1 9th Cir. Case No Clark v. Wells Fargo et al Page 1 of 31 UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT Andrew Glen Clark 9 th Cir. Case No Appellant vs. Appellees Originating Court Case No.6:14-cv JR Wells Fargo Bank, NA Attorney of Record Christian Rowley Seyfarth Shaw 560 Mission St. #3100 San Francisco, CA Ogletree Deakins et al c/o General Counsel Christopher Mixon 401 Commerce Street #1200 Nashville, TN City of Eugene, OR Attn: Lauren Sommers 125 East 8th Ave. Eugene OR County of Lane, OR Attn: Steven Dingle 125 East 8th Ave. Eugene OR State of Oregon via Attorney General Ellen Rosenblum and- Lane County Prosecutor Erik Hasselman and then District Attorney Alexander Gardner via Cecil Reniche-Smith, Asst. Attorney General for Oregon 1162 Court Street NE Salem OR For Immediate Hearing In Court, Oral Arguments Third Notice of Adjudicative Fact and 18 USC 4 Filing: Misprision of Felony Corporate Kidnapping and Corruption of FBI Processes Obstruction of Justice in Courts via Obfuscation First and Second Notices Support this Third Notice Forward: City of Eugene Police were used as willing, knowing armed muscle of a Racketeering Contains 1100 words of text on 4 pages followed by a copy of a filed FBI crime report. Enterprise. 2 nd Notice of Adjudicative Fact was events that as it turned out, were setting up me and the neighborhood for what would happen , just two days after a comprehensive in person FBI evidence parking. I responded to a knock on my door around 6 pm and two City of Eugene Police grabbed me at my door and pulled me onto my steps. I was handcuffed me behind my back. I
2 9th Cir. Case No Clark v. Wells Fargo et al Page 2 of 31 saw a third police officer with a barking canine unit a German Shepard War Dog. One of the police told me the dog responds to relaxation. I had the dog silent and wagging its tail in 5 seconds. All aspects of 2011 situation were audio/video recorded except the actual arrest event which lasted 4 minutes or so. I was barefoot and in t-shirt and shorts enjoying summer. Police asked me several times if they could go into my home to secure the back door. I told them it was locked and my home is insured so there was no need. Police then said let s go and I asked if I needed my wallet. A police officer said do you want me to go in and get it for you? and I asked if they had a search warrant otherwise I saw no reason for them to go in my home (where other people live). I should have asked to see an ARREST WARRANT because it was signed after fact. I asked if I could slip on my shoes which were right outside my door. Police said let s go and I was led away. I was barefoot and in handcuffs being paraded down my residential street in a quiet Eugene OR neighborhood. Two squad car and two SUV s were parked about a block away. I was told I would be recorded I was placed into a squad car and taken to Lane County Jail. The COBAN recording is on It is just me talking. It may be interesting but has little necessary value as evidence. While I was being scared and truthful others make up whatever. I was held in brutal captivity and finally released on citation to appear in Eugene Municipal Court for Charges of Second Degree Trespass. Prior to trial I endlessly communicated with City Prosecutor and pointed out there was no trespass, it was entirely fabricated, and it is proven as there is no video or
3 9th Cir. Case No Clark v. Wells Fargo et al Page 3 of 31 official eye witness of the alleged act. Wells Fargo has excellent video surveillance inside and out of the downtown branch. I worked in the mortgage office diagonal across the street. City Prosecutor s office was coincidentally in the building attached to my office. Most everyone had cellphones or smartphones that take pictures by Nothing. 2 nd Degree Municipal Trespass is the most minor of offenses. To my knowledge it had never been used as the sole basis for an at home arrest before and certainly not by a SWAT contingent. Police claim it was not a SWAT operation due to no riot gear. But: the police and canine were SWAT. Police with rifles were seen in the woods behind my home by neighbors. Attached is another of my FBI filing from I did not have the audio recordings when I brought it to FBI. It addresses just the written police reports. They are 100% psychosexual boilerplate. It is far into the land of insane. Most offensive: he threatened to rape his bosses. Only bosses for 100 miles were both male. Neither man reported or (otherwise admitted to) their fear or fantasy of violent homosexual rape. And what does THAT have to do with (made up) trespass? (Guilt in Proxy?) 18 The Court is asked to go to Page ( ) of this filing. On that page is absolute documentation of 18 corporate corruption of FBI processes. According to Martin Ogno of Wells Fargo Security in Portland OR: FBI does not take Clark s reports seriously. FBI processes do not work that way. 27 The Court is asked to go to Page 27( ) of this filing. Notice it was written a couple months AFTER events. For no reason, police entered me and my car into a special database for community violent
4 9th Cir. Case No Clark v. Wells Fargo et al Page 4 of 31 threats. It appears it was a federal system called National Incident-Based Reporting System (NIBRS), part of FBI s NCIS database. It is one of a handful of possible federal systems the police most likely frauded. It is easy to find the involved police officers and get the truth about the bigger picture. Almost immediately, guardianship of my adult retarded son was taken away for no reason while in process with Wells Fargo for employee reporting per law. The court claimed I was a threat of some sort so it makes sense for me to see a possible link, especially if a major federal system turns out to be involved. Wells Fargo retaliated via removal of family? I declare: once a person is entered into that Federal Crime Database all an attorney or law enforcement officer needs to do to accomplish nearly any other prejudicial legal action is to refer to that record. There was no reason I was threat listed. I wrote many letters to local police and police auditor to ascertain facts but was totally ignored. It astounds me that all Appellees even attempted to deny it all even when aware it was all captured on police records. It went badly downhill after this. Let there be trial or ADR, there is no valid reason this situation was obstructed from the Full Light of Justice for so long. /s/ Andrew Clark Andrew Glen Clark 3270 Stoney Ridge Rd.
