2 CITY OF GLENDORA March 7, 2017 General Municipal Election Dear Candidate: Thank you for your interest in the City of Glendora. Running for public office is a challenging and exciting experience that carries with it certain legal responsibilities and obligations. This Candidate Information Guide provides you with an overview of the major provisions related to the election process and the issuance of nomination documents for the March 7, 2017 General Municipal Election as outlined in local and state law. The Candidate Information Guide contains critical deadlines, rules and guidelines for campaigning, campaign finance disclosure filing requirements and a number of City and State conditions. It should be noted that the March 7, 2017 General Municipal Election will be a consolidated election with the Los Angeles Registrar of Voters so responsibilities will be shared. Running for office can be a confusing and difficult process, as laws frequently change. Forms, schedules and instructional materials are enclosed for you to use in meeting such requirements and I encourage your careful review of this information. For additional regulations, you may wish to review the California Elections Code, the California Government Code and the California Secretary of State website. The City Clerk s Office also recommends that any prospective candidate obtain legal advice to assist in complying with applicable California laws. The City Clerk s Office is committed to providing the best possible service to you, your campaign staff, and the voters of the City of Glendora. The official election hours for the Glendora City Clerk s Department are Monday through Friday 8:00 a.m. to 5:00 p.m., excluding holidays. The City Clerk s Department will be closed on the following dates during the nomination period: Thursday and Friday, November 24 and 25, 2016 for the Thanksgiving holiday. In order to allow us to provide quality service to each prospective candidate, please plan on setting aside approximately 30 minutes when scheduling an appointment with the City Clerk s Office to return your nomination documents. 3 About the City of Glendora OUR TOWN Glendora is nestled at the base of the scenic San Gabriel Mountains, in the eastern portion of Los Angeles County. Located approximately 27 miles from downtown Los Angeles, Glendora offers convenient access to major commercial, cultural, educational and recreational areas in Southern California. Affectionately known as the Pride of the Foothills, Glendora boasts one of Southern California's most attractive residential communities with its tree-lined neighborhood streets and quaint downtown Village shops to the modern architecture of the Financial Way business center. Glendora is a haven from the fast pace of the Los Angeles metropolitan area. Glendora s residents find pride in their superior schools, interactive government, and unparalleled lifestyle. Glendora is a great place to live, work and play. GOVERNMENT Founded in 1887, and officially incorporated in 1911, Glendora is a general law city. General Law cities operate under the basic laws established by California s Codes for cities. Glendora is a full-service City, offering its own police, public works, water, planning, economic development, library, and parks and community services programs. CITY COUNCIL Glendora maintains a Council/City Manager form of government. Residents elect five (5) Council Members at large to represent them. As elected representatives of its citizens, the City Council develops and establishes ordinances, provides direction to staff and sets policies in the best interest of the City. The City Council is the legislative body and is similar to a board of directors in a private corporation, appointing a City Manager to conduct the City s day-to-day affairs. Appointment of the Mayor and Mayor Pro Tem The Mayor is appointed by the City Council and is responsible for the following: Presides over the City Council meetings Represents the City at ceremonial events Signs all contracts, ordinances, resolutions and other documents as specified The Mayor Pro Tem is also appointed by the City Council and acts in place of the Mayor during his/her absence. Compensation City Council Members are compensated $700 per month, pursuant to Ordinance No In addition, the City Council also serves as the Successor Agency to the former Community Redevelopment Agency, Glendora Housing Authority and the Glendora Public Financing Authority, but receives no additional stipend for serving on said boards. Meetings Regular City Council meetings are held on the second and fourth Tuesdays of the month at 7:00 p.m. in the Council Chamber. Special or Adjourned meetings may be held as needed. 5 About Glendora General Municipal Elections Q. How many Council seats will be open for this election? A. Two open Council seats will be voted for in the 2017 election. Q. What are the eligibility requirements for running for a City Council seat? A. To hold any elective office within the City of Glendora, a person must be a United States citizen, 18 years or older, and be a registered voter of the City at the time the nomination paper is issued. The City Clerk will not issue a nomination paper if the candidate is not a registered voter. (California Elections Code [ E.C. ] 201.) If an elected official moves his or her place of residence outside of the City limits or ceases to be an elector of the City during his or her term of office, the office of that elected official shall immediately become vacant. (California Government Code [ G.C. ] ) Q. Is there a filing fee involved in my candidacy? A. No! There is no filing fee for a candidate for municipal office in Glendora. However, a deposit will be required to cover the cost of printing and required translation of the Candidate Statement, if you choose to file one. Q. Who can sign my nomination paper? A. Any registered voter in the jurisdiction of the incorporated City of Glendora may sign a nomination paper. This includes the candidate and/ or the circulator. No voter may sign more than one nomination paper for the same office. Each seat on the City Council is a separate office. Therefore, a citizen may sign a nomination paper for two different candidates for this election. Your nomination paper must contain at least 20 and not more than 30 signatures; a minimum of 20 must be verified for your nomination to be valid. Q. When will I be informed of my candidate qualification status? A. You will be informed by telephone and in writing as soon as your Nomination Papers are qualified or disqualified by the Los Angeles County Registrar. Q. When does a candidate s nomination become public? A. A candidate s name becomes public information from the time a candidate submits his/her nomination paper or files a Candidate Intention Statement (Form 501). The nomination paper, however, is not immediately available for public review. Q. What happens if some of the signatures I obtain on my nomination paper are not registered voters or do not live within the city limits? A. These signatures will not be counted toward the 20 signatures required for you to run for office. You must have 20 valid signatures to qualify as a candidate. The petition has 30 lines for signatures so it is advisable to get all thirty lines with qualified signatures. You may also want to file your nomination paper as early as possible so that the signatures can be validated. If you file early, you may still have an opportunity to received and circulate a supplemental nomination paper to obtain additional signatures in order to qualify you as a candidate. Q. What if I change my mind about running for office after filing nomination paper? A. You may withdraw as a candidate at any time PRIOR to the close of the nomination period, which is Friday, December 9, 2016 (or Wednesday, December 14, 2016, if the nomination period is extended). You are NOT permitted to officially withdraw after that date, and your name will appear on the ballot. Q. May I change or correct the spelling/wording on my Candidate's Statement after it has been submitted? A. No, you may not. Check your Candidate s Statement carefully before it is submitted. It will be printed exactly as submitted. Your statement can be withdrawn but not changed until 5:00 p.m. of the next working day following the close of the nomination period (E.C ). Q. How soon will the Final List of Candidates be available after the close of the nomination period? A. A complete list of candidates will be available the first working day following the close of the filing period, assuming all nomination paper signatures have been verified. Q. Does it cost anything to open a committee and file a Statement of Organization (Form 410)? A. Yes, effective January 1, 2013 (pursuant to SB 1001 (Yee)) all committees required to file the Form 410 must pay a $50 annual fee to the Secretary of State, the fee must be paid within 15 days of filing the Form 410. The annual fee must be paid no later than January 15 of each year until the committee terminates. 6 About Glendora General Municipal Elections Q. May I circulate Vote-By-Mail ballot applications? A. Yes, an individual, group or organization may distribute applications for Vote-By-Mail ballots. However, applications must use the uniform format approved by the Secretary of State. See the Secretary of State guidelines for distributing Vote-By-Mail Application and Vote-By-Mail application. Q. When officeholders or candidates receive contributions of $2,000 or more, are they required to have a committee? A. Yes, an officeholder or candidate who receives contributions (including loans) that total $2,000 or more in a calendar year must file a Statement of Organization, Form 410. Q. If I am only spending my own money on my campaign, do I still need to file campaign statements? A. Yes, you are still subject to the filing requirements of the Political Reform Act. If you plan to use personal funds to pay for campaign expenses, you should first deposit those funds into a campaign bank account opened for the purpose of your campaign. PLEASE NOTE: The only exception to this is that a candidate MAY use personal funds to pay the cost of their candidate s statement without first depositing those funds into a campaign bank account. Q. Must a committee wait until $2,000 is received to file a statement of organization? A. No, a committee may file a Statement of Organization before it is actually qualified. Not Yet Qualified should be entered in the " Date Qualified space on the form. Q. Where can I obtain filing forms? A. Campaign disclosure forms are available from the Fair Political Practices Commission (FPPC) website at click on View All Forms ; then click on the appropriate Form and/or Manual. Q. May I serve as my own campaign treasurer? A. Yes, State law allows you to serve as your own treasurer, as long as this is designated on the Form 410 Statement of Organization. Q. What happens if a candidate or treasurer is not available to sign a campaign disclosure statement on or before the filing deadline? A. An agent of the candidate or treasurer may sign the campaign disclosure statement. The agent must attach an explanatory note to the statement stating that as soon as the candidate or treasurer is available, he/she will verify and sign the statement and an amendment with the proper signature will be filed. In the event a committee treasurer will be unavailable to carry out his/her duties for an extended period of time, a new treasurer should be designated and the committee's Statement of Organization, Form 410, amended. Q. Are extensions given for campaign disclosure filing deadlines? A. Except for deadlines that fall on a Saturday, Sunday or official state holidays, no provisions exist for extensions of filing deadlines. A statement not filed on or before the deadline is considered late and is subject to late-filing penalties. Q. Why is there so much paperwork involved in being a candidate? A. State law requires that you file the appropriate materials to assure the voters that you are fully disclosing all information pertinent to your candidacy. The purpose of the requirements is to ensure a fair and democratic electoral process. Q. When will sample ballots be mailed to voters? A. State law requires sample ballots to be mailed to all qualified voters between 40 and 21 days before the election. Sample ballots will be mailed by the Los Angeles County Election Division. Q. How can I find out the election results? A. All semi-final results will be released from the Registrar-Recorder/County Clerk s Office at: Los Angeles County Registrar-Recorder/County Clerk, Imperial Highway, Norwalk, CA Semi-final election results will be continuously updated and displayed on the County s website, throughout Election Night and during the Official Canvass process. Bulletins are updated and results released approximately every 30 minutes until the last Semi- Official Results are tallied on Election Night. The County has (28) Days following the date of the election to complete the canvass. Q. When will the newly elected Council members take office? A. At the first regular meeting following the presentation of the 28-day canvass by Los Angeles County, or at a special meeting called for this purpose, the City Council will declare the results and install the newly elected council members. If a candidate statement is formatted to include numerous paragraph breaks and/or individual listings of accomplishments, endorsements, etc., the printed candidate statement may extend to two (2) pages. In these cases, the actual cost for the candidate statement may double and the candidate will be billed accordingly. The estimated cost for printing and translating the Candidate Statement in English and Spanish is $1,800 (two pages) The estimated cost of a Candidate Statement is calculated based on the anticipated cost of printing, handling and translating statement, with the assumption that multiple candidates will use statements and share the costs. The estimate is just an approximation of the actual cost and varies from election to election. The actual cost may be significantly more or less than the estimate. The City elections official is not bound by the estimate and may bill the candidate for additional actual expense or refund any excess paid depending on the final actual cost. My Candidate Statement can be withdrawn, by written request, any time during the nomination period and up to 5:00 p.m. on the next working day after the final filing date (EC (a)(3). After receipt of the printer s invoice and actual costs determined, candidates will receive a refund or a demand for additional payment. 34 NOMINATION PAPER GUIDELINES March 7, 2017 General Municipal Election Issuance of Nomination Paper and Requirements A nomination paper must be issued in the name of an individual candidate for nomination to a specific office and term of office. The candidate must be a resident of the City of Glendora (incorporated areas) and a registered voter of the City of Glendora at the time the nomination paper is issued. Candidates may be nominated by signatures of not less than 20 or more than 30 Glendora registered voters. If the nomination paper is determined to be insufficient or the candidate fails to obtain the correct number of valid signatures on the nomination paper, a supplemental petition will be issued on which the candidate may collect additional signatures. The supplemental petition must be filed not later than the last day of filing for that office. Nomination Papers must be pulled or filed during regular business hours, Monday through Friday from 8:00 a.m. to 5:00 p.m. You are strongly encouraged to make an appointment to file your Nomination Documents and individually review all procedures for candidacy with the City of Glendora s City Clerk. Call the City Clerk s Office at (626) to schedule your appointment. The nomination period begins on Monday, November 14, 2016 and ends at 5:00 p.m. on Friday, December 9, Circulation of Nomination Paper The circulator of a nomination paper must be 18 years of age or older at the time he/she circulates the paper. A candidate may circulate his/her own nomination paper. Only ONE (1) person may circulate each paper. Each candidate should carefully read the instruction on the nomination form. The required information must be neatly printed or typed. Signing the Nomination Paper A person must be registered to vote in the City of Glendora at the time of signing a nomination paper. The voter shall personally affix his/her signature and print his/her name and place of residence to the nomination paper in the place provided. A candidate may sign his/her own nomination paper. The circulator may also sign the paper to nominate the candidate. Signing more than one Nomination Paper Since there are two (2) seats to be filled at the election, an individual Glendora registered voter may sign a nomination paper for three (3) different candidates. If a registered voter signs multiple nomination papers for the same office, the voter s signature shall count only on the first three nomination papers filed with the City Clerk s Office. Declaration of Circulator Whomever circulates the nomination paper must complete the Declaration of Circulator in his/her own hand on the reverse side of the form where indicated affirming that all signatures obtained on the nomination paper were made in their presence and that, to the best of their knowledge and belief, each signature is the genuine signature of the person whose name it purports to be. Affidavit of Nominee and Oath or Affirmation of Allegiance The nominee must sign the Affidavit of Nominee and Oath or Affirmation of Allegiance in the presence of the City Clerk or a Notary Public. Once the nomination documents have been submitted to the City Clerk s Office, the City Clerk will verify the signatures of the signers on the Nomination Paper with the registration affidavits on file in the office of the Registrar of Voters. The City Clerk will notify candidates by telephone and in writing as soon as Nomination Papers are qualified or disqualified. 61 March 7, 2017 General Municipal Election CITY OF GLENDORA Campaign signs may be posted or placed on private property with property owner s permission. Campaign signs shall not be posted or placed in any way that poses a hazard or traffic sight visibility problem to motorists, pedestrians or cyclists using the public rights-of-way or in any manner that creates a hazard. The City may remove any campaign sign that it deems to be improperly placed. Campaign signs and billboards SHALL NOT be posted or placed on any building owned, operated, or leased by a public agency; on or within the confines of any public parks, recreation area, or other type of landscaped ground owned or operated by the City or other governmental agency; upon any flagpole or public tree; on any fence owned by a public agency; on any traffic-control sign or device; or on any telephone or utility pole. Examples of improper sign placement locations are: On fences along County flood control channels; Nailed or otherwise attached to any public tree (street or park) or utility pole; In any public tree well; On medians in public streets; On parkways (between the sidewalk and the street); generally speaking, the right-of-way on streets with no sidewalk extends ten feet from curb or end of street pavement. The City may, without prior notice, remove campaign signs that are placed on public property as described above. Candidates may reclaim improperly placed signs that are removed by City crews at the City Yard, 440 S. Loraine Avenue, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, holidays excepted. Signs not claimed within 72 hours of removal may be destroyed. The City and its employees are not liable for any claims of damage or loss resulting from the removal, storage or disposal of improperly placed signs. Candidates may wish to visit the City Yard on a regular basis to reclaim any of their improperly placed signs that were removed by City crews. Further questions on the proper placement of campaign signs should be directed to the City Clerk at (626) or the Public Works Director at (626) Campaign signs may be posted 60 days before the election and must be removed within five days after the election. Each candidate is held responsible by the City for the posting and removal of his/her campaign signs. SOUTHERN CALIFORNIA EDISON It is unlawful to post materials on Edison-owned utility poles (California Penal Code and 591). Listed as a misdemeanor, the Penal Code states that the offense is punishable by a fine of $500 and a maximum five-year imprisonment. CALTRANS The California Department of Transportation specifies State law governing campaign signs. Temporary political signs shall not be placed within the right-of-way of any highway, or be visible within 660 feet from the edge of the right-of-way of a classified landscaped freeway. State law directs the Department of Transportation to remove unauthorized temporary political signs and bill the responsible party for their removal. 62 March 7, 2017 General Municipal Election California Elections Code No person, on election day, or at any time that a voter may be casting a ballot, shall, within 100 feet of a polling place, a satellite location under Section 3018, or an elections official's office: (a) Circulate an initiative, referendum, recall, or nomination petition or any other petition. (b) Solicit a vote or speak to a voter on the subject of marking his or her ballot. (c) Place a sign relating to voters' qualifications or speak to a voter on the subject of his or her qualifications except as provided in Section (d) Do any electioneering as defined by Section Poll Watcher State law permits people to be present at polling places to observe the voting process on Election Day. However, no person may engage in electioneering or other election related conduct within one hundred feet of a polling place. (California Elections Code 18370). A decision by Los Angeles Superior Court judge held that election officials have discretion to define what conduct constitutes electioneering. Accordingly, candidates and those connected with their campaigns are advised as follows: 1. You should not visit polling places to introduce yourself to or shake hands with poll workers or those voting at the polls. 2. You should not give gifts of any kind, including gifts of food, beverage, candy, flowers, etc., to poll workers. 3. You should not display any badges, buttons, clothing, hats, kerchiefs, signs, pens, pencils, or any thing else that in any way suggests support for or opposition to any candidate or ballot measure at the polls. 4. If you drive to the polls in a vehicle with a sign or bumper sticker suggesting support for or opposition to any candidate or ballot measure, do not drive or park within 100 feet of the polling location. 5. You should follow these Poll Watcher guidelines: Have the right to be there to observe. No authorization is required. There are no qualifications required. Must not interfere with the voting process. Rules regarding proper conduct will be strictly enforced and that such rules apply within 100 feet of a polling place (i.e., within 100 feet of any building where voting is taking place) (a) No candidate or representative of a candidate, and no proponent, opponent, or representative of a proponent or opponent, of an initiative, referendum, or recall measure, or of a charter amendment, shall solicit the vote of a vote by mail voter, or do any electioneering, while in the residence or in the immediate presence of the voter, and during the time he or she knows the vote by mail voter is voting. (b) Any person who knowingly violates this section is guilty of a misdemeanor. (c) This section shall not be construed to conflict with any provision of the federal Voting Rights Act of 1965, as amended, nor to preclude electioneering by mail or telephone or in public places, except as prohibited by Section 18370, or by any other provision of law. In addition to any other penalty, any person who prints or otherwise duplicates, or causes to be printed or duplicated, a simulated ballot or simulated sample ballot that does not contain the statement required by Section or that uses an official seal or insignia in violation thereof, is guilty of a misdemeanor. California Elections Code "Electioneering" means the visible display or audible dissemination of information that advocates for or against any candidate or measure on the ballot within 100 feet of a polling place, an elections official's office, or a satellite location under Section Prohibited electioneering information includes, but is not limited to, any of the following: (a) A display of a candidate's name, likeness, or logo. (b) A display of a ballot measure's number, title, subject, or logo. (c) Buttons, hats, pencils, pens, shirts, signs, or stickers containing electioneering information. 63 VOTE-BY-MAIL March 7, 2017 General Municipal Election Time period for organizations to return absent voter ballot application. Applications shall be nonforwardable. Any individual, organization, or group that distributes applications for vote by mail voter ballots and receives completed application forms shall return the forms to the appropriate elections official within 72 hours of receiving the completed forms, or before the deadline for application, whichever is sooner. The name, address, and telephone number of any organization that authorizes the distribution of the applications shall be included on the application. Any application for a vote by mail voter s ballot that is sent by an individual, group, or organization to a voter shall be nonforwardable. Any vote by mail voter s ballot that is returned to an elections official as undeliverable shall not be forwarded by the elections official. A person may not submit a vote by mail ballot application electronically for another registered voter. The format used by ALL individuals, organizations, and groups who distribute Vote-by-Mail ballot applications MUST be the uniform format approved by the Secretary of State (California Elections Code 3007). PENALTIES FOR FRAUDULENT VOTE BY MAIL VOTING The following are excerpts from the California Secretary of State s Guide to Vote-by-mail Voting, please refer to appropriate codes for complete text. VOTING MORE THAN ONCE It is a crime, punishable by imprisonment, to vote more than once in any election (See Elections Code 18560). INTERFERING WITH THE ABSENT VOTING PROCESS It is a crime: It is a misdemeanor to willfully interfere with the prompt delivery to the elections official of a completed application for a voteby-mail ballot (See Elections Code 18576). A third party may not (without the voter's authorization) retain a completed application for a vote-by-mail ballot for more than 36 hours (excluding weekends and holidays) or beyond the deadline for applying, whichever is earlier (See Elections Code 3008). No one can deny a voter the right to return his or her application for a vote-by-mail ballot to the elections official (See Elections Code 18576). It is a crime to interfere with the prompt return of a voted vote-by-mail ballot (See Elections Code 18577), or to vote or attempt to vote a fraudulent vote-by-mail ballot (See Elections Code 18578). It is a misdemeanor to do any electioneering, or otherwise attempt to influence a voter, at the time he or she is voting a vote-bymail ballot (See Elections Code 18371). Vote-by-mail ballot return envelopes are signed under penalty of perjury, a violation of which can result in a prison term (See Penal Code 126). OTHER PENALTIES. It is a crime: To interfere with anyone's right to vote (See Elections Code 18502). To pay, or offer to pay, a person any amount of money or to give them anything of value in exchange for their vote for a particular person or issue. Similarly, it is against the law to pay someone to not vote (See Elections Code 18521, 18522, and 18524). To violate the secrecy of the ballot, or otherwise tamper with ballots or the voting system (See Elections Code and 18564). As a result, close contests may not be determined until the official canvass is completed.
