1 City Commission Minutes Regular Session City Commission Chambers 101 S Lincoln Ave. Chanute, KS CALL TO ORDER PLEDGE OF ALLEGIANCE Vice-Mayor Jacob LaRue presided and called the meeting to order at 6:30 p.m., the Pledge of Allegiance was recited. Commissioners Present: Staff Present: Vice-Mayor Jacob LaRue and Commissioners Phillip Chaney, Tim Fairchild, and Randy Galemore. Mayor Sam Budreau was present via telephone. Jeff Cantrell, City Manager; Brian Duncan, Assistant City Attorney; Tina Bailey, City Clerk; Cory Kepley, Chief Finance Officer; Rick Willis, IT Director; and Ryan Follmer, Community Services Director. INVOCATION The invocation was given by Mr. Oliver Bunker, Grace Episcopal Church. AGENDA The Agenda was approved on motion by Commissioner Galemore, seconded by Commissioner Fairchild. Voting Aye: All. Motion carried unanimously. CONSENT AGENDA The Consent Agenda is used to approve non-controversial or routine matters by a single motion and vote. The Consent Agenda consisted of the following: Minutes City Commission September 10, 2018 Minutes Golf Course Advisory Committee July 9, 2018 Minutes Golf Course Advisory Committee September 10, 2018 Warrant Register dated September 12, 2018 Warrant Register dated September 19, 2018 Request to Hold Annual Turkey Trot 5K Run/Walk November 10, 2018 Motion made by Commissioner Fairchild, seconded by Commissioner Galemore, to approve the Consent Agenda. PUBLIC COMMENTS Linus Thuston, Neosho County Attorney, 102 S Lincoln requested permission to speak during Agenda Item 8B-Review of Ordinance Restricting Open Sale of Drugs Used to Manufacture Methamphetamine. 2 Commission consensus was to allow County Attorney Linus Thuston to speak during Agenda Item 8B. Ruthann Boatwright, Main Street Chanute Executive Director reported on upcoming Main Street events. CITY MANAGER S REPORT City Manager Jeff Cantrell reported that the City has received a request that the City consider accepting the Sierra Midwest building as a donation to the City of Chanute. General discussion was made. Comments were made by City Manager Cantrell and CRDA Executive Director Matt Godinez. Commission consensus was for the City Manager and CRDA Executive Director to tour the building and request a Phase 1 Environmental Study. NEW ITEMS REQUEST TO HOLD CHS HOMECOMING PARADE OCTOBER 3, 2018 Chanute High School Assistant Principal/Activities Director Eric Flaton, is requesting permission to temporarily block certain City streets in order to hold a CHS Homecoming Parade, Wednesday, October 3, 2018 at 5:30 p.m. The parade route will begin at Royster Middle School, travel east on Main Street and end at the corner of Main and Highland. CHS Homecoming Committee member Karen Graham provided a brief summary of their request. She reported that following the parade the annual pep rally will be held at the Main Street Pavilion. General discussion was made. Motion made by Commissioner Chaney, seconded by Commissioner Galemore, to approve the request to temporarily block certain streets for a CHS Homecoming Parade, Wednesday, October 3, Voting Aye: All. Motion carried unanimously. REVIEW OF ORDINANCE RESTRICTING OPEN SALE OF DRUGS USED TO MANUFACTURE METHAMPHETAMINE The governing body recently asked that Ordinance No be returned to the governing body for review. City staff has reviewed this matter with County Attorney, Linus Thuston and David Clark and have concluded that there is a favorable, and correlative effect in limiting manufacturing of local methamphetamine. Commissioner Chaney agreed that there is a meth problem in Chanute but would like statistics showing that restricting the purchase of pseudoephedrine by prescription only is working. He said allergy sufferers are paying an additional cost to get a prescription from their doctor. Page 2 of 5

3 General discussion was made. Comments were made by Neosho County Attorney Linus Thuston, City Manager Jeff Cantrell, and Assistant City Attorney Brian Duncan. Commission consensus was that it is up to the Community to end the drug problem in Chanute. CONSIDER CART BARN RE-BUILD BID The City s cart barn was recently lost due to fire on the evening of August 26, Whitworth Construction has submitted a proposal in the amount of $28,000 for expedited replacement of the cart barn. Other contractors were contacted but weren t able to provide a quick-build schedule. City crews are at capacity and will be for some time, eliminating internal labor as a viable option for this project. Utilization of non-programmed funds will not significantly disrupt our projected year-ending fund balance. Motion made by Mayor Budreau, seconded by Commissioner Fairchild, to approve the Cart Barn Re-Build Proposal from Whitworth Construction, Inc. in the amount of $28,000. Voting Aye: All. Motion carried unanimously. Commissioner Chaney also requested clarification on the City Commission s position of potential claims for the loss of golf carts as a result of the fire. The City Commission concurred that the Kansas Tort Act provides the City immunity from such claims and that the City is not liable to replace the golf carts. NEIGHBORHOOD REVITALIZATION APPLICATION PETE S CORPORATION Pete s Corporation, has submitted an application under the Neighborhood Revitalization Program. It has been verified that the properties listed under the scope of the application, 701 N Santa Fe, parcel identification number and 715 N Santa Fe, parcel identification number are within the scope of the city limits of Chanute. The application has been approved by the Neosho County Appraisers office along with the Neosho County Treasurer s office. The application is now being submitted to the City Commission for consideration and approval. General discussion was made. Comments were made by CRDA Executive Director Matt Godinez. Motion by Commissioner Chaney, seconded by Mayor Budreau, to approve the Neighborhood Revitalization Application Pete s Corporation. Voting Aye: All. Motion carried unanimously. PROPERTY RESOLUTION 214 N HIGHLAND PROPERTY RESOLUTION 1810 S ASHBY PROPERTY RESOLUTION 502 N WASHINGTON Motion made by Commissioner Chaney, seconded by Commissioner Galemore, to adopt resolution declaring that the above properties are in violation of Chanute Municipal Codes and Page 3 of 5

4 authorizing abatement of certain nuisances as presented. Voting Aye: All. Motion carried unanimously. The Resolutions were assigned: No , No , and No COMMISSION COMMENTS Commissioner Chaney requested that Mr. Rick Ridout approach the Commission with his request. Rick Ridout reported that he is opening a new laundromat at 1405 S Santa Fe and requested that the City Commission consider waiving the City s fees for a new gas line to this location. General discussion was made. Comments were made by City Manager Jeff Cantrell and Community Services Director Ryan Follmer. Motion made by Commissioner Chaney, seconded by Commissioner Galemore, to waive half of the fees, with the City s half not to exceed $800, for the new gas line to Mr. Ridout s laundromat located at 1405 S Santa Fe. Voting Aye: All. Motion carried unanimously. Commissioner Fairchild commented on the methamphetamine discussion and that the Community has to decide that they want this problem to stop. Mayor Budreau reported that he had received complaints of tire repairs due to nails when traveling on 14 th Street to the City landfill. City Manager Cantrell reported that the City has purchased a magnet that will be placed on a City truck and dragged throughout town to pick up nails and debris. Commissioner Chaney commented that he appreciated tonight s methamphetamine conversation and that the Community needs to make a choice for change. Commissioner Chaney commented on dilapidated housing and the County Tax Sale. General discussion was made. Comments were made by City Manager Jeff Cantrell, Assistant City Attorney Brian Duncan, and Community Services Director Ryan Follmer. Commission consensus was for the City Attorney to prepare a letter from the Chanute City Commission to the Neosho County Commission requesting more frequent tax sales. The Commission also requested a future joint work session with the County Commission to discuss this item. Commissioner Chaney commented on several damaged downtown banner holders located on the 100 and 200 blocks of West Main. He also commented on the weathered banners located along the railroad tracks. 5 City Manager Cantrell will research repair of the damaged banner holders. Vice-Mayor LaRue requested an update on previous fiber to the neighborhood discussion. General discussion was made. Comments were made by City Manager Jeff Cantrell and Chief Finance Officer Cory Kepley. Mr. Kepley reported that James Lightfoot with ACRS plans to present this item to the Commission at the last regular City Commission meeting in October or the first meeting in November.
