1 CITY OF ESCONDIDO FEBRUARY 25, :00 p.m. Meeting Minutes Escondido City Council Community Development Commission CALL TO ORDER The Regular Meeting of the Escondido City Council and Community Development Commission was called to order at 4:00 p.m. on Wednesday, February 25, 2009 in the Council Chambers at City Hall with Mayor Pfeiler presiding. FLAG SALUTE Mayor Pfeiler led the flag salute. ATTENDANCE The following members were present: Abed, Daniels, Diaz, Waldron, and Pfeiler. Quorum present. Also present were: Clay Phillips, City Manager; Jeffrey Epp, City Attorney; Jonathan Brindle, Community Development Director; Ed Domingue, Engineering Services Director; Marsha Whalen, City Clerk; and Liane Uhl, Minutes Clerk. PROCLAMATIONS Mayor Pfeiler introduced Gerald Hampton, NAACP, and acknowledged the celebration of the NAACP Centennial Year Anniversary. ORAL COMMUNICATIONS Karl Higgins, Underground Technologies, presented a series of slides and urged Council to use plastic manholes in the city. Russ Lane, Escondido City Employees Association, indicated the ECEA has audited the budget and would like to meet with management to discuss it. David Pio, Escondido, indicated there were parking problems on Hickory Street. Lisa Prazeau, Chamber of Citizens, thanked the Mayor and City Manager for publicly answering her questions from the January 21, 2009 Council meeting. 2 Steve Kildoo, Escondido Childrens Museum, thanked staff for putting the AMGEN Tour of California event together. CONSENT CALENDAR Mayor Pfeiler removed item 10 from the Consent Calendar for discussion. Councilmember Abed abstained on item 6. MOTION: Moved by Councilmember Daniels and seconded by Councilmember Waldron that the following Consent Calendar items be approved with the exception of items 6 and AFFIDAVITS OF PUBLICATION, MAILING AND POSTING (COUNCIL/CDC/RRB) 2. APPROVAL OF WARRANT REGISTER (Council/CDC) 3. APPROVAL OF MINUTES: None Scheduled 4. TREASURER S REPORT: FOURTH QUARTER 2008, OCTOBER THROUGH DECEMBER 2008 (File No ) Staff Recommendation: Receive and file (City Treasurer s Office: Kenneth Hugins) 5. RESOLUTION IN SUPPORT OF THE COUNTY OF SAN DIEGO S PARTICIPATION IN THE 2010 CAMPAIGN FOR ACTIVE TRANSPORTATION Request Council support the County of San Diego s participation in the 2010 Campaign for Active Transportation. (File No ) Staff Recommendation: None (Mayor Lori Holt Pfeiler) RESOLUTION NO GRAND AVENUE MERCADO PROJECT: STATUS REPORT AND SECOND AMENDMENT TO THE CONSULTING AGREEMENT Request Council authorize the Mayor and City Clerk to execute a Second Amendment to the Consulting Agreement with EDAW, Incorporated, in the amount of $24,005 for additional environmental planning and landscape architectural design services for the Grand Avenue-Mercado Project. (File No [A-2911]) Staff Recommendation: Approval (Engineering Services: Robb Zaino) Councilmember Abed abstained on this item. RESOLUTION NO ELECTION TO RECEIVE A SHARE OF TAX INCREMENT ALLOCATED UNDER THE ESCONDIDO REDEVELOPMENT PLAN Request Council allow the City of Escondido to elect to receive a share of Tax Increment under the Escondido Redevelopment Plan, pursuant to Safety Code Sections and (File No ) Staff Recommendation: Approval (City Attorney: Jeffrey Epp; and Finance Department: Gil Rojas) RESOLUTION NO GRANT OF AN EASEMENT TO THE SAN DIEGO GAS AND ELECTRIC COMPANY (SDG&E) FOR INTALLATION OF UNDERGROUND UTILITY FACILITIES AT HUBBARD HILL February 25, 2009 Escondido City Council Meeting Book 52 Page 314

3 Request Council authorize the Real Property Manager to execute a contract granting an easement to SDG&E for the installation of underground utility facilities at Hubbard Hill. (File No ) Staff Recommendation: Approval (Engineering Services: Anne Marc-Aurele) RESOLUTION NO GRANT OF EASEMENT TO COX COMMUNICATIONS FOR TELECOMMUNICATIONS BACKBONE FOR BEVEN DRIVE/EUREKA RANCH SUBDIVISION Request Council authorize the Real Property Manager to execute an easement to Cox Communications for telecommunication equipment servicing the Eureka Ranch subdivision (Tract 839). (File No ) Staff Recommendation: Approval (Engineering Services: Anne Marc-Aurele) RESOLUTION NO ESCONDIDO FIREFIGHTERS ASSOCIATION NON-SAFETY BARGAINING UNIT CONTRACT Request Council authorize the extension of the Firefighter s Association Non- Safety Bargaining Unit contract. (File No ) Staff Recommendation: Approval (Human Resources: Sheryl Bennett) RESOLUTION NO Mayor Pfeiler acknowledged the Escondido Firefighters Association Non-Safety Bargaining Unit for supporting the City with this agreement. MOTION: Moved by Mayor Pfeiler and seconded by Councilmember Daniels to authorize the extension of the Firefighter s Association Non-Safety Bargaining Unit contract and adopt Resolution No Motion carried unanimously. CONSENT - RESOLUTIONS AND ORDINANCES (COUNCIL/CDC/RRB) The following Resolutions and Ordinances were heard and acted upon by the City Council/CDC/RRB at a previous City Council/Community Development Commission/Mobilehome Rent Review meeting. (The title of Ordinances listed on the Consent Calendar are deemed to have been read and further reading waived.) 11. ZONING CODE AMENDMENT: REAL ESTATE KIOSK DIRECTIONAL SIGNS (CASE NO. 4 CURRENT BUSINESS 13. SECOND AMENDMENT TO THE AFFORDABLE HOUSING AGREEMENT TO PROVIDE ESCONDIDO SENIOR HOUSING PARTNERS, L.P. WITH AN ADDITIONAL OPPORTUNITY TO APPLY FOR 9% LOW INCOME HOUSING TAX CREDITS (LIHTC) FOR FINANCING OF A 60 UNIT SENIOR HOUSING REDEVELOPMENT PROJECT, LOCATED AT 215 EAST WASHINGTON AVENUE (FORMER SITE OF MOBILE HAVEN TRAILER PARK) (File No [CDC-658-A]) Staff Recommendation: Approval (Community Services/Housing Division: Roni Keiser) a. RESOLUTION NO. CDC b. RESOLUTION NO Roni Keiser, Housing Manager, gave the staff report and presented a series of slides. MOTION: Moved by Councilmember Abed and seconded by Councilmember Daniels to approve an additional opportunity to apply for 9% low income housing tax credits (LIHTC) for financing of a 60 unit Senior Housing Redevelopment Project, located at 215 East Washington Avenue (former site of Mobile Haven Trailer Park), adopt Resolution No. CDC and Resolution No Motion carried unanimously. 5-y 14. IMPASSE HEARING OF THE ESCONDIDO FIREFIGHTERS' ASSOCIATION (SAFETY) BARGAINING UNIT. In accordance with the City of Escondido Employer-Employee Relations Resolution, the City Council will receive presentations from the City's Management Negotiating Team and the Firefighters Association Negotiating Team regarding the status and positions of the parties in the current negotiations. The City Council will be asked to consider action which may involve directing the implementation of either party's positions, including the adoption of Resolution , or taking action to provide further direction to the negotiators regarding continued negotiations. (File No ) Staff Recommendation: Receive the presentation and provide direction to the negotiation team (Human Resources Dept.: Sheryl Bennett) RESOLUTION NO Nikos Wizner and Mike Powell, Escondido Firefighters Association, presented their compromise proposal. Sheryl Bennett, Human Resources Director, introduced Richard Kreisler, Negotiator, who presented the City s last, best and final offer. Lee Casad, Public Works Teamsters 911, asked Council to treat all bargaining units with fairness and equality and not give more to other units. Julius Turner, Public Works Teamsters 911, asked Council to treat all bargaining units the same. Richard Studinka, Public Works Teamsters 911, urged Council to treat all associations fairly. Chester Mordasini, Teamsters Local Union 911 President, urged Council to treat all association groups fairly. Teamsters have agreed to the City s terms and every other bargaining units should be treated the same. Russ Lane, Escondido City Employees Association, asked the Council to treat everyone equally. 5 MOTION: Moved by Councilmember Diaz and seconded by Councilmember Waldron to accept the Firefighters Association offer. Ayes: Diaz and Waldron. Noes: Abed, Daniels and Pfeiler. Absent: None. Motion failed. MOTION: Moved by Councilmember Daniels and seconded by Councilmember Abed to accept the City s last, best and final offer and adopt Resolution No Ayes: Abed, Daniels and Pfeiler. Noes: Diaz and Waldron. Absent: None. Motion carried. BRIEFING (Staff) None FUTURE AGENDA 15.
