14 Pollinator Health PA (SB 231) An Act Concerning Pollinator Health Prohibits neonicotinoid applications on basswood or linden trees or plants in blossom Requires DEEP to classify certain neonics as restricted use pesticides Requires DoAg to develop best practices for minimizing neonics dust from treated seeds Requires CAES to develop a citizen s guide on model pollinator health Establishes a Pollinator Health Committee 11/22/16 Capitol Consulting LLC 14

16 Pollinator Health PA Neonicotinoid Definition The act defines neonicotinoid as a pesticide that selectively acts on an organism s nervous system as well as pesticides that DEEP and CAES determine will kill at least 50% of a bee population when up to two micrograms of the pesticide is applied to each bee. This definition specifically includes: clothianidin, dinotefuran, imidacloprid & thiamethoxam. 11/22/16 Capitol Consulting LLC 16

17 Pollinator Health PA Restricted Use Pesticides No later than January 1, 2018 the act requires DEEP to classify all neonics labeled for treating plants as restricted use pesticides. This classification requires these pesticides be applied only by or under the direct supervision of a certified applicator. Important to note: that any certified applicator is not affected by this legislation with respect to products the may or may not use. Citizens without an applicator license will be prohibited from using restrict use pesticides. 11/22/16 Capitol Consulting LLC 17

18 Pollinator Health No later than January 1, 2018 the act requires DEEP to classify all neonics labeled for treating plants as restricted use pesticides. On October 13, 2016 DEEP approved a list of neonics that would be classified as restricted use. On November 1 st DEEP established a timeline for wholesalers, distributors & retailers Wholesalers & distributors can sell neonics to retailers until 12/31/16 Retailers have until 1/1/18 to sell off existing inventory Consumers have until 1/1/19 to use neonics 11/22/16 Capitol Consulting LLC 18

19 Treatment of Bed Bugs PA (HB 5335) Responsibilities of Landlords & Tenants Regarding the Treatment of Bed Bugs Establishes a framework for treatment of bed bugs in rental properties, public housing but excludes single family homes. If a tenant suspect a beg bug infestation the landlord is required to hire a third party inspector. Landlords are required to hire a pest control agent if they aren t successful in treating bed bug infestation. Tenants are responsible for cost of if they knowingly fail to compile with treatment measures. Prohibits landlords from renting units that they know or suspect are infested with bed bugs. 11/22/16 Capitol Consulting LLC 19

20 Removal of Trees and Shrubs PA (HB 5150) Notices on Trees and Shrubs Prior to Removal This act applies to telephone, telecommunication and electric distribution companies. By Jan. 31, 2017 utilities intending to conduct vegetation management annually provide tree wardens a plan and schedules for activity. Towns must make these plans available to the public within 14-days. Requires the removal or disposal of any debris Notices by tree wardens may be posted groups of shrubs rather individual shrubs. 21 State Water Plan PA (HB 5540) State Water Plan Under current law the Water Planning Council must submit a state water plan to the General Assembly by January 1, This act allows legislative committees to hold hearings and either submit the plan to the General Assembly for approval or return the plan to the WPC for revisions. Under this act the plan is approved when the legislature adopts it by an affirmative vote. If the legislature fails to act within 2-years of submittal the plan is sent to the Governor for adoption or rejection. 11/22/16 Capitol Consulting LLC 21

22 Running Bamboo PA section 7 (SB 230) Technical Changes to Environment Related Statutes This act prohibits the planting of running bamboo within 40-feet of abutting property or a public right-ofway.
