Term of Office 4 year Term of Office beginning January 7, 2019 II. GC Qualifications Every candidate shall: A. Be a citizen of the United States of America Cal. Const., Art. IV, Section 2(c) 2 B. Be a registered voter and otherwise qualified to vote for that office at the time nomination papers are issued to the person C. Not have been convicted of a felony involving accepting or giving, or offering to give, any bribe, the embezzlement of public money, extortion or theft of public money, perjury, or conspiracy to commit any of those crimes. 20 D. Butte County Charter Article II, Section 2 and Government Code requirements for office of County Supervisor: The County of Butte shall have a Board of Supervisors, consisting of five members, each of whom must be an elector of the supervisorial district which he represents, must reside therein during his incumbency, must have been a resident of the county for five years immediately preceding his election 4, and shall be elected by the electors of the district which he is to represent. The term of office of Supervisors shall be four years, and until their successors are elected and qualify, except as hereinafter provided. Each member shall have been a registered voter of the district which he or she seeks to represent for at least 30 days immediately preceding the deadline for filing nomination documents for the office of Supervisor, and shall reside in the district during his/her incumbency. 1 GC refers to California Government Code 2 Article IV, section 2(c), of the California Constitution requires one year of residency in the district and three years of residency in California; however, it is the legal opinion of the California Secretary of State s Office that these provisions violate the U.S. Constitution and are unenforceable. 3 All code section references are to the California Elections Code unless otherwise stated. 4 West Law Notes: The five year residency requirement in this section was declared unconstitutional by the California Supreme Court in the case of Zeilenga v. Nelson (1971) 4 Cal. 3d 716; 94 Cal. Rptr. 602; 484 P.2d 578. Now see Government Code Section

2 County Supervisor District 3 Page 2 III. Requirements A. Campaign Finance Any individual who intends to be a candidate for elective office shall: 1. Candidate Intention Statement File with this office a Candidate Intention Statement (Form 501) for the specific office sought. A separate Form 501 must be filed for each election, including re-election to the same office. This statement shall be signed under penalty of perjury and filed anytime prior to the solicitation or receipt of any contribution or loan, including expenditures made from personal funds used for campaign purposes. GC Campaign Contribution Account a. A Statement of Organization Recipient Committee (Form 410) shall be filed anytime with the Secretary of State s Political Reform Division within 10 days of qualifying as a committee by receiving contributions totaling $2,000 or more in a calendar year. GC 82013(a), b. Establish one campaign contribution account at an office of a financial institution located in California after filing the Candidate Intention Statement. GC 85201(a) c. All contributions or loans made to the candidate, to a person on behalf of the candidate, or to the candidate s controlled committee shall be deposited in the account. GC 85201(c) d. Any personal funds, which will be used to promote the election of the candidate, shall be deposited in the account prior to the expenditure. GC 85201(d) e. All campaign expenditures shall be made from the account. GC 85201(e) 3. Exceptions a. Parts 1 and 2(d) and (e), above, do not apply to a candidate s payment of a filing fee and candidate s statement of qualifications fee from his or her personal funds. GC 85200, 85201(f) b. Part 2, above, does not apply if the candidate does not receive contributions and makes campaign expenditures from personal funds of less than $2,000 in a calendar year, excluding payment of filing fee and candidate s statement of qualifications. GC 85201(g) c. An individual who raises contributions from others for his or her campaign, but who raises or spends less than $2,000 in a calendar year, shall establish a campaign contribution account but is not required to file a Statement of Organization (Form 410) or other statement of bank account information. GC 85201(h)

Full Payment of Filing Fee Every candidate must pay a filing fee equal to 1% of the annual salary of the office sought as of the first day on which a candidate may circulate petitions in lieu of filing fee, made payable to Butte County Clerk-Recorder Filing fees will be paid at the time candidates obtain their Declaration of Candidacy form. All filing fees are non-refundable. 8105(a) Filing fees may be paid by cash, check, money order or credit/debit card. Checks or money orders must be made payable to Butte County Clerk- Recorder. If credit/debit card is used there is an additional $2.50 fee. 2. Petitions in Lieu of Filing Fee If candidate pays the filing fee in full, no action is required until February 12 th. a. A candidate may choose to submit, by February 7, 2018 (E-118), a petition containing signatures of registered voters in lieu of the filing fee. Refer to chart on page (a)(4) b. Petitions for in lieu signatures may be obtained and filed with this office between December 14, 2017 (E-173) and February 7, 2018 (E-118). 8106(b) c. The candidate will be furnished with original petition to use for making copies. When making copies be sure to make them double sided, and that the copy is clear and complete. Do not eliminate or cut off any wording. d. The candidate may submit signatures to cover the total number of valid signatures to waive the filing fee, or submit a portion to reduce the fee. 8106(b)(3) e. All signers must be registered voters in Butte County. 8106(b)(1) f. The candidate may appoint persons to circulate the petitions. Circulators must be 18 years of age or older. 102, 8106(b)(4) g. If the voter signs more than one petition for the same office, their signature shall be valid on the first petition filed. The other signature will be invalid. 8106(b)(2) h. Within 10 days after the receipt of the petition, this office shall notify the candidate of any deficiency. The candidate shall then, at the time of obtaining the Declaration of Candidacy pay any remaining filing fee to cover the deficiency. 8106(b)(3) i. Signatures obtained on petitions may be counted towards the nomination signature requirements. 8061, 8106(d)

4 County Supervisor District 3 Page 4 C. Ballot Designation Worksheet 1. Each candidate who submits a ballot designation shall file a completed ballot designation worksheet that supports the use of that ballot designation. The ballot designation worksheet shall be filed with this office at the same time that the candidate files the Declaration of Candidacy The designation shall remain the same for all purposes of both the Primary and General elections, unless the candidate, at least 98 days prior to the General Election, requests in writing a different designation which the candidate is entitled to use at the time of the request. The written request must be accompanied by a ballot designation worksheet (e) D. Statement of Economic Interests (Form 700) Each candidate must file a Statement of Economic Interests (Form 700) with this office disclosing investments, interests in real property, and any income received during the immediately preceding 12 months pursuant to the requirements of the Political Reform Act of 1974, as amended. GC 87200, 87201, This statement is to be filed between February 12, 2017 (E-113) and March 9, 2018 (E-88). It is not required if the incumbent has filed such statements within the past 60 days for the same jurisdiction. GC E. Nomination Documents Between February 12, 2018 (E-113) and March 9, 2018 (E-88), obtain nomination documents from this office. Nomination documents include nomination papers for collecting signatures and a Declaration of Candidacy that must be executed by the candidate. 333, 8020, 8040, 8041 If the eligible incumbent fails to file the nomination documents by 5:00pm on March 9, 2018 (E-88), there is an extension to the filing period, and any other person, if otherwise qualified, may obtain and file the nomination documents by 5:00pm on March 14, 2018 (E-83) Nomination Papers a. Gather between 20 and 40 signatures for filing the nomination papers, to secure your nomination. 8062(a)(3) b. The candidate may appoint persons to circulate the petitions. Circulators must be 18 years of age or older. The candidate may sign their own petition. 102, 106, 8066 c. All signers must be registered voters in Butte County. 100, 8068 d. Between February 12, 2018 (E-113) and March 9, 2018 (E-88), each section of the nomination paper shall be filed in this office. 8020, Declaration of Candidacy a. The Declaration of Candidacy shall be obtained from, and filed in this office.

All candidates must subscribe to the Oath or Affirmation provided under Section 3 of Article XX of the Constitution printed on the Declaration of Candidacy. 200 c. Once the Declaration of Candidacy has been filed, it may not be withdrawn Code of Fair Campaign Practices a. At the time the candidate is issued nomination documents a copy of the Code of Fair Campaign Practices will be provided. The candidate must review and decide whether they are going to subscribe to the Code b. It is the ultimate intent of the Legislature that every candidate for public office in this state who subscribes to the Code of Fair Campaign Practices will follow the basic principles of decency, honesty, and fair play in order that, after vigorously contested, but fairly conducted campaigns, the citizens of this state may exercise their constitutional right to vote, free from dishonest and unethical practices which tend to prevent the full and free expression of the will of the voters. The purpose in creating the Code of Fair Campaign Practices is to give voters guidelines in determining fair play and to encourage candidates to discuss issues instead of untruths or distortions c. In no event shall a candidate for public office be required to subscribe to or endorse the code d. The Code of Fair Campaign Practices pursuant to this chapter is a public record open for public inspection. The elections official shall accept, at all times prior to the election, all completed forms that are properly subscribed to by a candidate for public office and shall retain them for public inspection until 30 days after the election 20442, F.
