Call to Order The meeting was called to order by Mayor Pro-Tem Penny Christian. Opening Ceremony Invocation was by Council member Buck; Salute to the Flag. Roll Call Mayor: Mayor Pro-Tem: Fland Sharp (absent) Penny Christian Council members: Lee Buck Steve Hartkemeyer Rick Knight Pete Mittleman Tom Taylor Also present were City Manager George Forbes, City Attorney Stephen Stratford, City Clerk Heidi Reagan and Recording Secretary Cathy Martinich. Approval of Minutes Motion: It was moved by Mr. Hartkemeyer, seconded by Mr. Taylor, and passed, to approve the following minutes, as presented: Workshop Meeting, February 18, 2007 Regular Council Meeting, February 18, 2008 Communications Tom Taylor expressed his appreciation to Sandy Suckling, Roy Paxson Gary Meadors and staff members for a successful charity golf tournament. 4 Minutes of Regular City Council Meeting held Monday, March 3, 2008 Mayor a Presentation to Employees of the Quarter 4 th Quarter of 2007 Mayor Pro-Tem Christian read and presented the awards to the following employees: David Rice, Fire Department (Chief Frazier accepted the award on behalf of David Rice) John Palumbo, Beaches Energy Services Cathie Sheasley, Police Department Jim Choate, Police Department City Clerk a Appointment of Fifth Trustee to the Firefighters and Police Officers Pension Boards Motion: It was moved by Mr. Hartkemeyer, seconded by Mr. Taylor, to approve the appointment of Kyndra Mulder, Esq. to the Firefighters Pension Board and Bruce Corbitt to the Police Officers Pension Board; terms to expire March 31, Roll call vote: Ayes Buck, Hartkemeyer, Knight, Mittleman, Taylor and Mayor Pro-Tem Christian; motion carried unanimously. City Manager a Amend the Special Events Budget to Include Pops at the Beach for 2008 Motion: It was moved by Mr. Hartkemeyer, seconded by Mr. Taylor, to authorize the Mothers Day Concert as detailed in a memo from Roy Paxson, dated February 23, 2008, entitled Amending the Special Events Budget to include the POPS at the Beach for Discussion: Mr. Forbes explained that this year we are fortunate that Beaches Fine Arts Series is funding the Symphony. He added that there are unused monies from the air show as well as monies received for user fees from filming of the movie Recount, which enables the city to have the concert this year. Roll call vote: Ayes Hartkemeyer, Knight, Mittleman, Taylor, Buck and Mayor Pro- Tem Christian; motion carried unanimously. City Manager b Authorize Water Main Repair on A1A in the Vicinity of Beach Boulevard Motion: It was moved by Mr. Hartkemeyer, seconded by Mr. Taylor to authorize a change order to John Woody, Inc., as described in the memorandum from RC080303min Page 2 of 4

5 Minutes of Regular City Council Meeting held Monday, March 3, 2008 Ty Edwards, dated February 20, 2008; entitled Authorize Water Main Leak Repair on A1A in the Vicinity of Beach Boulevard. (construction cost - $32,685.00, plus a 10% contingency of $3,268.00; for a total price of $35,953.00) Discussion: Mr. Forbes explained that there is a broken water line on A1A that must be repaired. He stated that there is a contractor already working in the city that is able to make these repairs. Roll call vote: Ayes Knight, Mittleman, Taylor, Buck, Hartkemeyer and Mayor Pro- Tem Christian; motion carried unanimously. ORDINANCES ORDINANCE NO Second Reading Mayor Pro-Tem Christian requested that City Clerk Heidi Reagan read Ordinance No , on its second reading, by title only; whereupon Ms. Reagan read the following: AN ORDINANCE AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE CODE OF ORDINANCES OF THE CITY OF JACKSONVILLE BEACH, FLORIDA, BY RESCINDING SUBSECTION (B), EXTENDED HOURS FOR NEW YEAR S EVE. OF SECTION 4-2. HOURS OF SALE PERMITTED. PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. Discussion: Motion: Mr. Forbes said that this ordinance is on its second reading, so if it is passed by the council tonight it will be adopted and become law. He added that our current ordinance has allowed bars to stay open until 4:00am on New Year s Eve instead of closing at 2:00am as do the bars in neighboring communities. By Council passing this tonight, all the bars will have to close at 2:00am on New Years Eve. It was moved by Mr. Hartkemeyer, seconded by Mr. Buck to adopt Ordinance No , on its second reading, as read by title only; repealing extended hours for alcohol sales on New Year s Eve. Roll call vote: Ayes Mittleman, Taylor, Buck, Hartkemeyer, Knight and Mayor Pro- Tem Christian; motion carried unanimously. RC080303min Page 3 of 4
