1 TO: FROM: Office of Treaty Settlements Tūhoronuku Independent Mandated Authority DATE: November 2015 SUBJECT: Mandate Maintenance Report 7: September November 2015 PURPOSE This Deed of Mandate (DOM) Maintenance report is provided to the Office of Treaty Settlements (OTS) from Te Rōpū o Tūhoronuku Independent Mandated Authority (Tūhoronuku IMA) as the group mandated by Ngāpuhi for negotiations with the Crown. This report fulfils the requirements of the Office of Treaty Settlements for Tūhoronuku IMA to report on DOM maintenance for the period September November This report is provided as a condition of the Crown s recognition of the DOM. Summary of achievement throughout the reporting period Since the last report dated 9 August 2015, Tūhoronuku IMA has undertaken the following activity: Updating Ngāpuhi The Tūhoronuku Independent Mandated Authority (Tūhoronuku IMA) remains committed to updating Ngāpuhi on a regular basis through updates on our website, monthly newsletters and regular pānui and regional hui with all our stakeholders. Tūhoronuku IMA Update Hui in Australia Two (2) meetings were convened July 2015 in Perth and Sydney, Australia respectively which completed the round of update hui to all Ngāpuhi for the 2014 period. During these hui the Tūhoronuku IMA invited discussion on the Post Settlement Governance Entity (PSGE) and encouraged people to consider their aspirations for a Ngāpuhi post-settlement entity. 2 Presentation To ensure consistency the same presentation was delivered at all update hui with: Kaumātua Kuia, in the five (5) regions and the urban areas, and in Perth and Sydney. Additional information was provided about the mandated Hapū Kaikōrero elections process. Hapū Kaikōrero Nominations & Elections As reported in our last Maintenance report No.6, a new round of Hapū Kaikōrero elections were held. Again, it is important to note that following those elections twenty nine (29) valid nominations were received for twenty seven (27) hapū, bringing the total of sixty nine (69) hapū out of the one hundred and ten (110) in support of the Tūhoronuku IMA. Hapū Kaikōrero elections were required to elect one representative for each of the following hapū. Matarahurahu Election hui confirmed for 19 th August 2015, Oromahoe Marae. Ngai Tāwake Election hui confirmed for 20 th August 2015, Kohewhata Marae. Two representatives from each hapū were nominated. Following the withdrawal of one candidate from each hapū, the remaining nominees were duly appointed as the Hapū Kaikōrero: Matarahurahu: William Tane Ngai Tāwake: Adrianne Taungapeau Mandated Hapū Kaikōrero Induction An induction for the 27 newly elected mandated Hapū Kaikōrero was convened on the 15 th August The induction was aimed at welcoming Hapū Kaikōrero to Tūhoronuku IMA and broadening their understanding of the settlement negotiations environment in which they will all be operating and the work-streams that lay ahead. As part of the induction Hapū Kaikōrero met with the Negotiators, key staff from the Project team and the Deputy Secretary Lead Negotiator, Nigel Fyfe and his team. The mandated Hapū Kaikōrero all received information that will assist them in their roles. Resignation During the reporting period Tūhoronuku IMA received written notification from Stewart Otene of his resignation as the Hapū Kaikōrero for Te Uri Māhoe. Election of Chairperson and Deputy Chairperson As per the Tūhoronuku IMA Trust Deed, the annual election of Chairperson and Deputy Chairperson was completed on the 11 th September 2015 with the board electing Hone Sadler, Chairperson and Kara George, Deputy Chairperson. Replacing the Acting Chairperson Sam Napia and Deputy Chairperson Moana Tuwhare. Kaumātua Kuia Hui On the 9 th October 2015, a hui was convened with Ngāpuhi Kaumātua and Kuia to convey the outcome of the election and to present an update and the next steps moving forward. 3 Election of Chair and Deputy Chair; Waitangi Tribunal s Ngāpuhi Mandate Urgent Inquiry Report; and Tūhoronuku IMA s response to the tribunal s recommendations, the Ngāpuhi Outreach / Engagement Plan lead by Moana Tuwhare and small committee of Board members. The Kaumātua Kuia Hui resolved that: 1. They receive the report; 2. The issues of the Waitangi Tribunal s Ngāpuhi Urgent Hearing report be addressed by the Tūhoronuku IMA board. Tri-Partite Engagement Plan The Waitangi Tribunal released its urgent report on the Ngāpuhi Mandate on Friday 11 September On the 11 th September 2015, the Tūhoronuku IMA board agreed to establish a committee of Trustees to engage with hapū who are in opposition to Tūhoronuku. This committee is led by Moana Tuwhare and includes Tame Te Rangi, Helene Leaf, Bill Hori, Mere Mangu and Nora Rameka. The purpose of the committee is to engage with hapū opposing Tūhoronuku to discuss what it might take for them to come on board. In line with this, the Tūhoronuku IMA developed and agreed to a Tri-partite Engagement plan that included the Tūhoronuku IMA, Te Kotahitanga and the Crown. At the time of drafting this report the plan was still to be signed off by the three parties. Communications The three month reporting period saw intense communications activity, with a focus on: keeping Ngāpuhi fully abreast of settlement developments; Ngāpuhi settlement entity Tūhoronuku IMA welcoming the Waitangi Tribunal report; the results of a second round of Hapū Kaikōrero elections; - increased hapū represented to 69); refer to appendix 1 New Ngāpuhi settlement leadership meet with Minister for Treaty Negotiations; Ngāpuhi settlement Agreement in Principle could be reached in 2016 Minister for Treaty of Waitangi Negotiations. A detailed communications report has been prepared - see Appendix 2 Pānui (including website updates) Website: The website s homepage focus from August to October was the release of the new leadership of Tῡhoronuku IMA, increased hapū engagement, and a new round of hapū elections. Due to the Horizon Poll survey results which showed 65% of Ngāpuhi prefer to be communicated via , a Subscribe to our E-pānui tab has been created on the website homepage to encourage increased activity. A Freephone and service is published on website to give assistance to those Ngāpuhi wanting more information about the Ngāpuhi Tūhoronuku IMA Maintenance Report 7: 10 August 9 November

4 Facebook: Tūhoronuku Ngāpuhi Twitter: #tūhoronuku The Tūhoronuku IMA has completed updates for this reporting period. settlement. A Contact Us tab is accessible on the website homepage for all enquiries. Tūhoronuku Pānui E-pānui were circulated for September and October giving an overview of activity. This is distributed to 8,000 subscribers on the first Friday of every month. The pānui is also posted on the Tūhoronuku website and Facebook page. Pānui are also sent to subscribers during the month when there are significant matters to keep all Ngāpuhi informed. All pānui are posted on the Tūhoronuku website, Facebook page and referenced on Twitter. E-Pānui were distributed in August, September and October. Facebook The Tūhoronuku facebook TM page has been dramatically improved by our social media coordinator and has grown to over 5000 likes, through networking and engaging our Hapū Kaikōrero and hapū whānau networks, utilizing attractive graphics on the page. It is updated regularly with Ngāpuhi and Tūhoronuku IMA news, also statements and relevant media coverage. Media Activity Twitter All statements and pānui were tweeted on the Tūhoronuku Twitter page. 31 Media Statements were distributed during the three month period, some of which have been picked up by Māori and mainstream media. All were posted on the Tūhoronuku website, Tūhoronuku Facebook page and Twitter; also forwarded within Ngāpuhi internet networks. Te Rūnanga-ā-iwi o Ngāpuhi media vehicles - All Tūhoronuku IMA media statements have been distributed through Rūnanga media vehicles, and featured in the weekly E Mara e-pānui with a database of Some media statements also featured on the Rūnanga website. Beneficiary Register The Tūhoronuku IMA has advised the Crown that it will not be developing and maintaining a beneficiary register. Te Rūnanga A Iwi O Ngāpuhi (Rūnanga) has agreed Tūhoronuku IMA may have access to its database of registered members (50,000) for the purpose of communicating major decisions. Provision for this is via the Memorandum of Understanding signed between the Rūnanga and the Tūhoronuku IMA. As per previous reports: Access means that at any time the Tūhoronuku IMA has information to be sent to Ngāpuhi, this information will be provided to the Rūnanga for mailing to their members. Access does not mean, the Rūnanga will export or transfer their registration database details to the Tūhoronuku IMA. In lieu of a beneficiary register, the Tūhoronuku IMA does maintain a database of Ngāpuhi who have signed Hui attendance registers, for communication purposes. 5 The Project Team continues to work with the Crown Forestry Rental Trust (CFRT) to complete activities on approved contracts and develop applications for further funding. The following is a summary of the status of funding applications and approvals: Crown Forestry Rental Trust (CFRT) TIMA Funding for Agreement in Principle (AIP) Total funding of $1,016,000 has been approved, this includes specialist advice of $49,800, with the balance for operational funding. This contract is currently in progress through to June Timeframes will be reviewed as negotiations progress. Crown Forestry Rental Trust (CFRT) TIMA Funding to Scope Research Requirements for Settlement Total funding of $54,948 was approved. This contract was completed on 26 August Tūhoronuku IMA have submitted a business case that requests funding from the Crown Forestry Rental Trust for research and mapping to support settlement negotiations with the Crown. Crown Forestry Rental Trust (CFRT) TIMA Specialist Advice Funding for Agreement in Principle (AIP) A funding proposal ($74,568) for a specialist advisor to assist hapū with the development of Hapū Negotiation Profiles has been submitted to the November CFRT Trustees meeting for consideration; and A funding proposal ($65,550) for specialist advice to examine and quantify the socioeconomic deprivation of Ngāpuhi. 13 Communications Report Appendix Three During the reporting period 10 August 9 October 2015, our communications infrastructure continued to reach Ngāpuhi everywhere, with the focus during the reporting period being: Engaging with Ngāpuhi Hapū, encouraging them to join Tūhoronuku IMA. In its communications throughout the period, Tūhoronuku IMA stressed that the door is always open for all Hapū to join the process. A newly formed Hapū Engagement Working Group comprising of six trustees and a negotiator, have been tasked with engaging hapū; to strengthen existing hapū and potentially engage hapū who are yet to join Tūhoronuku. This is operating with participation from OTS. Keeping Ngāpuhi informed, through monthly e-pānui, regular media statements, Facebook, Twitter and Text activity. Listening to Ngāpuhi, in April a new Horizon Research poll was commissioned to hear from Ngāpuhi katoa what their thinking was on priorities for their iwi post settlement and how they wished to be communicated with. Results published in May showed 65% preferred to be contacted by and 17% by Facebook. Introducing the three prominent Ngāpuhi appointed as settlement Negotiators, profiling of Negotiators continues along with Hapū Kaikōrero meetings and other hui for Negotiators to meet with Ngāpuhi. And; As expected, the release of the Waitangi Tribunal s report regarding the Ngāpuhi Mandate Inquiry has generated media coverage and is being monitored by the Project Team; Website Our website is the primary source of all information and documents about the Ngāpuhi settlement process. The site is updated daily with news from or about the Ngāpuhi settlement, and the posting of relevant documents. All media statements, relevant media items and pānui are posted on Subscribe to our E-pānui and Join us on Facebook tabs have been built into the website homepage to promote increased activity. Facebook The Tūhoronuku Facebook site continues to be a popular vehicle to circulate news and provide engagement. The Facebook page is updated regularly with Ngāpuhi and Tūhoronuku IMA news, statements and/or relevant media coverage. Twitter All statements and pānui were tweeted on Tūhoronuku Twitter page. Media Statements were distributed during the reporting period, some of which have been picked up by Maori and mainstream media. All were posted on the Tūhoronuku and Te Rūnanga-ā -iwi o Ngāpuhi websites, Tūhoronuku Facebook page and Twitter. These are also forwarded within Ngāpuhi internet networks.
