ISEZ4KI BUILDING'," which I have signed into law as Public Law No This legislation names the new building for the Department of Agriculture after Mr. Francisco M. Isezaki. Mr. Isezaki was the first law enforcement officer on Guam to die in the line of duty, and he served as a Conservation Officer for the then Division of Fish and Wildlife of the Department of Agriculture. He had approached poachers and was subsequently killed. It is fitting that the Department of Agriculture's building be named after him as he gave his life for the conservation of wildlife. Isezaki, who died on October 31, while performing his duty as a Conservation Officer for the then 6 Division of Fish and Wildlife of the Department of Agriculture.

4 I Liheslaturan Gudhan also hds that the late Francisco M. Isezaki was the first law enforcement officer to die in the line of duty. I Liheslaturan Gudhan sadly remembers that the late Conservation Officer Isezaki, born on October 31,1919, died in the line of duty on his Forty-fifth (45th) birthday, and that his killer was never found. Section 2. Section 834 of Article 2, Chapter 8 of Title 1 of the Guam Code Annotated is hereby added to read as follows: "Section 834. Francisco M. Isezaki Building. Notwithstanding any other law, the Department of Agriculture building, located in Mangilao, Guam, shall be known as the 'Francisco M. Isezaki Building.' A plaque bearing the name of the honoree and other appropriate citations shall be placed at a conspicuous place on the main building.'' Section 3. Severability. If any provision of this Law or its application to any person or circumstance is found to be invalid or contrary to law, such invalidity shall not affect other provisions or applications of this Law which can be given effect without the invalid provisions or application, and to this end the provisions of this Law are severable.

13 TESTIMONY TO NAME DEPATMENT OF AGRICULTURE FRANCISCO M. ISEZAKI Good Morning Senator(s) First of all I want to thank you for allowing me to present my testimony to consider the naming of the Department of Agriculture to Francisco M. Isezaki building. People wonder, who is this person and what did he contribute to the community that would earn him to honor his name and be remembered. Conservation Officer Francisco M. Isezaki is a native born Chamono who was married and raised a family here on Guam. In the early sixty's, he became a Conservation Officer and dedicated his profession to enforce the fish, game, and forestry laws of Guam. On October 3 1, 1964, Conservation Officers Francisco M. Isezaki and Joaquin Acfalle were on a mission in the Naval Magazine area when they spotted illegal hunters and pursued the suspected individuals on foot with no additional back up units. Three individuals were confronted in an isolated area. Upon confrontation, Officer Isezaki was in the process in disarming the gunner while two individuals fled. Officer Acfalle pursued the two individuals, who finally apprehended them when he heard shots and rushed back to where the confrontation was made and discovered his partner, Officer Isezaki mortally wounded in the chest and abdomen area. The assailant fled into the jungle. Officer Isezaki was killed in the line of duty on h s birthday. Later a suspect was arrested and the island's first grand jury was impaneled and an indictment of murder in the first degree was returned towards the suspect. However, after the trial, the suspect was acquitted of the charges. Thirty-Seven years (37) ago, as of yesterday the soul of Officer Isezaki has not rested knowing that his murderer has not been brought to justice. To a-peace his soul afier paying the ultimate sacrifice in protecting our resources, it would be a small token on our part to honor him by placing his name under the Department of Agriculture the Francisco M. Isezaki Building. In closing, as the grandfather of Conservation Officers, we continue to carry his delcation, thoughts and feelings as a public servant to protect our valuable resources to the utmost so that our future generation of people will enjoy those resources that we ourselves enjoy today. 20 I., OVERVIEW The Committee on Rules, General Governmental Operations, Reorganization and Reform, and Federal, Foreign and General Affairs held a public hearing at 10 a.m. on November 01, 2001 in the Public Hearing Room, 1 Liheslaturan Guahan. Public notice was given in the October 27,2001 edition of the Pacific Daily News. Senators present at the public hearing were: Senator Mark Forbes, Chairman Senator Larry Kasperbauer, Member Senator Lou Leon Guerrero, Member Senator Vicente "Ben" Pangelinan, Member Senator Frank Aguon, Jr. 11. SUMMARY OF TESTIMONY Individuals appearing before the Committee to present oral and written testimony on the bill are as follows: Wayne W. Bigler, Lieutenant, Chief Conservation Officer, Dept. of Agriculture (Oral and written testimony) Mr. Wayne Bigler, a Lieutenant and Chief Conservation Officer with the Dept. of Agriculture read his written testimony before the Committee. Mr. Bigler addressed in his testimony, Mr. Isezaki, as a grandfather of the Guam Conservation Officers, and whose public duty to protect Guam's valuable resources is an inspiration to the many Dept. of Agriculture Peace Officers FINDINGS AND RECOMMENDATION The Committee on Rules, General Governmental Operations, Reorganization and Reform, and Federal, Foreign and General Affairs finds that Bill No. 180, as substituted, will commemorate and honor the late Francisco M. Isezaki, a Conservation Officer killed during line of duty and whose death remains unsolved. This act will name the New Department of Agriculture Building as the "Francisco M. Isezaki Building."
