3 TOWN OF LANTANA REGULAR MEETING MINUTES April 24, ROLL CALL: Mayor Stewart called the regular meeting to order at 7:00 p.m. and Mrs. Dritz called the roll. There was a moment of silent prayer followed by the Pledge of Allegiance to the flag. Mayor Stewart asked that Roy Lush s mother be remembered. PRESENT: Mayor Stewart, Vice Mayor Moorhouse, Vice Mayor Pro Tem Balfour, Councilmember Aridas, and Councilmember Shropshire. ALSO PRESENT: Deborah S. Manzo, Town Manager; Mrs. Dritz, Town Clerk; R. Max Lohman, Legal Counsel and approximately 30 spectators. 2. APPROVAL OF MINUTES: Councilmember Aridas made a motion to approve the regular meeting minutes of March 27, Vice Mayor Moorhouse seconded the motion. Motion passed AGENDA APPROVAL: Councilmember Balfour made a motion to approve the agenda as submitted. Vice Mayor Moorhouse seconded the motion. Motion passed STAFF AND COMMITTEE REPORTS: a. Council Reports Vice Mayor Moorhouse expressed his thanks to Chief Scheller and the Police Department for being professional and well organized during the Chinese President s visit. Councilmember Balfour stated the Friends of the Nature Preserve hosted Gene Joyner at the Lantana Nature Preserve this past Saturday and thanked Linda Brien for the set up. Councilmember Shropshire stated the Enjoy Lantana! event, Bark in the Park, was well attended. Mayor Stewart mentioned the Beach Clean Up event and thanked everyone who participated. He also mentioned the Travel Channel will be featuring the Old Key Lime House in a future episode of Booze Travelers. b. Town Manager Report Town Manager Manzo stated the Lantana Fishing Derby Tournament will be held this weekend. c. Proclamation declaring April 2017 as Florida Water Professionals Month. Mayor Stewart presented the Proclamation to Phil Donovan. Mr. Donovan thanked the Council. Town Council Meeting April 24, 2017 Page 1

4 5. ORDINANCES AND RESOLUTIONS: a. Consideration of Resolution No. R , amending the FY budget in accordance with Budget Resolution No. R Mayor Stewart introduced and explained this item on the agenda and read some details of the budget. Town Attorney Lohman read the resolution title: RESOLUTION NO. R A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LANTANA, FLORIDA, AMENDING ITS FISCAL YEAR BUDGET IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF BUDGET RESOLUTION R ; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mayor Stewart asked for Council disclosures. Mayor Stewart disclosed he spoke with Stephen Kaplan. There were no other Council disclosures. There were no individuals from the public who commented on the agenda item. Councilmember Aridas made a motion to approve Resolution R Vice Mayor Moorhouse seconded the motion. Motion passed 5-0. b. Consideration of Ordinance No. O to amend the municipal election qualifying dates in order to comply with the deadline for vote-by-mail ballots as established by the Division of Elections and the Supervisor of Elections. Mayor Stewart introduced and explained this item on the agenda. Town Attorney Lohman read the resolution title: ORDINANCE NO. O AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF LANTANA, FLORIDA, AMENDING CHAPTER 7. ELECTIONS OF THE CODE OF ORDINANCES OF THE TOWN OF LANTANA AT SECTION 7-1. QUALIFICATIONS AND SELECTION OF CANDIDATES; CANDIDATE VACANCIES. BY REPEALING AND READOPTING SAME, AS REVISED IN ORDER TO CHANGE THE QUALIFYING DATES FOR MUNICIPAL ELECTIONS TO COMPLY WITH VOTE- BY-MAIL BALLOT REQUIREMENTS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF THE CHAPTER 7. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. There were no individuals from the public who commented on the agenda item. Councilmember Balfour made a motion to approve Ordinance No. O on second reading. 5 Councilmember Aridas seconded the motion. Motion passed MISCELLANEOUS: a. Presentation by Grau & Associates, the Town s Auditors, of the Comprehensive Annual Financial Report (CAFR) for Fiscal Year Mayor Stewart introduced and explained this item on the agenda. He read highlights of the CAFR. Stephen Kaplan, Director of Finance thanked Sharon Almedia, Assistant Finance Director for her hard work on preparing the CAFR, as well as Grau & Associates. Council thanked all of Town staff for the preparation of the CAFR. Councilmember Shropshire made a motion to approve the Comprehensive Annual Financial Report (CAFR) for the fiscal year ending September 30, Councilmember Aridas seconded the motion. Motion passed 5-0. b. Consideration of the First Addendum to the Agreement for Professional Auditing Services with Grau & Associates. Mayor Stewart introduced and explained this item on the agenda. Racquel McIntosh, Grau & Associates, answered questions from Council. There were no individuals from the public who commented on the agenda item. Vice Mayor Moorhouse made a motion to approve the First Amendment to the Agreement for Professional Auditing Services with Grau & Associates and authorize the Town Manager to execute same and any future amendments. Councilmember Balfour seconded the motion. Motion passed 5-0. c. Consideration of a request for Taxicab Certificate of Public Convenience and Necessity by Flamingo Cab relative to Sec of the Town of Lantana Code of Ordinances. Mayor Stewart introduced and explained this item on the agenda and asked Council for disclosures. Mayor Stewart disclosed he spoke with Palm Beach County Consumer Affairs and Todd Bonlarron. Raid Alsmaili, applicant, gave an overview of his request and answered questions from Council. Vice Mayor Moorhouse made a motion to approve the request for a Taxicab Certificate of Public Convenience and Necessity by Flamingo Cab to operate one taxicab in the Town of Lantana. SE Consideration of a request for Special Exception approval to allow a Planned Commercial Development per Section 23-96(d)(23) of the Town of Lantana Code of Ordinances on the properties located at 224 N 3rd St. and 200 W. Lantana Rd. in the C1-Commercial Zoning District, Downtown Overlay - Train Depot Sub-Area. Mayor Stewart introduced and explained this item on the agenda. Attorney Lohman swore in anyone who wished to speak on any quasi-judicial agenda items. Mayor Stewart asked Council for disclosures. Vice Mayor Moorhouse disclosed he spoke with members from New Urban Design, Councilmember Aridas disclosed he spoke with the Town Manager, Councilmember Balfour and Councilmember Shropshire disclosed they spoke with the Town Manager and members from the Chamber, Mayor Stewart disclosed he spoke with the owner, Dave Arm, Stanley Gunlach and the Town Manager. David Thatcher, Director of Development Services, gave Plan Review Committee recommendations, noting that the applicant will need to submit a unity of title. Steve Durkin, 200 W. Lantana Road, owner of New Urban Group, LLC., gave an overview of the request. The following individuals from the public commented on the agenda item: Dave Arm, Greater Lantana Chamber of Commerce Vice Mayor Moorhouse made a motion to Special Exception to allow a planned commercial development on the properties located at 200 W. Lantana Road and 224 N. 3 rd Street in the C1-Commercial Zoning District, Downtown Overlay- Train Depot Sub-Area. Councilmember Aridas seconded the motion. Motion passed 5-0. * e. SE Consideration of a request for Special Exception approval to allow a business with drivethrough service per Section 23-96(d)(19) of the Town of Lantana Code of Ordinances on the property located at 200 W. Lantana Rd. in the C1-Commercial Zoning District, Downtown Overlay - Train Depot Sub-Area. Mayor Stewart introduced and explained this item on the agenda. David Thatcher, Director of Development Services, gave Plan Review Committee recommendations. There were no individuals from the public who commented on the agenda item. There was no Council discussion. Councilmember Aridas made a motion to approve Special Exception to allow a business with drive-through service on the property located at 200 W. SE Consideration of a request for Special Exception approval to allow a restaurant greater than twenty-five hundred (2,500) square feet per Section 23-96(d)(21) of the Town of Lantana Code of Ordinances for the property located at E. Ocean Ave. in the C1-Commercial Zoning District. Mayor Stewart stated that this item will need to be postponed. Attorney Lohman clarified that public comment must still take place and that the applicant can speak if they choose. David Thatcher, Director of Development Services, stated that the applicant was aware that the item was going to be postponed. There were no individuals from the public who commented on the agenda item. There was no Council discussion. Councilmember Aridas made a motion to postpone agenda item 6f to the June 12, 2017 Council meeting. Councilmember Balfour seconded the motion. Motion passed 5-0. * g. Consideration of a request to modify the previously approved Special Exception (SE ) for Water Tower Commons located at 1199 W. Lantana Road in the MXD Mixed Use Development Zoning District. Mayor Stewart introduced and explained this item on the agenda. Attorney Lohman swore in anyone who wished to speak on the agenda item. Mayor Stewart asked Council for disclosures. Councilmember Aridas disclosed he spoke with the Town Manager, Councilmember Balfour disclosed he spoke with the Town Manager, Dave Arm, members from Richman Group and visited a Richman Group development in Davie, Councilmember Shropshire disclosed he spoke with the Town Manager and Dave Arm, Mayor Stewart disclosed he spoke with Ken Tuma, members from Richman Group, Mike Langoff, the Town Manager and visited similar site developed by the Richman Group. Ken Tuma, Urban Design Kilday Studios, gave a brief presentation of the request. David Thatcher, Director of Development Services, gave Plan Review Committee recommendations. The following individuals from the public commented on the agenda item: Richard Schlosberg, 417 S. Atlantic Drive, Dave Arm, Greater Lantana Chamber of Commerce. Ken Tuma answered questions from Council. Chris Heggen, Kimley Horn Associates, answered questions from Council. Ken Tuma answered questions from Council and clarified the use of green spaces. Mayor Stewart passed the gavel to Vice Mayor Moorhouse. Mayor Stewart made a motion to approve with conditions the request in order to modify the parking from 2.5 spaces to 2.15 spaces per unit in the development order SE for the Water Tower Commons development located at 1199 W. Lantana Road in the MXD Mixed Use Development Zoning District. Councilmember Balfour seconded the motion. Motion passed 5-0. Maria Sanchez, Richman Group, 477 South Rosemary Ave, #301 West Palm Beach, FL, addressed the Council. Mayor Stewart clarified his reasoning for the motion and addressed Ms. Sanchez s concerns. Chris Heggen, Kimley Horn & Associates, addressed Council with parking space concerns. Jesse Weeppel, Richman Group, addressed Council. There was Council discussion. Vice Mayor Moorhouse made a motion to reconsider this agenda item. Councilmember Balfour seconded the motion. There was Council discussion. Motion passed 3-2 (Nay: Councilmember Shropshire and Councilmember Aridas) Vice Mayor Moorhouse made a motion to approve the request in Case SE in order to modify the previously approved Special Exception Order SE for the Water Tower Commons development located at 1199 W. Lantana Road in the MXD Mixed Use Development Zoning District. Councilmember Balfour seconded the motion. Town Council Meeting April 24, 2017 Page 6

9 Attorney Lohman clarified that this motion is as requested, which reduces the parking to 2.0 and modifies the Master Site Plan. Motion failed 2-3 (Nay: Mayor Stewart, Councilmember Aridas and Councilmember Shropshire) Ken Tuma asked for a few minutes to discuss with the Contract Purchaser before moving on to the other agenda items. Attorney Lohman suggested moving on to item 6j in order to give the applicant time to discuss. j. Consideration of an Amendment to the Solid Waste and Recyclable Materials Franchise Agreement with Republic Services of Florida GP, Inc., to collect disaster debris resulting from a natural disaster. Mayor Stewart introduced and explained this item on the agenda and asked Council for disclosures. All Councilmembers disclosed they spoke with the Town Manager. Mayor Stewart disclosed he spoke with Town Manger and Joanne Stanley from Republic Services. There were no individuals from the public who commented on the agenda item. Vice Mayor Moorhouse made a motion to approve an Amendment to Solid Waste and Recyclable Materials Franchise Agreement with Republic Services GP, Inc., in order to include disaster debris collection, on an as needed basis and to authorize the Town Manager to execute the agreement and any amendments thereto. Councilmember Shropshire seconded the motion. Motion passed 5-0. Ken Tuma asked Council of a postponement for items 6g, 6h and 6i for the May 22, 2017 Town Council meeting. 11 TOWN OF LANTANA GREATER LANTANA SCHOOL COMMUNITY EDUCATION COUNCIL / TOWN COUNCIL JOINT MEETING MINUTES April 24, 2017 Mayor Stewart called the joint meeting to order at 5:00 p.m. and led the Pledge of Allegiance to the flag. PRESENT: ALSO PRESENT: Mayor Stewart, Vice Mayor Moorhouse, Vice Mayor Pro Tem Balfour, Councilmember Aridas, Councilmember Shropshire, Chair Lyn Tate, Vice Chair, Teresa Wilhelm, Kathi Gundlach, and Greg Ganim. Deborah S. Manzo, Town Manager; Mrs. Dritz, Town Clerk; Janyn Robinson, Lantana Elementary School Principal; Ed Burke, Lantana Middle School Principal; 1 representative from Palm Beach Maritime Academy and 1 spectator. INTRODUCTIONS: Mayor Stewart introduced members of the Education Council. OVERVIEW OF JOINT MEETING: Mayor Stewart gave a brief overview of the joint meeting and a brief history of the Education Council. NEW BUSINESS: Chair Tate read her proposed revisions to the Mission Statement and asked members for feedback. There was discussion. Mayor Stewart asked that the revised mission statement be scheduled for adoption at an upcoming Town Council meeting. OVERVIEW OF SURVEY SYNOPSIS: Chair Tate expressed she had concerns on the responses from the survey and the lack of attendance from members at scheduled meetings. There was discussion on dates and times of the future meetings. Mrs. Dritz clarified that Diane Robinson cannot attend evening meetings and confirmed that Ms. Robinson s preferred time is Tuesday mornings. She also stated the Michele Fritts resigned this morning. Mayor Stewart stated that due to Ms. Fritts resignation, Mrs. Dritz will post an opening to fill that position. There was discussion. Vice Chair Whilhelm made a motion to hold future meetings on Mondays at 10:00 a.m. Kathi Gundlach seconded the motion. Motion passed 4-0. Chair Tate explained the importance of the responsibilities of members. There was discussion. 12 Vice Chair Wilhelm School Supplies Collection Greg Ganim - Green Schools Kathi Gundlach- School Board liaison There was further discussion regarding the mission statement. Vice Chair Wilhelm made a motion to approve the mission statement as The Greater Lantana School Community Education Council serves as a liaison between the greater Lantana schools community, the School Board of Palm Beach County and the Lantana Town Council. The Ed Council shall monitor and develop plans which may impact the greater Lantana schools community, gather input on issues that may affect the children in the Lantana schools community and plan a strategy to project school needs. Establish relationships with the Palm Beach County School Board to effectively lobby for Lantana's children. Develop strong communication with the schools principals to have a clear understanding of school needs and to present those recommendations to our Town Council. Kathi Gundlach seconded the motion. Motion passed 4-0. NEW BUSINESS: Chair Tate spoke about ideas for funding for Teacher Appreciation Week and asked for appreciation gift ideas. There was discussion. Stephen Kaplan, Director of Finance, stated the money collected should not be submitted to the Town because the purchasing policy would then be in effect. A total of $ was donated by members of the Education Council to be used to purchase teacher appreciation gifts and given to Chair Tate. It was agreed that Greg Ganim and Chair Tate would purchase the gifts and deliver them to the schools. Chair Tate mentioned the attendance requirements of the Education Council. Ms. Manzo clarified that the Town Attorney is currently drafting an Ordinance with proposed changes. There was discussion on the next Education Council meeting, which was scheduled for Monday, May 22 at 10:00 a.m. DIRECTION MOVING FORWARD: Chair Tate stated she would like to give an update to Council at the May 22 nd Town Council meeting. Ms. Manzo confirmed she will schedule it onto the agenda. COUNCIL COMMENTS: None. ADJOURNMENT: The motion was made and carried unanimously.
