1 Regular Meeting Minutes -1- August 28, 2018 MINUTES FOR THE REGULAR MEETING OF THE COUNCIL OF THE BOROUGH OF WALDWICK HELD ON TUESDAY, AUGUST 28, 2018 AT 7:30 PM Mayor Giordano called the meeting to order and read the Statement of Compliance. Mayor Giordano asked for a roll call. Present on roll call Mayor Giordano, Mr. Bjork, Mrs. Dellavechia, Mr. Farricker, Mr. Schatz and Mr. Sciolaro. Mr. Oravetz was absent. Also present: Laura Harris, Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong, Borough Attorney. Mayor asked everyone to join in the Pledge of Allegiance and to remain standing for a moment of silence for the passing of Senator McCain. Proclamations & Presentations Mayor Giordano asked the Clerk to read the resolution for the Appointment of Police Sergeant. RESOLUTION NO Appointment of Police Sergeant BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick that JOHN GRECO is hereby appointed Police Sergeant effective August 28, 2018; and BE IT FURTHER RESOLVED that he shall serve at an annual salary of $138,117. Mayor Giordano commented that John Greco grew up in Hawthorne and attended Hawthorne High School, graduating in He enlisted in the United States Marine Corps in 1999 and was sent to Parris Island for boot camp. He was a Rifleman in the Infantry and promoted to Private First Class. John received an Associate s degree in History from Bergen County Community College and transferred to Ramapo College where he studied Criminal Justice. In 2003, John began dispatching for Waldwick Police Department and attended the Bergen County Police Academy. In 2006 he became a Waldwick Police Officer. He has been assigned to Patrol and has been awarded Drug, Apprehension and Honorable Service citations along with two lifesaving CPR awards. 2 Regular Meeting Minutes -2- August 28, 2018 RESOLUTION NO Appointment of Police Sergeant BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick that KYLE MOORE is hereby appointed Police Sergeant effective August 28, 2018; and BE IT FURTHER RESOLVED that he shall serve at an annual salary of $138,117. Mayor Giordano commented that Kyle Moore was born and raised in Waldwick and attended Waldwick High School. He attended Stockton College where he majored in Criminal Justice and was a member of the baseball team. In September 2011, Kyle was hired as a Waldwick Police Officer and attended the Passaic County Police Academy. He has been assigned to Patrol, currently the Supervising Firearms Instructor as well as Active Shooter Instructor and Pistol and Carbine Armorer. In May 2016, he became a member of the Bergen County Regional Swat Team, serving as a Certified Swat Operator. Moved by: Mr. Farricker Seconded by: Mr. Schatz Clerk Halewicz swore in Kyle Moore with his family. Reports of Committees and Mayor s Report Mayor. Mayor Giordano stated that he and members of the Council attended the Sean Fisher Memorial Foundation s 10 th anniversary. Finance & Administration. Mr. Sciolaro had no report. Public Safety Committee. Mr. Schatz attended the Ambulance Corps and Planning Board meetings. Three resolutions were reviewed. Recreation & Health Committee. Mrs. Dellavechia commented that there is a concert at the Oval on Wednesday night. Buildings & Grounds Committee. Mr. Farricker had no report. Public Works Committee. Mr. Bjork stated that the paving will be taking place on Wednesday on West Prospect Street. Fire & Police Protection Committee. Mr. Oravetz was absent; however, Mayor Giordano read his report. He stated that Mr. Greco and Mr. Moore were promoted to the rank of Sergeant. The Fire department reported that Scott Stafford has passed away and that they had a fireman s funeral for him at St. Luke s Church.

4 Regular Meeting Minutes -4- August 28, 2018 Advertised Business Mayor Giordano asked the Clerk to read Ordinance No (A) Ordinance No AN ORDINANCE AMENDING ORDINANCE NO FIXING THE COMPENSATION, SALARIES AND WAGES OF OFFICIALS AND EMPLOYEES OF THE BOROUGH OF WALDWICK Moved by: Mrs. Dellavechia Seconded by: Mr. Farricker Mayor Giordano asked if any Council member wished to comment on the Ordinance just read. Mr. Sciolaro explained that our CFO Colleen Ennis is redistributing the money that is allocated for the salaries in the Finance Department. Mayor Giordano closed the Council comment, then opened it to the public comment. Mayor Giordano closed the public s comment. Mayor Giordano called for a motion to pass the ordinance on second reading, and that the Clerk be authorized to advertise in the local, legal newspaper as required by law. Mayor Giordano asked the Clerk to read Ordinance No (B) Ordinance No AN ORDINANCE ESTABLISHING A VOLUNTEER SNOW REMOVAL PROGRAM FOR SENIORS AND THE DISABLED Moved by: Mr. Bjork Seconded by: Mrs. Dellavechia Mayor Giordano asked if any Council member wished to comment on the Ordinance just read. Mayor Giordano closed the Council comment, then opened it to the public comment. Mayor Giordano closed the public s comment. 6 Regular Meeting Minutes -6- August 28, 2018 Mayor Giordano asked the Clerk to read Ordinance No (D) Ordinance No AN ORDINANCE AMENDING CHAPTER 91 VEHICLES AND TRAFFIC, SECTION 34 HANDICAPPED PARKING SUBSECTION (a) HANDICAP PARKING ON STREETS FOR PRIVATE RESIDENCES - OF THE REVISED ORDINANCES OF THE BOROUGH OF WALDWICK DESIGNATING ONE (1) HANDICAP PARKING SPACE AT 18 WEST PROSPECT STREET Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading, and that it be advertised in the local, legal newspaper as required by law, setting a public hearing two weeks from tonight s meeting at 7:30 pm or as soon thereafter as the matter may be reached. Moved by: Mr. Bjork Seconded by: Mrs. Dellavechia Unfinished Business None. New Business None. Public Comment John Vervoort, 34 Leonard Drive wanted to thank the Mayor and Council for opposing the bee keeping regulations. He proposed that Waldwick could become a Bee City. He then invited them to a few bee themed events. Laura DiGiovanni, 14 Cypress Court wanted to thank the Mayor and Council for implementing the marijuana prohibition ordinance. She then asked how Waldwick would be affected if the state of New Jersey legalized marijuana recreationally. Mr. Bossong replied stating that it s up to the state to determine if it will be regulated by them or by each individual town in the future. Ms. DiGiovanni then brought up Good Guy Vapes and how she believes they are illegally marketing to underage kids through Instagram. Mayor Giordano suggested she show any evidence of this to the Police. Theresa Sherman, 26 Smithfield Road followed up on the No-Knock Registry. Mr. Bossong stated that the Council will have an ordinance put in place in the future. She then asked how people can challenge ordinances that are already established. Mr. Bossong stated that depending on how court cases proceed, certain ordinances are called into question. She then asked about the rehabilitation of John Dow Avenue. Ms. Harris replied stating that they are going to pave the street. Ms. Sherman then asked if there could be a rumble strip put in place on John Dow as it is a shortcut used by many, and gets a good amount of incoming traffic on a daily basis. Ms. Harris replied stating that she will have the engineer take a look at it. She then asked about the tree donation to the Borough and where they could be placed.
7 Regular Meeting Minutes -7- August 28, 2018 Ms. Sherman then asked about Fair Share Housing and asked how we can prevent the multiple dwellings from coming in. Attorney Bossong explained that this is a maximum density issue and they are permitted it just depend upon where a municipality is with affordable housing. Waldwick is in good shape with 10 units per acre. Dina Scardigno, 33 John Dow Avenue spoke to the issue of the marijuana ordinance and asked if once they have a license, they could move here. Mr. Bossong explained that can t prevent it but if the State issues licenses, it would be for a specific site. If the Borough and residents provide opposition letters, it would be harder to them to obtain a license. Ms. Scardigno asked the Borough to brighten up the one way do not enter signs near her as they are hard to see. Mayor Giordano will have the Police go out and inspect and make any signs that are needed. Max Gourley, 72 Dora Avenue spoke to the issue of thanking the DPW over the winter while he was still living on Nordham, there was an issue with his grass being destroyed and in the spring them came out and took care of the issue. Mr. Schatz commented on the very large tree that fell two houses from his. The DPW was able to get it all cleaned up and the Police department did a great job as well with traffic control. Closed Session RESOLUTION NO WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of the public from a meeting in certain circumstances; and, WHEREAS, the Mayor and Council is of the opinion that such circumstances exist. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of Bergen, State of New Jersey, as follows: 1. The public shall be excluded from discussions of the closed session. 2. The general nature of the subject matter to be discussed is as follows: Personnel RICE Notice Issued 3. It is anticipated at this time that the above stated subject matter will be made public within 60 days or as soon thereafter as it is deemed to be in the public interest to do so based on the conclusion of the matter. This resolution shall take effect immediately. Moved by: Mr. Sciolaro Seconded by: Mr. Schatz
8 Regular Meeting Minutes -8- August 28, 2018 The Council convened into Closed Session at 8:40 pm. At 10:35 pm the Mayor and Council came back on the record of the Regular Meeting. Present on roll call: Mayor Giordano, Mr. Bjork, Mrs. Dellavechia, Mr. Farricker, Mr. Schatz and Mr. Sciolaro. Mr. Oravetz was absent. Adjournment There being no further business to come before the Municipal Council at its Regular Meeting, on MOTION by Mr. Farricker, seconded by Mr. Sciolaro and on roll call carried the meeting adjourned at 10:36 pm.
