, voting yes: Council Members Craig, Davis, de Triquet, Krasnoff and Ritter. Voting no: Council Members Ike, Kelly, Ward and West. Mayor Krasnoff asked City Council Members for any additional Unfinished Business. There was none offered. NEW BUSINESS A. AN ORDINANCE AMENDING CHAPTER 74 OF THE CHESAPEAKE CITY CODE, ENTITLED TRAFFIC AND VEHICLES, SECTION THEREOF, TO PERMIT A MAXIMUM SPEED LIMIT OF SIXTY-FIVE MILES

12 PER HOUR ON THE INTERSTATE SYSTEM OF HIGHWAYS AND OTHER LIMITED HIGHWAYS WITH DIVIDED ROADWAYS; SUBJECT TO A TRAFFIC ENGINEERING STUDY AND ANALYSIS OF AVAILABLE AND APPROPRIATE ACCIDENT AND LAW ENFORCEMENT TRAVEL. (Mayor Krasnoff) Acting City Clerk Pender presented the item. Council Member Ward, on a motion seconded by Council Member Craig, moved to continue the Ordinance to the August 11, 2015 City Council meeting. On the motion to continue the Ordinance to the August 11, 2015 City Council meeting, voting yes: Council Members Craig, Davis, de Triquet, Ike, Kelly, Krasnoff, Ritter, Ward and West. B. RESOLUTION REQUESTING THE DESIGNATION OF U.S. ROUTE 17 SOUTH AS A BLUE STAR MEMORIAL HIGHWAY AND AUTHORIZING THE CITY MANAGER TO TAKE ALL NECESSARY ACTION TO ACQUIRE, INSTALL AND MAINTAIN ONE OR MORE HIGHWAY MARKERS COMMEMORATING THIS DESIGNATION. (Mayor Krasnoff) (This item was considered before Non-Planning Public Hearing Item (A). Mayor Krasnoff asked Council Members for any additional New Business. Mayor Krasnoff asked that a work session on speed limits be scheduled for a future meeting. He requested that staff prepare a report explaining the traffic level of service classifications and maps displaying possible development areas including the current amenities in place. Council Member Davis requested that a Resolution be drafted for demolishing the Western Branch Theater; a report on an alternate bid for the 24 waterline on the Dominion Boulevard extension; Portsmouth Boulevard Corridor Study Task Force finding reports for further review and an amendment to Section 62 of the City code concerning setbacks for solid waste management facilities and include any/all stakeholders. Council Member Ike requested an amendment be drafted updating the definitions and classifications of Solid Waste Management facilities since some of the definitions were outdated as far as new waste disposal and recycling technologies were concerned. Council Member Ritter asked that citizens be kept in the mix when considering the amendments to the Solid Waste codes and the possible procurement issues. Council Member Ward discussed the Western Branch Task Force and suggested that the Economic Development Authority be consulted with those past findings. There was no further New Business

13 CLOSED SESSION City Attorney Proctor advised there would be four Closed Session topics and provided the following language for the consideration: to i) discuss the appointment of a city clerk; ii) discuss the disposal of publicly held real property where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body; iii) discuss a prospective business or the expansion of an existing business where no previous announcement has been made of the business interest in locating or expanding facilities in the City; and iv) consult with legal counsel pertaining to actual or probable litigation where such consultation in an open meeting would adversely affect the negotiating or litigating posture of the public body, and consultation with legal counsel employed or retained by the City regarding specific legal matters requiring the provision of legal advice by such counsel, as permitted by Section (A) (1), (3), (5) and (7) of the Code of Virginia. Council Member Ward, on a motion seconded by Vice Mayor de Triquet, moved approval of the Closed Session topics. On the motion to approve the Closed Session discussions, voting yes: Council Members Craig, Davis, de Triquet, Ike, Kelly, Krasnoff, Ritter, Ward and West. Voting no: City Council convened the Closed Session at 8:11 p.m., and reconvened the meeting at 8:48 p.m. CERTIFICATION OF THE CLOSED SESSION City Attorney Proctor read the following regarding the closed session certification: The Chesapeake City Council hereby certifies that to the best of each member s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered. Council Member Ike qualified his certification to state that he did not participate in a portion of the discussion concerning the potential expansion of an existing business where no previous announcement had been made. Council Member Ike did not participate in the discussion in order to avoid any appearance of impropriety due to his business relationship with one of the existing businesses in question. Council Member Ward, on a motion seconded by Vice Mayor de Triquet, moved to approve certification of the Closed Session discussions. On the motion to approve certification of the Closed Session discussions, voting yes: Council Members Craig, Davis, de Triquet, Ike, Kelly, Krasnoff, Ritter, Ward and West.
