1 REGULAR MEETING OF THE BLOOMFIELD BOARD OF HEALTH JANUARY 26, 2017 A of the Bloomfield Board of Health, as established by public record in The Bloomfield Life and posted on the Public Bulletin Board in the Municipal Building, was called to order on at 6:56 p.m. in Room 111 in the Municipal Building. APPROVAL OF MINUTES The Board, on a motion by VP Mehta, seconded by BM Rodriguez, reviewed the November 17, 2016 and December 8, 2016 minutes. After review, the Board unanimously approved the minutes as submitted. None were opposed. PUBLIC COMMENT None. 3 2 Bee Nailz BEAUTY/BARB11+ $ REVIEW OF THE DECEMBER 2016 COMMUNICATIONS The Board, on a motion by BM Rodriguez, seconded by VP Mehta, reviewed and unanimously voted to accept the December 2016 communications. DIRECTOR OF HEALTH AND WELFARE REPORT The Director provided the following report to the Board: Director reported holiday distribution activity from Division of Human Services and community partners, over 446 families benefited from the collaborations. Emergency Ready Go-Bags were distributed to residents 55 and over. Volunteers worked to assemble 400 bags as part of the MLK day of service. Other activities included collection of food, baby items and clothing that was distributed to families in need. Free tax preparation will be available every Wednesday at the Bloomfield Public Library between 10:30-6:00pm in February and March for residents who household income is under $65, Services are provided by appointment only. Zufall mobile dental van will be in Bloomfield from 10-3:00. Services are provided by appointment only. Human Services can provide additional information on all services. A $3, mini grant was received from the Food Trust to continue the Healthy Corner Store initiative. DECEMBER 2016 FINANCIAL REPORT voted to accept the December 2016 Financial Reports. COUNCIL LIAISON S REPORT No report. BOARD PRESIDENT S REPORT No report. UNFINISHED BUSINESS None. NEW BUSINESS RESOLUTION INTERGOVERNMENTAL SERVICES 3 of 9
4 INTERGOVERNMENTAL SERVICES RESOLUTION WHEREAS, N.J.S.A. 26:3-1 requires every New Jersey municipality to have a Board of Health; and WHEREAS, N.J.S.A. 26:3-2 allows a local Board of Health to adopt rules, regulations and ordinances for its government and that of its officers and employees; and WHEREAS, the Board of Health of the Township of Bloomfield has determined that in order to fulfill its State Mandate and in keeping with the purpose and intent of New Jersey State Statutes on shared services; and WHEREAS, the Board of Health has determined that the following services can be provided by the Township of Bloomfield in a way that promotes economies of scale. NOW, THEREFORE, BE IT RESOLVED that the Board of Health of the Township of Bloomfield, New Jersey, does hereby approve retaining the services of the Township of Bloomfield for the 2017 calendar year as follows: A. Accounting Services B. All Payroll Services C. Human Resources and benefits management excluding the following: employment in accordance with N.J.S.A. 26:3-19 et seq., termination and discipline D. Facilities management of the Board s offices and buildings E. Management Information Systems RESOLUTION NON-FAIR & OPEN CONTRACT FOR PEDIATRICIAN SERVICES The Board, on a motion by BM Rodriguez, seconded by BM Serbay, unanimously RESOLUTION AUTHORIZING THE AWARD OF A NON-FAIR AND OPEN CONTRACT FOR A PEDIATRICIAN Board of WHEREAS, the Board of Health of the Township of Bloomfield has a need for a Pediatrician and is going to award the contract as a non-fair and open contract pursuant to the provisions N.J.S.A. 19:44A-20.5; and WHEREAS, the Board of Health s Director of Health & Human Services has determined and certified in writing that the value of the services will not exceed $17,500; and WHEREAS, the term of this contract is one year ending December 31, 2017; and WHEREAS, Maryann Alessio, D.O., F.A.A.P., has indicated she will continue to act as the Pediatrician for the Board of Health of the Township of Bloomfield in accordance with the terms of her current contract; and WHEREAS, Maryann Alessio, D.O., F.A.A.P. has completed and submitted a Business Entity Disclosure Certification which certifies Maryann Alessio, D.O., F.A.A.P. has not made any reportable contributions to a political or candidate committee in the Township of Bloomfield and/or the Board of Health Members in the previous one year, and that the contract will prohibit Maryann Alessio, D.O., F.A.A.P., her agents and/or employees from making any reportable contributions during the term of the contract; and WHEREAS, the Board of Health s Director of Health & Human Services has certified that funds are available to cover the cost of this service. NOW, THEREFORE, BE RESOLVED that the President and Members of the Board of Health of the Township of Bloomfield authorizes the President of the Board of Health to enter into a contract with Maryann Alessio, D.O., F.A.A.P. as described herein; and BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution; and BE IT FURTHER RESOLVED that this resolution and the contract itself shall be available for public inspection at the office of the Board of Health s Director of Health & Human Services during regular business hours; and BE IT FURTHER RESOLVED that a notice of this action shall be printed once in the official newspaper of the Health of the Township of Bloomfield. 4 of 9
5 RESOLUTION NON-FAIR & OPEN CONTRACT FOR MEDICAL STANDING DIRECTOR & STANDING ORDERS RESOLUTION AUTHORIZING THE AWARD OF A NON-FAIR AND OPEN CONTRACT FOR A MEDICAL DIRECTOR AND STANDING ORDERS WHEREAS, the Board of Health of the Township of Bloomfield has a need for a Medical Director to fill standing orders and is going to award the contract as a non-fair and open contract pursuant to the provisions N.J.S.A. 19:44A-20.5; and WHEREAS, the Board of Health s Director of Health & Human Services has determined and certified in writing that the value of the services will not exceed $17,500; and WHEREAS, the term of this contract will begin January 1, 2017 and expire on December 31, 2017; and WHEREAS, Bloomfield ImmediCenter. (hereinafter provider ) has indicated it will act as the Medical Director for the Health Division of the Department of Health and Human Services of the Township of Bloomfield in accordance with the terms of their contract; and WHEREAS, Provider has completed and submitted as part of the contract a Business Entity Disclosure Certification which certifies that provider has not made any reportable contributions to a political or candidate committee in the Township of Bloomfield and/or the Board of Health Members in the previous one year, and that the contract will prohibit provider, its agents and/or employees from making any reportable contributions during the term of the contract; and WHEREAS, the Board of Health s Director of Health & Human Services has certified that funds are available to cover the cost of this service. NOW, THEREFORE, BE RESOLVED that the President and Members of the Board of Health of the Township of Bloomfield authorizes the President of the Board of Health to enter into a contract with provider as described herein; and BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution; and BE IT FURTHER RESOLVED that this resolution and the contract itself shall be available for public inspection at the office of the Board of Health s Director of Health & Human Services during regular business hours; ROLL CALL RESOLUTION LABORATORY TESTING CONTRACT voted to approve the following roll call resolution: Acceptance of the Garden State Laboratories, Inc. contract for the calendar year 2017 year not to exceed $2, for the year. 6 RESOLUTION AUTHORIZING THE AWARD OF A NON-FAIR AND OPEN CONTRACT FOR LEGAL COUNSEL WHEREAS, the Board of Health of the Township of Bloomfield has a need for an Attorney and is going to award the contract as a non-fair and open contract pursuant to the provisions N.J.S.A. 19:44A-20.5; and WHEREAS, the Board of Health s Director of Health & Human Services has determined and certified in writing that the value of the services may not exceed $17,500; and WHEREAS, the term of this contract is one year ending December 31, 2017; and WHEREAS, Board of Health would like to renew the legal services contract whereby Ronald J. Ricci Esq. was previously Board Counsel; and WHEREAS, Ronald J. Ricci Esq., has completed and submitted a Business Entity Disclosure Certification which certifies Ronald J. Ricci Esq., has not made any reportable contributions to a political or candidate committee in the Township of Bloomfield and/or the Board of Health Members in the previous one year, and that the contract will prohibit Ronald J. Ricci Esq. it agents and/or employees from making any reportable contributions during the term of the contract; and WHEREAS, the Board of Health s Director of Health & Human Services has certified that funds are available to cover the cost of this service. NOW, THEREFORE, BE IT RESOLVED that the President and Members of the Board of Health of the Township of Bloomfield authorizes the President of the Board of Health to enter into a contract with Ronald J. Ricci Esq, as described herein; and BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution; and BE IT FURTHER RESOLVED that this resolution and the contract itself shall be available for public inspection at the office of the Board of Health s Director of Health & Human Services during regular business hours; and BE IT FURTHER RESOLVED that a notice of this action shall be printed once in the official newspaper of the Board of Health of the Township of Bloomfield. RESOLUTION BOH/DEPARTMENT WEBSITE AS OFFCIAL NOTIFICATION/PAY-TO-PLAY The Board, on a motion by BM Serbay, seconded by BM Rodriguez, unanimously RESOLUTION DESGINATING INTERNET WEBSITE FOR OFFICIAL NOTIFICATION PURSUANT TO NEW JERSEY LOCAL UNIT PAY-TO-PLAY LAW WHEREAS, the Board of Health of the Township of Bloomfield ( Board ), is subject to the provisions of N.J.S.A. 19:44A-20.4 et seq., the New Jersey Local Unit Pay-To-Play law ( Law ); and WHEREAS, as part of the fair and open process contained in the Law, the related contract to be awarded under the fair and open process shall be publicly advertised in newspapers or on the Internet website maintained by the public entity (N.J.S.A. 19:44A-20.7); and WHEREAS, the Board of Health of the Township of Bloomfield maintains its Internet website at and WHEREAS, the Board desires to designate the Board of Health s Website as the official notification source for all contracts to be awarded as part of the fair and open process pursuant to the Law. NOW, THEREFORE, BE IT RESOLVED by the Board of Health of the Township of Bloomfield, as follows: 1. The Board hereby designates the Board of Health of the Township of Bloomfield s Internet Website at as the official notification source for contracts to be awarded as part of the fair and open process contained in N.J.S.A. 19:44A-20.4 et seq., the New Jersey Local Unit Pay-To-Play law; and 2. The Board in not precluded from utilizing its official legal newspaper for notification when it so desires. RESOLUTION NON-FAIR & OPEN CONTRACT FOR NURSE PRACTITIONER FOR PSYCHIATRIC SERVICES The Board, on a motion by BM Rodriguez, seconded by BM Serbay, unanimously 6 of 9
7 RESOLUTION AUTHORIZING THE AWARD OF A NON-FAIR AND OPEN CONTRACT FOR A NURSE PRACTITIONER FOR PSYCHIATRIC SERVICES WHEREAS, the Board of Health of the Township of Bloomfield has a need for a Nurse Practitioner for psychiatric services and is going to award the contract as a non-fair and open contract pursuant to the provisions N.J.S.A. 19:44A-20.5; and WHEREAS, the Board of Health s Director of Health & Human Services has determined that the value of the services will not exceed $17,500 for psychiatric consultation services for 2017; and WHEREAS, the term of this contract is to begin January 1, 2017 and ending December 31, 2017; and WHEREAS, Kim Dolan, APN (hereinafter Kim Dolan), has indicated she will act as a Nurse Practitioner to administer psychiatric services for the Board of Health of the Township of Bloomfield in accordance with the terms of its contract; and WHEREAS, Kim Dolan, has completed and submitted a Business Entity Disclosure Certification which certifies Kim Dolan has not made any reportable contributions to a political or candidate committee in the Township of Bloomfield and/or the Board of Health Members in the previous one year, and that the contract will prohibit Kim Dolan, her agents and/or employees from making any reportable contributions during the term of the contract; and WHEREAS, Kim Dolan understands the Board and Township are public entities and that, as a result, this Agreement is subject to the availability of funds and final adoption of a 2017 budget; and NOW, THEREFORE, BE RESOLVED that the President and Members of the Board of Health of the Township of Bloomfield authorizes the President of the Board of Health to enter into a contract with Kim Dolan as described herein; and BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution; and BE IT FURTHER RESOLVED that this resolution and the contract itself shall be available for public inspection at the office of the Board of Health s Director of Health & Human Services during regular business hours. SALARY ORDINANCE AMENDMENT FOR NON-REPRESENTED EMPLOYEES Discussion on the following ordinance was opened on a motion by BM Rodriguez, seconded by VP Mehta. After discussion, the Board unanimously approved the following salary ordinance amendment on its first reading with its second reading to take place at the Board's next regularly scheduled meeting in February AN ORDINANCE TO AMEND AND SUPPLEMENT AN ORDINANCE ENTITLED AN ORDINANCE ADOPTING TITLES AND ESTABLISHING SALARY RANGES FOR OFFICERS AND EMPLOYEES OF THE BOARD OF HEALTH, TOWNSHIP OF BLOOMFIELD" IS HERETOFORE AMENDED AND SUPPLEMENTED BE IT ORDAINED by the Board of Health of the Township of Bloomfield, New Jersey: Section 1. That section, Salary Range Per Annum of an ordinance entitled An Ordinance Adopting Titles and Establishing Salary Ranges for Officers and Employees of the Board of Health, Township of Bloomfield is hereby amended and supplemented so that the same shall read as follows: The following positions are hereby created and established in the Civil Service of the Board of Health, Township of Bloomfield and opposite each title and position there is established the salary range for such position. All employees hired after January 1, 1977 shall have a salary range of seven steps, **except those positions indicated in "Chapter 324, Officers and Employees of the Board of Health." Section 3. Employees covered under this ordinance terminating their services with the Board of Health, shall be paid one-twelfth (1/12) of their annual salary for each complete month employed by the Board. Such employees working a part of a month shall be paid for the actual days worked in the final month of employment to be calculated at the rate of one-tenth (1/10) of the bi-weekly salary multiplied by the actual number of days worked in the final month of employment. Section 4. All ordinances inconsistent herewith are hereby repealed. Section 5. This ordinance shall take effect according to law. HUMAN TRAFFICKING ORDINANCE DISCUSSION. The Board, on a motion by BM Rodriguez, seconded by BM Serbay, unanimously voted to open discussions on this matter. Director Lore stated that there was a previous proclamation passed by the Township Council. BM Serbay educated the Board on the types of situations that pertain to human trafficking and the effects on various individuals and communities. The Board, after discussion, agreed to place literature and a video on human trafficking on its website as well as possibly distributing literature to establishments regarding this matter. "WALKABILITY AUDIT PROPOSAL" The Board, on a motion by BM Rodriguez, seconded by VP Mehta, opened discussions on this matter. Dir. Lore informed the Board that a walkability audit determines various safety aspects that may affect individuals who walk certain routes and manners in which to make these routes safer for people to walk through. Dir. Lore stated that there are various funding abilities that can be made available to help either offset or fully pay for the audit. The Board, after discussion, unanimously voted to approve conducting the audit. 8 of 9
9 "STIPEND AS A RESULT OF CONTRIBUTIONS TOWARDS PARTNERS FOR HEALTH SHARED CONTRIBUTIONS PILOT PROGRAM" The Board on a motion by BM Rodriguez, seconded by VP Mehta, unanimously voted to open discussions on this matter. Stipend to be paid to Carol Manning, Social Work Specialist in the amount of $ for her contributions to the Partners for Health Shared Measurement System Pilot. RUCHI MEHTA DENISE SERBAY VACANT BOARD MEMBERS YES NO ABSTAIN ABSENT "RESOLUTION - NEW HIRE TEPORARY HIRE PART-TIME GRADUATE NURSE" The Board, on a motion by BM Rodriguez, seconded by VP Mehta, after discussion, unanimously R E S O L U T I O N APPOINTMENT OF PART-TIME TEMPORARY HIRE, GRADUATE NURSE WHEREAS, the Board of Health of The Township of Bloomfield has determined that it is currently in the best interest of the Department of Health & Human Services and the Township of Bloomfield to hire a part-time Graduate in order to maintain efficiency and productivity in the Department of Health and Human Services; and WHEREAS, the Board of Health, by New Jersey State Statute, N.J.S.A. 26:3-19 may employ such personnel as it may deem necessary and fix the duties and compensation of its appointees; and WHEREAS, the Director of Health & Human Services requests authorization to hire a graduate nurse to provide services needed to comply with inter-local contracts. NOW, THEREFORE, BE IT RESOLVED by the Board of Health of the Township of Bloomfield, that the selected candidate shall be placed in the Title of Graduate Nurse, Part-Time/Temporary hire. This part-time hire shall not exceed 14 hours for said services. NOW, THEREFORE, BE IT FUTHER RESOLVED by the Board of Health of the Township of Bloomfield that the assigned hours of this temporary hire shall not exceed a 12 month period in accordance with the New Jersey Department of Personnel procedures and be compensated at 1 of the Board s salary range for that title.
