1 President Vicki Hoppe called the regular Sharonville Council meeting of October 25, 2016 to order at 7:00 p.m. A moment of silence was held followed by the Pledge of Allegiance led by Charles Lippert. ROLL CALL In attendance for Roll Call were Council Members: Rob Tankersley, Mike Wilson, Charles Lippert, Shayok Dutta, Dave Koch, Sue Knight and Paul Schmidt. MINUTES The Minutes from the regular council meeting of October 11, 2016 were approved as written and distributed. REPORTS AND COMMUNICATIONS MAYOR KEVIN HARDMAN o 2017 Budget was presented to Council had the following highlights: General Fund is debt free; Spending larger amounts of capital funds on 5 year plans; Completion of the hilltop area street repair requires some heavy spending; Funds going toward repairing the old gym at the Community Center; Health Care budget will be less than 5% with Anthem and also a healthier workforce in part due to the Wellness Committee and their efforts. o Budget Meeting is scheduled for Thursday, November 10, 5:30pm in Council Chambers. All questions regarding the budget should be sent to all of Council so everyone is aware of the question and answer. SAFETY SERVICE DIRECTOR JIM LUKAS o Expressed support for the Tribe as the Cleveland Indians go for the World Series Championship. o Explanation of Legislation: is up for third reading tonight and is an annual piece of legislation updating codified ordinances and E and were explained by Chief Blasky. Ordinance E is for two new police cruisers, their decals and equipment needed inside in order to replace the two cruisers that were crashed. Ordinance is to dispose of two cruisers no longer needed by the police department. Ordinance will allow the purchase of 27 pieces of new body armor that has the highest level of protection and 15 rifle-rated body armor to be put in all patrol cars and SRO s. In response to Mr. Wilson s question regarding the body armor, Chief Blasky explained the only rifles with potential to penetrate the armor would be the larger sniper assault rifles. Mr. Ledbetter questioned the process of the disposal of these police vehicles and to which funds the proceeds will go, given the fact that it is from a drug seizure. The Ordinance will be amended prior to the third reading to include necessary language was explained by Scott McKeehan. This Ordinance allows for a transfer of city facility funds for HVAC repair at the Community Center rather than take it from their operational budget Budget now has funds in place for a contingency plan for HVAC maintenance. 2 2016-R-20 formalizes a long-standing agreement with West Chester and Butler County on minor maintenance on Crescentville and Fields Ertel roads R-21 authorizing litigation relating to the Kemper Crossing development which the City put an option on that whole contract where if something wasn t done by a certain date, the City could acquire the property for a fixed price, however the company is not turning over the deed, so the City needs the courts to enforce such action R-22 was explained by Richard Osgood. This Ordinance allows for a solution to dredging the Mosteller & Kemper Rds. water basin. To avoid dredging it every 3-5 years in order to rid sediment, this will allow the re-creation of the creek to its original function which will create a stream that naturally clears out sediment. In response to Mr. Koch s question, the cost to dredge the pond is approximately $20,000. Mr. Lucas noted the local match is in the budget book R-23 is regarding the Gateway 75 building and a TIFF related to the building that Gorilla Glue purchased. The City has been working to get that TIFF on the books with the State and the County ever since the sale and it finally is. It did not make the 2016 tax settlements so they are advancing those funds. The City would owe those funds to the current property owner and the school district. PRESIDENT OF COUNCIL VICKI HOPPE o The regularly scheduled Council Meeting on November 8, 2016 has been moved to Thursday, November 10, 2016 at 5:00 pm. The Budget Hearing will be held immediately following. CLERK OF COUNCIL TERESA BUCHEIT o No report. LAW DIRECTOR MARK PIEPMEIER o Veteran s Day Committee will hand out pins for all Sharonville residents or employees who are Veterans of the armed forces; these pins will be available at the front desk days surrounding Veteran s Day. RESIDENTS DESIRING TO BE HEARD BEFORE COUNCIL None. COUNCIL COMMITTEES LAW & PUBLIC SAFETY PAUL SCHMIDT o The next Law Committee meeting is scheduled for Tuesday, November 01, 2016 at 4:00 p.m. in the Administration Conference Room. RULE SUSPENSION MOTIONS The motion by Mr. Koch for the suspension of the regular rules of Council to allow for a first and only reading on Ordinance E and was seconded by Mr. Lippert. Voice Vote on passage. Motion approved unanimously. UNFINISHED BUSINESS ORDINANCE , Enacting the Codified Ordinance Changes Enacted by the Walter Drane Company. Clerk of Council gave the third reading of this ordinance. The motion for passage by Mr. Tankersley was seconded by Mrs. Knight. Roll Call Vote on passage. 3 NEW BUSINESS ORDINANCE , Authorizing the Safety/Service Director to Dispose of Excess Vehicles No Longer Necessary for Municipal Purposes. Clerk of Council gave the first reading of the ordinance. ORDINANCE E, Authorizing the Safety/Service Director to Enter Into a Contract to Purchase Two Patrol Cars and Declaring an Emergency. Clerk of Council gave the first and only reading of the ordinance. The motion for passage by Mr. Wilson was seconded by Mr. Tankersley. Roll Call Vote on passage. Motion approved unanimously. ORDINANCE , Amending 2016 Appropriations for Various Funds. Clerk of Council gave the first and only reading of the ordinance. The motion for passage by Mr. Lippert was seconded by Mr. Koch. Roll Call Vote on passage. Motion approved unanimously. RESOLUTION 2016 R 20, Resolution for the Purpose of the City of Sharonville, Hamilton County and Butler County, Ohio; the Butler County Commissioners, Butler County, Ohio; and West Chester Township, Butler County, Ohio Cooperating to Facilitate and Assign the Maintenance Responsibilities for Crescentville Road from Cincinnati Dayton Road West to Chesterdale Road and Fields Ertel Road From U.S. Route 42 East to the City of Sharonville Corp Line and to Authorize the Safety Service Director to Enter Into an Agreement for Said Maintenance Responsibilities. The Clerk of Council read the resolution. The motion for passage by Mr. Tankersley was seconded by Mrs. Knight. Roll Call Vote on passage. Motion approved unanimously. RESOLUTION 2016 R 21, Authorizing Litigation Involving Kemper Crossings, LLC. The Clerk of Council read the resolution. The motion for passage by Mr. Koch was seconded by Mr. Schmidt. RESOLUTION 2016 R 22, Resolution Supporting the Stream Restoration of Impacted Tributary to the Mill Creek Project in the City of Sharonville and Authorizing the Planning Director to Submit an Application for Clean Ohio Funds Green Space Conservation Program Through the Natural Resources Assistance Council. RESOLUTION 2016 R 23, Resolution Requesting the County Auditor to Make Advance Payments of Taxes. The Clerk of Council read the resolution. OTHER MATTERS TO BE HEARD BEFORE COUNCIL Announcement by Mrs. Knight that Greg Pugh, of Lunatic Fringe will be giving free haircuts to all Sharonville employees and active military from November 1 November 12.
