1 Galesburg City Council Regular Meeting City Council Chambers 55 West Tompkins Street, Galesburg, Illinois May 21, :00 p.m. Called to order by Mayor John Pritchard at 6:35 p.m. Roll Call #1: Present: Mayor John Pritchard, Council Members Angela Bastian, W. Wayne Dennis, Peter Schwartzman, Wayne Allen, 5. Absent: Council Members Fleming, Andersen, and Karlin, 3. Also present were City Clerk Kelli R. Bennewitz, City Manager Todd Thompson, and City Attorney Bradley Nolden. Mayor Pritchard declared a quorum present. Council Member Allen moved, seconded by Council Member Schwartzman, to convene into executive session at 6:00 p.m. for the purpose of discussing litigation and the approval of minutes from the March 26 and April 16, 2018, executive session meetings (5 ILCS 120/2(c) (11) and (21). Roll Call #2: Ayes: Council Members Bastian, Dennis, Schwartzman, and Allen, 4. Absent: Council Members Fleming, Andersen, and Karlin, 3. During the Executive Session, Council Member Dennis moved, seconded by Council Member Bastian, to recess to the regular meeting at 6:10 p.m. Roll Call #3: Ayes: Council Members Bastian, Dennis, Schwartzman, and Allen, 4. Absent: Council Members Fleming, Andersen, and Karlin, 3. Roll Call #4: Present: Mayor John Pritchard, Council Members Angela Bastian, W. Wayne Dennis, Russell Fleming, Corine Andersen, Peter Schwartzman, Wayne Allen, and Jeremy Karlin, 8. Also present were City Clerk Kelli R. Bennewitz, City Manager Todd Thompson, and City Attorney Bradley Nolden. Mayor Pritchard declared a quorum present. The Pledge of Allegiance was recited. Bonnie Ericson, Church of God, gave the invocation. Council Member Dennis moved, seconded by Council Member Bastian, to approve minutes of the City Council meeting from the May 7, 2018, meeting. 2 CONSENT AGENDA # All matters listed under the Consent Agenda are considered routine by the City Council and is enacted by one motion Approve Resolution accepting a grant from the Illinois Housing Development Authority s Abandoned Residential Property Municipal Relief Program in the amount of $30, Approve the bid from National Wash Authority in the amount of $26,000 for the cleaning of the Hawthorne Centre water tower Approve bid from itouch Biometrics in the amount of $20,000 for the purchase of a fingerprint reading and scanning system. A SORNA grant from the Illinois Criminal Justice Department will be used to purchase the equipment Approve Budget Adjustment #1 for the budget year ending December 31, Receive the March 31, 2018, Investment Schedule Approve a grant agreement modification with the State of Illinois Department of Commerce and Economic Opportunity Help Eliminate Lead Program. The modification includes an additional $193,806 in added funds for the study of blood testing results Approve bills in the amount of $1,217, and advance checks in the amount of $1,154, Council Member Andersen moved, seconded by Council Member Allen, to approve Consent Agenda Roll Call #6: Chairman declared motion carried by omnibus vote. 3 PASSAGE OF ORDINANCES AND RESOLUTIONS Council Member Dennis moved, seconded by Council Member Bastian, to approve Special Ordinance on final reading authorizing the Purchasing Agent to dispose of items through public auction or online auction. The City s annual auction will be held Saturday, June 2, 2018, at 9:30 a.m., at the Parks Maintenance Building on Veterans Drive. Roll Call #7: Council Member Bastian moved, seconded by Council Member Dennis, to approve Ordinance on final reading rezoning from B3, Central Business District to B2, General Business District, the property at 120 North Broad Street. Roll Call #8: Ordinance on first reading amending Sections through and Section of the Galesburg Municipal Code to establish the City of Galesburg Rental Licensing Program. Paul Stewart addressed the Council and commended the City Manager and staff for their work on this ordinance. While it is not perfect, he believes it is a good start and fully supports the licensing program. Council Member Bastian inquired about the self-inspections vs. a physical rental inspection. Director Carl noted that all landlords will be required to submit a self-inspection in May 2019 unless it is more than 10 units; in which case, they would be due in Staff will also begin working on a prioritization system for physical inspections. Council Member Fleming suggested that the last sentence of Section be stricken from the ordinance (Additionally, the City Attorney shall be authorized to seek any legal or equitable remedies he/she deems necessary to enforce Sections through ). He added that ordinances should be simple and precise and not wordy. May 21, 2018 Page 3 of 7

4 Ordinance on first reading amending Section through of the Galesburg Municipal Code to establish Minimum Housing Standards. Council Member Fleming stated that he would like to remove Section (C) regarding the regulation of the size of sleeping rooms. He added that even the Knox County Housing Authority does not regulate the size of these rooms. He is also not in favor Section (D) regarding sleeping room arrangements and access to another sleeping room and/or its connection to another another sleeping room or a bathroom. BIDS, PETITIONS, AND COMMUNICATIONS PUBLIC COMMENT CITY MANAGER S REPORT A. Special Events: a. Use of Lincoln Park by the Guardian Angels Humane Society for Bark in the Park on June 2, b. Use of city streets by Seminary Street Business Association for First Friday events on June 1, July 6, August 3, and September 7, c. Use of city streets and parking lot H for Run Galesburg Run on June 3, MISCELLANEOUS BUSINESS (Agreements, Approvals, Etc.) Council Member Andersen moved, seconded by Council Member Dennis, to approve an amendment to the Discovery Depot TIF I Redevelopment Agreement to provide for an additional incentive of $75,000, payable in Council Member Karlin inquired about the boundaries of TIF 1 and if this additional funding could instead be used for housing, blighted areas, demolitions, etc. He encouraged the City to have a system to evaluate the requests of TIF funding so that future projects are not left out. He will be voting in favor of this item, but added that they have already been granted TIF funding and that this could be used elsewhere in the City. City Manager Thompson stated that the TIF 1 boundaries are South Chambers Street, Mulberry Street, East Simmons Street, South Kellogg Street, and East Main Street. He also stated that this request will have no bearing on the use of TIF monies for the housing issues noted. He will provide an overview of current TIF funding levels. 5 Council Member Fleming moved, seconded by Council Member Bastian, to approve a subordination agreement with Intellihot, Inc., and Wintrust Bank. Roll Call #10: Council Member Andersen moved, seconded by Council Member Bastian, to approve the amendment to the PMTSP, LLC Redevelopment Agreement for the property located at 180 South Seminary Street by extending the project completion date to July 3, Roll Call #11: Council Member Fleming moved, seconded by Council Member Dennis, to approve the Workers Compensation settlement agreement with James Johnson in the amount of $30,000. Roll Call #12: Council Member Allen moved, seconded by Council Member Dennis, to approve the move of an armored transport carrier from the American Legion to the Veterans Memorial at Lincoln Park. Bill Tomlin, former Navy Seal, addressed the Council representing several veterans in attendance. He stated that he is from Galesburg and has a vested interest in our community and the moving of the carrier. He strongly believes that future generations need to see visually what freedoms have been secured for them. James Nelson, CFO of American Legion Post, addressed the Council in full support of the transport carrier being moved to Lincoln Park. May 21, 2018 Page 5 of 7

6 Roll Call #13: TOWN BUSINESS Council Member Allen moved, seconded by Council Member Dennis, that the City Council sit as the Town Board. The motion carried by voice vote Trustee Bastian moved, seconded by Trustee Schwartzman, to approve Town bills and warrants be drawn in payment of same. Fund Title Amount Town Fund $5, General Assistance Fund $2, IMRF Fund Social Security/Medicare Fund Liability Fund Audit Fund Total $7, Roll Call #14: Ayes: Trustees Bastian, Dennis, Fleming, Andersen, Schwartzman, Allen, and Trustee Fleming moved, seconded by Trustee Bastian, to receive the Annual Financial Audit for the year ended December 31,2017. Roll Call #15: Ayes: Trustees Bastian, Dennis, Fleming, Andersen, Schwartzman, Allen, and Trustee Allen moved, seconded by Trustee Dennis, that the Town Board resume sitting as the City Council. The motion carried by voice vote. Laura Fults address the Council and asked that the City request that something be changed with the speed bumps at Galesburg Towers. She understands it is private property but many May 21, 2018 Page 6 of 7

7 residents have fallen recently and the owners refuse to do anything. She would appreciate any help the City can give with the issue. CLOSING COMMENTS Council Member Allen stated that the veterans that showed up today were only a few in the area. He added that he is assisting with the move for the veterans in our community and that no public dollars will be used for the project. He thanked those in advance that will be helping with the refurbishing of the carrier, including the concrete pad and fencing that will also be constructed. Plans to have a flag in place will also help those in the community know that the military vehicle is a piece of history. Council Member Dennis sent his condolences to the students and families in Texas and strongly believes something needs to be done to stop this school violence. Council Member Bastian expressed her appreciation to the veterans that came to the meeting and for their service to our country. She wished everyone an upcoming happy Memorial Day holiday. Mayor Pritchard reminded citizens that school will be out for the summer this week and to be watchful of children. He added that the Farnham Street Bridge will be closed starting this Wednesday. The Mayor thanked the veterans for attending the meeting and for their service and reiterated that no public money will be used for the moving of the military vehicle to Lincoln Park.
