1 3815 Meeting of the Hoke County Board of Commissioners on Monday, April 6, 2015 at 7:00 p.m. in the Commissioners Room of the Pratt Building. MEMBERS PRESENT: James Leach, Chairman Allen Thomas, Jr., Vice Chairman Robert Wright Harry Southerland Tony Hunt OTHERS PRESENT: Letitia Edens, Interim County Manager Grady Hunt, County Attorney Linda Revels, Clerk to the Board Chairman Leach called the meeting to order with a quorum present and welcomed everyone. Jim Davis, former Sheriff, led the Pledge of Allegiance and Minister Bonita Thomas gave the invocation. Chairman Leach stated that a resolution for former commissioner Neil McPhatter needs to be placed on the agenda. Motion: Vice Chairman Thomas made a motion to place a resolution for former commissioner Neil McPhatter on the agenda. The resolution may be amended as needed, seconded by Commissioner Southerland. Public Hearings Planning Matters - Rezonings a. Application for general use rezoning RZ-15-1 submitted by James and Lois Bradley to rezone the approximately 3.69 acre parcel known as 190 Morgan Drive, also known as Parcel Identification Number (PIN) The request is to rezone the property from Highway Commercial (HC) to Residential Agricultural (RA-20). The Planning Board unanimously recommended approval. Mrs. Bradley was present and stated that several years ago they had property rezoned to Highway Commercial and apparently their house was in it. Chairman Leach stated that the Bradleys sold some land previously. When the rezoning was approved, it included their home. There were no speakers. Motion: Commissioner Southerland made a motion to close the public hearing, seconded by Commissioner Wright.

2 (minutes continued from the April 6, 2015 meeting) 3816 Motion: Commissioner Wright made a motion to approve the rezoning, seconded by Commissioner Southerland. b. Application for general use rezoning RZ-15-2 submitted by Willie and Lornette McCaskill to rezone two (2) unaddressed parcels. The approximately 0.5 acre Parcel Identification Number (PIN) and the approximately 0.39 acre PIN The request is to rezone both parcels from Residential Agricultural (RA- 20) to Neighborhood Business (NB). The Planning Board unanimously recommended approval. Ms. McCaskill was present and stated that they have a current business that is doing well and they want to expand. They have a mini-mart located on Turnpike Road. They want to include a fish market and eatery business. There were no speakers. Motion: Commissioner Wright made a motion to close the public hearing, seconded by Commissioner Hunt. Motion: Commissioner Hunt made a motion to approve the rezoning, seconded by Commissioner Southerland. Subdivision: 1a1. Proposed amendment to the preliminary plat for the 86 lot Bedford Subdivision. The request is to permit the development to have private roads. The Planning Board unanimously recommended approval. Planner Robert Farrell stated that they want to amend the plat to allow for private streets. They will be under the homeowners association. The amendment meets the requirements of the subdivision ordinance. Commissioner Hunt asked Mr. Farrell if he had a copy of the homeowners association agreement? He stated no but he will get a copy before the final plat is approved. Motion: Commissioner Hunt made a motion to approve the amended plat subject to a copy of the homeowner s association agreement, seconded by Commissioner Southerland.

Resolution Honoring Reverend Neil W. McPhatter Commissioner Hunt stated that the position with the Health Department will not cost any county dollars. Motion: Commissioner Wright made a motion to approve the consent agenda, seconded by Commissioner Hunt. RESOLUTION Celebrating the Life of Dr. Neil W. McPhatter WHEREAS, we are deeply saddened to learn of the death of Dr. Neil W. McPhatter who faithfully served the citizens of Hoke County as a member of the Board of County Commissioners, as the founding pastor (and builder) of Saint Andrews Holiness Church, and as a faithful steward of all that was entrusted to him, and WHEREAS, Dr. McPhatter was one of the organizers, who helped to establish the Hoke County Civic League. He was the treasurer for several years, and he continued to faithfully serve as a member until his health failed. He never waived in his belief that we are to build up and support the whole man; and WHEREAS, before retiring as a general contractor, Dr. McPhatter, constructed or remodeled many facilities in Hoke County; and

4 (minutes continued from the April 6, 2015 meeting) 3818 WHEREAS, he was a member of the Board of Commissioners from December 6, 1976, to December 7, 1992, during his tenure he also served as its vicechairman; and WHEREAS, he was a family man, a church leader, a gospel preacher, and an individual with attributes that exemplify the character of a good man whose steps are ordered by the Lord. NOW, THEREFORE, BE IT RESOLVED that we do honor the late Dr. Neil W. McPhatter for faithful service and for his lasting contributions to the citizens of the County of Hoke and in the surrounding areas. BE IT FURTHER RESOLVED that this Resolution will be made part of the permanent records of the County of Hoke, North Carolina, and that copies will be forwarded to his devoted wife with whom he lived with more than 70 years. JCPC 2 new members James Allen and Shirlyn Smith Motion: Commissioner Hunt made a motion to approve the JCPC appointments, seconded by Vice Chairman Thomas. Manager s Report Ms. Edens stated that the Blue Springs Community Building has been turned over to the county and our citizens can start using it for activities. Our Maintenance Director, James Tedder, did a great job. A meet and greet will be scheduled at a later date. The RFP for brokers for the insurance closed on March 31 st. Commissioner Hunt requested that this be on the next agenda. The DMV License Plate office was closed down on April 1 st for the installation of a third terminal. Ms. Edens also met with the Planning Director and Chief Building Inspector. A department head meeting regarding budget, was held on March 31 st. Budget requests are due back by April 20 th. Staff and Commissioner Wright and Commissioner Southerland attended the finance training at the LRCOG on March 26 th. The purchasing policy was mailed to department managers.

5 (minutes continued from the April 6, 2015 meeting) 3819 Schedule Budget Retreat Chairman Leach stated that they would probably hold the budget retreat in May due to the County Manager and Finance Officer reviewing the department budgets. Commissioner Hunt requested that this be placed on the next agenda. NCDOT District Engineer Marty Tillman and Assistant Supervisor, James Garner were present regarding DOT Presentation on private roads. Representative Ken Goodman was also present. Representative Goodman thanked the board for inviting him, in that he was here to learn. Chairman Leach stated that invitations were also sent to Representative Garland Pierce and Senator Ben Clark. Mr. Tillman stated that on October 1,1975, the General Assembly approved a law that to add any road to the state system, it had to be platted, recorded and paved. Roads prior to October 1, 1975 can be looked at but as an unpaved road. Other issues such as drainage, right-of-way, mailbox placement, and utilities are also considered. Private roads cannot be added to the state system; they must be public. The criteria must be followed regarding the number of houses per mile. The county does not maintain any roads. They are maintained either by developers, the city or the state. Prior to 2013 each county received a certain amount of dollars for roads, after 2013 the state set up a priority system. There are 4,329 miles of unpaved roads with 12 million dollars being set aside for paving. Mr. Tillman stated that his district encompasses 5 counties including Hoke. There is a list that the public can check. Commissioner Hunt asked if a road was on the list prior to 1975 with no houses, would it be paved? Mr. Tillman stated that it was possible, if it rated high enough such as for traffic volume. If the road was built after 1975 and not paved, it cannot be added to the system. There was a question from the audience regarding Purvis Court. Mr. Tillman stated that 75% of the land has to be signed by the property owners, with it being that if they do not sign, the other property owners can do a condemnation. There is a drop off from Highway 401 onto Purvis Road. Mr. Tillman stated that DOT is responsible for the paved public road section. Mr. Tillman stated that if the commissioners would get a list of the roads of concern to DOT and a contact person, they would check on them. A member of the audience stated that they want the roads safe and passable. They are taxpayers. Mr. Tillman stated that without the law changing, they cannot pave the roads. Representative Goodman stated that part of the problem is funding along with the law being changed. Money has to be available. He will work with DOT to identify the roads.

6 (minutes continued from the April 6, 2015 meeting) 3820 Chairman Leach stated that the commissioners will look at every avenue to help the citizens. A citizen from Spring Pine Lane stated that it would help if the road was dragged and the ditches cleaned out. A citizen stated that the board could look for grants. A citizen stated that they need help from their state legislators, DOT and the commissioners. Another citizen stated that they also need to contact the developers in that they need accountability. The property owners may have to also help with the cost. Commissioner Southerland stated that they need to get a sub-committee with the citizens, getting volunteers to help and identify and prioritize the roads. A citizen in the audience stated that he had equipment and could help. Vice Chairman Thomas stated that we have to do something, seeing what actually the county can do. We need to move forward. Chairman Leach requested that Vice Chairman Thomas and Commissioner Southerland serve on the sub-committee getting some names and bringing them back at the next meeting, consisting of about 7 to 9 members. Mr. Tillman stated that he and Mr. Garner would also serve. A notepad was presented for anyone that wanted to serve on the committee. Chairman Leach thanked Mr. Tillman and Mr. Garner for coming. Public Input 1. Roger Williams He stated that more revenue could be gotten from verification of vehicles with taxes and tags as well as requiring permits for more events such as yard sales. Trailers also need to be required to have tags. The board also needs to look at an impact fee. 2. John Harry He stated that the residents of Rockfish will be having a meeting regarding the road project with DOT in that area. He is inviting the commissioners. Chairman Leach stated that the commissioners initiated that project. 3. Bonita Thomas She stated that she had turned in paperwork to DOT on her private road and it was misplaced. She would appreciate any assistance from the commissioners. 4. Christina Davis-McKoy She wanted to introduce Shawn Reeves, a VISTA worker. Blue Springs is turning 20 years old and they are planning several events and will get invitations to the commissioners. Commissioner Southerland introduced Dr. Roxie Wells, President of the Cape Fear Hoke Campus.

7 (minutes continued from the April 6, 2015 meeting) 3821 Motion: Commissioner Wright moved that the Board of Commissioners for Hoke County go into closed session for the purpose of consulting with an attorney retained by the Board, in order to preserve the attorney-client privilege between the attorney and the Board, NCGS (a)(3)., seconded by Commissioner Southerland. Motion: Commissioner Wright made a motion to come out of closed session and go back into regular session, seconded by Commissioner Southerland. There was no action taken in closed session. There being no further business to come before the Hoke County Board of Commissioners, Commissioner Southerland made a motion to adjourn, seconded by Vice Chairman Thomas, unanimously carried.
