1 REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF KENILWORTH HELD ON WEDNESDAY EVENING, JUNE 10, MAYOR PULGIESE PRESIDED. Mayor Pugliese read the requirements of the Open Public Meetings Act. The Salute to the Flag was led by the Girl Scouts and the Boy Scouts.. ROLL CALL Roll Call at 8:00 P.M. showed the following Council Members present: Sal Candarella, Brian Joho, Rich LoForte, Barbara Macecsko and. Nick Mascaro. Councilman Deluca was absent. PRESENTATION Mayor Pugliese thanked the Boy Scouts and Girl Scouts for all they do for Kenilworth and he listed some of the things they do. The Boy Scouts have cleaned the area near the Library, helped with the Food Pantry, helped with the Food Drive, provided donations to senior assisted living off of Orange Avenue in Cranford, cleaned up Black Brook Park before the Fishing Derby, helped with the opening ceremonies for the Relay for Life, and collected a good deal of proceeds for the American Cancer Society at the Relay for Life. He said Girl Scouts Troop #40128 have served the community by putting in 400 hours doing the 3 Silver Award Service projects, they have also supported Relay for Life, they are involved with Prom Dress Donations and Halloween Costume donations for less fortunate children, they donate their time to the soup kitchens and nursing homes in the area as well as the Senior Center. Mayor Pugliese said he thinks he is leaving out a good deal of things that they do for our community but he will show his appreciation and acknowledge the scouts by presenting them with Certificates of Appreciation. On behalf of the Mayor and Council he thanked the Scouts and presented them with Certificates of Appreciation. RESOLUTION NO. 1 Introduced by Barbara Macecsko, adoption moved by same Seconded by Sal Candarella WHEREAS, and eight girls of Kenilworth Girl Scout Troop have achieved the Silver Award; WHEREAS, the Silver Award is achieved by working as a group, successfully completing a Cadette Journey and implementing a service project of at least 50 hours related to the Silver Award as per the guidelines of the Girl Scouts USA; and WHEREAS, after that, the girls were required to develop a service project demonstrating leadership skills learned and showing a commitment to community and the Girl Scout Promise and Law; and

2 Council Meeting June 10, 2015 Page 2 WHEREAS, the girl scouts of Troop divided into three (3) teams and developed their own Take Action projects to address identified concerns in their community; and WHEREAS, Sarah Kossor and Isabel Allocco, working with American Cancer Society, created survivor gift bags and educated the community on the Relay for Life and American Cancer Society work; and WHEREAS, Isabella Federico, Alyssa Corvelli and Rae Mauro, worked with Salvation Army, collecting over 150 children's Halloween costumes for their distribution closet for underprivileged children enrolled in financial assistance programs and educated the Kenilworth grade school community on Halloween and Fall safety; and WHEREAS, Hannah Miller, Kaylee Krill and Melody Stubbs, worked with Catherine's Closet, by sponsoring and participating in collections of gently used formal dress for students in need of affordable prom dresses. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Kenilworth congratulate the girls of Troop on earning their Silver Award and further for demonstrating their community involvement. MINUTES It was moved by Councilman Candarella, seconded by Councilman LoForte and carried that the minutes of the Regular Council Meeting of May 27, 2015 be approved as submitted. (Copies furnished each Council Member prior to the meeting.) COMMUNICATIONS AND PETITIONS NJSLOM Notices ( ed to all) State of NJ DOT Authorization to combine grant years 2014 & 2015 Union County Grant Opportunities: Greening UC & Kid s Recreation Trust ( ed to all) Borough Engineer Recommendation of Award CDBG YR40 ADA Curb/Ramp Improvements Department Reports for May 2015 were received by Clerk s Office, Finance Dept., Fire Dept., PZO Dept., Police Dept. and DPW.

3 Council Meeting June 10, 2015 Page 3 It was moved by Councilman Joho, seconded by Councilwoman Macecsko and carried that the above communications be received and filed and any money amounts indicated be spread over the minutes. All in favor. REPORT OF COMMITTEES MAYORS REPORT Mayor Pugliese reported the Land Use Ordinance will be on first reading tonight. He said it is comprehensive in nature, there are things in now that were not in the old ordinance like floor area ratio and impervious coverage ordinances and many more. There were some changes to the zoning map, some of which are not in line with the Master Plan but that was something, the Council as a whole thought needed to be changed. He said other than that, this is going to bring us into the 21 st Century and keep Kenilworth the great community that it is. He said the ordinance is going to go back to the Planning Board for their review and recommendations and from there it will come back to Council probably at the August meeting for a vote, if not the August meeting then at the September meeting. The ordinance is on-line. He said it was an expensive project but a project that got us into the 21 st century and overall it is great for the community, he said not everyone will agree with every single ordinance in this set but the bottom line is that all of us agree that something needs to be done with the approval of these ordinances. Mayor said the Relay for Life is this Saturday, June 13 th at 6:00 PM and it will go throughout the night and he hopes the whole community comes because it is a wonderful event. He said to do something like this for the community is nice to see. Last year he was getting calls on his cell phone around 11 PM and midnight about the noise that was coming from the Relay For Life. He said to those residents this happens once a year and it is for a good cause so it is probably something we can live with for one night. The fireworks will be held on Sunday, June 28 th and will start just after dark, the rain date is Sunday, July 5 th. We discussed last night that we will be making two applications for grants, one for the renovation of DiMario Park. We discussed taking down the tennis courts and perhaps applying for a grant that would turn the tennis court into a street hockey venue and also for the improvement of the basketball courts and maybe even a play set for the park. We are going to do some improvements regardless of getting the grants but it would be nice if we could get money that would pay for half because they are matching grants. He said by example, if it was $20,000, we would have to put up $10,000 and the County would put up the other $10, and in return all the County asks for is that we put a sign saying Your County Tax Dollars at Work. He said we will be applying for that and hopefully the County will give us some money back.

4 Council Meeting June 10, 2015 Page 4 The Senior picnic will be held on June 18 th at the 16 th Street Playground and will be from 10 am to 2 pm. All seniors that are Kenilworth residents are welcome to attend. The Army Corp of Engineers will be putting together a presentation at Union County College which will relate to the Rahway River flood remediation program which is a multi-million project that is a joint funded event from the Federal and State Government. He said there are about 5 or 6 different ways they can go about this. He said the presentation will be about 2 hours about what they plan on doing or what they could do and the effect it will have on the surrounding communities. The goal is to improve things, the extent of which no one knows, but each town will be improved but we don t know which plan they will go forward with. We have invited our engineer to attend the meeting so that he can best represent Kenilworth s interests. He said every Mayor that is there wants to represent their own town. He said he is not an engineer and none of us here are engineers so we thought it best we have out engineer there to lookout for our best interests. FINANCE DEPARTMENT Councilman Joho reported the Mayor and Council received the Finance and Tax Report through May 31, 2015 and there were not any items for concern in those reports. The tax collection rate is at 98.14% which is, as always, is a good sign. Our tax collection rate has always been at that level or near that level which is good news. DEPARTMENT OF HEALTH, EDUCATION & WELFARE Councilman LoForte reported that last night he received the official Board of Health response to to their review of the People for Animals request for establishing the trap, neuter, vaccinate and manage program. A copy was distributed to Mayor and Council and we will be discussing it at our next meeting. The Library has a few upcoming programs, on Wednesday, June 24 th they will have Dinosaurs visit the Library for children ages Children are invited to this special event and children and their families will have the opportunity to learn about dinosaurs that roamed the earth long ago and they will meet a life size realistic looking dinosaur from the Dinosaur Park in Secaucus, New Jersey. This month starts the Summer Reading Program which will begin on June 15 th, over 40 events are planned for July. People who sign up will be eligible to attend our many children s programs including the exciting Thursday night science event in July and August and teen Tuesdays and Legos on Wednesdays and Thursday bingo games for children with crafts and more. A full schedule of these event can be seen on

5 Council Meeting June 10, 2015 Page 5 PUBLIC SAFETY Councilwoman Macecsko reported that during the month of May there were 2717 calls made to the Police Department, 375 were calls. There were 18 summons given and there was one DUI. The Police Department was at the high school checking to make sure that our high school drivers were following the rules by having the right amount of passengers in the car and last week they did a cross walk check. She said it is good for the Police to try and keep up with the people because sometimes they use the Boulevard as a highway. Mayor Pugliese asked everyone to pay extra attention to the crosswalks in town especially the one on Michigan Avenue by DiMario Park, it is a narrow road and there are cars parked on both sides and there are kids constantly streaming out of the park and crossing the streets and they may not look both ways as we were taught. He said when you see a car stopped it doesn t mean you can drive around them because they could be stopped for a pedestrian. DEPARTMENT OF PUBLIC WORKS Councilman Deluca was absent. DEPARTMENT OF PLANNING, ZONING & ORDINANCES Councilman Candarella said his name is currently all over the Master Plan because at that time he was a Council liaison to the Planning Board and he had a lot of input and time in helping to produce that document. He said he read up on the ordinance and the changes that are proposed and he is in favor of them. He said he can see the reasoning behind Mayor and Council s thoughts in changing the zoning map and some of the other changes in the ordinance. He said he is in favor of the ordinance and he thinks Mayor and Council did a good job in suggesting some of these changes. He will be the person bringing them back to the Planning Board for their review tomorrow evening. He said everyone on the Planning Board will get a copy for them to review and report back their recommendations. He said within the last two weeks he met with the Construction Official and re-introduced himself to Jerry Eger and his staff and got their s and started the communication. He said we have a Planning Board Meeting tomorrow and he is trying to catch up everything he missed in the past 2 ½ years. DEPARTMENT OF RECREATION AND FIRE Councilman Mascaro said the Fire Report for this month was very normal and in uniform with the rest of the months. The Recreation Committee is having a Kenilworth Swim Night on July 9 th from 6PM to 9PM at the Orange Avenue Pool in Cranford.

All items will be recorded individually in full in the minutes. Councilwoman Macecsko moved that all items under the Consent Agenda be approved, seconded by Councilman Joho. Upon roll call the vote was unanimous. RESOLUTION NO. 2 BE IT HEREBY RESOLVED: available. That all bills be paid when properly audited and funds are RESOLUTION NO. 3 BOROUGH OF KENILWORTH COUNTY OF UNION WHEREAS N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget and, WHEREAS, the Director may also approve the insertion of any item of appropriation for an equal amount, WHEREAS, the Borough of Kenilworth wishes to amend its 2015 Budget to include an amount as revenue, NOW THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Kenilworth hereby requests the Director of the Division of Local Government Services to approve the insertion of an item in the budget of the year 2015 in the sum of..$180, which is now available as a revenue from: Special Items of Capital Revenue Anticipated with Prior Written Consent of the Director of Local Government Services: Public and Private Revenues Off-Set with Appropriations: N.J. Transportation Trust Fund Authority Act

Transportation Trust Fund Authority Act Adopted this 10 th day of June, 2015, and certified as a true copy of an original. 8 Council Meeting June 10, 2015 Page 8 RESOLUTION NO. 5 WHEREAS, the Borough of Kenilworth was awarded $20, for ADA Curb and Ramp Reconstruction through the Union County Community Development Block Grant (CDBG) Revenue Sharing Committee for Year 40; and WHEREAS, nine (9) requests for proposals were solicited for said project; the borough engineer recommends S Brothers Inc. of Manalapan, NJ at their total quote of $21,600.00; and WHEREAS, purpose; and the Municipal Treasurer has certified as to the availability of funds for this WHEREAS, the Local Public Contracts Law (NJSA 40A:11-1 et seq.) requires that the Mayor and Council pass a resolution authorizing the award of contracts. NOW THEREFORE BE IT RESOLVED, as follows: 1. The Borough of Kenilworth hereby awards a contract to S Brothers Inc., 16 Sobechko, Manalapan NJ (PO Box 317, South River NJ 08882), , whose proposal amounted to $21, The Mayor and the Borough Clerk are hereby authorized to execute all documents to effectuate the purposes herein above expressed. RESOLUTION NO. 6 WHEREAS, the Borough of Kenilworth wishes to participate in the State Department of Defense excess personal property program which allows approved municipalities to receive excess property at no cost; and WHEREAS, property; and LESO Operations will be coordinating with the Borough to identify and receive WHEREAS, the Borough of Kenilworth has agreed to abide by the provisions of the agreement for any property received. BE IT HEREBY RESOLVED, that the Mayor and Council of the Borough of Kenilworth hereby authorizes said participation in the program. RESOLUTION NO. 7 BE IT HEREBY RESOLVED: that the Mayor s appointment of:dominick Costa as Alternate #4, for the unexpired term ending 12/31/15 To the Planning Board; be and the same is hereby confirmed.

9 Council Meeting June 10, 2015 Page 9 RESOLUTION NO. 8 BE IT RESOLVED that CAROLINE MCEVOY be appointed as Alternate School Crossing Guard for the year 2015; be and the same is hereby confirmed. RESOLUTION NO. 9 WHEREAS, the Borough of Kenilworth has leased the property known as the Little League Field to the Kenilworth Little League since 1954; and WHEREAS, the current lease has expired and the Kenilworth Little League is desirous of continuing the utilization of the property that benefits the children of Kenilworth. BE IT HEREBY RESOLVED, that the Mayor and Clerk are authorized to sign the lease agreement with the Kenilworth Little League. Proposed Ordinance No was read for a first reading as follows: (Copy attached) BOROUGH OF KENILWORTH ORDINANCE NO The purpose of said ordinance is to create a new unified code for Land Use Regulation within the Borough.in substantial compliance with the new Master Plan RESOLUTION NO. 10 Introduced by Sal Candarella, adoption moved by same. Seconded by Rich LoForte BE IT HEREBY RESOLVED: That Proposed Ordinance No be and the same is hereby passed on first reading and ordered published according to law.
