1 AGENDA February 6, 2018 Regular Meeting of the Hazlet Township Committee held at 8:00 p.m. Salute to the flag and moment of silent prayer called by the Mayor. Mayor s Statement Open Public Meetings Act & Emergency Fire Exits. In Compliance with the Open Public Meetings Act of the State of New Jersey, adequate notice of this meeting of the Township Committee was provided in the following manner: (A) On January 2, 2018, advance written notice of this meeting was posted at: 1766 Union Avenue, Hazlet, New Jersey (B) On January 2, 2018, advance written notice of this meeting was forwarded to the Independent. On January 5, 2018 advanced written notice of this meeting was published in the Asbury Park Press. (C) On January 2, 2018, copies of advance written notice of this meeting were mailed to all persons who requested and paid for such notices on or before January 1, Time will be allotted for public comment at this meeting. Each speaker will be allotted a 5 minute time limit when recognized by the Mayor. Individuals wishing to address the Committee, shall give their name and address. Although the Township Committee encourages public participation, it reserves the right, through the Mayor, to terminate remarks to and/or by an individual not in keeping with the conduct of a proper and efficient meeting. The Township Committee will not, during the public portion of this meeting, discuss matters involving any specific, prospective or current employee. FIRE EXITS are located in the directions I am indicating: Farther down at the end of the room, through the doors and down the stairs, directly out the front door. To my right is the door, make a right down the hallway which leads to the stairs and directly out the rear of the building. If you are alerted for fire, please move in a calm and orderly manner to the nearest exit. Finally, let the record reflect that the minutes of this meeting will accurately reflect the topics addressed during this meeting but will not be a verbatim transcript of tonight s proceedings. They have been there for 50 years or so and if no one is going to speak I would then ask that my letter that was addressed to the Municipal Clerk be made a part of the record. 5 Resolutions, Motions and Appointments: Resolutions #54 through #62 are by Consent Agenda. All matters listed under Consent Agenda are considered to be routine by the Township Committee and will be enacted by one motion. There will be no separate discussions of these items. If discussion is desired by the Mayor or any member of the Township Committee, that item will be removed and will be considered separately. Advance copies of each resolution have been given to each Committee Member. The original resolutions are with the Municipal Clerk for inspection as listed below. 54. Refund of the overpayment of Landlord Registration Fee for 108 Liberty Place. 55 Refund of a 2018 Railroad Parking Permit to John O Niell. 56. Authorizing the Township to assess a Municipal Lien on a property for property maintenance. 57. Cancellation of taxes due to an exempt status for Block 187, Lot Cancellation of taxes due to an exempt status for Block , Lot Issuance of Raffle Licenses RL-4156, RL-4157 and RL-4158 to Cove Road PTO. 60. Refund of CCO fees for Richard Cardona. 61. Release of the performance guarantee for Digestive Disease Specialist of Central Jersey PC (JPA Holdings/Dr. Avendano), Block 183, Lot Refund of Construction Permit fees to Sunrun Installation Services. PUBLIC HEARING Anyone who would like to address the Township Committee regarding the below listed Resolutions on the Agenda, please come up, print your name and address on the sign in sheet. 6 2 nd Committeeman Glackin Voice vote: Yes Mayor Aagre- May I have a motion to reopen the public portion for resolutons. 2 nd Committeeman Glackin Voice vote: Yes Charles Hoffman- I am looking at number 63 and it is companion number 70 you are hiring someone to do something commercially but yet you appointed someone to do it. Is that because the person who is appointed is not fully qualified? Mayor Aagre- Actually HN Consulting is actually very qualified they are a consulting firm. Viktoria Carey is actually the CFO who will be on site. The consulting firm and Viktoria Carey are going over the records but they are advising and she will be the one on record as far as CFO. It is a two part item. Mr. Hoffman- Number 64 and 75 on resolution talks about health care and 75 talks about health care again. Administrator Pino- The state requires two separate resolutions. One for the regular active employees and one for the retiree employees. Mr. Hoffman- Number 65 what is the DEP Administrative Consent Order did we do something wrong? Attorney Gorman- Minor infraction for paperwork going back a number of years it was paperwork violations at public works. DEP has been hounding us for one on one case for 10 years and the other one about three years. We are having an administrative settlement with them. They were asking for some number over $80, we are paying $4, For whatever reason it does not seem like it relates but they insisted that we spend money towards buying a Hybrid vehicle. It has nothing to do with the paper violations it was the DEP. It was a settlement. That authorizing that settlement. Mr. Hoffman- The township has to buy this vehicle for its own use? Mayor Aagre- Yes we authorized that last meeting. 63. Authorizing the Municipal Administrator to execute a contract with HN Consulting to assist the Township, with the Financial Responsibilities, for the first six months of 2018.

Carol McCue- We are doing a project and the Marijuana resolution did you pass that? Deputy Mayor Kiley- Yes. Ms. McCue- How could I find out what the issue was, how did you pass the resolution? Mayor Aagre- The resolution is that we oppose it. We send that to our legislatures, Governor and Senators. Nothing is passed yet. All we are doing is opposing it. We are asking them to vote no for it. Ms. McCue- All the things here are for public knowledge? How would I see them. Administrator Pino- Go on the website and you can download them. Charles Hoffman- It has been less than 3 months we had our second serious accident on Middle Road and Florence Avenue. A major complaint at least by myself and my lady friend who we use that road quite a bit and probably other people also. The telephone pole needs to be moved. Do we have to pay for it if we demand them to do it? Mayor Aagre- We would wind up having to pay for it. Mr. Hoffman- It has to be done. Mayor Aagre- We will look into it as far as the police departments and get their recommendations and move on from there. Mr. Hoffman- I had talked to him about some intersections within the township that I expose myself to all the time. I am wondering if you are giving it any serious thought before you start buying salt for next year? Are you going to go over the Brine Program? Administrator Pino- I do not know. Mr. Hoffman- The state is using on the Garden State now. Committeeman DiNardo- Everyone is using it. Mr. Hoffman- What is the level four for the gentleman on the Land Use Board?

12 Mayor Aagre- It is a classification. Just duration of term. A Class IV is a regular member with a five year term limit. Class I is a Mayor or Governing Body which is a one year limit. Class III is a township employee which I believe is a one year term. Mr. Hoffman- We now have a road program which I am happy to hear. The only problem is Clark Street and Stone Road stub have they been made part of it? Mayor Aagre- They are still working on the roads that are part of it. We are looking at the top 80 roads that need repair. We are looking at pricing and how we can fund it. It is not in place yet. Mr. Hoffman- Is the Recycling Program mandated by the DEP? Mayor Aagre- Yes Mr. Hoffman- Then Monmouth County is the next step down and they enforce it for the municipalities correct? I think I mentioned this to Mr. Pino awhile back the Chinese have strongly restricted the amount of waste material they will accept. Which means the bottom is falling out of the market and we are going to have to pay more out of our pocket because we are not going to get a lot of money back for recycling? The question is should you complain to Monmouth County? Mayor Aagre- It is definitely not a money maker. Maureen Finnegan- My concern is the water in this township. I am here over 30 years and I have never had problems with my water. It tastes like dirt and smells like ammonia and chlorine. I don t know if it is because of the new water company. Is it a new water source? Mayor Aagre- No. Ms. Finnegan- It is not me if you go the Hazlet page. It is just awful. I have never had to have a filter on my water. Deputy Mayor Kiley- We have met with the water company and they have told us they have not changed their process or their water source. We have shared the complaints of residents that there are different odors in the water and they have insisted they have not made any changes. I would direct you to advise them also. Ms. Finnegan- Can we get an outside tester to test the water? Attorney Gorman- Under state law and you get it every year in the mail a little pamphlet on the water results. They are required to do it. My guess whoever is paying for that which is probably Shore Lands but it is regulated by DEP and every year they test the water for all the parameters that are required under statute and regulations. Ms. Finnegan- Is there a way of getting an independent testing on it? How much could it costs? Attorney Gorman- I don t know how many sample points they take. Do they take it right from your source or the tap in your house? It will vary from house to house street to street depending on what is in their distribution system. Committeeman Glackin- We can always do some inquiries on how much it will cost and see if we want to pursue it. We will look into it.

13 Ms. Finnegan- We are getting post cards now for insurance is that just coincidental? I noticed the last couple of years a lot of water main breaks. Is this their way of saying you better get this because your pipe will be breaking or is it just a coincident? Mayor Aagre- As you know, many of the pipe systems in the town are quite old. First thing check with your homeowners insurance and see if it is covered. That is what I did and I was not so I went for it. Committeeman DiNardo- Your water from the meter to your house is not covered by any homeowner s policy and the majority of the houses in Hazlet had galvanized pipes put in. If you are one of the homes in that 50 year window I am off Beers Street and a lot of people in my neighborhood have been losing their water pipes.
