OVERVIEW COMMITTEE REPORT DIGEST The Committee on Labor, the Public Structure, Public Libraries, and Technology convened the public hearing on February 3, 2010 at 9:00 am in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill (LS) - "An act relative to establishing the "Guam World War II Loyalty Recognition Commission" for the purposes of bringing together island leaders and WWII survivors of the community for the purpose of aggressively pursuing the endorsement and timely passage of the Guam War Reparations Legislation in acknowledgement of the inhumane treatment received by the people of Guam during World War II; and, to repeal and reenact 2201 and 2204 of Chapter 22, Title 1, Guam Code Annotated" sponsored by F.B. Aguon, Jr. Public Hearing Requirements Notices of the hearing were disseminated via facsimile and to all senators and all main media broadcasting outlets on January 27, 2010 (5-day Notice) and on February 1, 2010 (48-Hour notice) pursuant to meeting the requirements of the Open Government Law. SUMMARY OF TESTIMONIES Interim Chairman Adolpho B. Palacios, Sr. called the Committee on Labor, the Public Structure, Libraries, and Technology to order at 9:12 am, welcomed and introduced Senators present. Chairman Adolpho B. Palacios, Sr. Chairman Palacios read the title of Bill No (LS), then allowed the author of the bill, Senator Frank B. Aguon Jr., to give a brief presentation on the bill. Senator Frank Aguon, Jr. Senator Aguon thanked the chairman and those who have come to testify. He noted that Senator Taitague would like to be a cosponsor on this bill, and that she is a strong advocate for war reparations, also Senator Frank Bias Jr., who not be at the public hearing. Bias extended his support for this bill. Senator Aguon gave a brief presentation on Bill No (LS). He stated that with this legislation on bill, it empathizes to put closer on the particular issue of way reparations. Senator Aguon stated that the reason for this issue to be heard quickly as possible is because many of the direct recipients have passed away. Senator Aguon stated that the focus of this bill would be to establish a commission that could push for the issue of war reparations and compensation be given and recognized the next DOD budgetary meeting. Tom Barcinas Mr. Barcinas, stated his name and that he is in support of the intent of Bill274-30, but with some recommendations. Mr. Barcinas' first recommendation is rather then naming the chairman, to let that group when they meet to elect or vote for their chairman. The second recommendation is that the commission or any group, seek representation first with the Guam Congress Representative's Office of Congresswoman Bordallo, so that there is unity and cohesiveness. 2

7 Committee on Labor, the Public Structure, Libraries and Technology Committee Report on Bill No (LSl Page -3- Joe Garrido Mr. Garrido thanked the chairman for allowing him to speak, and introduced himself. Mr. Garrido stated that we should be collecting war reparations from two nations, the United States and Japan. Mr. Garrido stated that his family has not yet been compensated, and there are issues of damages from the war, from personal issue of his family (deaths, torture and inhumane treatment). Mr. Garrido stated that the island war reparations should also add the treatment of Post Traumatic Stress Disorder (PTSD). He would also like to have a public hearing on issues that are not covered by war reparations, so it can be discussed. Mr. Garrido has a problem with the title of the hilt the Guam World War 2 Loyalty Recognition Act he prefers the "Chamorro WWII War Reparation" title because it denotes international human rights which can be supported by the people of Guam's political status. He believes also that this bill will be shutdown in the next DOD budget hearing. The next issue should be human rights and U.S. obligation on the treaty that they signed. Mr. Garrido recommended that on Page 1 Line 3, to include U.S. Congress and department of interior, and a few of Guam's leaders, and the end put that it was unsuccessful. Mr. Garrido also recommends that the Speaker and Governor should be the ones who should lead talks with the U.S. Cole Herndon Mr. Herndon thanked the chairman and the senators of the 30 1 h Guam Legislature. Mr. Herndon stated that he had met Mr. Barcinas before, and that he wanted to help him and his cause. Mr. Herndon heard from Tony Palomo on KUAM requesting that people sign a petition for war reparations. Mr. Herndon collected t600 out of 31,000 collected total signatures for war reparations. Mr. Herndon stated that he wanted to help because nobody in his family in the stated has gone through the problems that the people of Guam had. Mr. Herndon stated that the biggest obstacle that Congress had is paying off heirs, then later the chairman in Congress stating that it will not be a problem, Mr. Herndon stated that the issue with war reparations are progressing finely, due to the efforts of Congresswoman Bordallo. Mr. Herndon stated that we should coordinate with Congresswoman Bordallo on Bill No Mr. Herndon stated that he will only support this bill if Congresswoman Bordallo supports it. Ben Garrido Mr. Garrido introduced himself, and that he supports this bill. Mr. Garrido acknowledged the speaker before him about the word "Loyalty/' he too does not like that word being used more then once. Mr. Garrido stated that he was not born and raised to "kiss ass". Mr. Garrido doesn't like it when the island leaders say to enjoy 3

Mr. Garrido suggests canceling the liberation day festivities, until the candidates get the war reparations and self determination. Mr. Garrido believes that in order to get Congress to listen to the people that the island of Guam, we must stop pretending that it is a full self government when we do not. He suggests that the only big celebration that Chamorros can celebrate is the rise of our true self-determination. Bobing Wolford Many of you are leaving. I am speaking here because I participated in the first march. My mother and father died and still up to now there is nothing. More people in Saipan received money. I know that you all went over there for the war reparation to see how they can still do this to us. Give the people their money from war reparation. Many have died already. Good thing that I am still alive. Please give our people who need that money. The marines will bring in their trash in the military build-up. Many died, their necks cut, my mother was slapped, my father was punched from the Japanese. There are no Japanese that are good. For my mother and father. Chairman Palacios allowed Senators to give comments and/or questions. Senator Teio Taitague Senator Taitague acknowledged Mr. Barcinas for putting in his time and effort. The Guam Legislature must really move on this. Taitague said what she likes about the addition of survivors to be included in this commission. Senator Taitague suggested that the legislature come up with some type of funding to pay to the heirs of the cola. Senator Frank Aguon, Jr. Senator Aguon stated that if the commission is established it should be inclusive of a minimal of four (4) survivors, for the opportunity of telling their story. Senator Aguon stated that one of the challenges that the community of Guam will have is budget. Senator Aguon quoteed President Obama that over the next 3 years the budget will remain the same. So for a new program to get funding it must get funding from another agency in the federal budget. Joe Garrido He recommends that when we approach Congress. He stated that we should come to them as a whole. He also suggested that there should be two claims accepted by Congress, one is list of claimants who will accept what Congress has awarded them, 4

Chairman Adolpho B. Palacios, Sr. Senator Palacios stated that this commission will be enacted 30 days of passing of this bill into law. Joe Garrido Mr. Garrido stated that the commission will die after 2010 or when the bill is passed in Congress, Mr. Garrido comments that commission will also survive through other avenues if needed to be present if the legislature allows it to exist. Chairman Adolpho B. Palacios, Sr. Bill No (LS) is duly heard. Chairman Palacios concluded the hearing and requested that written testimony be submitted within the next ten (10) days. He adjourned the hearing at 12:15 pm. III. WRITTEN TESTIMONIES No written testimony received within the ten (10) day period after the public hearing. IV. REPEAL AND REENACT 2201 AND 2204 OF -.a CHAPTER 22, TITLE 1, GUAM CODE ANNOTATED. BE IT ENACTED BY THE PEOPLE OF GUAM: w. C Section 1. Legislative Findings and Intent. The Liheslaturan 2 Guahan finds that recent efforts by Guam's Delegate of the U. S. House of 3 Representatives and a few of Guam's leaders for the adoption of the war 4 reparations provision within the DOD budget was unsuccessful, and has 5 proven that additional and collective efforts will need to be exhausted to 6 realize the successful passage of the World War II reparations contained in 7 House Resolution 44 over the next year, or its insertion into the next fiscal 8 year's DOD budget. 1

11 1 11.World War II survivor, or heir. 2 The Commission shall conduct its initial meeting no later than thirty 3 (30) days following the enactment of this Act." 4 Section 3. Section 2204 of Chapter 22, Title 21, Guam Code 5 Annotated is repealed and reenacted, to read: 6 " Budget and term of existence. As its first item of discussion, 7 the Commission shall adopt a budget that would address its operational 8 requirements for fiscal year 2010, and officially present such budgetary 9 requirements to I Liheslaturan Guahan immediately thereafter. The 1 o Governor may, should he so choose, utilize his transfer authority to II provide the necessary funding to address the initial operations of the 12 Commission, pending legislative action on the Commission's budget 13 request. 14 The Commission shall exist for the duration of fiscal year 2010 only, 15 or until such time that the World War II Loyalty Recognition Act or the 16 provisions therein are adopted by the U. S. Congress and signed by the 17 President of the United States. For the Commission to continue its 18 existence beyond September 30, 2010, a majority of members shall adopt a 19 resolution justifying its continual operations for the purposes outlined 20 above, and, shall further, present any additional budgetary requirements 21 and resolution to I Liheslaturan Guahan for action." 4

12 tremendous importance and time sensitive nature of continuing their 2 support and realizing the adoption of the Guam World War II Loyalty 3 Recognition Act (House Resolution 44) or the provisions contained therein. 4 In addition to conducting, at a minimum, quarterly visits to the U. S. 5 Congress and the Obama administration representatives, the Commission 6 shall also encourage key members of Congress or the Obama 7 administration to visit Guam and to dialogue with the community on the 8 tremendous importance for the adoption of the war reparations. In 9 carrying out these responsibilities, the Commission shall work 1 o collaboratively with Guam's delegate to the U. S. House of Representatives. 11 The Commission shall be composed of the following members: I Maga'lahen Guahan, who shall serve as the Chairperson, I Segundo Na Maga'lahen Guahan; Speaker of I Liheslaturan Guahan or a Senator designee; Chairperson of the Committee of I Liheslaturan Guahan 16 maintaining oversight over federal issues; Senator, minority, I Liheslaturan Guahan; President of the Mayors Council of Guam, or a Mayor designee; Mayor or Vice-Mayor, to be selected by a majority of the Mayors 20 Council of Guam; World War II survivor; World War II survivor; 23 lo.world War II survivor; 3

It's an Issue that only about a handful of people came to provide testimony today before the Guam Legislature. Although only a few survivors of the Japanese occupation of Guam came out to provide testimony on Bill 274, and shared support for the measure, It's clear that their patience is wearing thin. Joe Garrido said, "The many efforts that were done by the first delegate up to the present delegate have not been successful," adding, "and my experience is that I think we got a 50/50 chance that that either that bill will be shot down next budget hearing and never get war reparations from the United States." The measure up for discussion today would establish the Guam World War II Loyalty Recognition Commission for the purposes of bringing together island leaders and survivors of the community to aggressively pursue the endorsement and passage of the Guam war reparations legislation. Garrido says while he understands that we're struggling to find ways to put the bill on the table of Congress before the next budget hearing, he argues that something must be done as he says their rights are being ignored. He said, "I don't understand why we continue to deny ourselves the rights that we are requesting to be recognized in front of Congress is human rights, not civil rights," he said. Vicente Garrido, who also showed support for the bill, has concerns with the word loyalty being used in this situation. He also urges all island leaders to write a letter to Congress demanding that they give the war reparations now. "We cannot continue to keep telling Uncle Sam, how many times we have to say 'loyalty' [sic]. The war reparations are long overdue and its time for Congress to settle this once and for all," he professed. He said, "Definitely, It's been too long, and It's just been dragging on so long. But I think we're beginning to see that eventually this thing will be resolved." In the meantime, the House Armed Services Committee is scheduled to meet tomorrow at lam Guam time to receive testimony on the Fiscal Year 2011 National Defense Authorization Budget request from the Department of Defense.
