AsyouwillrecallfrommyJanuary2,2013letter,therehasbeenamarkedincreaseinthe numberofimportrejectionsofaustralianmeatproductsatourportsnofnentrysincethe implementationofaemis.aemisisaprivatizedinspectionsystemthatremoves Australiangovernmentinspectorsfromslaughterlinesandtransfersthosedutiesto companyemployeestoperform.itispatternedafterthehaccpnbasedinspectionmodels Project(HIMP)beingpilotedinfivehogslaughterplantshereintheUnitedStates.Inthat Januaryletter,weattachedacommunicationbetweenFSISandtheAustralianDepartment ofagriculture,fisheriesandforestry(daff) saustralianquarantineandinspection Service(AQIS)aboutthoseimportrejectionsforvisiblefecalandingestacontamination.In addition,wesentyouinternalaustralianmeatindustrycommunicationsthatdescribedthe levelofpanicthatwasbeginningtosurfaceabouttheimportrejectionsendangering furtherprivatizationofthemeatinspectionprograminaustralia. 1 WejustlearnedthatonJune4,2013,officialsfromtheAustralianDAFFmetwithstafffrom FSIStodiscussrecentimportrejectionsfromtwoAustralianmeatplantsthatexporttothe UnitedStates AustralianEstablishment2309,FletcherInternationalExports,and AustralianEstablishment866,LobethalAustraliaPtyLtd.Theproductsfromthesetwo plantswererejectedinmay2013forvisiblefecalandingestacontamination.whatis 1 LetterfromWenonahHauter,ExecutiveDirectorofFood&WaterWatch.toAgricultureSecretaryTom Vilsack,January2,2013.
2 noteworthyaboutthesetwoplantsisthefactthattheyhadbeenbothbeendelistedfrom eligibilitytoexporttotheunitedstatesin2012,relistedinearly2013anddelistedagainin May2013.Asyouknow,fecesandingestaaresourcesofmicrobiologicalcontamination thatcanleadtofoodborneillness. Inresponsetotheimportrejectionsofproductsfromthesetwoestablishments,DAFFhas decidedtointensifyinspectionofthoseplantswithgovernmentinspectors.so,privatizing inspectioninaustraliahasledtoincreasedgovernmentverification.itseemstousthatthe AustralianshaveadmittedthatAEMIShasfailed. SincemyJanuary2,2013letter,therehasbeenanothernoteworthydevelopmentthatcalls intoquestionthewisdomoffsisgrantingequivalencystatustoaemisortoanyother foreignmeatinspectionsystemthatisbasedonhimp.aemiswasgrantedequivalency statusbasedonahimppilotprojectbeingconductedinfiveu.s.hogslaughterplants.food &WaterWatchhasdisagreedwiththisapproachsinceapilotprojectisnotrepresentative ofthehogslaughterindustryasawhole thesefiveplantscomprise0.81percentofthe 616hogslaughterplantsthathavegrantsofinspectionintheUnitedStates muchless thantheentiremeatindustry.butsince2006,fsishasgrantedequivalencystatusto foreignbeef,mutton,goatslaughterinspectionsystemsbasedonhognslaughterhimp. Thisseemsincongruoustousasthemethodsofslaughteraresomuchdifferentamong thesespeciesofanimals.butthereisanothersignificantissue.onmay14,2013,theusda OfficeofInspectorGeneral(OIG)issuedaverycriticalauditreportthathasreceived widespreadpublicityentitled, FoodSafetyandInspectionService Inspectionand EnforcementActivitiesatSwineSlaughterPlants. Inthatauditreport,theOIGmadethe followingobservations: AlthoughHIMPwasintendedtoimprovefoodsafety,wefoundthat3ofthe 10plantscitedwiththemostNRs(nonNcompliancereports)fromFYs2008 to2011werehimpplants.infact,theswineplantwiththemostnrsduring thistimeframewasahimpplant withnearly50percentmorenrsthanthe plantwiththenexthighestnumber Inthe15yearssincetheprogram sinception,fsisdidnotcriticallyassess whetherthenewinspectionprocesshadmeasurablyimprovedfoodsafetyat eachswinehimpplant akeygoalofthehimpprogram.fsisofficialstold usthat, the[himpprogramwas]intendedtohelptheagency...improve uponthelevelofprotectionprovidedbycurrentinspectionprocedures. Therefore,FSISneedstodeterminewhatmeasurableimprovementto inspectionproceduresisexpectedasaresultofthehimpprogram.asof January2013,FSIShasnotcompletedtheassessment. Additionally,becauseHIMPisstillinapilotstage,FSISneedstoreviewthe program sprogresstodetermineitssuitabilityasapermanentprogram.fsis shouldevaluatehimpplants noncompliancehistoriesandallowonlythose plantswithastronghistoryofregulatorycompliancetoremaininthe program.withoutareview,himpplantsthatarecontinuallynoncompliant 2
3 suchastheswineplantwiththemostnrsnationwide havelessassurance offoodsafetythanatraditionalplant. 2 Domestically,thehogplantsoperatingundertheprivatizedinspectionpilotmayhavebeen producinglesssafeproducts.internationally,fsishasbeenbasingitsequivalency determinationsonaflawedinspectionmodelthatrendersthosedeterminationsflawedas well,leavingu.s.consumersvulnerabletounsafeimportedmeatproducts.weneednotgo toofarbackinhistoryortoofarindistancetofindsuchanexample.in2012,canada experienceditslargestmeatrecallinhistorywhenbeefproductsfromcanadian Establishment38,theformerXLFoodsplant,werefoundtobecontaminatedwithE.coli' 0157:H7'(whichwasoriginallydiscoveredbytheUSDAinspectionprogramalongthe CanadianborderthattheObamaAdministrationseemstowanttoeliminate).Eighteen Canadianconsumersweremadeillfromthatbeef.Over4millionpoundsweresubjectto therecallhereintheunitedstatesaswehadimportedsomeofthebeef.thatplantwas operatingunderthehighlinespeedinspectionsystem(hlis)forcattleslaughterinwhich mostoftheinspectionwasturnedovertocompanyemployeestoperform.inmarch2006, FSISgrantedtheCanadianFoodInspectionAgencyequivalencystatusforHLISbasedon ourhimppilotinhogslaughter. 3 ButtheserecenteventsdonotseemtodissuadeUnder SecretaryforFoodSafetyElisabethHagenwhowasrecentlyquotedasbeingaproponent ofmovingforwardwiththeexpansionofhimpinhogandbeefslaughterhereintheunited States. 4 WehavealsolearnedinrecentweeksthattheEuropeanUnionhasexpressedconcernover meatproductsimportedfromaustralianestablishmentsoperatingunderaemis. Specifically,theconcernliesinthepossibleconflictsofinterestofthecompanyinspectors ontheslaughterlinessincetheyreceivebonusesfromtheiremployerstokeepproduction up.consequently,thesecompanynpaidemployeeswouldbereluctanttoshutdownoreven slowdownaslaughterlineforfoodsafetyviolations.ironically,thiswasasimilarconcern expressedbyanfsisauditorinmarch2011whenhe/shevisitedaustralianestablishment 0080,NolanMeatsPtyLtd.ThatparticularplantwastheonlyAustralianestablishmentto pilottheaemisinspectionmodelpriortofsismakingitsequivalencydeterminationon AEMIS.IntheauditreportthattheFSISauditorfiled,thefollowingobservationwasmade: EmployeesoftheestablishmentthatworkasAQISApprovedOfficers(AAO) conductingofficialpostmorteminspection,receivefinancialbenefitsthatare tiedtoprofitsgeneratedbytheoperatoroftheestablishmentwhose productstheyinspect.theseaaosreceivesalariesandprofitsharing 2USDAOfficeofInspectorGeneral. WeunderstandthatFSISplanstoconductanewauditoftheAustralianmeatinspection systemlaterthismonth.inlightoftheonngoingproblemssincethefullimplementationof AEMIS,weurgethatathoroughevaluationoftheAEMISinspectionsystembeconductedin thataudit.frankly,webelievethataemisshouldbescrappedandyoushouldbeginthe processtoceaseitsrecognitionasanequivalentinspectionsystemsinceitisdeeplyflawed forthereasonsicitedabove.
