Transfer Authorization for the Guam Public School 3 System. OVERVIEW The Committee on Finance, Taxation, Commerce and Economic Development held a public hearing on Wednesday, April 16, 2008, at I Liheslaturan Guahan's Public Hearing Room on Bill No. 268 (EC), "AN ACT TO AUTHORIZE THE GUAM PUBLIC SCHOOL SYSTEM TO TRANSFER FUNDS BETWEEN APPROPRIATIONS FOR FISCAL YEAR 2008." Notices for the public hearings were disseminated throughout all local media via facsimile and are attached herein meeting the requirements of the Open Government Law. a. Committee Members and Senators present: Senator Edward J.B. Calvo, Chairman Senator Adolpho Palacios Senator Frank Ishizaki b. Appearing before the Committee: Ms. Frances Danieli, GPSS Mr. Wilfred Aflague, GPSS Written Testimonies received: NIA II. SUMMARY OF VERBAL TESTIMONIES: Chairman Calvo began the hearing by stating that the genesis of Bill 268 was information his office received from GPSS that Operational funds for FY 2008 were to be exhausted very soon and that the ability to transfer funds NOT REQUIRED for Personnel needs in FY 2008 would greatly assist GPSS in

Chairman Calvo asked GPSS representatives present to confirm the lack of Operational funds and the availability of excess funds in Personnel available for transfer to Operational needs. Ms. Danieli thanked Chairman Calvo for introducing Bill 268 and concurred that funds in Personnel could be transferred to Operational needs as GPSS fully expected lapses in Personnel funding in FY When asked by Chairman Calvo what level of lapses GPSS expected Ms. Danieli responded by stating GPSS expects approximately $25 Million in Personnel lapses. Chairman Calvo asked Ms. Danieli to repeat her statement which she did, again stating the anticipated $25 Million dollar figure. Mr. Aflague concurred with the statements made by Ms. Danieli to which Chairman Calvo stated that that was a huge amount and enough to fund an entire agency such as the Guam Police Department for an entire fiscal year. Senator Ishizaki asked when the GPSS Management Audit would be completed to which Mr. Aflague replied that a selection was made and the final award documents were in the process of final review. Chairman Calvo asked GPSS to provide the Committee with information on the use of bond funds to pay for the correction of health and safety issues within GPSS and to have a revised use of the remaining bond proceeds sent to the Committee. GPSS replied that this would be done and sent to the Committee soon. III. WRITTEN TESTIMONIES: Written testimony on Bill 268 was received on April 21, 2008 from Interim Superintendent of Education Ms. Corina Paulino disputing the statements made by Ms. Danieli and Mr. Aflague regarding the level of Personnel lapses. Ms. Paulino' s testimony states a deficit in Personnel of $5,228,582 and a deficit in Operations of $8,711,537 totaling a $13.9 Million shortfall in GPSS Personnel and Operations in FY

8 Committee Report Bill Number 268 (EC) Committee on Finance, Taxation, Commerce and Economic Development On June 16, 2008 the Office of the Public Auditor (OP A) released an "Guam Public School System's FY 2008 Payroll Analysis/' supporting the Office of Finance and Budget's contention that Personnel lapses will occur in FY The OP A concluded that $7.6 Million in Personnel lapses would be realized and went on the lend support to Bill 268' s intent to allow the transfer of funds between Personnel and Operations to meet GPSS obligation. The Committee will continue to receive written testimonies regarding Bill 268 for the next ten working days in compliance with local law. IV.
