California Retail Food Code Implementation Status September 24, 2008
Intent t of CalCode Replace CURFFL with an updated code based on current scientific knowledge Incorporate FDA Food Code language as appropriate and acceptable to all parties Eliminate the need for special interest legislation as much as possible Statewide standardized interpretation and enforcement
Common Laments Where is this required in CalCode? I interpret this CalCode Section to mean, but my Health Inspector disagrees. How come only County EH requires this? I don t agree with CalCode regarding.. It s not fair that someone can purchase a cheap cart and sell, competing with the restaurant across the street. I don t care what CalCode says or what other counties are doing, I am not enforcing/allowing. My Health Inspector said that the State enacted CalCode and I should call the State to discuss..
CalCode is NOT Perfect 2 CRFSC sponsored legislative bills currently active: SB CalCode general clean-up AB 2540 Mobile Food Facilities (urgency clause)
Special Interest Legislation AB 97 Trans Fat Ban (chaptered) AB 2168 Farm Stands (pending) AB 2588 Authority to enact Ordinances to Restrict MFF Operation (chaptered) SB 1420 Chain Restaurant Nutritional Labeling (pending)
Dodged d a Bullet AB 1773 Long-term health care facilities Status: Business as usual pending CDPH report
New Player at CRFSC: Vended Food Storage Operators Disconnect between vending machine definition and commissary definition New requirements based on CalCode????
CalCode Plan Check Issues Major differences in interpretation and enforcement statewide Perceived industry bias against mobile food facilities Mechanical Exhaust Ventilation requirements
CalCode Section Definition of Approved Acceptable to EH agency based on: 1. Conformity with applicable law, or (if no law) current public health principles, practices, and recognized industry standards that protect public health.

CalCode Section (c) (2) Pre-existing non-conforming structural conditions that do not pose a public health hazard are deemed in compliance pending replacement or renovation Public and private school cafeterias Licensed health care facilities New structural/installation requirements in CalCode that did not exist in CURFFL
Operational Issues HACCP plan review/approval: when, who, how? Pets at outdoor dining areas (patios, sidewalk in front, etc.) Demonstration of Knowledge for TFF operators Definition for Licensed Health Care Facility Prohibition of Bare Hand Contact with RTE food
What s Next for CRFSC? Sponsor CalCode clean-up legislation where need identified Review FDA Food Code revisions for inclusion in CalCode Review of CRFSC structure and operation Outreach to all impacted industry segments
CDPH Role Partnership with CCDEH thru Food Safety Policy Committee participation FDB Guidelines CalCode revisions on FDB website Participation in CRFSC process Informal Mediation Formal Issue Resolution Process???
CCDEH Role Ongoing local agency staff training Issue Submission to CRFSC Participation of appropriate local agency staff on CRFSC Subcommittees CCDEH Guidelines Outreach to Industry Formal Issue Resolution Process??
CALIFORNIA RETAIL FOOD SAFETY COALITION Issue Submission Form The California Retail Food Safety Coalition (CRFSC) brings together representatives from the Food Industry, government and academia to identify and address emerging food safety concerns in order to formulate recommendations for presentation to the State Legislature.
