For any service or product, I will try to use Cook County suppliers. I would contract for professional services to avoid conflicts. 10. What is your position in regard to putting all Assistant State's Attorneys and other employees of your office under Civil Service or other merit systems? How would hiring minorities and women and retaining career personnel in your office be affected? I support hiring, employment and retention practices that promote fairness and equal opportunity. The baseline for prosecutor employment is legal competence and trial advocacy skill. The system does not function on behalf of victims or offenders if we tolerate anything less. 11. What is your position on state s attorney promotions based on convictions? Opposed. Such a practice incents behaviors counter to the pursuit of justice. People are not data points. 12. Do you favor mandatory drug testing of your employees, prisoners, and/or probationers, and under what circumstances and standards? Yes, using accepted legal protocols established for County employees. 13. Please address the issue of prosecuting police officers for police brutality or any other crime? Page 3 of 7

4 A. General: Essay I will prosecute crime no matter who commits it, including police officers. The trust we have with the public is to never let politics, uniforms, race, or money triumph over justice. I have put forward a plan for changing the way the State s Attorney s office deals with police involved shootings: senior prosecutor unit exclusively for police-involved shootings that reports direct to the chief prosecutor, varied investigative teams, use of grand juries, public report of charging rationale, never leave evidence control to municipal authorities. (Click this link for more) 14. What is the appropriate role for the State s Attorney Police force? Should it cooperate with other law enforcement agencies and if so, what guidelines should be followed? The SA does not have a police force; it has investigators and the Sherriff covers unincorporated Cook. That said, the SA should take a lead role in coordinating the efforts of the 128 law enforcement agencies in the County when it comes to prioritizing county wide crime prevention and reduction. 15. What means would you employ to encourage neighborhood outreach and citizen input into your office? One of the shortcomings of the current State s Attorney is a certain deafness when it comes to responding to community groups about crime reduction and prevention. I have a more activist view of the SA role and have proposed that the chief prosecutor take the lead in engaging parent, pastors, principals, police, businesses, social service agencies and not-for-profits in a community wide effort to combat crime. This safety alliance has a very high priority. Do you support: B. Civil Rights and Public Policy 16 X legislation to prohibit the use of eavesdropping and wire-tapping in criminal investigations? 17 X the mandatory videotaping of all interrogations? 18 X prosecuting cases based on citizen audio or video recording of a police officer? 19 X establishing an elected, all-civilian, police review board. 20 X Should any changes be made state of the law on fitness to stand trial and the insanity defense? If yes, please elaborate below. B. Civil Rights and Public Policy: Essay 21. What is your position on carrying concealed weapons? It is the law. I am required to enforce the law. 22. What is your position on capital punishment? Illinois repealed the death penalty. 23. How quickly is the State s Attorney s office required to turn around a Freedom of Information Request (FOIA). What do you think the turnaround time should be? The SA has five days to respond. Extensions of five days are allowed. I think the time frame is appropriate. 24. Under what circumstances should law enforcement agencies put citizens or organizations under surveillance? Too broad a question. It depends on circumstances and the evidence. Page 4 of 7

Prosecutorial Discretion Assistant States Attorneys having the power to reduce the charge from a felony to a misdemeanor or dismiss the case outright if the circumstances warrant? a program to integrate aspects of the juvenile justice and child welfare systems to better serve children who cross between the dependency and delinquency systems and recommend to the court which system could serve the best interests of the child and the safety of society? Please elaborate below. B. Prosecutorial Discretion: Essay 28. What criteria will you employ in reaching prosecution, sentencing recommendation, and immunity grant decisions? The criteria is fairness, consistency and justice. 29. Please comment on the felony screening process currently used by the State's Attorney's office. The assistants need better training in order to improve charging decisions. 30. What do you think about the use of programs as alternatives to prosecution? I am in favor of alternative programs. We need to make better use of the programs already in place. 31. Should the present procedures for bail and personal recognizance bonds be changed and, if so, how? Procedure is fine. It is the policy of how the office recommends bonding that needs to change so it is fair and consistent. 32. In what circumstances, if any, would your office seek to prosecute juveniles as adults? Depends on the nature of the crime, the criminal history of the juvenile and in accordance with the rules for transfer. 33. What would you do to reduce the wrongful prosecutions and convictions? Change culture of SAO from convictions rates to justice, offer better training, instill belief in doing what is right. 34. What would you do to avoid political influence on investigations and prosecutions? I would not have my campaign dependent on a politician nor would I have my campaign financed by entities beholden to that same politician. Page 5 of 7

Prosecutorial Priorities: Essay 37. What are your priorities in prosecuting various types of crime? What is your attitude toward prosecuting so called victimless crimes? Highest priorities are violent crime and public corruption. 38. Comment on the adequacy of the State's Attorney's treatment of crimes of domestic violence. Given that cases of domestic violence are complicated and emotional, we must ensure that assistants have specialized skills and training. We also need to take steps necessary to make sure that victims come forward and testify. 39. How would you address the problem of hate crimes and violence against racial minorities, gays, and lesbians? How would you implement the Hate Crimes statute? Assistants in felony review need to be intimately familiar with hate crimes laws and understand how to charge violators of those laws. 40. Under what circumstances would you prosecute political demonstrators? When demonstrators cross the line of civil disobedience and break the law. 41. Comment on the current procedures for handling rape cases. What changes would you make, if any? I would begin by investigating complaints that the SAO is not testing rape kits promptly. 42. What would you change, and what would you keep, in the present system of handling criminal housing prosecutions? Given limited resources, we will work to make sure that violators of fair housing law are prosecuted aggressively. 43. What are your proposals, if any, for increasing investigations and prosecution of election fraud? Where we are provided with a complaint, we will investigate and prosecute as necessary. B. Civil Duties: Essay 44. What types of cases involving law reform or civil activism (such as civil rights or environmental enforcement) would you anticipate bringing to the State's Attorney's office? 45. What proposals do you have to increase public corruption prosecutions? As a former federal prosecutor, I am serious about prosecuting public corruption. It is the elephant in every room when we talk about politics in Cook County. It is our finely tuned system of winks and nods, contracts with kickbacks, jobs Page 6 of 7

7 B. Civil Duties: Essay here for political favors there. The SA need to hold people accountable so government plays by the same rules and lives up to the same standards as everyone else. We need to double down on our efforts in this area and use our subpoena powers to make sure taxpayers are getting what they pay for. 46. What would you do to improve and manage potential conflict of interest recusal policies for yourself and your top assistants in order to avoid situations like the Jon Burge investigation? See answer to Question A Comment on the propriety of prosecutorial public criticism of judges on criminal case outcomes. Where public criticism of judicial decisions is warranted, I will comment.
