E-83 EVENTS SIGNATURES IN LIEU OF FILING FEE PETITIONS (Excluding Independent Candidates) During this period petition forms may be obtained to secure signatures in lieu of all or a portion of the filing fee. Signatures submitted on the in lieu petitions may also be applied to the signature requirements for offices on the nominating petition provided they are registrants of the same party, if applicable, as the candidate. (E. C. 8061, 8105 & 8106) NOMINATION PERIOD FOR ALL CANDIDATES (Excluding Independent Candidates) During this period candidates must submit signature in lieu petitions when applying for their nomination documents. (E.C. 8020, 8041, 8061, 8100, 8105, 8106 & 10407) EXTENSION IF INCUMBENT DOES NOT FILE If nomination documents for the incumbent of a state constitutional, insurance commissioner, legislative, judicial or county office are not filed by March 10, 5 p.m., the nomination period shall be extended for that office until March 15, 5 p.m., for persons other than the incumbent. NOTE: Extension period does not apply: 1) when there is no incumbent eligible to be elected to a county office, 2) when incumbent for a state constitutional, insurance commissioner, legislative or county office has served the maximum number of terms as permitted by the California Constitution, 3) to congressional offices, 4) to party county central committee, central committee or county council offices. E-88 EVENTS SIGNATURES IN LIEU OF FILING FEE PETITIONS DEADLINE (Excluding Independent Candidates) Last day for candidates to file signature in lieu petitions. Candidate will be notified within 10 calendar days of filing the petition of any deficiency. Candidate may then, prior to the close of the nomination period, submit a supplemental petition or pay the prorata portion of the filing fee to make up the deficiency. (E.C. 8061, 8105 & 8106) SIGNATURES IN LIEU PETITIONS CHECKED Last day to determine sufficiency of signatures in lieu of filing fees submitted by all candidates. If determined that the petition is deficient, the candidates may, before the close of nomination period (March 10), either submit a supplemental petition or pay a prorate fee. (E. C. 8106) NOMINATION PERIOD DEADLINE (Excluding Independent Candidates) Last day for all candidates to file nomination documents. *Date adjusted due to weekend and/or holiday If an eligible incumbent fails to file nomination documents, the filing period shall be extended until March 15, 5 p.m., for persons other than the incumbent. (E. C. 8020, 8022, & 8204) NOTE: There will be no extension for offices in which incumbent is not eligible to run for re-election because of term limit prohibition. 17 SIGNATURES IN LIEU OF FILING FEE PETITIONS (E. C. Sec. 8106) PRIMARY ELECTION SIGNATURES IN LIEU OF FILING FEE A candidate may submit a petition containing signatures of registered voters in lieu of paying the filing fee in order to run for office. Official Filing documents are available between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, excluding holidays at the: Registrar-Recorder/County Clerk's Office Imperial Highway, Norwalk, 2nd Floor, Room 2013 FILING FEE REQUIRED State law requires that a filing fee be paid by the candidate at the time the nomination documents are issued. Signatures in lieu of the filing fee must be submitted at the time the candidate applies for Nomination Documents. Filing fees may be paid in cash, or by certified cashier s check or personal check. Checks are to be made payable to the Secretary of the State for all State and Federal Offices and to the Registrar-Recorder/County Clerk for all County Offices. All filing fees received by the Secretary of State and County Elections Officials are non-refundable. Beginning December 30, 2005 through February 23, 2006 this office will furnish to each candidate, or his/her authorized representative, upon request and without charge, forms for securing signatures. If additional forms are required, the candidate may duplicate the forms. Valid signatures in lieu of the filing fee are counted towards the number of signatures on a Nomination Paper provided the signatures are registrants of the same party as the candidate. Signatures are verified within ten (10) days after submission and the candidate is notified of the number of invalid signatures. If the requisite number of valid signatures has been met, no additional signatures are needed. If the requisite number has not been met, the candidate has the option of submitting additional signatures or paying the prorata amount of the filing fee to cover any invalid signatures. If additional signatures are submitted, they must be filed by 5:00 p.m. on the last day to file nomination documents. Signature in lieu of filing fee petitions must be filed no later than the applicable filing deadline. Valid signatures on the signature in lieu petitions may be applied to the nominating petition signature requirement however the signature in lieu petition forms cannot be substituted for purposes of filing nominating petitions. Nominating petitions forms will be available commencing February 13*, 2006 through March 10, Candidates of the American Independent, Green, Libertarian, Natural Law or Peace and Freedom Parties who choose to obtain signatures under Election Code Section 8106(a)(6) must obtain the signatures of 10% of the registered voters in the district in which he/she seeks the nomination or signatures, which ever is less. *Holiday, office will be open. During tenure of office, not be an officer, agent or employee of an insurer or directly or indirectly interested in any insurer or licensee under the California Insurance Code, EXCEPT (a) as a policyholder, or (b) by virtue of relationship by blood or marriage to any person interested in any insurer or licensee. (Insurance Code 12901). May not have served for more than two terms as State Insurance Commissioner. ( (a) Insurance Code.) 32 QUALIFICATIONS FOR OFFICE AND SIGNATURE IN LIEU OF FILING FEE REQUIREMENTS Office: Sheriff Term of Office: 4 Years Qualifications: A registered voter of the jurisdiction at the time nomination documents are issued. (Govt. Code 24001). Candidates must meet one of the following criteria at the time of filing nomination documents: 1. An active or inactive advanced certificate issued by the Commission on Peace Officer Standards and Training. 2. One year of full-time, salaried law enforcement experience as specified, of which at least a portion shall have been accomplished within five years prior to the date of filing, and possesses a master s degree from an accredited college or university. 3. Two years of full-time, salaried law enforcement experience as specified, of which at least a portion shall have been accomplished within five years prior to the date of filing, and possesses a bachelor s degree from an accredited college or university. 4. Three years of full-time, salaried law enforcement experience as specified, of which at least a portion shall have been accomplished within five years prior to the date of filing, and possesses an associate in arts or associate in science degree or the equivalent from an accredited college. 5. Four years of full-time, salaried law enforcement experience as specified, of which at least a portion shall have been accomplished within five years prior to date of filing, and possesses a high school diploma or equivalent. (Govt. Code ) (Voters established term limits for Sheriff, beginning December On October 29, 2004 the Superior Court voided term limits for the sheriff.) Use the Candidate Registration and Qualification (CRQ) form to request candidate filing documents. Forms must be obtained from and filed with the RR/CC office, Election Information Section, 2nd Floor, Room Fill out Candidate Registration and Qualification (CRQ) form. 1. You must verify that the candidate information, including the name to appear on ballot, office title, addresses, telephone/ fax numbers, and web site is printed correctly on all forms. The following will be issued to each candidate: a) Petition in lieu of filing fee forms. SIGNER QUALIFICATIONS A signer must be a resident of the jurisdiction and the county and registered with the same party as the candidate for whom the petition is being circulated, except when a declines-to-state registrant may sign the petition of any partisan candidate whose party, at the time of submission of the petitions for verification, has notified the Secretary of State that it has adopted a rule allowing such registrants to vote their party s ballot at the ensuing primary election. A) EACH SIGNER must print and sign own name and include residence address. Exception: A signer who is unable to personally affix his/her own name and/or address on the petition may be assisted by another person. The voter must however, affix his/her own mark/signature on the petition. Two witnesses to signature (or mark) are required and such witnesses must also sign their names. 1. If a district includes more than one county, the circulator can only circulate the petition in the county in which he or she resides. Only one circulator is allowed to circulate a petition section. Circulator must complete Affidavit of Circulator in own handwriting. DO NOT TYPE. 1. Fill in appropriate information in blank spaces. 2. Fill in dates signatures were obtained. 3. Fill in execution date and place of signing. 4. Sign name. Each signature and residence address on petition in lieu of filing fee form is verified against the voter s Affidavit of Registration information. If a person signs in lieu petitions for more candidates than there are offices to be filled, the signatures are counted only on those petitions which, taken in the order filed, do not exceed the number of offices to be filled. Candidates will be notified immediately if there are irregularities regarding the number of invalid signatures. NOTE: Candidates not meeting the signature requirements for nomination will be issued a Nomination Paper for the supplemental signatures. Additional signatures to supplement any invalid signatures must be filed or the prorata portion of the fee paid by 5:00 p.m. on the last day to file nomination documents.
