PUBLIC HEARING 4.1 Public Hearing and Approval of the Annual Budget Plan and the Annual Service Plan for for the Sierra Sands SELPA (Goal #1, #2, #3) The public will have the opportunity to comment on these documents prior to the board considering them for approval. The documents describe the services provided by the SELPA and an overview of the allocation of resources available to the SELPA. 5. At this time, members of the public may address the board on an item not on the agenda. Comments should relate to items of public interest within the board s jurisdiction. The law prohibits the board from taking action on items not on the agenda. If appropriate, your comments will be referred to staff for response. When addressing the board, please state your name and address at the podium and limit your remarks to three minutes. In accordance with the board bylaws, the board will limit the total time for public input to 30 minutes. Those wishing to address the board beyond the 30-minute time limit may do so at the end of the scheduled meeting agenda. 6. EDUCATIONAL ADMINISTRATION 6.1 Report to the Board: 21 st Century Community Learning Centers Grant Application (Goal #1, #2, #5) The 21 st Century Community Learning Centers federal grant program supports the creation of community learning centers that provide academic enrichment opportunities during non-school hours for children, particularly students who attend high-poverty and/or low-performing schools. The program helps students meet state and local standards in core academic subjects, offers students a broad array of enrichment activities, and offers literacy and other educational services to the families of participating children. 6.2 Approval of Recommendation to Modify the Master Schedule at District Middle Schools Beginning in the School Year (Goal #1, #2, #3) A 55-minute six period day schedule is being recommended at district middle schools in order to provide flexibility in course scheduling, maximize class loads, increase the opportunity for students to take electives, realize a substantial cost savings in staffing, and balance teacher loads and instructional time for all courses. 2 2

EDUCATIONAL ADMINISTRATION (continued) 6.3 Approval of Sierra Sands Unified School District School Accountability Report Cards (Goal #3, #5) Since November 1988, state law has required all public schools receiving state funding to prepare and distribute a School Accountability Report Card (SARC). A similar requirement is also contained in the federal No Child Left Behind Act. The purpose of the report card is to provide parents and the community with important information about each public school. 7. POLICY DEVELOPMENT AND REVIEW 8. PERSONNEL ADMINISTRATION 8.1 Certificated Employment, resignation, retirement, leave of absence, change of status, termination 8.2 Classified Employment, resignation, retirement, leave of absence, change of status, termination 8.3 Adoption of Resolution # , Week of the School Administrator (Goal #5) This resolution declares the week of March 2-8, 2009, as Week of the School Administrator in recognition of the outstanding dedication and professionalism of the district s administrative staff. 8.4 Waiver Request Enabling the District to Assign Individuals in Certificated Positions Without Appropriate Credentials Approval of the governing board is required when a district is filing for a Variable Term Waiver or a Provisional Internship Permit to assign individuals who are not appropriately credentialed for their assignment. Approval is requested to submit a Provisional Intern Permit for Spencer Richards, Resource Specialist, Burroughs High School. 9. GENERAL ADMINISTRATION 9.1 Gifts to the District 9.2 Approval to Submit a Request for Allowance of Attendance at Rand School Because of Emergency Conditions Due to Inclement Weather Classes were cancelled at Rand Elementary School on December 18, 2008 because of inclement weather and the closure of roads making it impossible for students and staff to report to school. The district is filing for a waiver to the California Department of Education requesting that apportionment be maintained and instructional time be credited for Rand Elementary School for December 18, California School Boards Association (CSBA) Delegate Assembly Election The board may vote for four candidates for vacancies in Subregion 12-B of the CSBA Delegate Assembly. Sierra Sands is a member of Subregion 12-B. 10. CONSTRUCTION ADMINISTRATION 10.1 Report to the Board: Measure A and Other Construction Activities and Issues (Goal #3, #4) 10.2 Approval of the Terms and Conditions of the Site Lease, Lease-Leaseback, and Construction Services Agreements and Enabling Resolutions Related to Modernization Projects at Burroughs High School (# ), Rand Elementary School (# ), Las Flores Elementary School (# ), and Richmond Elementary School (# ) (Goal #3, #4) 3 3

BUSINESS ADMINISTRATION 11.1 Adoption of Resolution # Authorizing the District to Seek Grant Funding for Warehouse Delivery Vehicle Replacement (Goal #3, #4) The district is eligible to apply for funding for two warehouse delivery vehicles through the Kern County Air Pollution Control District. The grant funding is available in an effort to reduce emissions from motor vehicles operating in Kern County. 12. GENERAL ADMINISTRATION 3.1 Consideration of Ridgecrest Charter School s Request for Facilities for the School Year Following review of the process in determining the district s offer, motion passed to approve providing facilities to the Ridgecrest Charter School for the school year under the terms and conditions outlined in the offer, which is not only compliant with the law but balances the needs of the charter school with the facility and programmatic needs of the district. APPROVAL OF MINUTES Hearing no comments, the minutes of the regular and special meetings of January 15, 2009 were adopted by consensus as written. 3. PROGRAMS AND PRESENTATIONS With an introduction from Principal Ingrid Larsen, students from Mesquite High School provided the board with an overview of all the programs offered at Mesquite High School and how these programs, the caring staff, and the culture at Mesquite High School make the school a Model Continuation High School. 4. PUBLIC HEARINGS 4.1 Tentative Agreement between Chapter 188 of the California School Employees Association and the Board of Education Regarding Contract Reopeners for Mr. Scott opened a public hearing at 7:24 p.m. to provide time for public comment on the tentative agreement between Chapter 188 of the California School Employees Association and the Board of Education regarding contract reopeners for Hearing no comments, the public hearing was closed at 7:25 p.m. 7

8 2/5/09 minutes 5. REPORTS AND COMMUNICATIONS 5.1 Student Member s Report Hannah reported that middle schools were excited about their annual science fairs. At James Monroe, they also learned from No Name Calling Week and were looking forward to the Valentines dance. The Safe School Ambassadors conference and class competitions added to activities at Murray Middle School. Mesquite High School was recognized by the Indian Wells Valley Water District for their water conservation efforts. The winter sports rally, preceded by spirit days all week, highlighted activities at Burroughs. Plans were also in place for the King of Hearts dance. 5.2 Reports from Members of the Board Mrs. Covert commented on the dinner and meeting of the Kern County School Boards Association and thanked all those who attended the groundbreaking ceremony for the district s modernization projects. Mr. Rockwell commented on the brief ceremony held at Burroughs High School for Kayla Kovar, who signed a national letter of intent to attend UCLA on a track scholarship. 5.3 Superintendent s Report Mrs. Rummer reported on the very impressive groundbreaking ceremony and celebration held on January 30 to kick-off the districtwide modernization projects. The ceremony was held at Faller School with a James Monroe musical ensemble and the USS Ronald Reagan Honor Guard and Drill Team setting the stage for the ceremonial turning of the dirt on modernization projects that will not only benefit the students and staff but the community as a whole. Mrs. Rummer also reported that the state was still without an adopted budget, thereby leaving school districts without direction in responding to budget cuts, which are sure to come. While noting that staff continues to gather information regarding possible cost-saving measures, Mrs. Rummer cautioned that the current budget crisis is very serious. 5.4 Communications Communications from schools were distributed for information. 5.5 Comments from the public on items not on the agenda 6. EDUCATIONAL ADMINISTRATION 6.1 Report to the Board: Consolidated Application, Part II (Goal #1, #2, #3, #4, #5) The Consolidated Application, Part II no longer requires board approval. However, with significant changes in funding and structuring of the state grants, an overview of the application was presented for information. 8 2

EDUCATIONAL ADMINISTRATION (continued) 6.2 Adoption of Resolution # Approving Behavioral Intervention Plans (Hughes Bill) Mandated Cost Claim Settlement and Waiving Rights to File Any Claim Regarding the Hughes Bill Statute and Regulations in the Future Motion passed to adopt Resolution # as presented. If approved by 85% of all districts, county offices of education, and special education local plan areas constituting 92% of statewide ADA, this settlement ends a fourteen-year dispute with the State of California regarding funding for state behavioral intervention plan requirements that are in excess of federal law. Motion passed to approve the contract with the San Joaquin County Office of Education for use of this data management system. The report included a statement indicating the district is in compliance with the accountability requirements of the law in that bond proceeds are being used only for the purpose so described in Measure A. 10 4

GENERAL ADMINISTRATION (continued) 9.3 Appointment of Replacement Member to the Citizens Oversight Committee (Goal #4) Felice McLane, chairperson of a subcommittee of the Citizens Oversight Committee charged with advertising, interviewing, and recommending a replacement member, outlined the subcommittee s process and recommendation that Kelly Curtis be named to the committee as a member with children enrolled in the district. 12 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, EDUCATIONAL ADMINISTRATION 4.1 Public Hearing and Approval of the Annual Budget Plan and the Annual Service Plan for for the Sierra Sands SELPA (Goal #1, #2, #3) BACKGROUND INFORMATION: Assembly Bill 602 requires Special Education Local Plan Areas (SELPAs) to submit an Annual Budget Plan and an Annual Service Plan that are adopted at a public hearing of the board. As required in Education Code Section 56205, together these plans must identify expected expenditures and include a description of services, the physical location of services, and must demonstrate that all individuals with exceptional needs have access to services and instruction appropriate to meet their needs as specified in their Individualized Education Plan (IEP). CURRENT CONSIDERATIONS: According to the governance and policymaking process established within the Sierra Sands SELPA Local Plan for Special Education, an Annual Budget Plan and an Annual Service Plan must be developed each year. The completion of the process will be documented by evidence that a public hearing has been held before the adoption of the Annual Budget Plan and the Annual Service Plan. The timeline by which these plans have been brought forward this year was delayed due to a new requirement of the California Department of Education Special Education Unit that CASEMIS data be used in the development of these budget and service plans. This data was not available until after the first of the year. FINANCIAL IMPLICATIONS: The special education services provided by the Sierra Sands SELPA are supported through a combination of categorical special education state and federal funding, the expenditure of which is documented in these plans. SUPERINTENDENT S RECOMMENDATION: It is recommended that the board conduct a public hearing on the Annual Budget Plan and the Annual Service Plan for and approve these plans to be submitted to the California Department of Education as presented. 12

19 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, EDUCATIONAL ADMINISTRATION 6.1 Report to the Board: 21 st Century Community Learning Centers Grant Application (Goal #1, #2, #5) BACKGROUND INFORMATION: The 21 st Century Community Learning Centers federal grant program supports the creation of community learning centers that provide academic enrichment opportunities during non-school hours for children, particularly students who attend high-poverty and/or low-performing schools. The program helps students meet state and local standards in core academic subjects, such as reading and math; offers students a broad array of enrichment activities that can complement their regular academic programs; and offers literacy and other educational services to the families of participating children. The 21 st Century Community Learning Centers grants may only be awarded to Title I schools with 40% or higher poverty rates. Sierra Sands currently operates three state funded After School Education and Safety Grants at Faller, Inyokern, and Pierce Elementary Schools and one before school program at Pierce. CURRENT CONSIDERATIONS: A 21 st Century Community Learning Center grant application for Las Flores and Richmond Elementary Schools has been prepared and submitted to the California Department of Education. Principals have been consulted and signed approval of the application. Required consultation with private schools has also occurred. The scope of the grant for each school was determined by factors including the size and location of the school. An assessment of the availability, distance from, and current participation in existing community after school programs was also conducted. Collaboration occurred with local agencies, which will be involved in the implementation of this grant if the Sierra Sands application is successful. Awarding of the five-year grants will be done through a priority system determined by the state, which will include factors such as school performance, school poverty levels, number of applications received, and availability of funding. Successful grants may begin in August FINANCIAL IMPLICATIONS: The Sierra Sands Unified School District application is requesting $166,500 per year to conduct after school programs for up to 124 elementary students. SUPERINTENDENT S RECOMMENDATION: This report is provided for informational purposes and does not require board action. 19

20 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, EDUCATIONAL ADMINISTRATION 6.2 Approval of Recommendation to Modify the Master Schedule at District Middle Schools Beginning in the School Year (Goal #1, #2, #3) BACKGROUND INFORMATION: On January 15, 2004 the governing board approved a recommendation from the Middle School Task Force to modify instructional minutes at the middle school level. This modification in instructional minutes created a 70-minute block schedule for two content areas - mathematics and English/language arts - while keeping all other content areas at 45 minutes. The purpose of this new master schedule structure was to provide additional time for students to master the content standards in mathematics and English/language arts, thus impacting performance on the California High School Exit Exam and the STAR performance. CURRENT CONSIDERATIONS: The Middle School Task Force reconvened on January 26, 2009 to evaluate the success of the block master schedule. The Middle School Task Force is comprised of middle school teachers, counselors, principals, and district administration. Members of the committee provided input on the advantages and disadvantages of the current schedule, analysis of STAR data prior to and during implementation of the block schedule, and general observations associated with the schedule. Advantages to the current block schedule include: Provides additional minutes for instruction and understanding of concepts to cover standards, complete projects, and assist with homework Provides limited collaboration time for teachers in English/language arts and mathematics Adjusted English minutes for grades 6, 7, and 8 more evenly at the time of implementation NCLB and the CAHSEE emphasize English and math Fewer students per teacher, approximately 120 versus 210 Disadvantages to the current block schedule include: Limits flexibility in scheduling which creates unbalanced class loads Creates student enrollment imbalance between core teachers Creates imbalance in instructional minutes in core areas: English/language arts and math at 70 minutes and history, science, electives and PE at 45 minutes Impacts special education placement/movement/mainstreaming (Special Day Class schedule does not align with block schedule) Limits course selection/electives Requires additional FTE in English/language arts and mathematics to meet course enrollment needs (math and English/language arts teachers teach four periods per day while science and history teachers teach six periods per day) 20

21 Item 6.2, Educational Administration 2 February 19, 2009 Middle School Master Schedule The chart below illustrates the number of instructional minutes over time at the middle school level for review. # Instructional Minutes Prior to Block Schedule (prior to ) # Instructional Minutes in Current Block Schedule ( Present) With the implementation of the block schedule beginning in , instructional minutes in English/language arts for students in grades 6 and 7 decreased from 16,200 to 12,600 minutes, while instructional minutes for students in grade 8 increased from 8,100 to 12,600. During the time that the block scheduling has been in place, overall student performance in all three grade levels and all core areas has increased. Student performance increased in social science, the core area whose minutes remained unchanged. It is unclear whether additional time was the determining factor on improved student performance because all core areas improved over the five year period. In an effort to address issues surrounding the block schedule, a 55-minute six period day schedule was presented to the committee for consideration. 24 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, EDUCATIONAL ADMINISTRATION 6.3 Approval of Sierra Sands Unified School District School Accountability Report Cards (Goal #3, #5) BACKGROUND INFORMATION: Since November 1988, state law has required all public schools receiving state funding to prepare and distribute a School Accountability Report Card (SARC). A similar requirement is also contained in the federal No Child Left Behind Act. The purpose of the report card is to provide parents and the community with important information about each public school. CURRENT CONSIDERATIONS: In revising BP 0510 last July, it was noted that Education Code requires the governing board to approve all district SARCs and evaluate the data contained in the SARCs as part of the board s regular review of the effectiveness of the district s programs, personnel, and fiscal operations. Sierra Sands School Accountability Report Cards for are currently available to parents and the community on the district website and in paper copy upon request. A link to those reports is also posted with this board packet on the website. FINANCIAL IMPLICATIONS: With this information posted on the district website, the cost of wide distribution of these reports has been eliminated. The cost of having a small number of hard copies printed and available is minimal. California has approximately 15,000 certificated and classified administrators who provide leadership and support to the educational programs of California s public schools. CURRENT CONSIDERATIONS: Resolution # declares the week of March 2 through March 8, 2009 as the Week of the School Administrator in the Sierra Sands Unified School District. The resolution also declares that in Sierra Sands Unified School District, certificated and classified administrators provide support to our schools, programs, and students in many ways. They develop and implement curriculum by selecting textbooks and instructional materials. Site administrative teams ensure that effective and innovative classroom instruction is promoted on a daily basis. Certificated and classified administrators manage departmental and site budgets, and maintain school and district facilities. District administrators provide student transportation and nutrition programs to our students and their families, as well as guidance and staff development that improve teacher effectiveness in the classroom. The board s adoption of Resolution # , declaring March 2 through March 8, 2009, as Week of the School Administrator will allow the district to formally recognize the outstanding dedication and professionalism of its administrative staff, both certificated and classified. FINANCIAL IMPLICATIONS: Donations provide support to the district and have a positive financial impact. SUPERINTENDENT S RECOMMENDATION: Accept the gifts as described and send appropriate letters of appreciation. 32

33 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, GENERAL ADMINISTRATION 9.2 Approval to Submit a Request for Allowance of Attendance at Rand School Because of Emergency Conditions Due to Inclement Weather BACKGROUND INFORMATION: When a district or school is prevented from maintaining the required number of minutes or days of attendance as prescribed by education code due to emergency conditions, the district may apply to the California Department of Education for allowance of attendance and instructional time credit with documentation of the emergency conditions by affidavits of the members of the governing board of the district and the county superintendent of schools. CURRENT CONSIDERATIONS: On December 18, 2008, Cal Trans closed Highway 395 due to snow from the intersection of State Route 58 to the San Bernardino/Kern County line near Johannesburg. Because of this road closure, the classroom teacher and bus transportation were unable to report to Rand Elementary School, which is located in Johannesburg. Sections and of the California Education Code provide for the crediting of attendance when the average daily attendance has been materially decreased because of an emergency condition. In order to receive attendance credit for this loss of instructional time, the district has prepared and wishes to submit a request for allowance of attendance to be submitted to the California Department of Education. The County Superintendent of Schools will support the district in this request. FINANCIAL IMPLICATIONS: If approved, the district will be held harmless from revenue loss that would result from loss of ADA or instructional time during this emergency situation. SUPERINTENDENT S RECOMMENDATION: It is recommended that the board approve submission of the Request for Allowance of Attendance Because of Emergency Conditions to the California Department of Education for Rand Elementary School on December 18, 2008, as a result of emergency conditions due to inclement weather. 33

42 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, GENERAL ADMINISTRATION 9.3 California School Boards Association (CSBA) Delegate Assembly Election BACKGROUND INFORMATION: The CSBA Delegate Assembly is the primary policy-making body of the California School Boards Association. It sets the general policy direction for the association that represents California s school districts and county offices of education. Delegates fulfill a critical governance role by communicating the interest of local boards to CSBA s Board of Directors, Executive Committee, and staff. Delegates give policy and legislative direction through the adoption of the policy platform every two years and the adoption of other policy statements of the association. They also speak on issues and provide direct advocacy on behalf of the association. Delegates play an important communication and support role within their regions, and they also elect the association s officers and board of directors. Elections are conducted annually to fill vacancies on the CSBA Delegate Assembly. Elections are conducted by region. Sierra Sands is a part of Subregion 12-B. Currently Sierra Sands board member Bill Farris serves on the Delegate Assembly. CURRENT CONSIDERATIONS: There are four vacancies in Subregion 12-B of the CSBA Delegate Assembly for which there are five candidates. The candidates are incumbents Kevin L. Burton, Fruitvale School District; Blaine Geissel, Rosedale Union Elementary School District; and other candidates Linda Brenner, Panama-Buena Vista Union School District; George F. Hodgkinson, Mojave Unified School District; and Deanna Rodriguez-Root, Richland School District. Brief biographical sketches from the candidates are included for review. FINANCIAL IMPLICATIONS: None. SUPERINTENDENT S RECOMMENDATION: The board may vote for up to four candidates. No more than one vote can be cast for any one candidate. 42

51 SIERRA SANDS UNIFIED SCHOOL DISTRICT FEBRUARY 19, CONSTRUCTION ADMINISTRATION 10.2 Approval of the Terms and Conditions of the Site Lease, Lease-Leaseback, and Construction Services Agreements and Enabling Resolutions Related to Modernization Projects at Burroughs High School (# ), Rand Elementary School (# ), Las Flores Elementary School (# ), and Richmond Elementary School (# ) (Goal #3, #4) BACKGROUND INFORMATION: The Sierra Sands Unified School District Board of Education approved the selection of Barnhart, Inc. as the construction management firm at a special meeting held on April 24, Throughout the current projects, the district has found Barnhart, Inc. to be an outstanding organization with whom to work, and the lease-leaseback construction delivery method very acceptable and advantageous to the district. With the guidance of counsel, the district has chosen to move forward with lease-leaseback as its chosen construction delivery method for modernization of Burroughs High School, Rand Elementary School, Las Flores Elementary School, and Richmond Elementary School. CURRENT CONSIDERATIONS: As part of the process with lease-leaseback, a validation action must be completed. During this process, the district will initiate a judicial action which will describe the process it used and the results it achieved during the selection process for the chosen construction management firm. Within 30 to 60 days, it is expected that a judgment will be made in favor of the district s process and selection. As soon as the validation action is completed, it is anticipated that the district and Barnhart Inc. will sign the construction agreement. In order to proceed with this validation action, board approval of the terms and conditions of the site lease, lease-leaseback, and construction management agreements for these projects, as well as an enabling resolution for each project, must be approved by the governing board. The resolutions are included in this board packet. For ease of handling because of the size of the other agreements, they will be posted as a separate document with the board packet on the district s website. The resolutions and agreements for each project are alike except for slight differences between those located on base property and those not located on base property. Because this is the beginning of the validation action process which speaks to approval of the contract form and process used to get to that point, there are several clauses in these documents which are blank. That is usual for this point in the process. The process to arrive at a guaranteed maximum price begins once the validation action starts. 51

It is further recommended that the associated Resolutions # (Burroughs), # (Rand), # (Las Flores), and # (Richmond) enabling the district to proceed with the validation action on these projects be approved as well. 52

53 Resolution No RESOLUTION OF THE BOARD OF EDUCATION OF THE SIERRA SANDS UNIFIED SCHOOL DISTRICT AUTHORIZING THE EXECUTION AND DELIVERY OF A SITE LEASE AND SUBLEASE AND OTHER ACTS RELATING TO THE CONSTRUCTION OF THE BURROUGHS HIGH SCHOOL MODERNIZATION PROJECT WHEREAS, the Sierra Sands Unified School District ("District") desires to perform modernization improvements on a portion of the Burroughs High School buildings, as more particularly described in Exhibit A attached hereto and incorporated herein by this reference (the Site ), as a lease-leaseback project whereby the District will lease the Site which the District owns to Barnhart, Inc., a Heery International Company ( Barnhart ) who will construct the Project thereon and lease the Project and underlying Site back to the District; WHEREAS, Education Code Section authorizes the governing board of a school district, without advertising for bids, to let to any person, firm or corporation any real property belonging to the district if the instrument by which such property is let requires the lessee to construct on the demised premises, a building or buildings for use of the school district during the term thereof, and provides that title to the building shall vest in the school at the expiration of that term; WHEREAS, it is in the best interest of the District to cause the construction of the Project through lease and sublease of the Site pursuant to Education Code Section 17406; WHEREAS, in order to complete the Project, it is necessary that the District enter into the Site Lease, in which the Site will be leased to Barnhart, and a Sublease which provides for the sublease of the Site and the lease of the Project by Barnhart to the District, and that certain other action be taken and authorized; WHEREAS, the Sublease includes construction provisions with which Barnhart shall comply with respect to construction of the Project ("Construction Services Agreement"); WHEREAS, pursuant to Section of the Education Code, the plans and specifications for the Project must be prepared and adopted prior to entering into Site Lease and the Sublease agreement for the Project ( Plans and Specifications ); WHEREAS, the Plans and Specifications have been submitted to the Division of State Architect ("DSA"); WHEREAS, pursuant to Education Code Section et seq., District shall obtain the DSA preliminary approval of the Plans and Specifications for the Project subject to minor revisions, if any, prior to execution of the Site Lease or Sublease, and prior to commencement of the Project; 53
